Amending and supplementing some articles of Decree No. 139/2018/ND-CP

dated October 8, 2018 of the Government on business of motor vehicle inspection services

conducting motor vehicle inspection services

Pursuant to the Law on Government Organization dated June 19, 2015; the Law amending and supplementing some articles of the Law on Government Organization and the Law on Local Administration dated November 22, 2019;

Pursuant to the Road Traffic Law dated November 13, 2008;

Pursuant to the Investment Law dated June 17, 2020;

At the proposal of the Minister of Transport;

The Government promulgates this Decree amending and supplementing some articles of Decree No. 139/2018/ND-CP dated October 8, 2018 of the Government on business of motor vehicle inspection services.

Article 1. Amending and supplementing some articles of Decree No. 139/2018/ND-CP dated October 8, 2018 of the Government on business of motor vehicle inspection services (hereinafter referred to as Decree No. 139/2018/ND-CP)

1. Amending and supplementing Article 1 as follows:

“Article 1. Scope of Regulation

This Decree stipulates conditions for conducting business of motor vehicle inspection services for automobiles, semi-trailers or tractor-trailers pulled by automobiles, and similar types of vehicles (hereinafter collectively referred to as motor vehicles); management of business of motor vehicle inspection services.”

2. Amending and supplementing Clause 1, Clause 2, Clause 3, Clause 5, Clause 6, Clause 7, and adding Clause 10 of Article 3 as follows:

a) Amending and supplementing Clause 1 of Article 3 as follows:

“1. Motor vehicle inspection (hereinafter referred to as inspection) is the initial and periodic examination of technical safety and environmental protection of motor vehicles.”

b) Amending and supplementing Clause 2 of Article 3 as follows:

“2. Certificate of Technical Safety Inspection and Environmental Protection for Road Motor Vehicles (hereinafter referred to as certificate of inspection) is a certificate confirming that a motor vehicle has been inspected and meets the standards, regulations, and provisions on technical safety and environmental protection.”

c) Amending and supplementing Clause 3 of Article 3 as follows:

“3. Motor vehicle inspection unit (hereinafter referred to as inspection unit) is a public service institution, enterprise, or cooperative established in accordance with the law, providing public service to perform inspection work and issue certificates of inspection for motor vehicles.”

d) Amending and supplementing Clause 5 of Article 3 as follows:

“5. Inspector is a person who has been trained and issued an inspector certificate to carry out part or all of the procedures for inspecting vehicles and is responsible for the results of the inspections they conduct. Inspectors are divided into two levels: Motor Vehicle Inspector and Senior Motor Vehicle Inspector.”

đ) Amending and supplementing Clause 6 of Article 3 as follows:

“6. Operational staff is a person who performs tasks such as receiving, returning, storing files, entering data, searching, checking, comparing motor vehicle files for inspection, printing inspection results, and performing other office duties as assigned by the inspection unit.”

e) Amending and supplementing Clause 7 of Article 3 as follows:

“7. Head of the inspection department is a senior motor vehicle inspector, responsible for the inspection results at the inspection line they oversee.”

g) Adding Clause 10 of Article 3 as follows:

“10. An organization establishing an inspection unit is a legal entity established and operating in accordance with the law.”

3. Amending and supplementing Article 4 as follows:

“Article 4. Principles for the operation of motor vehicle inspection services

1. Only organizations that have been issued a certificate confirming their eligibility to operate motor vehicle inspections may be permitted to conduct such inspections.

2. Inspection activities must ensure independence, objectivity, transparency, and compliance with legal regulations.

3. In cases where the system of inspection units does not meet the inspection needs of organizations and individuals, it is permissible to mobilize inspection units and personnel from the People's Public Security Force and the People's Army to participate in supporting motor vehicle inspections within the scope regulated by this Decree.

4. The establishment and formation of inspection units must be consistent with provincial planning, specialized sector planning, and other related planning, including consideration of specific factors of localities, remote areas, mountainous regions, and islands; appropriate to the number and density of registered vehicles in the area; and encourage the application of modern inspection technology and equipment.

5. The location for establishing inspection units must comply with regulations on connecting to transportation systems; facilitate the entry and exit of motor vehicles for inspection; ensure safety and convenience during operations, without causing traffic congestion or obstruction, particularly in large cities.”

4. Amend and supplement Article 5 as follows:

“Article 5. General Conditions

An organization that meets the conditions regarding physical infrastructure, organizational structure, and human resources as stipulated in this Decree and the National Technical Regulations on inspection units issued by the Ministry of Transport shall be granted a certificate confirming eligibility to operate motor vehicle inspections.”

