CIRCULAR

Amending and supplementing some Circulars in the fisheries inspection sector, protecting and developing aquatic resources,

protection and development of aquatic resources

Pursuant to the Fisheries Law dated November 21, 2017;

Pursuant to the Law on Local Administration Organization dated June 16, 2025;

Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;

Pursuant to Resolution No. 76/2025/UBTVQH15 dated April 14, 2025 of the Standing Committee of the National Assembly on the reorganization of administrative units in 2025;

Pursuant to Decree No. 35/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Fisheries and Inspection Service;

The Minister of Agriculture and Rural Development issues this Circular amending and supplementing some Circulars in the fisheries inspection sector, protecting and developing aquatic resources.

Article 1. Amending and supplementing some articles of Circular No. 19/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development guiding on the protection and development of aquatic resources (amended and supplemented by Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development amending and supplementing some Circulars in the fisheries sector).

1. Amending and supplementing Clause 7 of Article 3 as follows:

"7. Entering investigation data into the national database for the protection and development of aquatic resources and storing the investigation results in accordance with regulations."

2. Amending and supplementing Point g Clause 2 Article 5 as follows:

"g) Entering investigation data into the national database for the protection and development of aquatic resources and storing the investigation results in accordance with regulations."

3. Replacing some phrases of Circular No. 19/2018/TT-BNNPTNT (amended and supplemented by Circular No. 01/2022/TT-BNNPTNT) as follows:

a) Replacing the phrase "Ministry of Agriculture and Rural Development" with the phrase "Ministry of Agriculture and Environment" at Point b Clause 5 Article 11; Clause 1 Article 15; Point a Clause 1 Article 16, Article 18;

b) Replacing the phrase "Fisheries General Department" with the phrase "Fisheries and Inspection Service" at Point b Clause 5 Article 11 and the name of Article 15.

4. Amending and supplementing some contents of Appendix III issued together with Circular No. 19/2018/TT-BNNPTNT (already amended and supplemented by Appendix III issued together with Circular No. 01/2022/TT-BNNPTNT) as follows:

Article 2. Amend and supplement some Articles of Circular No. 20/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development on uniforms, emblems, flags, traditional flags, inspection fishery cards, and paint colors for inspection fishery boats (amended and supplemented by Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development to amend and supplement some Circulars in the field of fisheries).

1. Amending and supplementing some points of Article 5 as follows:

a) Amend and supplement Point i Clause 3 as follows:

“i) Leather shoes, work shoes on board ships;”

b) Amend and supplement Point x Clause 3 as follows:

“x) Work clothes on board ships, belt for carrying support tools;”

2. Amend and supplement Point d Clause 1 Article 6 as follows:

“d) Winter and summer formal suits trousers and shirts have dark gray color, black shoes;”

3. Supplement Clause 3a after Clause 3 Article 7 as follows:

“3a. The Vietnam Fisheries Inspection Emblem shall be worn on the left chest; it is made of metal covered with transparent plastic with a length of 80 mm and width of 20 mm. In the center of the Vietnam Fisheries Inspection Emblem is a shield (in the middle of the shield is the Fisheries Inspection Emblem); on both sides of the shield are rectangles (inside the rectangle are three waves); below there are two pine branches.

The model of the Vietnam Fisheries Inspection Emblem prescribed in Appendix VII issued together with this Circular.”

