At the proposal of the Director of the Department of Early Childhood Education,

DECISION:

Article 1. This Decision hereby promulgates the Minimum Conditions for Kindergarten Classes, Preschool Classes, and Independent Child Groups with Many Difficulties in Areas Where It Is Not Possible to Establish a Kindergarten.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Heads of the Office, Directors of the Department of Early Childhood Education, Heads of relevant units under the Ministry of Education and Training, Chairpersons of People's Committees of provinces and centrally governed cities, and Directors of Departments of Education and Training shall be responsible for implementing this Decision.

PART I

GENERAL PROVISIONS

Article 1. Scope of application

Article 1. This document stipulates the organization and management, minimum conditions for kindergarten classes, preschool classes, and independent child groups with many difficulties in areas where it is not possible to establish a kindergarten, belonging to both public and private sectors.

Article 2. Kindergarten classes, preschool classes, and independent child groups must comply with the provisions of the Charter of Kindergartens issued pursuant to Decision No. 27/2000/QD-BGD&ĐT dated July 20, 2000, of the Minister of Education and Training (hereinafter referred to as the Charter of Kindergartens) and the provisions of this document. herein.

Article 2. Purpose

DKTT are basic criteria that kindergarten classes, preschool classes, and independent child groups must meet to ensure children's rights to education and play according to educational requirements.

2. DKTT includes criteria specified for kindergarten classes, preschool classes, and independent child groups in accordance with the requirements of the Charter of Kindergartens, serving as a basis for forming kindergartens when all necessary conditions are met.

DKTT serves as a basis for local authorities at various levels and educational management agencies to inspect and plan investments in establishing kindergarten systems. 2. Organizations and individuals wishing to open kindergarten classes must ensure compliance with the minimum conditions stipulated in this document.

3. Kindergarten classes, preschool classes, and independent child groups must meet the minimum conditions prescribed in this document before they can receive children and carry out childcare and education activities.

Chapter II

ORGANIZATION AND MANAGEMENT

Article 5. Class and Group

1. A kindergarten class is a combined group of different age children, with a maximum of 30 children per class.

2. A preschool class or an independent child group is geographically separate from other classes or groups.

Article 6. Authority to Establish

1. Kindergarten classes, preschool classes, and independent child groups are established by the Chairman of the People's Committee of communes, wards, towns (collectively referred to as commune level) based on agreement with the Educational and Training Department.

2. In cases where kindergarten classes, preschool classes, or independent child groups have very few children (five or fewer) and only one class or group, the head of the class or group must register their practice with the People's Committee at the commune level and report to the Educational Department.

3. Conditions for establishment, application forms, and procedures for establishing kindergarten classes, preschool classes, and independent child groups shall be carried out in accordance with the provisions of this document and the Charter of Kindergartens. kindergarten.

Article 6. Management of plans for nurturing, caring for, and educating children

1. Classes and groups must have plans and measures to implement their annual tasks in accordance with the actual situation of the locality. Organize activities for caring for and educating children in accordance with the guidance of the education sector.

2. There must be specific assignment tables for each teacher and childcare provider.

3. There must be a system of registers to track the quantity and quality of care and education for children, including:

- Professional monitoring register

- Property management register

- Child feeding regime management register

4. Annually, there must be a plan to conduct regular health checks for childcare providers.

Article 7. Responsibilities of class and group leaders and parent representative councils

1. Class and group leaders must comply with administrative management by local authorities, follow professional directives from educational management agencies at all levels, and fully implement policies and benefits for teachers and workers.

- Proactively propose measures to local authorities, coordinate with parent representative councils and the community to encourage children, including those with disabilities, to attend classes and groups.

- Publicly disclose sources of income to the parent representative council.

2. Parent representative councils must cooperate with teachers, class and group leaders in activities aimed at improving the quality of care and education for children.

3. Encourage material and financial support for classes and groups from state funds, contributions from domestic and international economic and social organizations, individuals, and families.

Chapter III

MINIMUM REQUIREMENTS

Article 8. Class and Group Leaders

1. Must have received at least 30 days of professional training in early childhood education or short-term management training (with certification).