5. Amend the name of Article 6 as follows:

“Article 6. Conditions Regarding Physical Infrastructure”.

6. Amend and supplement Article 7 as follows:

“Article 7. Conditions Regarding Organizational Structure and Human Resources

1. The organizational structure of inspection units must include at least the following departments:

a) Leadership Department: Comprising the Director, Deputy Director, or person in charge of the inspection unit to manage and direct the inspection unit; among which there must be at least one leader who meets the conditions to sign inspection certification as stipulated in Article 24 of this Decree;

b) Inspection Department: Comprising the head of the inspection department and inspection officers to carry out technical condition checks and evaluations of vehicles;

c) Office Department: Comprising professional staff and other employees to perform office work and support inspection activities.

2. The human resources of inspection units consist of:

a) At least one leader meeting the conditions stipulated in Article 24 of this Decree;

b) At least one head of the inspection department;

c) The inspection line must have at least two inspection officers to ensure all inspection stages are carried out. Personnel specified in points a and b of this clause may participate in inspections at inspection lines and are counted as inspection officers on the inspection line;

d) Professional staff to perform tasks as prescribed in Clause 6, Article 3 of this Decree.”

7. Amend the name of Chapter III as follows:

“Chapter III

ISSUANCE, RENEWAL, TEMPORARY SUSPENSION OF OPERATIONS, AND REVOCATION

OF CERTIFICATES CONFIRMING ELIGIBILITY TO OPERATE MOTOR VEHICLE INSPECTIONS

MOTOR VEHICLE INSPECTION

8. Amend and supplement Article 8 as follows:

“Article 8. Procedures and steps for issuing certificates of qualification for vehicle inspection activities

1. After completing investment and construction in accordance with the provisions of the law, the organization establishing the inspection unit shall prepare one set of application documents to request issuance of a certificate of qualification for vehicle inspection activities and send it to the Department of Transport, Department of Transport and Construction (hereinafter referred to collectively as the Department of Transport), including:

a) A request for inspection and issuance of a certificate of qualification for vehicle inspection activities according to the model prescribed in Appendix VII attached to this Decree;

b) A list of personnel of the unit accompanied by the following documents: Decision on appointment of leadership of the inspection unit; decision on appointment for the head of the inspection department; certified copies of labor contracts in accordance with regulations, recruitment decisions or acceptance decisions for inspectors and technical staff, and certified diplomas and certificates of each individual;

c) A comparison of regulations on material facilities and inspection lines according to national technical standards;

d) Layout plans of overall site and workshop floor plans with arranged inspection lines and testing equipment;

đ) An approval document for investment policy from the competent authority of the locality (certified copy or original for verification);

2. Procedures and methods for issuing certificates of qualification for vehicle inspection activities

a) Within three working days, if the application documents are complete and comply with the regulations, the Department of Transport will notify the organization establishing the inspection unit about the time for on-site inspection and evaluation. In case the application documents are incomplete or do not comply with the regulations, the Department of Transport must notify the organization establishing the inspection unit in writing, specifying the reasons;

b) Within five working days from the date of notification for inspection and evaluation, the Department of Transport will conduct on-site inspection and evaluation. The results of the evaluation will be recorded in a Record according to the model prescribed in Appendix I attached to this Decree. If the requirements are met, a certificate of qualification for vehicle inspection activities according to the model prescribed in Appendix II attached to this Decree, with the registration number of the inspection unit specified in Appendix VI attached to this Decree, will be issued within five working days; if the inspection and evaluation results do not meet the requirements, the Department of Transport must notify in writing within five working days for the organization establishing the inspection unit to rectify and undergo re-inspection and evaluation.

3. The submission of application documents and delivery of results can be done directly at the Department of Transport, through the postal service, or via online methods. The components of the application documents for each method of submission must comply with the provisions of Clause 1 of this Article.

9. Amend and supplement Article 9 as follows:

“Article 9. Procedures and steps for reissuing certificates of qualification for vehicle inspection activities

1. Reissuing a certificate of qualification for vehicle inspection activities due to revocation shall be carried out like the initial issuance according to the provisions of Article 8 of this Decree.

2. In case the certificate of qualification for vehicle inspection activities is lost or damaged, the inspection unit shall submit a request for reissuance of the certificate to the Department of Transport. Based on the retained file, the Department of Transport will issue a new certificate of qualification for vehicle inspection activities within five working days from the date of receipt of the request (with a note that this certificate replaces the previously issued certificate which was lost or damaged).

