CIRCULAR

Issuing the List of Objects Subject to Plant Quarantine;

The List of Objects Subject to Plant Quarantine that require risk analysis

pest risk analysis before importation into Vietnam

Pursuant to the Law on Plant Protection and Quarantine No. 41/2013/QH13;

Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Plant Protection Department;

The Minister of Agriculture and Rural Development issues the List of Objects Subject to Plant Quarantine; the List of Objects Subject to Plant Quarantine must undergo pest risk analysis before importation into Vietnam.

Article 1. List of Objects Subject to Plant Quarantine

1. Plants Live trees and parts thereof.

2. Plant Products

a) Roots, fruits, seeds, flowers, leaves, stems, branches, roots, tree bark;

b) Various types of sheets, meal, crude oil, natural fiber, plant fiber;

c) Flour, starch of plant origin (excluding dough, modified starch);

d) Tobacco stems, tobacco strands, betel nut strands, feed enzyme, raw cotton, cotton waste, straw, hay, and aquatic plants;

đ) Round wood, sawn timber, wooden pallets, wood shavings, coconut shavings;

e) Raw materials for animal feed of plant origin;

g) Plant-based growing media.

3. Fungi (excluding salted, frozen, canned fungi, yeast).

4. Silkworm cocoons, silkworm pupae, and winged ants.

5. Various types of insects, spiders, plant pathogens, nematodes, bacteria, viruses, phytoplasmas, viroids, and weeds for identification, training, biological control, and scientific research purposes.

6. Means of transport and storage for objects subject to plant quarantine.

7. Other objects capable of carrying plant quarantine pests shall be determined by the Plant Protection Department and reported to the Minister of Agriculture and Rural Development for decision.

8. In cases of export of objects not listed in this Article, plant quarantine shall be conducted according to the requirements of the importing country and international treaties to which Vietnam is a party.

Article 2. List of Objects Subject to Plant Quarantine Risk Analysis Before Importing into Vietnam

1. Live trees and parts thereof.

2. Fresh roots and tubers.

3. Grass and grass seeds.

4. Beneficial organisms used in plant protection.

5. Imported plants found to contain Vietnamese plant quarantine pests.

6. Other objects subject to plant quarantine that pose a high risk of carrying plant quarantine pests, as determined and reported by the Plant Protection Department to the Minister of Agriculture and Rural Development for decision.

Article 3. Objects Subject to Plant Quarantine Exempt from Risk Analysis

Objects subject to plant quarantine as stipulated in Article 2 of this Circular are exempt from risk analysis in the following cases:

1. Plant breeding material for scientific research;

2. Beneficial organisms for scientific research;

3. Other cases, the Director of the Plant Protection Department shall report to the Minister of Agriculture and Rural Development for decision.

4. Importation of objects specified in Clauses 1, 2, and 3 of this Article must be accompanied by a Plant Quarantine Import Permit and comply with the relevant regulations on plant quarantine.

Article 4. Transitional Provisions

For objects subject to plant quarantine imported into Vietnam before the effective date of this Circular and not yet subjected to pest risk analysis, the exporting country's plant quarantine authority must provide information to the Plant Protection Department as required for pest risk analysis. Based on the results of the pest risk analysis, the Plant Protection Department will supplement necessary plant quarantine measures to effectively prevent plant quarantine pests.

Article 5. Implementation Provisions

1. This Circular takes effect from January 1, 2015.

2. This Circular replaces Circular No. 39/2012/TT-BNNPTNT dated August 13, 2012, issued by the Minister of Agriculture and Rural Development on the List of Objects Subject to Plant Quarantine Pest Risk Analysis Before Importation into Vietnam; and Circular No. 40/2012/TT-BNNPTNT dated August 15, 2012, issued by the Minister of Agriculture and Rural Development on the List of Objects Subject to Plant Quarantine of the Socialist Republic of Vietnam.

3. The Head of the Ministry’s Office, the Director of the Plant Protection Department, and other related organizations and individuals are responsible for implementing this Circular.

During the implementation of this Circular, if there are difficulties or obstacles, agencies, units, organizations, and individuals should promptly reflect them to the Ministry of Agriculture and Rural Development (Plant Protection Department) for consolidation and submission to the Minister for consideration and decision.
