Regulations on job code and qualification standards for specialized civil servants in occupational safety and health technical inspection

Pursuant to the Civil Servant Law dated November 15, 2010;

Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Based on the proposal of the Director of the Cadre and Civil Servant Department;

Pursuant to Decree No. 89/2021/NĐ-CP dated October 18, 2021 of the Government amending and supplementing certain articles of Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on training and capacity building for cadres, civil servants, and public officials;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces; and Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces;

The Minister of Labor, Invalids and Social Affairs promulgates this Circular on job code and qualification standards for specialized civil servants in occupational safety and health technical inspection.

 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the job code, qualification standards, and appointment and classification of pay according to job titles for specialized civil servants in occupational safety and health technical inspection.

2. This Circular applies to specialized civil servants in occupational safety and health technical inspection working in public service units providing technical inspection services for various types of machinery, equipment, and materials with strict requirements for occupational safety.

Article 2. Job codes for specialized civil servants in occupational safety and health technical inspection

1. Senior Technical Inspector for Occupational Safety and Health, job code: V.09.03.01.

2. Technical Inspector for Occupational Safety and Health, job code: V.09.03.02.

3. Technical Assistant for Occupational Safety and Health Inspection, job code: V.09.03.03.

Article 3. General ethical standards for specialized civil servants in occupational safety and health technical inspection

Objectivity, prudence, seriousness, and a sense of responsibility towards assigned tasks; actively participate in scientific research to develop the profession; comply with the rights and obligations of civil servants as prescribed in the Civil Servant Law and other relevant laws concerning occupational safety and health technical inspection during the performance of duties.

Chapter II

QUALIFICATION STANDARDS FOR JOB TITLES

Article 4. Senior Technical Inspector for Occupational Safety and Health - Job Code: V.09.03.01

1. Duties:

a) Lead the summary and evaluation of technical inspection work within the assigned scope. Propose issues requiring amendments and supplements to the inspection procedures, technical standards, and regulations to improve national regulations;

b) Lead or participate in compiling content, programs, and materials for training managers on technical management principles, operational management, operational procedures, and technical incident handling measures, and preventive measures for inspected objects based on current technical safety standards and regulations; participate in compiling programs, materials, and training and capacity building for occupational safety and health technical inspectors when assigned;

c) Lead or participate in scientific and technological tasks related to occupational safety and health technical inspection within the assigned scope;

d) Perform accident investigation tasks for incidents caused by inspected objects when required;

đ) Develop and implement technical safety inspection plans for occupational safety and health according to the authority granted;

e) Organize and directly conduct technical safety inspections for machinery, equipment, and materials with strict occupational safety requirements, personally responsible for the inspection results. Evaluate the inspection process, propose measures to ensure safety to prevent incidents and accidents caused by inspected objects;

g) Participate in drafting, compiling, and reviewing technical safety standards and regulations at the request of competent authorities, develop technical safety and labor hygiene measures when required.

2. Qualifications regarding education and training:

a) Hold a bachelor's degree or higher in relevant technical fields suitable for the scope of technical inspections;

b) Hold a certificate for the occupation title of specialized civil servant in occupational safety and health technical inspection or a technical inspector certificate for occupational safety and health technical inspection.

3. Qualifications regarding professional expertise and skills:

a) Have the ability to lead and implement technical inspection activities and propose solutions to enhance the effectiveness of such activities;

b) Have the ability to coordinate with related organizations and individuals during the implementation of technical inspection activities;

c) Have the ability to guide technical inspection activities in accordance with the trained field;

d) Have led at least one provincial or ministerial-level scientific and technological task related to occupational safety and health technical inspection and achieved satisfactory results, or participated in at least two such tasks and achieved satisfactory results;

đ) Have the ability to apply information technology in performing senior technical inspector duties and have the ability to use foreign languages in specific tasks assigned.

4. Minimum time requirement for civil servants applying for or being considered for promotion to the position of Senior Technical Inspector for Occupational Safety and Health: Must have served in the position of Technical Inspector for Occupational Safety and Health or equivalent for at least nine years (excluding probationary and trial periods). In cases where they have served in equivalent positions, they must have served in the position of Technical Inspector for Occupational Safety and Health for at least one year (12 months) up to the deadline for submitting application registration forms for examination or promotion.

