DECREE
Regarding the adjustment of the minimum wage level, allowance levels, and living expenses
for subjects receiving wages, allowances, and living expenses

THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
At the proposal of the Minister, Head of the Government Organizational Structure - Civil Service Department, Minister of Labor, Invalids and Social Affairs, and Minister of Finance,
DECREE:
Article 1. From January 1, 2001, adjust the minimum wage level, allowance levels, and living expenses for subjects receiving wages, allowances, and living expenses as follows:
1. Increase the minimum wage from 180,000 VND/month as stipulated in Decree No. 175/1999/NĐ-CP dated December 15, 1999, and Decree No. 10/2000/NĐ-CP dated March 27, 2000, of the Government to 210,000 VND/month applicable to subjects receiving wages and allowances from state budget funds and workers in enterprises;
2. Increase the monthly living expense for village, ward, and town cadres currently working and those who have retired as stipulated in Decree No. 175/1999/NĐ-CP dated December 15, 1999, of the Government corresponding to the increase in the minimum wage from 180,000 VND to 210,000 VND/month;
3. Increase the pension and monthly allowance according to social insurance regulations stipulated in Decree No. 175/1999/NĐ-CP dated December 15, 1999, of the Government and Decision No. 234/1999/QĐ-TTg dated December 22, 1999, of the Prime Minister corresponding to the increase in the minimum wage from 180,000 VND to 210,000 VND/month;
4. Increase the fund for allowances and subsidies for persons with meritorious service by 26.7% compared to the current fund stipulated in Decree No. 175/1999/NĐ-CP dated December 15, 1999, of the Government.
Article 2.
1. The Government Organizational Structure - Civil Service Department shall take the lead and coordinate with relevant ministries and sectors to guide the implementation of the adjustment of the minimum wage level and living expenses as stipulated in Clause 1 and 2 of Article 1 of this Decree.
2. The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with relevant ministries and sectors to guide the implementation of the adjustment of the minimum wage level for enterprises, pension levels, and monthly allowances for subjects receiving monthly allowances according to social insurance regulations, and allowances for persons with meritorious service as stipulated in Clauses 1, 3, and 4 of Article 1 of this Decree.
3. The Ministry of Finance shall allocate the additional wage, allowance, subsidy, and living expense fund stipulated in this Decree in the state budget estimates at each level according to the current classification and implement the settlement of the wage, allowance, subsidy, and living expense fund under the state budget according to regulations.
Article 3. The Ministry of National Defense and the Ministry of Public Security, after reaching an agreement with the Government Organizational Structure - Civil Service Department, the Ministry of Finance, and the Ministry of Labor, Invalids and Social Affairs, shall guide the implementation of the provisions of this Decree for armed forces under their management.
Article 4. The Government Organizational Structure - Civil Service Department shall cooperate with relevant ministries, sectors, and localities to promptly study and develop a project to reform the salary policy and social allowances in accordance with the spirit of Resolution No. 7 of the 8th Central Committee of the Party for consideration and decision by the Government for implementation in 2002.
Article 5. This Decree takes effect from January 1, 2001.
Deductions and benefits enjoyed according to wages or living expenses as prescribed by the State shall be recalculated in accordance with the adjustment of the minimum wage level and living expenses stipulated in this Decree.
Article 6. The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairmen of provincial and centrally-administered city People's Committees are responsible for implementing this Decree.