2. Must have permanent residence registration in the commune or ward where the class or group is located, or in another commune or ward within the district (or urban district).

3. Must have good moral character, not violate laws, and not suffer from infectious diseases.

Article 9. Teachers and Childcare Providers

1. Teachers and childcare providers must receive at least three months of professional training according to the education sector's program. For classes and groups with ethnic minority children, childcare providers must speak Vietnamese fluently and be able to communicate with children in the ethnic language. Teachers directly teaching in favorable areas must graduate from kindergarten teacher training college, while in difficult areas, teachers teaching five-year-old classes must also graduate from teacher training college.

2. Teachers, childcare providers, and service staff must have good moral character and strictly adhere to national regulations.

3. Must have a certificate of being free from infectious diseases issued by authorized health authorities.

4. Care for and educate children according to programs and plans guided by the education sector. Treat all children fairly and kindly. Absolutely no criticism of students in front of the class.

5. Meet with all parents at least once per academic year and regularly inform parents about the child's situation to help the child develop well in all aspects.

6. Enjoy benefits as stipulated in Decision No. 161/2002/QĐ-TTg dated November 15, 2002, of the Prime Minister and Circular Joint No. 05/2003/TTLT-BGD&ĐT-BNV-BTC dated February 24, 2003, of the Ministry of Education and Training, the Ministry of Home Affairs, and the Ministry of Finance guiding certain policies for developing early childhood education.

Article 10. Organization of Classes and Groups

1. For kindergarten classes for children aged from 36 to 72 months, organize according to the Kindergarten School Regulations, with the maximum number of children per class as follows:

a) Two sessions without accommodation: at least 1 teacher/class

- Small kindergarten class (3-4 years old): up to 25 children/class

- Medium kindergarten class (4-5 years old): up to 30 children/class

- Large kindergarten class (5-6 years old): up to 35 children/class

b) Two sessions with accommodation: 1.5 to 2 teachers/class.

2. For groups of children aged from 3 months to under 36 months, organize according to the Kindergarten School Regulations, including:

- From 3 to 6 months old: 3 to 4 children/caregiver. Up to 15 children/group

- From 7 to 12 months old: 4 to 5 children/caregiver. Up to 18 children/group

- From 13 to 18 months old: 6 to 7 children/caregiver. Up to 20 children/group

- From 19 to 24 months old: 8 to 9 children/caregiver. Up to 22 children/group

- From 25 to 36 months old: 10 to 12 children/caregiver. Up to 25 children/group

3. For preschool classes: from 3 to 72 months old

a) The maximum number of children per class shall not exceed 30 children/class;

b) For classes or groups with accommodation of 20 children or more, there must be an additional food service staff responsible for nutrition and general hygiene;

c) Based on the specific age group (kindergarten, nursery), calculate the appropriate staffing according to the regulations for kindergarten classes and groups of children.

d) For classes or groups with 5 children or fewer, the class or group owner, teacher, or caregiver shall comply with the staffing regulations set forth in Clause 1 of this Article for kindergarten classes and Clause 2 of this Article for groups of children.

Article 11. Physical Facilities for Classes and Groups

1. All independent classes and groups must clearly display their name and operating license number.

2. Classes and groups must be built solidly or semi-solidly, with beautiful surroundings, having well-ventilated doors and windows, sufficient natural light, neat arrangement, and free from leaks or damage, with floors tiled or wooden.

3. Classroom area: ensuring at least 1 - 1.5 m²/child. There must be clean water for daily activities and sufficient drinking water for children every day.

4. There must be play areas for children, safety fences or gates, bathrooms, and appropriate facilities suitable for the age group and sufficient for use.

5. Places where meals are provided for children must have separate kitchens that are safe, located far from the classes or groups; fire prevention and food safety must be ensured. Implement regular food inspections.

Article 12. Equipment for a Group of Children

1. Provide mats for children to sit and play, beds for sleeping, blankets and pillows for children, shelves for toys, towels and cups for children; one chair for the caregiver.

2. Provide a minimum set of equipment including: a water container; toys, tools, and materials for play and purposeful play activities; enough potties for children's use.

