Article 1.- NOW, WE ISSUE HEREBY ATTACHED TO THIS DECISION THE REGULATIONS ON GRADUATION EXAMINATIONS FOR PRIMARY AND LOWER SECONDARY SCHOOLS AND UPPER SECONDARY SCHOOLS.

Article 2.- The chairmen of the People's Committees of provinces, cities, and special zones directly under the Central Government, the directors of the General Office of the Ministry of Education, the heads of the organization and cadres department, the heads of the primary and lower secondary education department, the heads of the upper secondary education department, the directors of provincial education departments, and the heads of educational bureaus shall be responsible for implementing this Decision.

REGULATIONS

GRADUATION EXAMINATIONS FOR PRIMARY AND LOWER SECONDARY SCHOOLS AND UPPER SECONDARY SCHOOLS
(issued pursuant to Decision No. 305-QĐ dated March 24, 1981)
NATURE, MEANING, AND PURPOSES OF THE EXAMINATION

PART I
Graduation examinations for primary and lower secondary schools and upper secondary schools hold a special position in evaluating accurately the academic achievements and discipline of students throughout their entire level of study, thereby encouraging students to diligently study and improve themselves.

Article 1.- Graduation examinations for primary and lower secondary schools and upper secondary schools combine comprehensive internal school assessments with state evaluations of individual students.

Article 2.- The results of graduation examinations for primary and lower secondary schools and upper secondary schools, together with daily academic and disciplinary records in student transcripts, serve as important grounds for the State to properly utilize each trained student.

Article 3.- The purposes of graduation examinations for primary and lower secondary schools and upper secondary schools are:

Article 4.- 1. To accurately and objectively evaluate the academic achievements of students and the training outcomes of schools, and report those results truthfully to the Party, the State, and the people.

2. To encourage and motivate students to diligently study and improve themselves, and teachers to continuously enhance their sense of responsibility to teach well and guide students to study effectively.

3. To encourage and motivate all levels of the Party, government, and education sectors, parents of students, and the whole society to pay attention to teaching and learning.

4. To identify strengths and weaknesses in educational work, propose policies and measures to promote effective teaching and learning in schools, improve educational management and guidance, and contribute to bringing educational management and guidance into a regular system according to socialist legal norms.

To achieve the purposes of the examination, the evaluation of examination results will be based on:

Article 5.- 1. Academic achievements and discipline of students in the final year of their level, comprehensively evaluated by the school according to current regulations and recorded in grade books and transcripts.

2. Results of cultural subject examinations during the examination period.

The organization of the examination must ensure the following basic requirements:

Article 6.- 1. Accurately assess the overall quality of students through the strict, honest, and fair implementation of examination procedures. Examination staff and students participating in the examination must strictly adhere to examination regulations and rules.

2. Implement the democratic rights of students and their parents: publicly post lists of graduating students and announce examination scores to all participating students. Resolve student complaints according to established procedures within thirty days of announcing examination results.

ELIGIBILITY AND CONDITIONS FOR PARTICIPATION IN THE EXAMINATION

PART II
The graduation examinations for primary and lower secondary schools or upper secondary schools are organized for:

Article 7.- 1. Students who have completed the final grade of their level in the academic year when the examination is held at various types of primary and lower secondary schools or upper secondary schools permitted to operate according to plans;

2. Students who have completed the final grade of their level in previous academic years but did not pass the graduation examination or did not meet the conditions for participation (self-study candidates).

In addition to these two categories, other special cases must be reviewed and decided upon by the provincial or municipal education departments (for primary and lower secondary school graduation examinations) or the Ministry of Education (for upper secondary school graduation examinations).

Students referred to in Point 1, Article 7, if they meet the following conditions, may participate in the examination:

Article 8.- 1. Have completed the curriculum of all grades in their level, with full assessment results from the school regarding educational aspects in each grade according to current regulations;

2. Total number of days absent in the final grade of the academic year (whether in one or multiple absences) does not exceed forty-five days;

3. Ranked at least average in moral conduct in the final grade of the academic year;

4. Regarding cultural subjects, they must fall into one of the following categories:

a. Up to five subjects with an annual average score between 4 and 4.9, and the remaining subjects must score 5 or higher;

b. Up to three subjects with an annual average score between 4 and 4.9 and one subject with an annual average score between 3 and 3.9, and the remaining subjects must score 5 or higher;

c. Up to one subject with an annual average score between 4 and 4.9 and two subjects (of which only one can be literature or mathematics) with an annual average score between 3 and 3.9, and the remaining subjects must score 5 or higher.