4. Amend and supplement Points c, d, đ, and e Clause 3 Article 8 as follows:

“c) Heads of Departments under the Bureau having functions and tasks related to fisheries inspection, Chiefs of Fisheries Inspection Regional Branches, Directors of Centers under the Bureau having functions and tasks related to fisheries inspection, Chiefs of Fisheries Inspection Teams: small border, four small stars and two vertical yellow stripes;

d) Deputy Heads of Departments under the Bureau having functions and tasks related to fisheries inspection, Deputy Chiefs of Fisheries Inspection Regional Branches, Deputy Chiefs of Fisheries Inspection Teams, Deputy Directors of Centers under the Bureau having functions and tasks related to fisheries inspection, Deputy Heads of provincial fisheries inspection agencies: small border, three small stars and two vertical yellow stripes;

đ) Heads of Centers under the Bureau having functions and tasks related to fisheries inspection; Heads of Departments, Station Chiefs of Fisheries Inspection Stations, Team Leaders of Inspection Boat Teams under Fisheries Inspection Regional Branches under the Bureau; Heads of units under Fisheries Inspection Teams; Heads of Fisheries Inspection Departments, Station Chiefs of Fisheries Inspection Stations under provincial fisheries inspection agencies: small border, two small stars and two vertical yellow stripes;

e) Deputy Heads of Centers under the Bureau having functions and tasks related to fisheries inspection; Deputy Heads of Departments, Deputy Station Chiefs of Fisheries Inspection Stations, Deputy Team Leaders of Inspection Boat Teams under Fisheries Inspection Regional Branches under the Bureau; Deputies of units under Fisheries Inspection Teams; Deputy Heads of Fisheries Inspection Departments, Deputy Station Chiefs of Fisheries Inspection Stations at the provincial level: small border, one small star and two vertical yellow stripes.”

5. Amend and supplement some Clauses of Article 10 as follows:

a) Amend and supplement Clause 2 as follows:

“2. Formal hat has a dark gray color, similar in specifications to the kepi hat.”

b) Amend and supplement Clause 5 as follows:

“5. Impact-resistant helmet: Has a light gray color with scattered patterns, is a type of head protection covering the head, back of the neck, and ears, with a windscreen in front, and the fisheries inspection emblem attached in front, with the fisheries inspection emblem printed on both sides. The helmet frame is made of plastic, with an inner shock-absorbing layer, foam padding around the ear flaps, and straps to secure the helmet.”

c) Supplement Clause 5a after Clause 5 as follows:

“5a. Soft work hats on board ships have specifications and materials similar to men's and women's soft hats; fabric with light gray scattered patterns; with the fisheries inspection emblem attached.”

6. Amend and supplement some Clauses of Article 11 as follows:

a) Amend the title of Clause 10 as follows:

“10. Work clothes on board ships: Clothes have light gray scattered patterns, specifications as follows:”

b) Supplement Clause 12a, Clause 12b after Clause 12 as follows:

“12a. Belt for carrying support tools woven from nylon fabric, gray in color; with a plastic buckle, and a strap for attaching support tools; width of 5 cm.

12b. Work shoes on board ships: High-collared canvas shoes, anti-slip, fabric with light gray scattered patterns.”

7. Amend and supplement Clause 3 Article 12 as follows: “3. Authority to issue uniforms:

a) The Director of the Fisheries Inspection Bureau decides on the provision of uniforms for central and regional fisheries inspectors under the Bureau or delegates the Fisheries Inspection Regional Branches to provide uniforms for regional inspectors under the Bureau according to regulations;

b) The Director of the Department of Agriculture and Environment decides on the provision of uniforms for provincial-level fisheries inspectors managed or delegates subordinate agencies responsible for state management of fisheries inspection at the provincial level to provide uniforms according to regulations.”

8. Amend and supplement Clause 2 Article 13 as follows:

“2. The number of the fisheries inspection card consists of three groups of characters defined as follows:

a) The first group of characters represents the code of the Ministry of Agriculture and Environment: G10;

b) The second group of characters is the symbol of the direct managing agency, detailed provisions are set out in Appendix V issued together with this Circular;

c) The third group of characters represents the serial number of the issued fisheries inspection card starting from the series number 0001;

d) The three groups of characters above are connected by a hyphen (-).

Example:

G10-TSKN-0001 is the number of the card of officials under the Fisheries Inspection Bureau.

