THE MINISTER OF TRANSPORTATION

Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government stipulating the tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 13/CP dated February 25, 1994 of the Government promulgating "Regulations on the Management of Maritime Activities at Seaports and Marine Areas in Vietnam"; Decree No. 24/2001/NĐ-CP dated May 30, 2001 of the Government amending and supplementing certain articles of the Regulations on the Management of Maritime Activities at Seaports and Marine Areas in Vietnam promulgated together with Decree No. 13/CP dated February 25, 1994 of the Government;

Considering the proposal of the Director of the Legal Affairs and Transportation Department and the Director General of the Vietnam Maritime Administration,

DECISION:

Article 1. -

1. Permission is granted to Berth No. 1 - Dung Quat Port of the Vietnam-Russia Joint Venture Oil Refinery to receive dry cargo vessels from Vietnam and foreign countries with a gross tonnage up to 10,000 DWT to enter and exit for loading and unloading operations.

Article 2. -

Vessels entering and exiting Berth No. 1 - Dung Quat Port must arrive at the pilot station location within a water area with a radius of 01 nautical mile, with the center having the following coordinates:

- Latitude: 15° 26' 30" N.

- Longitude: 108° 45' 30" E.

Article 3. -

1. The Quang Ngai Harbor Master's Office shall be responsible for specialized state management of maritime activities in the Berth No. 1 - Dung Quat Port area and based on weather conditions, operational conditions of the berth, and specific drafts of vessels, issue decisions to permit vessels to safely enter and exit Berth No. 1 - Dung Quat Port.

2. The Quang Ngai Harbor Master's Office may collect fees as prescribed by law.

Article 4. - The Vietnam-Russia Joint Venture Oil Refinery shall be responsible for providing relevant documents related to the berth to the Quang Ngai Harbor Master's Office, organizing safe exploitation of Berth No. 1 - Dung Quat Port according to its intended purpose, and collecting freight charges as prescribed by law.

Article 5. - Relevant state management agencies of ministries and sectors shall perform their tasks and powers as prescribed by law at Berth No. 1 - Dung Quat Port.

Article 6. -

1. This Decision takes effect from October 1, 2002.

2. The Heads of the Ministry's Office, the Director of the Legal Affairs Department - Transport Service of the Ministry of Transport, the Director of the Vietnam Maritime Administration, the Director of the Quang Ngai Harbor Master's Office, the Vietnam-Russia Joint Venture Oil Refinery, the Heads of relevant agencies, units, and individuals shall be responsible for implementing this Decision.
