On the basis of Law on State Budget Management dated June 25, 2015;

Decree No. Decree No. 163/2016/NĐ-CP dated December 21, 2016 of the Government detailing the implementation of certain provisions of the Law on State Budget;

The Minister of Finance issues this Circular guiding the financial mechanism to implement the Project on Enhancing the Capacity of the Teaching Staff and Management Personnel of Higher Education Institutions to Meet the Requirements of Fundamental and Comprehensive Educational Reform during the Period of 2019-2030 approved by the Prime Minister under Decision No. 89/QĐ-TTg dated January 18, 2019.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular guides the financial mechanism to implement the Project on Enhancing the Capacity of the Teaching Staff and Management Personnel of Higher Education Institutions to Meet the Requirements of Fundamental and Comprehensive Educational Reform during the Period of 2019-2030 approved by the Prime Minister under Decision No. 89/QĐ-TTg dated January 18, 2019 (hereinafter referred to as Decision No. 89/QĐ-TTg);

The content related to admission, selection criteria, and organization of training of the Project on Enhancing the Capacity of the Teaching Staff and Management Personnel of Higher Education Institutions to Meet the Requirements of Fundamental and Comprehensive Educational Reform during the Period of 2019-2030 (hereinafter referred to as the Project) shall be implemented in accordance with the provisions of Circular No. 25/2021/TT-BGDĐT dated September 8, 2021 of the Ministry of Education and Training guiding the implementation of doctoral and master's degree training programs for teaching staff of higher education institutions under Decision No. 89/QĐ-TTg (hereinafter referred to as Circular No. 25/2021/TT-BGDĐT).

Article 2. This Circular applies to higher education institutions that participate in the Project according to the provisions of Circular No. 25/2021/TT-BGDĐT of the Ministry of Education and Training, and relevant agencies, organizations, and individuals in implementing the Project.

Article 2. Sources of Funds

Clause 1. The state budget allocated in the annual budget for educational and vocational training expenses according to the分级任务如下:

2. Financial sources for higher education institutions participating in the Project:

a) Higher education institutions sending lecturers to study are responsible for ensuring funding from legitimate financial sources to provide training in foreign languages and necessary skills for selected students to be trained abroad; supporting students participating in the Project's training programs beyond the contents and expenditure levels specified in this Circular (if applicable). The content and expenditure level shall be carried out according to the internal expenditure regulations of the unit;

b) Higher education institutions are responsible for ensuring funding from legitimate financial sources to enhance the capacity of lecturers and managers, attract scientists and individuals with doctoral degrees; implement activities within the framework of the Project according to the functions and tasks of the unit. The content and expenditure level shall be carried out according to the internal expenditure regulations of the unit.

3. Legitimate funding, support, and mobilization from organizations and individuals as prescribed. The content and expenditure level shall be implemented according to current regulations for each type of capital, encouraging units to follow the provisions of this Circular.

Chapter II
SPECIFIC PROVISIONS

Article 3. Content of support for full-time training abroad at the doctoral and master's levels

1. Tuition fees and related expenses: Payment shall be made according to the contract signed between the Ministry of Education and Training and the overseas training institution, or according to the level announced by the overseas training institution in the student acceptance letter (in US dollars or local currency); the maximum amount shall not exceed 25,000 US dollars per student per academic year or equivalent in local currency. In cases where tuition fees exceed 25,000 US dollars per student per academic year, the excess tuition fee shall be paid by the student themselves or by the university that sends lecturers to study according to the internal expenditure regulations of the unit.

In special cases, where there is a need to attract and create sources of lecturers from outstanding graduates and young scientific staff who meet the conditions stipulated in Decree No. 140/2017/NĐ-CP dated December 5, 2017 of the Government on policies to attract and create sources of cadres from outstanding graduates and young scientific staff, the Minister of Education and Training shall consider and decide on each specific case, making payments according to the tuition fee levels specified by the training institution within the allocated budget estimate.

2. Passport and visa fees: Payment shall be made according to the State regulations for passport fees and actual visa fee invoices issued by the countries where the students are sent for training.