For students currently studying who do not meet the conditions for participation, the principal must inform the student and their family ten days before the examination date.

Regarding the categories mentioned in Point 2, Article 7:

Article 9.- 1. Students from the previous academic year who took the examination but did not pass the graduation examination, if they wish to retake the examination, may register to participate in the examination forty-five days before the examination date at their former school or the nearest examination site, provided they meet the following conditions:

a. Not exceeding twenty years old for the primary and lower secondary school graduation examination and twenty-four years old for the upper secondary school graduation examination;

b. Obtaining a certificate from local authorities (commune, ward, town, etc.) where they reside or from their workplace or production unit confirming that they have a good awareness and attitude in complying with Party and State policies, actively participating in labor or social activities, and maintaining good moral character during the time they were not continuing their studies at school.

b. Received from the local authority (commune, ward, town, etc.) where they reside or from the agency or production unit managing them, a certificate confirming that they have a good awareness and attitude in implementing the policies and guidelines of the Party and State, have actively participated in labor or social work, and possess good moral character during the period when they are not continuing their studies at school.

2. Students from the previous academic year who did not meet the conditions to take the exam and did not continue their studies, if they wish to take the exam, shall register for the exam 45 days before the exam date at their former school, provided that they meet the following conditions:

a. For students who did not meet the moral conditions, they must satisfy the two conditions mentioned in point 1 of this Article.

b. For students who did not meet the cultural conditions, in addition to satisfying the two conditions mentioned in point 1 of this Article, they must also be confirmed by their former school to have met the conditions to take the exam in terms of culture. Only subjects with an annual average score too low to meet the conditions for taking the exam will be re-examined. The re-examination score will replace the annual average score of the subject for the purpose of assessing the examination conditions.

Article 10.- The Ministry will establish specific regulations regarding examination files. For students currently studying at primary and secondary schools, the principal is responsible for preparing complete examination files for students in their school to present to the examination board.

For students who have studied in the previous academic year and wish to take the exam if they meet the conditions, they must submit complete application materials at the registration location.

Article 11.- At the beginning of the second semester, the school must conduct a preliminary review of the examination files of students, identify cases where examination files are missing or contain errors to supplement and correct them. Fifteen days before the exam, the school must conduct a final review of all examination files before the education department or provincial/municipal education authority conducts another review.

Article 12.- The examination board will conduct a final review and confirm or deny the eligibility of each student as a candidate. If any student's file is found to be incomplete or questionable, the examination board must immediately notify the school to supplement or verify it, but still allow the student to take the exam, while recording the matter to be referred to the marking board for further consideration and reported to the provincial/municipal education authority for resolution.

CHAPTER III
SUBJECTS OF THE EXAM, DATE OF THE EXAM, EXAM PROGRAM AND EXAM QUESTIONS

Article 13.- In principle, students must take exams in subjects they have studied. Annually, the Ministry of Education bases on the actual teaching and learning situation of schools to determine and announce no later than April 15th the written exam subjects, oral exam subjects, and subjects whose annual average score serves as the exam score.

Article 14.- The graduation exams for primary and secondary schools are organized uniformly nationwide around the first ten days of June each year. Specific dates and times will be determined by the Ministry of Education.

Article 15.- The exam program covers the entire level of study, mainly based on the curriculum of the final grade. The Ministry of Education stipulates scientific knowledge and types of practical exercises from the start of the academic year for schools to organize review sessions for students, ensuring they are well-prepared in knowledge and skills for the exam.

Article 16.- Regarding the organization of exam questions:

1. The organization of exam questions for the primary school graduation exam will be the responsibility of the Director of the Provincial/Municipal Department of Education or the Head of the Central Administrative Region's Education Office. Each year, the provincial/municipal department of education bases on the Ministry of Education's guidelines for setting exam questions, proceeds to set exam questions, guide marking and scoring to organize the exam uniformly within the province or city, including central administrative regions.

2. The organization of exam questions for the secondary school graduation exam nationwide will be the responsibility of the Ministry of Education.