3. In case there is a change in the location, site, inspection workshop, layout of inspection lines, or testing equipment affecting the number of operational inspection lines of the vehicle inspection unit compared to the previously issued certificate of qualification for vehicle inspection activities, the unit must notify the Department of Transport (accompanied by a comparison of regulations on material facilities and inspection lines according to national technical standards). Within five working days from the date of receipt of the notification, the Department of Transport will conduct inspection and evaluation of the changes. If the requirements are met, a certificate of qualification for vehicle inspection activities will be issued within five working days; if the inspection and evaluation results do not meet the requirements, the Department of Transport must notify in writing within five working days for the inspection unit to rectify and undergo re-inspection and evaluation.

10. Amend and supplement Clause 1 and Clause 2 of Article 10 as follows:

a) Amend and supplement Clause 1 of Article 10 as follows:

"1. The inspection unit will be temporarily suspended for one month if it violates any of the following cases:

a) Failing to ensure one of the conditions, requirements, or regulations stipulated in this Decree and national technical standards for inspection units;

b) Having two instances of inspectors being penalized according to Clause 1 of Article 38 of Decree No. 100/2019/NĐ-CP dated December 30, 2019 of the Government on administrative penalties for violations in road traffic and railway transport within a continuous period of twelve months;

c) Assigning inspectors to inspect vehicles that do not match the content of their inspector certificates."

b) Amend and supplement Clause 2 of Article 10 as follows:

"2. The inspection unit will be temporarily suspended for three months if it violates any of the following cases:

a) Conducting inspections and issuing inspection certificates for vehicles not in accordance with regulations, standards, or technical norms;

b) Having three or more instances of inspectors being penalized according to Clause 1 of Article 38 of Decree No. 100/2019/NĐ-CP or having two or more inspectors' certificates revoked within a continuous period of twelve months, except in cases where the inspector certificates are revoked according to Clause 6 of Article 18 of this Decree;

c) Imposing requirements or procedures not stipulated by the Ministry of Transport regarding vehicle safety and environmental protection inspections, causing difficulties for organizations and individuals; refusing to provide vehicle inspection services contrary to the law.

d) Continuing to violate one of the cases of violation stipulated in Clause 1 of Article 10 of this Decree for a continuous period of 12 months.

11. Amend and supplement Clause 1, Clause 2, and add Clause 6 of Article 12 as follows:

a) Amend and supplement Clause 1 of Article 12 as follows:

“1. Within five working days from the date of discovering the violation or receiving the notification of violation from competent authorities, the Department of Transport shall issue a decision to temporarily suspend the operation of the vehicle inspection unit, revoke the certificate of eligibility for vehicle inspection activities, and notify the Vietnam Vehicle Inspection Agency and relevant agencies to coordinate in implementation.”

b) Amend and supplement Clause 2 of Article 12 as follows:

“2. The vehicle inspection unit must return the certificate of eligibility for vehicle inspection activities to the Department of Transport in case it has been revoked, and immediately cease vehicle inspection activities upon the decision taking effect.”

c) Add Clause 6 of Article 12 as follows:

“6. The vehicle inspection unit must implement corrective actions for violations mentioned in the decision to temporarily suspend operations and can only resume operations after completing such corrective actions, while simultaneously reporting on the operational status of the unit to the Department of Transport and the Vietnam Vehicle Inspection Agency.”

12. Amend and supplement Point c of Clause 3 of Article 13 as follows:

“c) Transfer all vehicle files managed by the unit to another vehicle inspection unit according to the guidance of the Department of Transport.”

13. Amend and supplement Point a and Point b of Clause 1 of Article 14 as follows:

a) Amend and supplement Point a of Clause 1 of Article 14 as follows:

“a) Professional qualifications: Graduated from a bachelor's program in Mechanical Engineering with the following contents included in the curriculum: Automotive Theory, Automotive Construction, Automotive Structural Calculations, Technical Maintenance of Automotive, Internal Combustion Engines and Automotive Electrical Systems or equivalent contents. In cases where these contents are not fully covered, supplementary training may be conducted at higher education institutions;”

b) Amend and supplement Point b of Clause 1 of Article 14 as follows:

“b) Must have a minimum of twelve months of internship as a vehicle inspector according to the content prescribed by the Ministry of Transport. If the trainee already has direct experience in maintaining and repairing vehicles at service centers for automobile manufacturers, assemblers, and importers in accordance with Decree No. 116/2017/NĐ-CP dated October 17, 2017 of the Government on conditions for production, assembly, importation, and provision of warranty and maintenance services for automobiles, and if the total accumulated work experience ranges from twelve to twenty-four months, then the internship period is six months, and over twenty-four months, the internship period is three months (the service center bases its confirmation and responsibility for the trainee’s work time on the employment contract and social insurance records).”

