REGULATIONS
Organization and operation of the Population - AIDS and Social Issues Steering Committee, Ministry of Culture and Information
(Promulgated together with Decision No. 31/2002/QĐ-BVHTT, dated
December 10, 2002 of the Minister of Culture and Information)
Article 1: Organizational structure of the Population - AIDS and Social Issues Steering Committee, Ministry of Culture and Information:
The Population - AIDS and Social Issues Steering Committee, Ministry of Culture and Information (hereinafter referred to as the Steering Committee) was established pursuant to Decision No. 654/QĐ-BVHTT dated April 18, 1998 of the Minister of Culture and Information.
a. The organizational structure of the Steering Committee includes:
- 01 Chairperson (to be concurrently held by one Deputy Minister)
- 02 to 03 Vice-Chairpersons (to be concurrently held by the Directors of the Ethnic Groups and Mountainous Areas Department, the Press Department, and the Cultural Information Institutions Bureau)
- Members are leaders of the Ministry's Office; the Planning Department, the Finance and Accounting Department, the Personnel and Cadres Department, and the International Cooperation Department.
b. Supporting the Steering Committee is a Secretariat, consisting of: staff from the Ministry's Office, the Planning Department, the Press Department, the Ethnic Groups and Mountainous Areas Department, the Finance and Accounting Department, the Personnel and Cadres Department, the International Cooperation Department, the Cultural Information Institutions Bureau, and clerical staff (on contract).
c. Operating mechanism:
Members of the Steering Committee and the Secretariat perform their duties concurrently with their respective departments and units.
Article 2: Functions and Tasks of the Steering Committee:
The Steering Committee has the functions and tasks stipulated in Article 2 of Decision No. 654/QĐ-BVHTT dated April 18, 1998 of the Minister of Culture and Information, including:
1. Developing Proposals, Projects, Programs, and Plans for information, education, and communication activities aimed at guiding the public to effectively implement population policies, family planning, crime prevention, drug control, prostitution control, HIV/AIDS prevention, and malaria control. At the same time, coordinating with relevant agencies in organizing and implementing information and propaganda activities in these areas according to Decision No. 61/2002/QĐ-TTg dated June 5, 2002 of the Prime Minister.
2. Implementing and promoting Proposals, Projects, Programs, and Plans for population education and communication, family planning, crime prevention, drug control, prostitution control, HIV/AIDS prevention, and malaria control, which have been approved by the National Committee and integrated into regular tasks and national cultural and information program objectives in a practical and effective manner.
3. Directing, inspecting, and urging subordinate units of the Ministry and local Departments of Culture and Information to implement population communication and family planning, crime prevention, drug control, prostitution control, HIV/AIDS prevention, and malaria control tasks. Organizing mid-term and final reviews and commendation activities throughout the sector.
4. Inspecting and supervising the allocation and use of funds approved by the National Committee in accordance with the objectives, ensuring proper financial settlement and accounting procedures.
Article 3: Powers, responsibilities, and relationships of the Steering Committee and the Secretariat Team:
1. The Steering Committee:
+ Comrade Deputy Minister - Chair of the Steering Committee:
- Implement the guidelines, policies, objectives, and directions of the Government and National Committees on drug abuse prevention, prostitution, HIV/AIDS, and crime prevention to develop plans, programs, and projects of the Ministry.
- Provide information on activities related to drugs, prostitution, crimes, and HIV/AIDS both domestically and internationally for members of the Steering Committee.
- Review programs, projects, and plans of the Ministry concerning drug abuse prevention, prostitution, HIV/AIDS, and crime prevention.
- Attend meetings organized by the National Committee or delegate Deputy Chairs, Members, and specialists to attend.
- Dispatch members of the Steering Committee or the Secretariat Team to participate in activities of the National Committees.
- Sign documents, reports, plans, and proposals sent to the National Committee.
- Chair meetings between the Steering Committee and permanent offices under the National Committee and relevant sectors.
