CIRCULAR

Amending and supplementing certain provisions of the Regulation on the organization and operation of boarding secondary schools for ethnic minorities

promulgated together with Circular No. 24/2010/TT-BGDĐT dated August 2, 2010 of the Minister of Education and Training;

On the basis of Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training; The Minister of Education and Training

Pursuant to the Education Law on June 14, 2005; the Law Amending and Supplementing Certain Articles of the Education Law on November 25, 2009;

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

On the basis of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Education; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Education; Decree No. 07/2013/NĐ-CP dated January 9, 2013 of the Government regarding the amendment of point b, Clause 13, Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Education;

The Minister of Education and Training issues this Circular to amend and supplement certain provisions of the Regulation on the organization and operation of boarding secondary schools for ethnic minorities promulgated together with Circular No. 24/2010/TT-BGDĐT dated August 2, 2010 of the Minister of Education and Training.

Pursuant to Decree No. 115/2010/NĐ-CP dated December 24, 2010 of the Government stipulating responsibilities for state management of education;

At the proposal of the Director of the Ethnic Education Department,

Article 1. Amending and supplementing certain provisions of the Regulation on the organization and operation of boarding secondary schools for ethnic minorities promulgated together with Circular No. 24/2010/TT-BGDĐT dated August 2, 2010 of the Minister of Education and Training as follows:

"Article 3. Tasks of boarding secondary schools for ethnic minorities

1. Clause 3 shall be amended and supplemented as follows:

Boarding secondary schools for ethnic minorities (PTDTBT) shall perform the tasks prescribed in the current Charter of Secondary Schools and the following tasks:

1. Organizing the review of students for boarding.

2. Organizing special educational activities appropriate to the context.

3. Organizing feeding and caring for boarding students.

4. Implementing policies as stipulated in Article 6 of this Regulation.

5. Implementing socialization to serve the educational activities of PTDTBT schools."

"Article 4. Name of school, school signboard

2. Clause 4 shall be amended and supplemented as follows:

1. The name of the school is specified as follows: Boarding Secondary School for Ethnic Minorities + level of education + specific name of the school.

2. The name of the school is recorded on the decision establishing the school, the school signboard, the seal, and transaction documents.

Line one: People's Committee of the district (city district, town, city) directly under the province and the name of the district (city district, town, city) under the province;

3. The school signboard shall include the following contents:

a) Top left corner:

Line two: Department of Education and Training.

c) At the bottom is the address and phone number of the school."

b) Centered is the school name as prescribed in Clause 1 of this Article.

"Article 5. Infrastructure and equipment of PTDTBT schools

3. Article 5 shall be amended and supplemented as follows:

PTDTBT schools have land, infrastructure, and equipment according to the current Charter of Secondary Schools, in addition to the following:

1. Infrastructure ensuring the organization of teaching for two sessions per day.

2. Facilities serving management, care, and feeding of boarding students: Dormitory duty room, dormitory building; kitchen, dining hall, bathroom; sanitation facilities, clean water, and accompanying equipment.

3. Equipment and tools serving cultural, physical education, recreational, and entertainment activities for boarding students."

"Article 5a. Organizational structure of PTDTBT schools

4. Article 5a is added after Article 5 as follows:

1. The organizational structure of PTDTBT schools according to the current Charter of Secondary Schools. In addition, each school has an additional Boarding Student Management Team responsible for managing, feeding, and caring for boarding students.

2. The Boarding Student Management Team has a team leader, one to two deputy leaders, and members under the management and direction of the Principal, appointed and assigned tasks by the Principal."

5. Clause 2 of Article 7 is amended and supplemented as follows:

"2. The establishment plan clearly defines the objectives, tasks, programs, and educational content; land, infrastructure, equipment, proposed construction site, organizational structure, resources, and finance; development directions and plans for the school. In the development directions and plans, it must ensure the following stable ratios:

- For elementary PTDTBT schools: At least 25% of boarding students;

a) Ratio of ethnic minority students: At least 50% of the total number of students in the entire school are ethnic minority students.

b) Ratio of boarding students:

- For middle school PTDTBT schools: At least 50% of boarding students;

- For elementary and middle school PTDTBT schools: At least 25% of elementary students and 50% of middle school students as boarding students."

6. Clause 2 and Clause 3 of Article 15 are amended and supplemented as follows:

"2. Review dossier includes:

a) Application for boarding with the opinion of parents or guardians of the student;

b) Household registration book (copy presented with original for verification or certified copy; in case of loss of household registration book, there must be a confirmation of residence from the competent authority at the local government).

3. Review process:

a) Students submit the dossier to the school;

b) The school collects the dossier and prepares a list;

c) The review board conducts the review;

d) Approving and announcing the results of the review:

- The review board publicly announces the preliminary list of those who will be reviewed within seven working days before submitting to the District People's Committee for formal approval;

- The District People's Committee approves the results of the review;

- The People's Committee of the commune and the PTDTBT school announce the results of the boarding student review at least ten working days before the opening ceremony.

e) Handling complaints

The review board resolves complaints about the results of the boarding student review (if any) within ten working days from the date of announcement of the results."

"Article 16. Teaching and learning activities

7. Article 16 is amended and supplemented as follows:

PTDTBT schools organize teaching and learning activities according to the current Charter of Secondary Schools. The school organizes teaching for two sessions per day for students. Teaching and learning activities must be suitable for the psychological and physiological characteristics of ethnic minority students.

8. Clause 3 of Article 19 is amended and supplemented as follows:

"3. Applying teaching methods, forms of organizing teaching, and examination and evaluation methods suitable for ethnic minority students; participating in the management and education of students outside regular class hours."

Abolish Clause 2 of Article 13.

Article 2. This Circular takes effect from January 25, 2016.

Article 4. The Head of the Office, the Director of the Ethnic Education Department, the Heads of relevant units under the Ministry of Education and Training; the Chairpersons of the People's Committees of provinces and centrally governed cities; and the Directors of provincial Departments of Education and Training are responsible for implementing this Circular.