14. Amend and supplement Point d of Clause 1, Point d of Clause 2 of Article 15 as follows:

a) Amend and supplement Point d of Clause 1 of Article 15 as follows:

“d) A document confirming the internship as a vehicle inspector issued by the vehicle inspection unit; a document confirming the internship from the service center in accordance with Point b of Clause 1 of this Decree if applicable;”

b) Amend and supplement Point d of Clause 2 of Article 15 as follows:

“d) The acceptance of applications and issuance of results shall be carried out directly at the Vietnam Vehicle Inspection Agency or through the postal system or via online methods. The application components for each method of submission must comply with the provisions of this Clause.”

15. Amend and supplement Clause 1 of Article 16 as follows:

“1. Within thirty days before the vehicle inspector certificate expires, the vehicle inspection unit and the vehicle inspector must submit a request for reissuance of the certificate (accompanied by a color photograph measuring 4 cm x 6 cm, taken in ID card style, within six months) to the Vietnam Vehicle Inspection Agency.

Within five working days from receipt of the request, the Vietnam Vehicle Inspection Agency will notify the schedule for the assessment of the vehicle inspector's professional skills at the vehicle inspection unit. The assessment period shall not exceed five working days from the date of notification. Within three working days from the date of assessment, if the requirements are met, the certificate will be issued; if not met, the reasons for non-compliance will be recorded in the inspection report. The vehicle inspection unit and the vehicle inspector have the right to request a reassessment from the Vietnam Vehicle Inspection Agency one month after the initial non-compliant assessment.”

16. Amend and supplement Clause 1, Clause 3, Clause 4, Clause 6, and add Clause 8 of Article 18 as follows:

a) Amend and supplement Clause 1 of Article 18 as follows:

“1. Tampering with inspection results or failing to adhere to regulations, procedures, standards, technical norms, and related guidelines concerning inspection activities to a degree that causes serious consequences related to vehicle safety.”

b) Amending and supplementing Clause 3 of Article 18 as follows:

“3. Having been penalized twice within a continuous period of twelve months for violating the provisions set forth in Clause 1 of Article 38 of Decree No. 100/2019/NĐ-CP.”

c) Amend and supplement Clause 4 of Article 18 as follows:

“4. Being convicted by a court judgment due to violations related to the field of vehicle inspection.”

d) Amend and supplement Clause 6 of Article 18 as follows:

“6. Not directly performing inspection tasks or guiding and evaluating vehicle inspector skills for a continuous period of twelve months or more.”

đ) Add Clause 8 of Article 18 as follows:

“8. Proposing requirements not stipulated by the Ministry of Transport regarding vehicle safety and environmental protection inspections, thereby causing difficulties for organizations and individuals.”

17. Amend and supplement Article 19 as follows:

“Article 19. Procedure for Revoking the Inspector's Certificate

1. Within five working days from the date of discovering the violation or receiving a violation notification from competent authorities, the Vietnam Vehicle Inspection Agency shall issue a decision to revoke the inspector's certificate, notify relevant agencies to coordinate implementation, and publish on the Vietnam Vehicle Inspection Agency’s electronic information website.

2. The inspector must return the inspector's certificate to the Vietnam Vehicle Inspection Agency and immediately cease participating in vehicle inspection activities at the inspection unit upon the decision taking effect.

3. An inspector whose certificate has been revoked may only be evaluated for reissuance of the inspector's certificate after thirty-six months from the revocation date. In cases revoked under Clause 6, Article 18 of this Decree, they may be re-evaluated for issuance of the inspector's certificate upon request.