- Convene and chair mid-term and final review meetings of the Steering Committee and the entire sector regarding areas within the Committee's jurisdiction.
- Assign tasks to Deputy Chairs and Members of the Steering Committee.
- Delegate authority to Deputy Chairs to handle matters of the Committee in their absence.
+ Deputy Chairs: Participate in reviewing programs, projects, and activity plans within the Committee's jurisdiction; guide and supervise the implementation of assigned tasks; evaluate, recommend, and propose to the Chair matters within their responsibility and coordinate with other Deputy Chairs during the implementation process.
- Deputy Chair - Responsible for propaganda work, commendation, and rewards. Directly organize and implement projects, proposals, and plans for population education and communication, crime prevention, prostitution, and HIV/AIDS. Sign documents, contracts, and terminate contracts for assigned responsibilities or those of colleagues who are absent. Handle Committee matters when authorized by the Chair.
- Deputy Chair - Responsible for planning and organizing activities, directly organize and implement projects, programs, and plans for drug abuse and malaria prevention education and communication. Sign documents, contracts, and terminate contracts for assigned responsibilities or those of colleagues who are absent. Handle Committee matters when authorized by the Chair.
- Deputy Chair - Responsible for training and instructing forces engaged in information dissemination and social evil prevention work; integrate population publicity work with cultural lifestyle construction at grassroots levels. Organize the implementation of assigned projects through signing responsibility contracts with the Steering Committee.
- Members: Based on the functions and responsibilities of their agencies or units, they have the duty to participate and provide opinions on project proposals, plans for population education and communication, crime prevention, drug abuse, prostitution, HIV/AIDS, and malaria. Integrate the Committee's communication tasks with their unit's regular responsibilities. Participate in Committee tasks when assigned by the Chair or Deputy Chairs. Regularly report on the implementation of assigned tasks to the Chair and directly responsible Deputy Chairs.
Member leading the Planning Department: Responsible for informing allocated budget plans, coordinating activity contents with the Steering Committee. Guide Secretariat Team members (assigned to oversee specific tasks), draft detailed plans with budgets for each activity to organize signing responsibility contracts between the Steering Committee leader and the National Committee's permanent office, accountable to the Steering Committee for annual plan completion progress.
Member leading the Finance and Accounting Department: Responsible for working with the Ministry of Finance to transfer funds to the Ministry's Office account or subordinate units, local Departments of Culture, Sports, and Tourism accounts to implement assigned tasks (through responsibility contracts between the Steering Committee and units). Accountable to the Steering Committee for correct purpose fund allocation, effective fund utilization, and settlement with the Ministry of Finance.
Member leading the Ministry's Office: Responsible for managing and approving funds for activity implementation through contracts between the Steering Committee and implementing units transferred to the Office account by the Finance and Accounting Department.
Manage and allocate funds for the Steering Committee's inspection and supervision activities of Ministry units, local Departments of Culture, Sports, and Tourism, meeting planning, proposal, and project development, contract signing and termination, mid-term and final reviews, commendations, overtime payment, office supplies, and be accountable for fund settlement with the Finance and Accounting Department.
Member leading the International Cooperation Department: Responsible for guiding the development of proposals and projects between the Steering Committee and the National Committee and international organizations in population education and communication, crime prevention, drug abuse, prostitution, and HIV/AIDS, and reporting to the Steering Committee.
Member leading the Organization and Cadre Department: Responsible for drafting documents on regulations and policies in areas under the Committee's jurisdiction. Advise the Ministry leadership on the organizational structure of the Steering Committee. Propose general issues on commendations and rewards for the Committee.
2. The Secretariat Team:
Assist the Steering Committee in implementing tasks stipulated in Decision No. 654/QĐ-BVHTT dated April 18, 1998, of the Minister of Culture, Sports, and Tourism. The Secretariat Team has a team leader and several members.
a. The Secretariat Team Leader has the following duties:
1- Urge, adjust, and coordinate tasks among team members through additional assignments or support.