3. Living expenses:

a) Living expenses provided to students according to the levels specified in the Appendix attached to this Circular. Living expenses are granted based on the actual time spent studying abroad (from the date of enrollment to the end of the course but not exceeding the duration specified in the decision to send for training by the Minister of Education and Training).

b) The payment of living expenses to students shall be made periodically every quarter or six months, ensuring it does not affect their studies and research.

4. Compulsory health insurance:

a) Level of compulsory health insurance: Payment shall be made according to the levels specified by the host country (based on the level announced in the student acceptance letter of the training institution) and shall be provided in US dollars or local currency; the maximum amount shall not exceed 1,000 US dollars per person per year.

b) If students wish to purchase health insurance at a higher level than stipulated in this Circular, they must cover the difference themselves.

5. Airfare for departure and return (economy class):

a) Students will be provided with one round-trip ticket from Vietnam to the place of study and one round-trip ticket from the place of study back to Vietnam (except in cases where the host side covers the cost) throughout the entire training period.

b) Payment shall be made according to the current regulations on state budget expenditure systems and standards.

6. Travel expenses (to offset airport fees and transportation costs from the airport to accommodation and vice versa) shall be provided once with a quota of 100 US dollars per person for the entire training period.

7. Other expenses arising during the training period:

a) Bank transfer and receipt fees related to overseas training programs (if applicable): Based on the regulations of the host country's and Vietnam's banks, if bank transfer or receipt fees arise, the state budget will provide this expense according to the actual occurrence.

b) Support for handling risks and force majeure incidents affecting students sent for training: In cases where students die, the state budget will support the full cost of transporting the body or urn from abroad back home or support the remaining cost of transportation after insurance has been paid out.

c) In cases where the actual training time exceeds the duration specified in the decision to send for training by the Minister of Education and Training (including due to force majeure such as war, natural disasters, epidemics), and the student still ensures satisfactory results recognized by the foreign training institution, the student will only be eligible for extended benefits and policies when there is a supplementary decision by the Minister of Education and Training, but the total time shall not exceed the prescribed completion period for the training program as stipulated in Clause 4, Article 4 of Circular No. 25/2021/TT-BGDĐT.

Article 4. Content of support for full-time doctoral training programs within the country

1. Tuition fees paid to domestic higher education institutions selected by the Ministry of Education and Training to participate in the implementation of the project's training tasks: The payment will be made according to the level specified by the higher education institution, with a maximum not exceeding the tuition fee framework prescribed in Decree No. 81/2021/NĐ-CP dated August 27, 2021 of the Government on the mechanism for collecting and managing tuition fees for educational institutions under the national education system and policies on exemption, reduction of tuition fees, and support for learning expenses; service prices in the field of education and training.

2. Support for learning and research expenses for students includes:

a) Support for expenses for students to implement thesis topics, attend conferences and seminars within the country, specifically as follows:

- Medical and Pharmaceutical Sciences, Physical Education, Sports, Arts: VND 20 million/student/year;

- Natural Sciences, Engineering, Technology; Agriculture, Forestry, Aquaculture: VND 18 million/student/year;

- Social Sciences, Economics, Law; Hotel Management, Tourism, and other fields: VND 13 million/student/year;

Duration of support: During the study period at the training institution (not exceeding 4 years).

b) Support for expenses for students to publish scientific articles in international journals, attend international conferences and seminars, and go abroad for short-term internships:

- The state budget supports 100% of publication fees for research results published in reputable international scientific and technological journals listed in the Web of Science database, as announced by the international scientific and technological journal, in the capacity of main author or corresponding author;

- Students who meet the conditions stipulated in Circular No. 25/2021/TT-BGDĐT are invited to attend international conferences and seminars or go abroad for short-term internships, and their travel and living expenses will be supported by the state budget according to the provisions of Circular No. 102/2012/TT-BTC dated June 21, 2012 of the Ministry of Finance on the regulations for work-related expenses for civil servants and public officials going abroad for short-term missions funded by the state budget (maximum not exceeding one time during the entire training period). In cases where students receive financial support from other organizations related to attending international conferences and seminars or short-term internships, the state budget will not provide support for expenses already covered.