G10-TSKNV1-0003 is the number of the card of officials under the Fisheries Inspection Regional Branch I.

G10-KNQN-0005 is the number of the card of officials under the Fisheries Inspection of Quang Ninh Province.”

9. Amend and supplement Point a Clause 3 Article 14 (amended and supplemented by Clause 2 Article 2 of Circular No. 01/2022/TT-BNNPTNT) as follows:

“a) Training institutions organize training and issue certificates of training in fisheries inspection business;”

10. Amend and supplement some Clauses of Article 15 as follows:

a) Supplement Clause 2a after Clause 2 as follows:

“2a. Procedures for issuing new and replacing Fisheries Inspection Cards

a) Provincial-level fisheries and inspection management agencies directly under the central government send letters along with application files for new issuance and replacement of Fisheries Inspection Cards to the Fisheries Inspection Bureau;

b) Within 10 working days from the date of receipt of the application letter for new issuance and replacement of Fisheries Inspection Cards from provincial-level fisheries and inspection management agencies, the Fisheries Inspection Bureau will examine and issue new or replace Fisheries Inspection Cards according to regulations.”

b) Amend and supplement Point g Clause 3 as follows:

“g) Two color photos measuring 2 cm x 3 cm; photos taken wearing winter or summer fisheries inspection uniforms (wearing a kepi hat with all insignia attached), taken within one year prior to the date of filing the application.”

11. Amend and supplement some Points and Clauses of Article 16 as follows:

"c) A civil servant's application form for reissuance of a Card according to Model 2 attached to this Circular;"

"c) Two color photographs measuring 2cm x 3cm; one photograph wearing winter or summer fisheries inspection uniform (wearing a peaked cap with full insignia of fisheries inspector), taken within no more than one year from the date of filing the application."

b) Supplement Clause 3 as follows:

"3. Procedure for issuing replacement Fisheries Inspection Cards

a) The provincial fisheries management and inspection authority shall submit a request letter along with the application file to the Fisheries Inspection Department;

b) Within ten working days from the date of receipt of the request letter for issuing replacement Fisheries Inspection Cards from the provincial fisheries management and inspection authority, the Fisheries Inspection Department shall examine and issue replacement Fisheries Inspection Cards in accordance with regulations."

12. Replace certain phrases in Circular No. 20/2018/TT-BNNPTNT (amended and supplemented by Circular No. 01/2022/TT-BNNPTNT) as follows:

a) Replace the phrase “Ministry of Agriculture and Rural Development” with the phrase “Ministry of Agriculture and Environment” at point a, Clause 2, Article 13; Clause 2, Article 23;

b) Replace the phrase “Fisheries General Department” with the phrase “Fisheries Inspection Department” at Clause 1, Article 14; point a, Clause 3, Article 15; Clause 1, Article 18; Article 23;

c) Replace the phrase “Director of the Fisheries General Department” with the phrase “Director of the Fisheries Inspection Department” at Clause 1, Article 14;

d) Replace the phrase “Fisheries Inspection Department” with the phrase “Fisheries Inspection Department” at point a, Clause 2, Article 4; Clause 2, Article 12 and at the Traditional Flag Model in Appendix I issued together with this Circular.

13. Supplement Appendix VII Model of the Fisheries Inspection Emblem with Appendix I issued together with this Circular.

14. Amend and supplement some models in Appendix II issued together with Circular No. 20/2018/TT-BNNPTNT as follows:

a) Amend the ceremonial hat model and the impact-resistant hat model at item 6 by item 1 of Appendix II issued together with this Circular; amend the work trousers and shirt model on board at item 7 by item 2 of Appendix II issued together with this Circular;

b) Supplement item 8 with the belt model for carrying support tools by item 3 of Appendix II issued together with this Circular; supplement item 9 with the soft work hat model by item 4 of Appendix II issued together with this Circular; supplement item 10 with the work shoes model on board by item 5 of Appendix II issued together with this Circular.

