Circular No. 31/2000/TT-BLDTBXH of the Ministry of Labor, Invalids and Social Affairs on guiding the implementation of adjustments to allowances and subsidies for persons engaged in revolutionary activities, families of martyrs, war invalids, wounded veterans, and those who have contributed to the revolution.

CIRCULAR

of the Ministry of Labor, Invalids, and Social Affairs guiding the implementation of adjustments to allowances and subsidies for persons engaged in revolutionary activities, families of martyrs, war invalids, disease invalids, and persons who have contributed to revolutionary causes

Pursuant to Clause 4, Article 1 of Decree No. 77/2000/NĐ-CP dated December 15, 2000 of the Government; after reaching consensus with the Government's Organization-Cadre Department and the Ministry of Finance; the Ministry of Labor, Invalids, and Social Affairs guides the adjustment of monthly allowance and subsidy levels for persons engaged in revolutionary activities, families of martyrs, war invalids, disease invalids, and persons who have contributed to revolutionary causes as follows:

I. OBJECTS AND MONTHLY ALLOWANCE AND SUBSIDY LEVELS

1. Persons engaged in revolutionary activities before 1945.

a) Allowance level: 171,000 VND/month.

In addition to the aforementioned allowance, they also receive the following subsidy levels:

- Persons engaged in revolutionary activities who are detached and currently receiving salary or pension shall be granted a monthly subsidy calculated based on years of pre-revolutionary activity, with each year entitling them to a subsidy of 38,000 VND;

- Persons engaged in revolutionary activities who are not detached and do not receive salary or pension, if they participated in revolutionary activities from 1935 or earlier, shall be granted a monthly subsidy of 253,000 VND; if their participation was from 1936 to August Revolution 1945, they shall be granted a monthly subsidy of 190,000 VND.

b) Primary dependents of persons engaged in revolutionary activities before 1945 who are receiving survivor benefits:

- Basic survivor benefit level: 120,000 VND/person/month;

- Survivor maintenance benefit level: 370,000 VND/person/month.

2. Persons engaged in revolutionary activities "pre-uprising": Monthly subsidy level: 90,000 VND/month.

3. Dependents receiving survivor benefits for martyrs:

- Basic survivor benefit level: 120,000 VND/person/month;

- Survivor maintenance benefit level: 370,000 VND/person/month;

- Survivor benefit level for two martyrs: 250,000 VND/person/month.

4. Mothers of Vietnam Heroic Mothers, Heroes of the Armed Forces, and Labor Heroes:

a) Mothers of Vietnam Heroic Mothers:

- Allowance level: 450,000 VND/month;

- Maintenance allowance level for single mothers of Vietnam Heroic Mothers without support: 467,000 VND/month.

b) Heroes of the Armed Forces and Labor Heroes: Allowance level: 120,000 VND/month.

5. War Invalids:

a) War Invalids and persons receiving policies equivalent to war invalids:

- Monthly allowance level according to the combined levels of disability allowances. Specifically, war invalids and persons receiving policies equivalent to war invalids who have lost more than 81% of their working capacity due to severe injuries shall receive an additional monthly subsidy of 100,000 VND/person; if they have lost more than 81% of their working capacity due to injuries that are not particularly severe, they shall receive an additional monthly subsidy of 30,000 VND/person.

b) Military personnel injured at work (war invalids category B confirmed before December 31, 1993) shall receive the following allowances:

- Loss of working capacity from 21% to 30%: Allowance level = 78,000 VND/month;

- Loss of working capacity from 31% to 40%: Allowance level = 97,000 VND/month;

- Loss of working capacity from 41% to 50%: Allowance level = 136,000 VND/month;

- Loss of working capacity from 51% to 60%: Allowance level = 155,000 VND/month;

- Loss of working capacity from 61% to 70%: Allowance level = 213,000 VND/month;

- Loss of working capacity from 71% to 80%: Allowance level = 252,000 VND/month;

- Loss of working capacity from 81% to 90%: Allowance level = 310,000 VND/month;

- Loss of working capacity from 91% to 100%: Allowance level = 349,000 VND/month.

