Decision No. 31/2005/QD-BTC On Supplementing the List of Projects to Borrow Credit for State Investment and Development

REGARDING THE SUPPLEMENTATION OF THE LIST OF PROJECTS TO BORROW DEVELOPMENT CREDIT FUNDS FROM THE STATEOF THE STATE

THE MINISTER OF FINANCE

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 106/2004/ND-CP dated April 1, 2004 of the Government on State development credit;

Pursuant to Resolution No. 13/2004/NQ-CP dated November 3, 2004 of the Government;

Pursuant to Circular No. 270/TTg-KTTH dated March 17, 2005 of the Prime Minister;

Pursuant to Circular No. 428/TTg-CN dated April 14, 2005 of the Prime Minister;

At the proposal of the Director of the Department of Financial Affairs of Banks and Financial Institutions.

DECISION:

Article 1. To supplement the list of projects to borrow development credit funds from the State issued together with Decision No. 54/2004/QD-BTC dated June 16, 2004 of the Minister of Finance as follows:

1. Cement production projects belonging to the following categories may borrow State development credit funds up to a maximum of 30% of the total investment cost of the project (including capital for purchasing domestic production equipment):

- New cement production projects (producing clinker) located in economically disadvantaged areas (Category B) and particularly disadvantaged areas (Category C) as stipulated in Decree No. 35/2002/NĐ-CP dated March 29, 2002 of the Government;

- The West Ninh, Son La, Yen Bai, Phu Tho, Tuyen Quang cement projects.

2. Project of the Quang Trung Mechanical Enterprise, Ninh Binh Factory for manufacturing lifting equipment at Phuong Nam Commune, Uong Bi Town, Quang Ninh Province.

3. Construction works and investment projects listed under Categories A, B, and C as stipulated in Decree No. 35/2002/NĐ-CP dated March 29, 2002 of the Government, which use products of lifting equipment from the Quang Trung Mechanical Enterprise, may borrow funds and enjoy preferential treatment regarding State development credit to purchase these products provided that the lifting equipment products of the Quang Trung Mechanical Enterprise have a localization rate of 80% or more. The preferential period will end in 2008.

Article 2. The above projects that meet the conditions as prescribed may borrow State development credit funds.

Article 3. This Decision takes effect 15 days after its publication in the Official Gazette and replaces Decision No. 99/2004/QD-BTC dated December 17, 2004 of the Minister of Finance on the supplementation of the list of projects to borrow development credit funds from the State.

The Chairman of the Management Council, General Director of the Development Support Fund; the Director of the Department of Financial Affairs of Banks and Financial Institutions; and the Project Investors of the aforementioned projects are responsible for implementing this Decision./.
