ORDINANCE
AMENDING SOME ARTICLES OF THE ADMINISTRATIVE VIOLATION HANDLING ORDINANCE

BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10 OF THE TENTH NATIONAL ASSEMBLY SESSION ON DECEMBER 25, 2001;
THIS ORDINANCE AMENDS SOME ARTICLES OF THE ADMINISTRATIVE VIOLATION HANDLING ORDINANCE APPROVED BY THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY ON JULY 2, 2002.
Article 1. AMENDING SOME ARTICLES OF THE ADMINISTRATIVE VIOLATION HANDLING ORDINANCE REGARDING ADMINISTRATIVE SUPERVISION AS FOLLOWS:
1. ABOLISH Clause 5 Article 22, Article 27, Clause 7 Article 30 and Section 5 Chapter VII (including Articles from Article 102 to Article 109).
2. REMOVE the phrase "and 27" in Clause 3 Article 1, in Clause 2 of Articles 3, 6 and 11. REMOVE the phrase ", administrative supervision" in Article 112, Clause 2 Article 118 and in Article 119.
Article 2
1. FROM THE DATE THIS ORDINANCE TAKES EFFECT, THE APPLICATION OF THE ADMINISTRATIVE SUPERVISION MEASURE SHALL BE TERMINATED; IN CASES WHERE THE APPLICATION OF THE ADMINISTRATIVE SUPERVISION MEASURE IS UNDER CONSIDERATION, THE CONSIDERATION SHALL BE TERMINATED; IN CASES WHERE A DECISION HAS BEEN ISSUED BUT NOT YET IMPLEMENTED, THAT DECISION SHALL BE REVOKED; IN CASES WHERE A DECISION IS BEING IMPLEMENTED, THE IMPLEMENTATION SHALL BE TERMINATED.
2. ALL PRIOR PROVISIONS ON ADMINISTRATIVE SUPERVISION UNDER THE ADMINISTRATIVE VIOLATION HANDLING ORDINANCE ARE ABOLISHED.
3. THE GOVERNMENT SHALL BE RESPONSIBLE FOR ORGANIZING THE IMPLEMENTATION OF THIS ORDINANCE.
