Issuing the List of Objects Subject to Plant Quarantine of the Socialist Republic of Vietnam

Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development and Decree No. 75/2009/ND-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Plant Protection and Plant Quarantine Ordinance No. 36/2001/PL-UBTVQH10 promulgated by the President on August 8, 2001;

Based on Decree No. 02/2007/NĐ-CP dated January 5, 2007 of the Government on Plant Quarantine;

Considering the proposal of the Director of the Plant Protection Department;

The Minister of Agriculture and Rural Development hereby issues the list of objects subject to plant quarantine of Vietnam as follows:

Article 1. Issuing the list of objects subject to plant quarantine (hereinafter referred to as objects) for export, import, transshipment, temporary import for re-export, temporary export for re-import, and transit through Vietnam including:

1. Plants

Live plants and parts thereof used as seeds or for other purposes.

2. Plant products

a) Roots, fruits, seeds, flowers, leaves, stems, branches, roots, and tree trunks;

b) Sheets, bran, oil cakes, powder, starch, fiber, sawdust, medicinal herbs;

c) Tobacco stems, spun tobacco, spun areca nut, cigarettes, cigars, beer yeast, wine yeast, feed yeast, tea, cotton, coconut fiber, cassava slices, rattan, bamboo, matting, straw, hay, grass, duckweed, and marine plants;

d) Wood and wood products (except wood and wood products with a notification of exemption from quarantine according to regulations);

đ) Handicrafts of plant origin;

e) Packaging materials, cushioning materials, and growing media of plant origin;

g) Animal feed or raw materials for processing of plant origin;

h) Rubber latex, plant resin, natural gum, paper pulp, and rolled paper;

3. Mushrooms and wood ear fungus;

4. Organic fertilizers and microbial fertilizers;

5. Fish meal, silk waste, silkworm cocoons, hair, skin, bones, horns, hooves, and ant wings.

6. Insects, spiders, plant pathogens, nematodes, bacteria, viruses, phytoplasmas, viroids, weeds, and plant specimens for identification, training, biological control, and scientific research.

7. Means of transport, production, and storage of objects.

8. Other objects capable of carrying plant quarantine pests.

Article 2. In cases where objects not included in the list under Article 1 of this Circular are exported, such actions shall be carried out based on the requirements of the importing country and international practices that Vietnam has joined.

Article 3. Effectiveness

1. This Circular takes effect from September 29, 2012.

2. This Circular abolishes Decision No. 72/2005/QĐ-BNN dated November 14, 2005 of the Minister of Agriculture and Rural Development on announcing the list of objects subject to plant quarantine of the Socialist Republic of Vietnam. During implementation, if there are difficulties or obstacles, relevant agencies, organizations, and individuals should promptly report to the Ministry of Agriculture and Rural Development (Plant Protection Department) for consideration and resolution./.