3. Exam questions, marking guidelines, and scoring criteria must ensure confidentiality, accuracy, and security from the drafting stage through typing, printing, distribution, storage, and usage according to the regulations of the Ministry.

CHAPTER I V
ARTICLE CONDITIONS FOR PASSING AND GRADING CRITERIA

Article 17.- Students with an average score of 5 points or higher in all subjects, without any subject having a score below 3 points, shall be recognized as passing directly.

Article 18.- The additional passing criteria shall only apply to students currently enrolled in primary or secondary schools as mentioned in Point 1 of Article 7.

Students falling into either of the following categories shall be eligible for additional passing criteria:

1. Having an average score of 5 points or higher in all subjects, without any subject receiving a zero score;

2. Having an average score of 4.5 points or higher in all subjects, without any subject receiving a zero score, and meeting one of the following conditions:

a. Being rated as good or better in both moral and cultural aspects throughout the year;

b. Being rated as good or better in moral aspect and rated as average or better in other educational aspects throughout the year;

c. Being the child of烈士子女（持有有效证明），全年品德被评为良好及以上；

d. Being a war invalid or veteran who has served at least three years in the military or youth volunteer corps (with valid certification from the managing authority) and is now returning to continue their studies at a primary or secondary school, with a rating of good or better in moral aspect throughout the year.

Article 19.- In special cases where additional passing criteria need to be applied beyond those stipulated in Article 18, the Department of Education must submit to the Ministry of Education for decision.

Article 20.- Graduation results for primary and secondary school students are classified into five categories based on the following standards:

1. Excellent (awarded commendation certificates by the Ministry of Education and announced in the industry journal) for students who pass directly, have an average score of 9 points or higher in all subjects, with no subject scoring below 6 points, and are rated as good or better in all educational aspects in the final grade.

2. Good (awarded commendation certificates by the Department of Education) for students who pass directly, have an average score of 8 points or higher in all subjects, with no subject scoring below 5 points, and are rated as good or better in all educational aspects in the final grade.

3. Satisfactory for students who pass directly, are rated as good or better in all educational aspects in the final grade, and meet one of the following conditions:

a. Having an average score of 7 points or higher in all subjects, with only one non-literature or mathematics subject scoring as low as 4 points;

b. Having an average score of 6.5 points or higher in all subjects, with no subject scoring below 5 points.

4. Average for remaining students who pass directly.

5. Ordinary for students who are additionally passed (passed by exception).

Passing grades will be recorded in the graduation list and graduation certificate.

Article 21.- Students falling into any of the following categories will be eligible for exceptional graduation:

1. Students who fall ill before the exam, unable to participate, if they have a valid medical certificate from health authorities and the school, and are rated as good or better in all educational aspects in the final grade.

2. Students who fall ill or encounter unexpected events during the exam, unable to continue, if there is a valid confirmation record from health authorities or the examination committee, then:

- Subjects already taken must achieve 5 points or higher;

- The annual average score of unexamined subjects must be 5 points or higher.

3. Students who did not participate in the exam due to being conscripted, joining the youth volunteer corps, serving national defense, or moving to new economic zones according to state policy after completing the first or second semester, if they are rated as good or better in moral aspect at the end of the first or second semester or throughout the year, and rated as average or better in other educational aspects.

4. Students in the final grade selected by the Ministry of Education or central government agencies to join international competition teams (in mathematics or foreign languages, etc.).

Students granted exceptional graduation will not be ranked as passed and this will be clearly noted on the graduation certificate. Independent candidates will also not be ranked as passed and this will be clearly noted on the graduation certificate.

Article 22.- Students' test scores must be returned to schools for immediate announcement to examinees after the district, county, or city education boards review the primary school graduation exams and the provincial or municipal education departments review the secondary school graduation exams. Lists of graduates must be publicly posted at the primary and secondary schools where the students took the exams. If any errors or omissions are discovered after the lists are published, corrections must be made immediately and the decisions announced.

Article 23.- The handling of student complaints regarding examinations is regulated as follows:

1. Only accept appeals from students who did not graduate within one week of the test score announcement, and only consider appeals with specific content and credible evidence.

2. Provincial or municipal education departments must establish re-examination committees for both primary and secondary school graduation exams to re-evaluate disputed tests.