3. Provide sufficient clean water for daily use and drinking water for children every day; provide enough paper, colored markers, and personal items for each child such as face towels, drinking cups, etc., and homemade toys and tools using local materials.

4. Provide tools and materials for caregivers, including: a guidebook for implementing childcare and education activities; a record book for monitoring children; a record book for group assets; materials for disseminating knowledge about raising children to parents.

Article 13. Equipment for a preschool class and kindergarten class

1. There shall be tables and chairs suitable for children to sit on (especially for five-year-old children): 1 table and 2 chairs/02 children; 1 table, 1 chair, and 1 board for teachers. If it is a boarding class, there shall be boards or beds for children to lie on, ensuring sufficient warmth or ventilation.

2. There shall be a minimum set of equipment including: water containers for drinking and daily use; toys, materials, and tools for purposeful learning activities.

3. There shall be homemade toys and tools using local materials; there shall be shelves for storing toys and tools.

4. Each child shall have their own personal items: cups, face towels, bowls, spoons... toys, and study tools.

5. There shall be teaching aids for preschool teachers including: a guidebook for implementing care and education activities; a record book for monitoring children; a logbook for organizing educational activities for children during the day; materials for disseminating knowledge on raising children to parents.

6. The equipment for the preschool class shall be based on the number of children in each age group (preschool, nursery) in the class.

Article 14. Education Activities and Quality of Care and Education for Children

1. Preschool classes, kindergarten classes, and independent groups must implement the framework program for caring for and educating children issued by the Ministry of Education and Training. In particular, for the five-year-old kindergarten class, they shall not teach ahead of the primary school curriculum.

2. Teachers shall not leave the class or group at any time when children are present. Absolute safety for children must be ensured. Emphasis shall be placed on preventing malnutrition.

3. Activities shall be carried out strictly according to the class schedule, with emphasis on allowing children to play primarily, without creating pressure for them to study.

4. Teachers shall love, respect, and take meticulous care of children's upbringing, nurturing, and hygiene, paying attention to organizing activities that allow children to play and develop their thinking skills.

5. Conditions shall be created for ethnic minority children to communicate in Vietnamese; children with disabilities shall participate in early intervention programs.

Chapter IV

RESPONSIBILITIES OF MANAGEMENT AUTHORITIES AT ALL LEVELS

Article 15. Responsibilities for Directing Implementation at All Levels of Government

1. People's Committees at all levels shall direct relevant agencies to build networks to develop preschool classes, kindergarten classes, and groups according to specific conditions of each locality.

2. People's Committees at the commune level shall directly assist and direct the development of preschool classes, kindergarten classes, and groups to meet the conditions stipulated in this document within their jurisdiction..

Article 16. Responsibilities of Educational Management Agencies

1. Departments of Education and Training shall be responsible for advising provincial and city People's Committees to build and implement appropriate policies to support the development of preschool classes, kindergarten classes, and independent groups to achieve minimum conditions. Managing, inspecting, evaluating, and reporting to the Ministry of Education and Training on the implementation of minimum conditions for preschool classes, kindergarten classes, and independent groups as stipulated in this document.

Advising the People's Committee to support communes and help classes and groups to achieve minimum conditions and meet the requirements of preschool education development.

2. District Offices of Education and Training shall be responsible for advising the People's Committee to support communes and help classes and groups to achieve minimum conditions and meet the requirements of preschool education development.

Article 17. Rewards and Handling of Violations

1. Organizations, persons in charge, class leaders, group leaders, caregivers of preschool classes, kindergarten classes, and independent groups who have outstanding achievements in caring for and educating children shall be recognized and rewarded as in the public system.

2. Preschool classes, kindergarten classes, and independent groups that do not meet the minimum conditions stipulated in this document shall suspend operations until they supplement the necessary conditions. After receiving opinions from educational management agencies and local authorities, they must invest to ensure compliance with the minimum requirements specified in this document before resuming operations. If the class or group leaders do not comply with the regulations of educational management agencies and local authorities, they will be dealt with according to the law depending on the severity of the violation./.