Higher education institutions sending lecturers for study are responsible for establishing standards, criteria, and regulations for supporting students based on the provisions of Circular No. 25/2021/TT-BGDĐT of the Ministry of Education and Training and the provisions of this Circular, to ensure they meet the conditions for receiving support as outlined above, and publicly announce these before implementation.

In addition to state budget support, higher education institutions sending lecturers for study may mobilize additional legal contributions to support students' learning and research expenses according to internal expenditure regulations of the unit.

Article 5. Content of support for joint training programs leading to a doctorate degree

Joint training programs leading to a doctorate degree shall be implemented in accordance with the provisions of the Ministry of Education and Training in Circular No. 25/2021/TT-BGDĐT. The content and funding levels are as follows:

1. For the period when students concentrate within the country: Implemented according to Article 4 of this Circular.

2. For the period when students concentrate abroad (maximum not exceeding two years): Implemented according to Article 3 of this Circular.

Chapter III
ESTABLISHING BUDGET PROJECTIONS, ALLOCATION, MANAGEMENT, AND SETTLEMENT OF EXPENSES

Article 6. Budget Preparation

1. For the Ministry of Education and Training:

a) Annually, based on the objectives and tasks of the Project, the Ministry of Education and Training shall guide management agencies of public higher education institutions to send lecturers for study (for public institutions) and private higher education institutions to send lecturers for study to report on the implementation of the Project, develop plans to implement the Project detailing the number, method, and level of training, and at the same time prepare the budget for implementing the Project according to the sources of funding (for state budget support and other sources of funding) in accordance with the contents and expenditure levels specified in this Circular;

b) Based on reports, plans, and proposals for budget preparation from ministries, central agencies, localities, and private higher education institutions; guidelines for annual state budget preparation from the Ministry of Finance; the Ministry of Education and Training shall be responsible for reviewing and consolidating the budget for implementing the Project, submitting it to the Ministry of Finance for reporting to the competent authority for approval in accordance with regulations. Among which:

- For full-time training abroad; the duration of training abroad under joint training methods and training costs for students in private higher education institutions: The budget for implementing the Project is prepared and consolidated in the annual state budget of the Ministry of Education and Training to pay to foreign higher education institutions and students as prescribed;

- For full-time concentrated training within the country; the duration of training within the country under joint training methods: The budget for implementation is prepared and consolidated in the annual state budgets of ministries, central agencies, and localities to pay to domestic higher education institutions and students as prescribed.

2. For ministries, central agencies, and localities:

3. For private higher education institutions:

Article 7. Allocation and Transfer of Budget Estimates

1. Based on the budget estimate for implementing the Project that has been assigned by the competent authority; the implementation plan of the Project, the approved training quota, and the list of students based on actual circumstances; ministries, central agencies, and localities shall allocate and transfer budget estimates to higher education institutions under their jurisdiction to send lecturers for training in accordance with regulations for full-time domestic training methods and the domestic training period for joint training methods, and submit to the financial authorities at the same level for inspection in accordance with laws on state budget; simultaneously submit to the Ministry of Education and Training for monitoring and consolidation.

2. The training costs for full-time overseas training methods; the overseas training period for joint training methods, and the training costs for students from non-public higher education institutions participating in the Project shall be allocated and transferred within the annual budget estimates of the Ministry of Education and Training to pay for foreign training institutions accepting students according to the Project and the students.

3. For the year 2022, the Ministry of Education and Training, ministries, central agencies, and localities shall proactively arrange funds within the allocated budget estimates to implement the tasks of the Project in accordance with the guidelines set out in this Circular.

Article 8. Principles of Management and Settlement of Funds from the State Budget

1. Regulations on controlling the payment of support funds for students at the State Treasury:

a) Regarding the procedures for controlling and paying domestic training funds and overseas training funds through the State Treasury: Implement in accordance with the provisions of Government Decree No. 11/2020/NĐ-CP dated January 20, 2020, stipulating administrative procedures under the State Treasury (hereinafter referred to as Decree No. 11/2020/NĐ-CP).

b) Regarding the regulations on controlling and paying funds through the State Treasury: Implement in accordance with the provisions of Circular No. 62/2020/TT-BTC dated June 22, 2020, issued by the Ministry of Finance guiding the control and payment of regular expenses from the state budget through the State Treasury and current regulations, wherein the procedures for controlling expenses for overseas training funds are carried out as follows:

The budget-using unit prepares a budget withdrawal form based on the total amount in the list of transferring training funds for scholarship students by country/school, type of foreign currency, or a separate form for each student and sends it to the State Treasury along with the documents specified in Clause 7 of Decree No. 11/2020/NĐ-CP.