Specifically, military personnel injured at work (war invalids category B confirmed before December 31, 1993) who have lost more than 81% of their working capacity due to severe injuries shall receive an additional monthly subsidy of 70,000 VND/person; if they have lost more than 81% of their working capacity due to injuries that are not particularly severe, they shall receive an additional monthly subsidy of 20,000 VND/person.

c) Primary dependents of war invalids and persons receiving policies equivalent to war invalids who have lost more than 61% of their working capacity and are receiving survivor benefits:

- Basic survivor benefit level: 84,000 VND/person/month;

- Survivor maintenance benefit level: 147,000 VND/person/month.

d) Caregivers for war invalids (including military personnel injured at work classified as war invalids category B confirmed before December 31, 1993) and persons receiving policies equivalent to war invalids who have lost more than 81% of their working capacity and are being cared for at home (collectively referred to as war invalids):

- Subsidy level for caregivers of war invalids who have lost more than 81% of their working capacity: 170,000 VND/month;

- Subsidy level for caregivers of war invalids who have lost more than 81% of their working capacity due to severe injuries: 210,000 VND/month.

6. Disease Invalids:

a) Allowance levels as follows:

+ Loss of working capacity from 61% to 70%: 227,000 VND/month;

+ Loss of working capacity from 71% to 80%: 261,000 VND/month;

+ Loss of working capacity from 81% to 90%: 314,000 VND/month;

+ Loss of working capacity from 91% to 100%: 349,000 VND/month.

Specifically, disease invalids who have lost more than 81% of their working capacity due to severe illnesses shall receive an additional monthly subsidy of 100,000 VND/person; if they have lost more than 81% of their working capacity due to illnesses that are not particularly severe, they shall receive an additional monthly subsidy of 30,000 VND/person.

b) Military personnel suffering from occupational diseases (disease invalids category 3 confirmed before December 31, 1994) shall receive the following allowances:

- Loss of working capacity from 41% to 50%: Allowance level = 122,000 VND/month;

- Loss of working capacity from 51% to 60%: Allowance level = 139,000 VND/month;

c) Caregivers for disease invalids who have lost more than 81% of their working capacity and are being cared for at home:

- Subsidy level for caregivers of disease invalids who have lost more than 81% of their working capacity: 170,000 VND/month;

- Subsidy level for caregivers of disease invalids who have lost more than 81% of their working capacity due to severe illnesses: 210,000 VND/month.

d) Primary dependents of disease invalids (who have lost more than 61% of their working capacity) receiving survivor benefits:

- Basic survivor benefit level: 84,000 VND/person/month;

- Survivor maintenance benefit level: 147,000 VND/person/month.

7. Persons who have contributed to the revolution:

a) Persons who contributed to revolutionary causes before the August Revolution 1945:

- Basic allowance level: 120,000 VND/month;

- Maintenance allowance level: 370,000 VND/month.

b) Persons who contributed to revolutionary causes during the resistance war:

- Basic allowance level: 80,000 VND/month;

- Maintenance allowance level: 250,000 VND/month.

8. Objects entitled to monthly allowance systems in education and training:

Monthly allowance for students and pupils who are beneficiaries of preferential policies studying at state-run educational institutions: universities, colleges, vocational schools, occupational training centers, preparatory courses for university, and boarding schools for ethnic minority students without receiving salary or living expenses while studying as stipulated in Article 66 of Decree No. 28/CP dated April 29, 1995 of the Government:

a) The allowance of 175,000 VND/month shall be granted to students and pupils who are: Heroes of the Armed Forces, Labor Heroes, war invalids; persons enjoying benefits similar to those of war invalids; children of war invalids, children of disabled veterans, and children of persons enjoying benefits similar to those of war invalids with a disability rate of 81% or higher due to severe injuries or illnesses.

b) The allowance of 140,000 VND/month shall be granted to students and pupils who are: Children of martyrs currently receiving monthly pension; children of war invalids, children of disabled veterans, and children of persons enjoying benefits similar to those of war invalids with a disability rate of 81% or higher.

c) The allowance of 115,000 VND/month shall be granted to students and pupils who are: Children of martyrs currently receiving care pension; children of war invalids, children of disabled veterans, and children of persons enjoying benefits similar to those of war invalids with a disability rate of 61% to 80%.
Allowances and subsidies not specified in this Circular shall remain unchanged at the levels of allowances and subsidies in December 2000.