Article 5. Occupational Safety and Health Technical Inspector - Code: V.09.03.02

1. Duties:

a) Establish or participate in establishing inspection plans for specific inspection objects within their assigned specialty, in accordance with the division of labor;

b) Directly carry out inspections of machines, equipment, materials that have strict requirements for occupational safety and health, and bear individual responsibility for the inspection results; provide technical safety advice to organizations using such machines, equipment, and materials within the assigned scope;

c) Participate in scientific and technological tasks related to technical safety inspection within the assigned scope;

d) Participate in compiling training manuals and organizing occupational safety and hygiene training, training for managers and operators of objects with strict safety requirements within the assigned inspection scope;

đ) Participate in compiling programs, documents, and training for technical inspector vocational skills when assigned;

2. Qualifications regarding education and training:

a) Hold a bachelor's degree or higher in relevant technical fields suitable for the scope of technical inspections;

b) Hold a certificate for the occupation title of specialized civil servant in occupational safety and health technical inspection or a technical inspector certificate for occupational safety and health technical inspection.

3. Qualifications regarding professional expertise and skills:

a) Possess the ability to work independently and perform inspection technical safety operations within the assigned scope consistent with the trained specialty;

b) Possess the ability to grasp and apply advanced methods and technologies during the execution of assigned inspection technical safety tasks consistent with the trained specialty;

c) Possess the ability to lead coordination with organizations and individuals during the execution of assigned technical safety inspection tasks consistent with the trained specialty;

d) Possess the ability to guide vocational skills, disseminate experience, and participate in scientific research serving technical safety inspection work;

đ) Recognize potential hazards and establish preventive measures while performing inspection tasks;

e) Possess the ability to apply information technology in performing technical inspector duties and possess the ability to use foreign languages in certain specific assigned tasks;

4. Minimum working time requirement for officials participating in the examination or promotion to the position of Occupational Safety and Health Technical Inspector: Must have at least two years of service in the position of Occupational Safety and Health Technical Inspector or equivalent. In cases where there is equivalent professional position experience, they must have at least one year (full twelve months) of service in the position of Occupational Safety and Health Technical Inspector up to the deadline for submitting application registration for examination or promotion;

Article 6. Occupational Safety and Health Technical Inspector Assistant - Code: V.09.03.03

1. Duties:

a) Perform specific tasks in the inspection process of machines, equipment, materials with strict requirements for occupational safety and health under the direction and supervision of the Occupational Safety and Health Technical Inspector;

b) Propose measures to improve the quality of technical safety inspection work;

c) Timely identify defects in inspection equipment and tools, propose remedial measures to ensure inspection quality;

d) Bear direct responsibility for conclusions at specific inspection steps according to the assignment;

2. Qualifications regarding education and training:

a) Hold a diploma from a college level or higher in a technical specialty;

b) Hold a certificate for the occupation title of specialized civil servant in occupational safety and health technical inspection or a technical inspector certificate for occupational safety and health technical inspection.

3. Qualifications regarding professional expertise and skills:

a) Possess the ability to work independently, proactively, and collaboratively in groups during the execution of technical safety inspection tasks;

b) Proficiently use equipment and tools for technical safety inspection work; understand the principles and structure of inspection equipment and tools; be familiar with inspection procedures and relevant technical safety standards and regulations for assigned inspection objects; understand regulations on electrical, mechanical, pressure vessel safety, and fire prevention and control;

c) Possess the ability to apply information technology in performing technical inspector duties and possess the ability to use foreign languages in certain specific assigned tasks;

Chapter III

APPOINTMENT AND SALARY GRADING FOR THE PROFESSIONAL POSITION OF OCCUPATIONAL SAFETY AND HEALTH TECHNICAL INSPECTOR SPECIALIST CIVIL SERVANT

Article 7. Principles for Appointment to Professional Positions in the Technical Safety and Labor Inspection Specialty

1. The appointment to professional positions for technical safety and labor inspection specialists must be based on the job positions they currently hold and meet the criteria for professional positions as stipulated in Articles 4, 5, and 6 of this Circular and the provisions set forth in Article 8 of this Circular.

2. When appointing and determining salary grades for professional positions in the technical safety and labor inspection specialty, it shall not be combined with salary grade increases or promotions in professional positions for specialists.

Article 8. Cases for Appointment to Professional Positions in the Technical Safety and Labor Inspection Specialty

1. Specialists who have been appointed to professional position ranks in the technical safety and labor inspection specialty according to Circular Jointly Issued No. 35/2015/TTLT-BLDTBXH-BNV dated September 16, 2015, by the Minister of Labor, Invalids, and Social Affairs and the Minister of Home Affairs regarding the code numbers and criteria for professional positions in the technical safety and labor inspection specialty, shall now be classified under equivalent professional position ranks as specified in Article 2 of this Circular.