18. Amend and supplement Article 20 as follows:

“Article 20. Professional Staff

1. Minimum professional qualification: completion of a college program.

2. Must undergo training in vehicle inspection procedures as prescribed by the Ministry of Transport.

19. Amend and supplement Article 24 as follows:

“Article 24. Conditions for Leaders of Inspection Units Authorized to Sign Inspection Certificates

1. Appointed in accordance with the law and responsible for vehicle inspection activities at the unit.

2. Must be a senior vehicle inspector or have served as a vehicle inspector for a minimum of thirty-six months.

20. Amend and supplement Clause 2 of Article 25 as follows:

“2. Maintain material conditions, organizational structure, and human resources as prescribed in this Decree; ensure that inspection equipment operates normally; comply with inspection and calibration procedures for inspection equipment as stipulated by laws on measurement. During the inspection process, the inspection unit must comply with laws on environmental protection, safety, labor hygiene, fire prevention, and firefighting.”

21. Supplement Clause 7 of Article 25 as follows:

“7. Manage and issue various types of seals and inspection certificates in accordance with regulations.”

22. Amend and supplement Article 27 as follows:

“Article 27. Implementation Organization

1. Responsibilities of the Ministry of Transport

a) Uniformly manage state administration over vehicle inspection activities and organize the implementation of this Decree;

b) Issue regulatory documents detailing the implementation of this Decree;

c) Issue National Technical Regulations for vehicle inspection units;

d) Organize inspections, checks, and handling of violations according to the law;

đ) Coordinate with the Ministry of Public Security and the Ministry of Defense to implement provisions under Clause 3, Article 4 of this Decree;

e) Lead the development and unify with the Ministry of Finance before issuing service fee regulations for vehicle inspections according to price laws.

2. Responsibilities of the Ministry of Finance

Coordinate with the Ministry of Transport to issue service fee regulations for vehicle inspections according to price laws.

3. Responsibilities of the Ministry of Science and Technology

a) Issue regulatory documents within its authority regarding measurement for measuring instruments used in vehicle inspection activities;

b) Lead coordination with related ministries and sectors to organize the implementation of inspections, checks, calibrations, and verifications for measuring instruments used in vehicle inspection activities according to laws on measurement.

4. Responsibilities of Provincial People's Committees and Municipalities Directly Under the Central Government

a) Coordinate with the Ministry of Transport to organize the implementation of this Decree;

b) Direct the Department of Transport and local functional agencies to manage state administration over vehicle inspection service business operations within their jurisdiction; strictly control the establishment of inspection units to ensure compliance with laws and this Decree.

5. Responsibilities of the Vietnam Vehicle Inspection Agency

a) Organize supervision of vehicle inspection service business operations nationwide; handle or recommend handling of violations within its authority;

b) Develop, manage, and guide the uniform use of software management programs, inspection databases, data transmission, vehicle inspection data management, and inspector databases nationwide; connect and share vehicle inspection data with functional agencies to coordinate state administration tasks; organize alerts on the Inspection Management Program for vehicles in violation based on agency recommendations;

c) Compile materials, organize training and professional instruction for inspectors and staff upon request from vehicle inspection units, organizations, or individuals; disseminate regulatory documents, update professional inspection knowledge; guide the Department of Transport on vehicle inspection management and inspection procedures;

d) Publish on the Vietnam Vehicle Inspection Agency’s electronic information website lists of inspection units granted, temporarily suspended, or revoked certificates of eligibility for vehicle inspection activities; lists of inspectors and professional staff;

đ) Continue implementing tasks prescribed in Articles 8 and 9 of this Decree when the Department of Transport has not yet implemented them and has requested in writing;

e) Transfer copies of certificates of eligibility for vehicle inspection activities (certified by the Vietnam Vehicle Inspection Agency or electronic versions) to the Department of Transport for storage and management according to its authority.

6. Responsibilities of the Department of Transport

a) Organize management of vehicle inspection activities; inspect, check, and handle violations in the implementation of vehicle inspection service business regulations in this Decree and related laws within their jurisdiction;

b) Implement issuance, reissuance, temporary suspension, and revocation of certificates of eligibility for vehicle inspection activities; inspect and evaluate maintenance of material conditions, human resources, and inspection activities;

c) Notify (in writing or through software programs) the results of implementing the contents prescribed in points a and b of this article to the Vietnam Vehicle Inspection Agency.

d) Publish on the Department of Transport's electronic information website the list of inspection units that have been granted, temporarily suspended, or had their certificates revoked for meeting the conditions to operate vehicle inspections; the list of inspectors and technical staff under the management of the Department of Transport.

7. Responsibilities of organizations establishing inspection units

a) Be responsible for the legality of the application dossier for issuing certificates of meeting the conditions to operate vehicle inspections;

b) Notify the Department of Transport before implementing the establishment of inspection units;

c) Strictly prohibit interference in the work of vehicle inspections conducted by subordinate inspection units to violate legal regulations;

d) Jointly bear responsibility in cases where inspection units violate the provisions of this Decree and related laws.