The settlement documents for training fund payments to students must include the following contents: Name of the student; Country where the student is studying; Purpose of expenditure; Amount in foreign currency for each student; Account name of the beneficiary (name of the foreign training institution or individual beneficiary); Account number of the beneficiary; Bank Identifier Code (SWIFT code) of the beneficiary bank or full name and address of the beneficiary bank; Intermediate bank (if any); Transfer fee; Other (if any).

The budget-using unit is responsible for the legality, validity, and accuracy of the contents in the budget withdrawal forms for training fund payments to students and the documents sent to the State Treasury; ensuring compliance with the content and expenditure standards stipulated in this Circular.

The State Treasury bases its control and processing of requests for the bank to transfer funds from the State Treasury's payment account to each beneficiary on the allocated budget estimates and the documents submitted by the unit.

For living expenses and health insurance of students studying abroad, before enrollment, prepayment for travel expenses and up to a maximum of three months' living expenses can be provided.

2. Support funds granted to students according to the decision approving the Minister of Education and Training shall be calculated from the date the student officially enrolls at the training institution or from the effective date of the decision for doctoral students; but not exceeding four years (48 months) for doctoral students and not more than two years (24 months) for master's students. During periods of suspended study or research, students will not receive support funds from the Project.

3. In cases where students violate the law leading to criminal prosecution, imprisonment, or expulsion due to violations of the training institution's regulations during their studies or research: The State will stop providing support funds according to the decision of the Minister of Education and Training.

4. Students must fully reimburse all training costs if they fail to fulfill their responsibilities as stipulated in Clause 2, Article 6 of Circular No. 25/2021/TT-BGDĐT. The reimbursement of training costs shall be carried out in accordance with the provisions of Government Decree No. 143/2013/NĐ-CP dated October 24, 2013, regarding the reimbursement of scholarships and training costs for students who are not civil servants or public officials, Government Decree No. 101/2017/NĐ-CP dated September 1, 2017, regarding the training and development of civil servants and public officials, and other relevant current regulations.

5. The management and use of funds paid to non-public entities shall comply with current laws on the state budget and the provisions of this Circular, and be settled according to contracts within the approved budget estimates.

6. The Ministry of Education and Training shall be responsible for coordinating with related agencies to supervise and inspect the management of funds for implementing the Project, evaluate, and consolidate the results of the Project's implementation in accordance with regulations.

7. The funds for implementing the Project shall be managed, used, and settled in accordance with the nature of the funding sources and corresponding budget items, consolidated in the annual settlement report of the unit submitted to the superior management agency for review and to the financial authority for settlement approval in accordance with laws on the state budget.

Chapter IV
IMPLEMENTATION

Article 9. Implementation Organization

1. This Circular takes effect from July 20, 2022.

2. Students who have been admitted and are currently enrolled in the Doctorate Training Program for University and College Teachers for the period 2010-2020 pursuant to Decision No. 911/QD-TTg dated June 17, 2010 of the Government Prime Minister, and the Overseas Training Program for Cadres funded by the State Budget for the period 2013-2020 pursuant to Decision No. 599/QD-TTg dated April 17, 2013 of the Government Prime Minister, shall continue to be paid according to the provisions set forth in Circular Joint Circular No. 130/2013/TTLT-BTC-BGDĐT dated September 19, 2013 of the Ministry of Finance and the Ministry of Education and Training guiding financial regulations implementing Decision No. 911/QD-TTg; Circular Joint Circular No. 05/2015/TTLT-BTC-BGDĐT dated March 10, 2015 of the Ministry of Finance and the Ministry of Education and Training guiding admission and financial regulations implementing Decision No. 599/QD-TTg until completion of their training programs as approved by the Ministry of Education and Training.

3. During implementation, if the legal normative documents cited in this Circular are amended, supplemented, or replaced by new documents, they will be applied according to the new documents.