II. FUNERAL ALLOWANCE

Funeral allowance shall be provided to the person responsible for burial for those who are recognized as martyrs; those who died and were war invalids or disabled veterans with a disability rate of 61% or higher; Mothers of Vietnam Heroic Soldiers; Heroes of the Armed Forces, Labor Heroes; revolutionaries and anti-war fighters captured and imprisoned by the enemy; revolutionaries before 1945 (revolutionary veterans); primary relatives of martyrs and those who have contributed to the revolutionary cause who are receiving care pensions.

Funeral allowance shall be provided at the same level as for civil servants and public officials who have passed away (the amount from January 1, 2001 is 1,680,000 VND).

III. REGIONAL SUBSIDY (IF APPLICABLE) AND HEALTH INSURANCE CONTRIBUTION LEVEL

 The regional subsidy and health insurance contribution level shall be calculated based on the general regulations of the State on the current minimum wage (the minimum wage implemented from January 1, 2001 is 210,000 VND/month).

IV. PROCEDURES FOR APPLICATION AND DOCUMENTATION

1. The Department of Labor, Invalids and Social Affairs (Department of Organizational Labor and Social Affairs) at the district level shall prepare two lists and send one copy to the Provincial Department of Labor, Invalids and Social Affairs, retaining one copy.

2. The Provincial Department of Labor, Invalids and Social Affairs shall compile a summary list of beneficiaries eligible for adjustment of allowances and subsidies (three copies), along with the list, and submit it to the People's Committee of the province or city for decision, then send the summary list to the Ministry of Labor, Invalids and Social Affairs (Department of Invalids and Martyrs and Persons Contributing to the Cause) two copies.

3. The Ministry of Labor, Invalids and Social Affairs shall compile a summary list of beneficiaries eligible for adjustment of allowances and subsidies, prepare a budget estimate for additional allowances and subsidies, and submit it to the Ministry of Finance.

4. The Ministry of Finance shall allocate funds based on the budget estimate of the Ministry of Labor, Invalids and Social Affairs for the additional allowance and subsidy fund of beneficiaries according to the prescribed regulations.

5. After receiving the notification of funding, the Director of the Provincial Department of Labor, Invalids and Social Affairs shall report to the People's Committee of the province or city to adjust allowances and subsidies according to the approved list.

V. IMPLEMENTATION

1. The Provincial Department of Labor, Invalids and Social Affairs shall be responsible for reviewing and approving beneficiaries entitled to allowances and subsidies under this Circular.

2. The Provincial Department of Labor, Invalids and Social Affairs; the Provincial Department of Finance and Prices; and the provincial or municipal Treasury shall be responsible for coordinating, guiding, and implementing the provisions of this Circular.

3. To ensure timely provision of allowances and subsidies adjusted according to the guidelines of this Circular starting from January 2001, the Ministry of Finance will temporarily allocate the first quarter of 2001 additional allowance and subsidy fund for localities to implement. From the second quarter of 2001 onwards, the Ministry of Finance will allocate the additional allowance and subsidy fund for localities after receiving the approved list and summary compiled by the People's Committee of the province or city according to the procedures stipulated in Section IV of this Circular.

4. The Ministry of National Defense and the Ministry of Public Security, after consultation with the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance, shall guide the implementation for armed forces under their jurisdiction.

5. This Circular shall take effect from January 1, 2001.

During the implementation process, if there are any difficulties, they should be reported to the Ministry of Labor, Invalids and Social Affairs for research and resolution.