2- Develop plans and operating budgets for the guidance work of the Board: monitoring, inspecting, supervising the implementation of tasks assigned by the Board to units under the Ministry, local Departments of Culture, Sports and Tourism, preparing for mid-term and annual reviews, commendations and rewards, signing and terminating contracts; Processing overtime payment procedures and office supplies for members of the Board and the secretariat team.
3- Prepare contents for meetings of the Board, draft speeches for Board leaders attending conferences and seminars organized by the National Committee.
4- Summarize and write quarterly and annual reports on the Board's activities.
5- Manage the administrative and office operations of the Board, process incoming and outgoing documents to seek opinions from Board leaders.
b. Members of the team have the following responsibilities:
- Develop plans and content for activities in the third quarter each year, coordinate with the Team Leader, include detailed budget estimates prepared by the accounting department to seek opinions and organize for the Board leaders and the Ministry’s Office leaders to sign Responsibility Contracts with the National Committee's permanent offices or branch contracts to implement them.
- Directly implement (or monitor and urge) contract contents within deadlines and according to quality requirements set by the National Committee and the Board; prepare acceptance certificates for products under Responsibility Contracts with the National Committee and relevant units to transfer to the Finance Department of the Office for contract termination and final settlement of expenses.
- Coordinate with other team members to integrate contents or support each other during the implementation process.
- Report on the implementation results of assigned tasks to the Team Leader at the mid-year review point and end-of-year summary.
- In addition to the above tasks, team members may be assigned specific tasks by the Board.
c. The Board's secretary has the following responsibilities:
- Be permanently stationed at the Board's Office.
- Receive information through telephone calls and incoming and outgoing documents to report to the Team Leader for processing.
- Manage documents and assets at the Board's Office.
- Draft routine documents, type documents ensuring quality, submit documents for Board leaders' signature, handle reception duties.
- Be subject to management and direction by the Team Leader.
Article 4: Relationships, Working Mechanism, and Operating Budget of the Board:
a- Relationships:
- With National Committees: Subject to guidance on implementing policies, programs, and plans. Report on activity results and propose mechanisms, policies, and solutions for program and plan implementation.
- With Ministry of Culture, Sports and Tourism Leaders: Subject to direction and management on implementing policies, programs, and plans.
- With subordinate units and local Departments of Culture, Sports and Tourism: Guide organization in implementing assigned tasks within the Board's programs and plans.
b- Working Mechanism:
- The Board meets regularly twice a year (first and fourth quarters) to hear reports on the program and plan activities and their outcomes, address emerging issues during the process. Meeting contents are prepared by the secretariat.
- The secretariat meets once a quarter, the Chairman or Vice-Chairman may convene extraordinary meetings if necessary.
- The Board and Secretariat conduct inspections of unit and provincial Department of Culture, Sports and Tourism implementation of assigned tasks within the Ministry's overall program and plan, and recommend solutions to authorities for arising issues.
- The Board and Secretariat operate on a part-time basis. Each member is responsible for attending meetings and discussing common issues, organizing implementation of assigned tasks according to Board assignments.
- Board and Secretariat members receive additional compensation for overtime and outside hours work as stipulated by the State.
c- Operating Budget:
Funds for guidance, inspection, project development, program planning, commendation-reward, overtime pay, mid-term and annual reviews, office supplies are allocated annually from the communication budget of national programs through the Ministry's Office account.
Article 5: Implementation Clause
This regulation shall take effect fifteen days from the date of signature.
The Steering Committee, the secretariat, and the heads of subordinate agencies and units under the Ministry shall be responsible for implementing this Regulation. In case issues arise that require amendments or supplements during the implementation process, the Chairman of the Population, AIDS, and Social Issues Steering Committee shall submit a document to the Minister of Culture, Sports and Tourism for consideration and decision.