Article 24.- The storage of examination records is regulated as follows:

1. Provincial or municipal education departments or district education boards must retain indefinitely the registration sheets, student score sheets, graduation lists, graduation certificate registers, and files of students granted exceptional graduation.

2. Provincial or municipal education departments or district education boards must retain for three years the appeal files of examinees (including the test papers of these students).

3. Provincial or municipal education departments or district education boards must retain for one year the test papers of examinees (excluding the test papers of students who appealed).

Article 25.- Based on the examination board's graduation results and the examination result review by the provincial or municipal education departments, the director of the education department and the head of the provincial or municipal education department will issue primary and secondary school graduation certificates to graduating students within sixty days of announcing the test results. Provincial or municipal education departments must maintain registers of issued graduation certificates annually for local graduating students. The Ministry of Education will specify the format of the graduation certificate register and the model of primary and secondary school graduation certificates.

CHAPTER V
ORGANIZATION AND LEADERSHIP OF THE EXAMINATION

Article 26.- The Ministry of Education is responsible for:

1. Enact examination regulations, directives, and circulars to guide the organization of examinations, examination procedures, and specific measures to address issues arising during the examination period.

2. Prepare examination questions, grading scales, and unified marking guidelines for the secondary school graduation examination for localities.

3. Direct and inspect the work of examination boards, marking boards, and the overall organization and direction of examinations conducted by provincial, municipal, and centrally-administered city People's Committees and Departments of Education.

4. Approve additional pass cases outside the examination regulations as proposed by Departments of Education.

Article 27.- To assist the Ministry in directing examination work, the Ministry will issue a decision to establish the following organizations:

1. The Examination Question Setting Committee for Secondary School Graduation Examinations;

2. Examination Supervision Boards for Basic Education Graduation Examinations and Secondary School Graduation Examinations. These boards are responsible for supervising the entire examination process of localities in accordance with the Ministry’s examination regulations, including decisions, directives, and guidance from the Ministry. If any locality is found not complying with the Ministry’s examination regulations, they must promptly report it and may recommend that the Ministry not recognize all or part of the examination results of that locality. In necessary cases, the Ministry may establish inspection and supervision teams for examinations in certain localities.

Article 28.- Provincial, municipal, and centrally-administered city People's Committees are responsible for:

1. Directing Departments of Education to fully and strictly implement the examination regulations for basic education and secondary school graduation examinations issued by the Ministry of Education;

2. Creating favorable conditions and mobilizing forces from various sectors to assist the Department of Education in organizing the examinations well.

3. Issuing decisions to establish organizations tasked with overseeing and marking secondary school graduation examinations and re-marking basic education and secondary school graduation examinations at the request of the Department of Education.

Article 29.- Departments of Education are accountable to the Ministry of Education and provincial, municipal, and centrally-administered city People's Committees for the entire examination work for basic education and secondary school graduation examinations, specifically:

1. Directing the completion of grading, student assessment, and preparation of files, books, and necessary material resources to serve the examinations.

2. Safeguarding and preserving the examination questions and marking guidelines for the secondary school graduation examinations provided by the Ministry from receipt until transfer to local examination boards.

3. Preparing examination questions, grading scales, and marking guidelines for the basic education graduation examinations within their jurisdiction according to the Ministry's guidelines. The examination questions and grading scales must ensure accuracy, confidentiality, and security from drafting, typing, printing to marking completion.

4. Organizing the examination, marking, review, and announcement of results for basic education and secondary school graduation examinations, rewarding and disciplining in accordance with the examination regulations and Ministry guidelines. Conducting inspections on examination boards to ensure strictness, objectivity, and accurate assessment of students' cultural knowledge through the examinations.

Article 30.- Departments of Education shall submit to provincial, municipal, and centrally-administered city People's Committees for issuance of decisions to establish the following organizations to assist in examination work:

1. The Examination Question Setting Committee for Basic Education Graduation Examinations responsible for preparing examination questions, marking guidelines, and grading scales for the basic education graduation examinations.

2. Examination Direction and Supervision Boards for Basic Education and Secondary School Graduation Examinations responsible for organizing implementation and supervising examination tasks in accordance with the Ministry's examination regulations.

3. Examination Boards for Secondary School Graduation Examinations responsible for overseeing and marking examinations.

4. Re-Marking Examination Boards for Basic Education and Secondary School Graduation Examinations responsible for re-marking disputed examination papers.