15. Supplement number 26 following number 25 in item 1 of Appendix III issued together with Circular No. 20/2018/TT-BNNPTNT as follows:

Article 3. Amend and supplement some articles of Circular No. 22/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development on crew members of fishing vessels and fishery service vessels (amended and supplemented by Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development amending and supplementing some Circulars in the field of fisheries).

1. Supplement Article 28a after Article 28 as follows:

"Article 28a. Requirements for transferring positions of civil servants serving as crew members on fisheries inspection vessels

1. Based on the need to arrange positions for civil servants serving as crew members on fisheries inspection vessels, such civil servants may be transferred or promoted to higher positions if they meet the specific requirements stipulated in Clauses 2, 3, 4, 5, 6, 7, 8, and 9 of this Article.

2. Requirements for civil servants transferring from the position of First Officer to Captain:

a) Holding the rank of Fisheries Inspector Officer or higher;

b) Having a Certificate of Competency for Captain of equivalent or higher class of vessel assigned to the position of Captain;

c) Having at least 24 months of experience in the position of First Officer of equivalent or higher class of vessel.

3. Requirements for civil servants transferring from the position of Second Officer to First Officer:

a) Holding the rank of Fisheries Inspector Officer or higher;

b) Having a Certificate of Competency for Chief Officer of equivalent or higher class of vessel assigned to the position of First Officer;

c) Having at least 24 months of experience in the position of Second Officer of equivalent or higher class of vessel.

4. Requirements for civil servants transferring from the position of Third Officer to Second Officer:

a) Holding the rank of Fisheries Inspector Officer or higher;

b) Having a Certificate of Competency for Deck Cadet of equivalent or higher class of vessel assigned to the position of Second Officer;

c) Having at least 36 months of experience in the position of Third Officer of equivalent or higher class of vessel.

5. Requirements for civil servants transferring from the position of Chief Engineer or Radio Operator to Third Officer:

a) Holding the rank of Fisheries Inspector Officer or higher;

b) Having a Certificate of Competency for Deck Cadet of equivalent or higher class of vessel assigned to the position of Third Officer;

c) Having at least 36 months of experience in the position of Chief Engineer or Radio Operator.

6. Requirements for civil servants transferring from the position of First Engineer to Chief Engineer:

a) Holding the rank of Fisheries Inspector Officer or higher;

b) Having a Certificate of Competency for Chief Engineer of equivalent or higher class of vessel assigned to the position of Chief Engineer;

c) Having at least 24 months of experience in the position of First Engineer of equivalent or higher class of vessel.

7. Requirements for civil servants transferring from the position of Second Engineer to First Engineer:

a) Holding the rank of Intermediate Fisheries Inspector Officer or higher;

b) Having a Certificate of Competency for Second Engineer of equivalent or higher class of vessel assigned to the position of First Engineer;

c) Having at least 24 months of experience in the position of Second Engineer of equivalent or higher class of vessel.

8. Requirements for civil servants transferring from the position of Third Engineer to Second Engineer:

a) Holding the rank of Intermediate Fisheries Inspector Officer or higher;

b) Having a Certificate of Competency for Engine Cadet of equivalent or higher class of vessel assigned to the position of Second Engineer;

c) Having at least 36 months of experience in the position of Third Engineer of equivalent or higher class of vessel.

9. Requirements for civil servants transferring from the position of Electrician to Third Engineer:

a) Holding the rank of Intermediate Fisheries Inspector Officer or higher;

b) Having a Certificate of Competency for Engine Cadet of equivalent or higher class of vessel assigned to the position of Third Engineer or higher;

c) Having at least 36 months of experience in the position of Electrician."

2. Amend and supplement Article 42 as follows:

Article 42. Responsibilities of the Fisheries and Fishery Surveillance Bureau

1. The Director of the Fisheries and Fishery Surveillance Bureau decides on the job title conversion for civil servants who are sailors under the management of the Fisheries and Fishery Surveillance Bureau.

