This Decision applies to agencies, organizations, and individuals related to the confirmation of goods used directly for developing activities of technology incubation, science and technology business incubation, technological innovation; specialized transportation equipment in production lines used directly for the production activities of investment projects.

Pursuant to the proposal of the Minister of Science and Technology;

Article 2. Documents for requesting confirmation of goods used directly for developing activities of technology incubation, science and technology business incubation, technological innovationAt the request of the Inspectorate of thepurposes to develop activities of technology incubation, science and technology business incubation,From 100 million VND to less than 300 million VND1. Request letter for confirmation (in accordance with Form No. 01).

Article 1. Scope of Regulation and Applicability

2. Explanation about goods included in the List or meeting the criteria prescribed by the Ministry of Science and Technology concerning goods used directly for developing activities of technology incubation, science and technology business incubation or technological innovation.

3. Purchase contract or agency contract (certified copy or copy presented together with original for verification) or other relevant documents to determine the purchase or import transaction.

4. In addition to the above documents, the organization or individual requesting confirmation shall submit the following documents:

a) Certified copy (or copy presented together with original for verification): Investment registration certificate, business registration certificate (if applicable);

b) List of machinery, equipment, spare parts, materials to implement scientific and technological tasks of technology incubation facilities, science and technology business incubation facilities (for cases where confirmation is requested for machinery, equipment, spare parts, materials specifically used directly for developing activities of technology incubation, science and technology business incubation);

c) List of machinery, equipment to implement scientific and technological tasks or technological innovation investment projects (for cases where confirmation is requested for machinery, equipment specifically used directly for technological innovation).

4. In addition to the above documents, organizations and individuals requesting confirmation shall submit the following papers:

a) Certified true copies (or copies presented together with original documents for verification): Investment registration certificate, business registration certificate (if applicable);

b) List of machinery, equipment, spare parts, and materials to carry out scientific and technological tasks of technology incubation facilities, science and technology enterprise incubation facilities (in the case of requesting confirmation that goods are specialized machinery, equipment, spare parts, and materials directly used for developing technology incubation activities, and science and technology enterprise incubation activities);

c) List of machinery and equipment to carry out scientific and technological tasks or technology innovation investment projects (in the case of requesting confirmation that goods are specialized machinery and equipment directly used for technology innovation).

Article 3. Procedures for confirming goods directly used for developing technology incubation activities and science and technology business incubation activities

1. Organizations and individuals shall prepare one set of documents in accordance with Article 2 of this Decision and submit them directly or through postal service to the People's Committee of the province or city where the project or technology incubation facility, science and technology business incubation facility is located, or to the competent authority of the project or technology incubation facility, science and technology business incubation facility (in cases where there is a competent authority).

2. Within three working days from the date of receipt of the documents, the competent authority specified in Clause 1 of this Article shall examine the documents and notify organizations and individuals if the documents are not valid, require supplementation or modification.

3. Within ten days from the date of receipt of valid documents, the competent authority specified in Clause 1 of this Article shall issue a written response to organizations and individuals (according to Form No. 02), clearly identifying the list of goods directly used for developing technology incubation activities and science and technology business incubation activities; in case of refusal to confirm, a written statement specifying the reasons must be provided. The competent authority specified in Clause 1 of this Article shall notify organizations and individuals about the extension of the response time in cases where it is necessary to review the documents according to Clause 4 of this Article.

4. In cases where necessary, the competent authority specified in Clause 1 of this Article may organize a committee to review the documents before issuing a written response. The time for reviewing and responding shall not exceed twenty days from the date of receipt of valid documents; in case of refusal to confirm, a written statement specifying the reasons must be provided. The costs for organizing the committee to review the documents shall be covered by the state budget.

Article 4. Procedures for confirming goods directly used for technological innovation

1. Organizations and individuals shall prepare one set of documents in accordance with Article 2 of this Decision and submit them directly or through postal service to the Ministry of Science and Technology.

2. Within three working days from the date of receipt of the documents, the Ministry of Science and Technology shall examine the documents and notify organizations and individuals if the documents are not valid, require supplementation or modification.

3. Within ten days from the date of receipt of valid documents, the Ministry of Science and Technology shall issue a written response to organizations and individuals (according to Form No. 02), clearly identifying the list of goods directly used for technological innovation; in case of refusal to confirm, a written statement specifying the reasons must be provided. The Ministry of Science and Technology shall notify organizations and individuals about the extension of the response time in cases where it is necessary to review the documents according to Clause 4 of this Article.

4. In cases where necessary, the Ministry of Science and Technology may organize a committee to review the documents before issuing a written response. The time for reviewing and responding shall not exceed twenty days from the date of receipt of valid documents; in case of refusal to confirm, a written statement specifying the reasons must be provided. The costs for organizing the committee to review the documents shall be covered by the state budget.

Article 5. Documents for requesting confirmation of specialized transportation equipment used directly in production lines of investment projects

1. Request for confirmation document (according to Form No. 03).

2. Description of specialized transportation equipment meeting the criteria stipulated by the Ministry of Science and Technology regarding specialized transportation equipment used directly in production lines of investment projects.

3. Technical documentation of specialized transportation equipment, clearly stating the name of the equipment, year of manufacture, technical specifications, condition of the equipment, power, function, and photographs of the specialized transportation equipment.

4. Purchase contract or agency contract (certified copy or copy presented together with the original for verification) or other relevant documents to determine the purchase or import relationship.

5. List of machinery and equipment of the investment project approved by the investor in accordance with the law.

6. In addition to the above documents, organizations and individuals requesting confirmation shall submit certified copies (or copies presented together with the original for verification) of the following documents (if applicable): Investment registration certificate, business registration certificate.

Article 6. Procedures for confirming specialized transport equipment used directly in production processes of investment projects

1. Organizations and individuals shall prepare one set of documents in accordance with Article 5 of this Decision and submit them directly or via postal service to the Ministry of Science and Technology.

2. Within three working days from the date of receipt of the documents, the Ministry of Science and Technology shall examine the documents and notify organizations and individuals if the documents are not valid, require supplementation or modification.

3. Within ten days from the date of receipt of valid documents, the Ministry of Science and Technology shall issue a written response to organizations and individuals (in Form No. 04); in cases of refusal to confirm, it must provide a written statement detailing the reasons. The Ministry of Science and Technology shall notify organizations and individuals about the extension of the response time if necessary for document verification as stipulated in Clause 4 of this Article.

4. In cases where necessary, the Ministry of Science and Technology may organize a committee to review the documents before issuing a written response. The time for reviewing and responding shall not exceed twenty days from the date of receipt of valid documents; in case of refusal to confirm, a written statement specifying the reasons must be provided. The costs for organizing the committee to review the documents shall be covered by the state budget.

Article 7. Implementation Provisions

1. This Decision takes effect from September 15, 2018.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, and related agencies are responsible for implementing this Decision./