2. New specialists recruited after completing their probation period as prescribed and evaluated as meeting the requirements by the head of the public service unit shall be appointed to the corresponding professional position rank in the technical safety and labor inspection specialty that they were hired for.

Article 9. Salary Grading Method

1. The professional positions in the technical safety and labor inspection specialty shall apply the specialized salary scale for cadres and staff in state-run units (Scale 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government concerning the salary system for cadres, civil servants, staff, and armed forces personnel, as follows:

a) The professional position of Senior Technical Inspector for Safety and Labor Inspection shall apply the salary coefficient for staff type A2 group 1 (from coefficient 4.40 to coefficient 6.78);

b) The professional position of Technical Inspector for Safety and Labor Inspection shall apply the salary coefficient for staff type A1 (from coefficient 2.34 to coefficient 4.98);

c) The professional position of Technical Inspector Assistant for Safety and Labor Inspection shall apply the salary coefficient for staff type B (from coefficient 1.86 to coefficient 4.06).

2. Determination of salary upon completion of the probation period and appointment to a professional position:

a) In cases where the candidate holds a doctoral degree, they shall be assigned to level 3, with a salary coefficient of 3.00 for the professional position of Technical Inspector for Safety and Labor Inspection, code number: V.09.03.02;

b) In cases where the candidate holds a master's degree, they shall be assigned to level 2, with a salary coefficient of 2.67 for the professional position of Technical Inspector for Safety and Labor Inspection, code number: V.09.03.02;

c) In cases where the candidate holds an associate degree, they shall be assigned to level 2, with a salary coefficient of 2.06 for the professional position of Technical Inspector Assistant for Safety and Labor Inspection, code number: V.09.03.03.

3. The transfer of salary classification for specialists moving from their current professional positions to those in the technical safety and labor inspection specialty as stipulated in this Circular shall follow the guidelines provided in Clause 2, Section II, of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs regarding salary classification when upgrading, transferring, or changing the category of civil servants and staff.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Transitional Provisions

Specialists who have been appointed to professional positions in the technical safety and labor inspection specialty according to the law prior to the effective date of this Circular shall be deemed to meet the criteria for professional positions in the technical safety and labor inspection specialty as stipulated in this Circular corresponding to the professional positions they have been appointed to.

Article 11. Implementation Organization

1. Public service units shall base their recruitment, utilization, and management of technical safety and labor inspection specialists on the provisions of this Circular.

2. Non-public sector organizations, institutions, and units may apply these provisions for recruitment, utilization, and management of personnel.

3. The heads of public technical safety and labor inspection units directly managing and utilizing specialists shall be responsible for:

a) Reviewing job positions within the unit, developing plans for appointment to professional positions in the technical safety and labor inspection specialty within the unit's technical safety and labor inspection authority, submitting them to the competent authority for review and decision-making or deciding according to their authority;

b) Deciding on the appointment to professional positions for technical safety and labor inspection specialists to corresponding professional positions in the technical safety and labor inspection specialty according to their authority or proposing the competent authority to issue an appointment decision after the plan for appointment to professional positions has been approved by the competent authority.

4. Ministries, agencies at the ministerial level, government agencies, provincial People's Committees, and municipal People's Committees directly under the central government shall be responsible for:

a) Directing units under their management to implement appointments to professional positions and salary classifications for technical safety and labor inspection specialists in public technical safety and labor inspection units;

b) Deciding on appointments to professional positions and salary classifications for technical safety and labor inspection specialists under their management to corresponding professional positions in public technical safety and labor inspection units according to their authority;

c) Reporting the results of appointments to professional positions and salary classifications for technical safety and labor inspection specialists in public technical safety and labor inspection units under their management to the Ministry of Labor, Invalids, and Social Affairs.

Article 12. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from February 13, 2023.

2. This Circular replaces Circular Joint Circular No. 35/2015/TTLT-BLDTBXH-BNV dated September 16, 2015 of the Minister of Labor, War Invalids and Social Affairs and the Minister of Home Affairs stipulating job code and qualification standards for vocational positions in the occupational safety and health inspection profession.

3. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, implementation shall be carried out according to the amended, supplemented, or replaced documents.

4. The Minister, Heads of ministerial-level agencies, Heads of government agencies; Chairpersons of provincial People's Committees under the central city and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.

5. In the course of implementation, if there are any difficulties, individuals and organizations are advised to report to the Ministry of Labor, War Invalids and Social Affairs for consideration and resolution./.