Article 31.- County, district, and town Education Bureaus are accountable to Departments of Education and county, district, and town People's Committees for the entire examination work for basic education graduation examinations in their jurisdictions.

Article 32.- County, district, and town Education Bureaus shall submit to county, district, and town People's Committees for issuance of decisions to establish examination boards for basic education graduation examinations in their jurisdictions.

Article 33.- The organization of examination oversight and marking must be carried out according to the following principles:

1. Teachers cannot oversee or mark examination papers of their own schools.

2. Teachers marking examinations must have taught or currently teach the subject in the final grade.

3. Examination supervisors and markers for basic education graduation examinations must be staff and teachers from primary schools within the county, district, and town.

4. Examination supervisors and markers for secondary school graduation examinations must be staff and teachers from secondary schools within the province, municipality, and centrally-administered city.

Article 34.- The duties, powers, and working procedures of examination boards are carried out according to the examination practice guidelines and other guiding documents for basic education and secondary school graduation examinations issued by the Ministry of Education.

Article 35.- Chairpersons of examination boards, county, district, and town Education Bureaus, and Departments of Education must strictly comply with reporting requirements as stipulated by the Ministry. All cases resolved outside the provisions of the examination regulations and Ministry guidelines must be reported and recommended to the Ministry and can only be implemented after the Ministry has made a decision.

Chapter VI
REWARD AND DISCIPLINE IN THE EXAMINATION PERIOD

Article 36.- Rewards and punishments for staff and teachers involved in examination oversight and marking, those serving the examination process, or students participating in the examinations must be carried out according to the following principles:

1. Determining the form of reward or punishment for each individual is based on the level of achievement or specific misconduct during the performance of their duties as specified in the Ministry's examination regulations.

2. Commendation and disciplinary actions must be carried out strictly, democratically, promptly, and have educational effects on officials, teachers, students, and those involved in examination supervision and marking duties.

Article 37.- Forms of commendation for officials and teachers supervising and marking examinations and those involved in examination support duties include:

1. Departments of Education at provincial level issue certificates of merit;

2. People's Committees at provincial, municipal, and centrally governed city levels, and People's Committees at district and equivalent levels issue certificates of merit;

3. The Ministry of Education issues certificates of merit.

Article 38.- Disciplinary measures against officials, teachers supervising and marking examinations, and those involved in examination support duties include the following four types, decided by management authorities:

1. Reprimand before all officials, workers, and employees within the scope of a district, town, or province;

2. Warning before all officials, workers, and employees within the scope of a district, town, or province;

3. Demotion in work position, demotion in technical rank, reduction in salary, and transfer to other work;

4. Forced termination of employment or prosecution before the law.

Article 39.- All officials, teachers, workers, and employees directly assigned tasks related to examination or examination support duties must be under the direction of the Examination Supervision Board Chair or Marking Board Chair and must be clearly informed about their requirements and methods of performing their tasks. If they violate any of the provisions below, they will be recorded on the spot, immediately suspended from their work, and depending on the severity of the violation, disciplinary action will be recommended according to the forms:

1. Reprimand: Due to lack of responsibility, they violated examination regulations, but the harm was not significant such as:

- Absent from the examination board without a valid reason;

- Incorrectly copying or omitting questions in the examination paper, which were discovered and corrected by the Examination Supervision Board Chair during a review, although it caused some harm but did not significantly affect students' performance;

- Tolerating students copying answers or looking at each other's papers during the examination.

2. Warning: Violations of examination regulations are relatively serious such as:

- Altering birth certificates, school records, grade books, or name and score lists of students taking the examination;

- Losing or misplacing examination files, preventing students from taking the exam;

- Incorrectly copying or omitting questions in the examination paper, which were not discovered in time, causing the entire examination room to follow the backup question paper;

- Incorrectly adding up or omitting scores, significantly affecting the examination results of students.

3. Demotion in work position, demotion in technical rank, reduction in salary, and transfer to other work if they seriously violate examination regulations, causing significant harm to the organization of the examination such as:

- Providing answers or transferring papers to students during the examination;

- Compiling incorrect or out-of-syllabus examination questions, affecting examination results;

- Due to lack of responsibility, leaking examination questions, causing significant harm to the organization of the examination;

- Due to lack of responsibility, losing many students' examination papers, causing significant harm to the organization of the examination.