2. Take the lead in organizing guidance and inspection of the implementation of regulations concerning job titles and crew quotas for fishery law enforcement vessels.

3. Replace certain phrases in Circular No. 22/2018/TT-BNNPTNT (amended and supplemented by Circular No. 01/2022/TT-BNNPTNT) as follows:

a) Replace the phrase "Ministry of Agriculture and Rural Development" with "Ministry of Agriculture and Environment" in Clause 3, Article 43; Clause 3, Article 46, and in the Model Certificate and License Forms for Master, Chief Engineer, and Engineer of Fishing Vessels in Appendix II issued together with Circular No. 22/2018/TT-BNNPTNT;

b) Replace the phrase "Fisheries General Department" with "Fisheries and Fishery Surveillance Bureau" in Clause 3, Article 43, and Clause 3, Article 44.

4. Replace Appendix I issued together with Circular No. 22/2018/TT-BNNPTNT (amended and supplemented by Clause 5, Article 4 of Circular No. 01/2022/TT-BNNPTNT) with Appendix IV issued together with this Circular.

Article 4. Amend and supplement certain articles of Circular No. 18/2022/TT-BNNPTNT dated November 22, 2022 of the Minister of Agriculture and Rural Development stipulating the procedures for patrol, inspection, and supervision at sea by the fishery surveillance force.

1. Amend and supplement Article 1 as follows:

Article 1. Scope of Regulation

This Circular stipulates the procedures for patrol, inspection, and supervision by the fishery surveillance force to enforce Vietnamese laws and international treaties to which the Socialist Republic of Vietnam is a member regarding fishing and protection of aquatic resources.

2. Amend and supplement Clause 1, Article 22 as follows:

“1. The Fisheries and Fishery Surveillance Bureau shall be responsible for directing, guiding, organizing mobilization meetings, training sessions, and professional training according to assigned functions and tasks, conducting publicity, mid-term reviews, final evaluations, and assessments of patrol, inspection, supervision activities, and law enforcement by the fishery surveillance force, and inspecting the implementation of this Circular nationwide.”

3. Replace certain phrases in some articles, clauses, and points as follows:

a) Replace the phrase "Ministry of Agriculture and Rural Development" with "Ministry of Agriculture and Environment" in Clause 3, Article 22;

c) Replace the phrase "Director of the Fishery Surveillance Bureau" with "Director of the Fisheries and Fishery Surveillance Bureau" in Point a, Clause 2, Article 6; Point a, Clause 1, Article 7.

4. Replace Appendix IV issued together with Circular No. 18/2022/TT-BNNPTNT with Appendix V issued together with this Circular.

Article 5. Responsibility for Implementation

1. Ministries, agencies equivalent to ministries, provincial People's Committees, and related organizations and individuals are responsible for implementing this Circular.

2. In case issues arise or difficulties occur during implementation, organizations and individuals shall promptly report to the Fisheries and Fishery Surveillance Bureau for consolidation and reporting to the Minister of Agriculture and Environment for consideration and decision.

Article 6. Implementation Provisions

1. This Circular takes effect from August 18, 2025.

2. Transitional provisions:

a) For training courses for masters, chief engineers, and engineers of fishing vessels that are ongoing before this Circular takes effect, continue to apply the content and framework of the training program for masters, chief engineers, and engineers issued together with Circular No. 22/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development until the end of the course;

b) For patrols, inspections, and supervision at sea that are ongoing before this Circular takes effect, continue to use the Inspection and Supervision Record Form for Fishing Vessels issued together with Circular No. 18/2022/TT-BNNPTNT dated November 22, 2022 of the Minister of Agriculture and Rural Development stipulating the procedures for patrol, inspection, and supervision at sea by the fishery surveillance force until the end of the patrol voyage back to shore.