8. Responsibilities of inspection units

a) Adhere to the conditions stipulated in this Decree and relevant laws regarding business conditions and vehicle inspection activities; ensure that measuring instruments operate normally; comply with legal requirements for inspecting, calibrating, and verifying measuring instruments;

b) Cooperate with competent state agencies to perform tasks related to assessing the technical condition and protecting the environment of vehicles;

c) Ensure a minimum operating time of eight hours per day and five days per week for vehicle inspections; publicly announce inspection times at the inspection unit's headquarters;

d) Hand over all archival files related to vehicles according to the guidance of the Department of Transport when dissolving the inspection unit or having its certificate of meeting the conditions to operate vehicle inspections revoked;

đ) Subject to supervision and inspection by authorized agencies regarding the business conditions for vehicle inspection services;

e) Assign qualified inspectors to participate in training updates and supplements to vehicle inspection skills when there are changes in standards, regulations, and scientific and technological advancements in vehicle inspection work;

g) Manage and oversee inspection activities at the unit, bear full responsibility when violations or corruption occur within the inspection unit;

h) In cases where changes in inspectors affect the operation of the inspection unit, notify the Department of Transport and the Vietnam Inspection Agency;

i) Refrain from conducting inspections for cases that do not comply with administrative penalty decisions in road traffic; cases exceeding the deadline for resolving violation incidents recorded in administrative violation records or notification documents issued by authorized authorities if the vehicle owners or violators do not appear at the authority's office to resolve and handle the matter; cases warned in the Vehicle Inspection Management Program. After the vehicle owner or violator fulfills the obligations mentioned above, they will be inspected according to the regulations."

Article 2. Repeal certain clauses and articles; replace phrases; replace and supplement some Appendices of Decree No. 139/2018/NĐ-CP

1. Repeal Clause 2 of Article 2, Clause 5 of Article 11, Article 17, Article 21, Article 22, Article 23, and Article 26.

2. Replace the phrase "inspection officer certification" with "inspection officer certificate" in the name of Clause 1, the name of Clause 2 of Article 14; Clause 1, Point a and Point b of Clause 2, Clause 3, the name of Article 15; Clause 2 and the name of Article 16; Clause 2 and the name of Article 18 of Decree No. 139/2018/NĐ-CP and accompanying Appendices; Appendices III, IV, and V issued with Decree No. 139/2018/NĐ-CP.

3. Replace Appendix I, Appendix II, and Appendix III issued with Decree No. 139/2018/NĐ-CP respectively with Appendix I, Appendix II, and Appendix IV issued with this Decree.

4. Supplement Appendices VI, VII, and VIII to Decree No. 139/2018/NĐ-CP with Appendices III, V, and VI issued with this Decree.

Article 3. Implementation Provisions

1. This Decree takes effect from June 8, 2023.

2. Transitional Provisions

a) Certificates of meeting the conditions to operate vehicle inspections issued before the effective date of this Decree continue to be valid and shall apply the conditions stipulated in this Decree; Inspection officer certificates issued before the effective date of this Decree continue to be valid until the expiration date of the certificates;

b) From the effective date of this Decree, individuals currently undergoing practical training as inspection officers shall be subject to the internship period stipulated in Point b, Clause 13, Article 1 of this Decree;

c) The Vietnam Inspection Agency will not issue training certificates for technical staff from the effective date of this Decree;

d) Application dossiers for certificates of meeting the conditions to operate vehicle inspection services submitted to the Vietnam Inspection Agency before the effective date of this Decree shall be processed according to the provisions of Decree No. 139/2018/NĐ-CP;

đ) From the effective date of this Decree, if the Department of Transport has not yet implemented the tasks specified in Clause 8 and Clause 9 of Article 1 of this Decree, it shall request the Vietnam Inspection Agency to continue performing them. As of January 1, 2026, the Department of Transport shall implement the issuance and reissuance of certificates of meeting the conditions to operate vehicle inspections according to the provisions of Clause 8 and Clause 9 of Article 1 of this Decree;

e) Inspection units shall continue to apply the current service fee schedule for vehicle inspections until a new schedule is issued;

g) In cases where legal documents cited in this Decree are amended, supplemented, or replaced, the amended, supplemented, or replaced documents shall be applied;

3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government, and related organizations and individuals are responsible for implementing this Decree./.