4. Forced resignation or prosecution under the law if they very seriously violate examination regulations, causing significant harm to the organization of the examination such as:

- Tampering with examination scores to allow students to graduate;

- A- Bribery to allow students to graduate;

- Intentionally leaking or selling examination questions, marking guidelines, causing significant harm to the organization of the examination in a locality;

- Engaging in acts of sabotage or assaulting those involved in examinations, disrupting security and order in the examination area, causing the examination to be postponed and unable to proceed in the locality.

For other violations, they will be handled according to the disciplinary forms stipulated in Article 38, depending on the offender's awareness, nature, and consequences of the violation.

Article 40.- Forms of commendation for students taking the examination include:

1. County, District, or City Education Departments issue certificates of merit for cases where:

a. They are classified as excellent in the examination;

b. They demonstrate a spirit of struggle, identifying and preventing negative behaviors in examinations.

2. The Ministry of Education issues certificates of merit for cases where:

a. They are classified as outstanding;

b. They show courageous and resolute actions in preventing acts of sabotage, assaults, or disorderly conduct during examinations or in discovering major violations of examination regulations.

Article 41.- Disciplinary measures against students taking the examination include:

1. Examination supervisors reprimand students in the examination room.

2. The Examination Supervision Board Chair warns students before the entire examination group.

3. The Examination Supervision Board Chair decides to suspend further participation in remaining subjects.

4. The Examination Supervision Board Chair recommends that the Marking Board not mark the examination papers, nullify direct pass or additional pass results, and recommend the County, District, or City Education Department to prohibit students from participating in graduation examinations for one to two years for secondary education graduates, and the Provincial or Municipal Education Departments for high school graduates.

5. After the Marking Board has completed its work, if any misconduct by students is discovered during the examination, the Provincial or Municipal Education Departments may revoke the graduation results and reclaim the graduation certificate, prohibiting them from participating in graduation examinations for one to two years.

Article 42.- Students who violate any of the following provisions during the examination must be recorded on the spot and disciplined according to the following forms:

1. Warning, if they commit relatively serious deficiencies such as:

- Passing their work to another student to copy or allowing another student to copy from them, despite being warned twice and continuing to violate;

- Copying another student's work, despite being reminded twice and continuing to violate.

2. Disqualification from the examination results, if they commit serious deficiencies such as:

- Bringing unauthorized materials into the examination room (from the time the question paper is read in the examination room) whether used or not;

- Receiving pre-prepared answers or scratch paper from another student in the examination room or from someone outside the examination room, whether used or not;

- Having identical papers indicating copying from each other during the examination, discovered by the examination marking teacher and confirmed by the examination marking committee;

- Submitting another person's work or scratch paper as their own examination paper, discovered by the examination marking teacher and confirmed by the examination marking committee, intentionally not submitting the examination paper;

- For other violations, disciplinary measures will be applied according to the forms specified in Article 41 based on the nature and degree of the violation.

3. Prohibition from taking the graduation examination for one to two years, if they commit deficiencies such as:

- Assaulting examination invigilators, examiners, service personnel, or other students, especially those leading such actions;

- Causing disorder and disrupting the security of the examination area, seriously affecting the examination results, especially those leading such actions.

All forms of disciplinary action against students participating in the examination must be announced to the examination board and notified to the parents of the students, the school, and the Ho Chi Minh Communist Youth Union of the school.

CHAPTER VII
IMPLEMENTING PROVISIONS

Article 43.- This regulation applies to the general secondary education graduation examination and the general high school graduation examination throughout the country starting from the 1980-1981 academic year. However, Point 4 of Article 8, Chapter II will apply from the 1981-1982 academic year. Previous regulations, rules, and guiding documents regarding the examination that contradict this regulation are hereby abolished.

Article 44.- The Ministry of Education will issue guiding documents to implement this regulation.

Article 45.- Comrades chairmen of the People's Committees of provinces, cities, and centrally governed municipalities, heads of the Ministry's Office, Heads of the Department of Cadre and Civil Service Organization, Heads of the Departments of General Secondary Education I and II, Heads of the Department of General Secondary Education III, directors of municipal education departments, and chiefs of provincial education bureaus are responsible for enforcing this regulation.
