Regulations on functions, tasks, powers, and organizational structure
of the Training Department
At the proposal of the Director of the Cinema Department.
WHEREAS Law on Education No. 38/2005/QH11 dated June 14, 2005 of the National Assembly, Session XI, and Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Education;
WHEREAS Law on Vocational Training No. 76/2006/QH11 dated November 29, 2006 of the National Assembly, Session XI, and Decree No. 139/2006/NĐ-CP dated November 20, 2006 detailing and guiding the implementation of certain provisions of the Law on Education and the Labor Code regarding vocational training;
WHEREAS Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
CONSIDERING the proposal of the Director of the Training Department and the Director of the Cadre and Civil Servant Organization Department,
DECISION:
Article 1. Position and Functions
The Training Department is an agency under the Ministry of Culture, Sports and Tourism with the function of advising the Minister to implement state management over training and capacity building for human resources in the cultural, sports, and tourism sectors in accordance with the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit draft regulatory legal documents on training and capacity building for human resources in the cultural, sports, and tourism sectors to the Minister.
2. Submit to the Minister long-term plans and annual plans, national target programs, action programs, and projects on training and capacity building for human resources in the cultural, sports, and tourism sectors; guide and inspect their implementation after approval.
3. Review the establishment files, development of academic disciplines, and levels of education of training institutions in the cultural, sports, and tourism sectors; review joint training and capacity building proposals, and the establishment of training institutions in the cultural, sports, and tourism sectors by Vietnamese and foreign individuals in Vietnam.
4. Manage the training activities of subordinate training institutions under the Ministry of Culture, Sports and Tourism and coordinate with relevant functional agencies of other ministries, sectors, and localities to manage state activities related to training in the cultural, sports, and tourism sectors.
5. Coordinate with the Planning and Finance Department to propose budget allocations, financial resources, and physical facilities to serve training and capacity building for human resources in the cultural, sports, and tourism sectors under the Ministry.
6. Organize the development of framework curricula for various training fields and professions; organize the compilation of common textbooks for training institutions in the cultural, sports, and tourism sectors at postgraduate, undergraduate, college, and vocational levels.
7. Study and propose special policies and systems for teachers and students at training institutions in the cultural, sports, and tourism sectors.
8. Submit to the Minister international cooperation plans on training and capacity building for human resources in the cultural, sports, and tourism sectors and organize their implementation after approval.
9. Coordinate with the Science, Technology, and Environment Department to direct scientific research activities at subordinate training institutions under the Ministry of Culture, Sports and Tourism.
10. Guide and inspect admission procedures; inspect the implementation of regulations on organization of training, examination, and graduation certification; guide and inspect student affairs at subordinate training institutions under the Ministry of Culture, Sports and Tourism. Inspect and coordinate with inspection bodies to enforce educational laws against training institutions in the cultural, sports, and tourism sectors, handle complaints, denunciations, and propose measures to address violations of educational laws according to the law.
11. Propose recommendations for conferring titles of People's Teacher and Excellent Teacher.
12. Submit to the Minister for confirmation the results of the evaluation for Professor and Associate Professor titles by the Inter-ministerial Council on Cultural, Sports, and Tourism Affairs in accordance with the law.
13. Implement administrative reform contents according to the program and plan of the Ministry; manage civil servants, implement policies and systems for cadres and civil servants within its jurisdiction; manage assets in accordance with the law.
14. Implement periodic and ad hoc reporting systems on assigned areas in accordance with the law and the Ministry of Culture, Sports and Tourism.
15. Perform other tasks assigned by the Minister.
Article 3. Organizational Structure of the Department
1. The Director and Deputy Directors.
2. Professional civil servants.
The Director of the Training Department is responsible for arranging and assigning officials and civil servants according to the job titles and professional standards; establishing and promulgating the Department's Operating Regulations.
Article 4. Effective date
This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 29/2004/QĐ-BVHTT dated June 18, 2004 of the Minister of Culture, Sports and Tourism on the functions, tasks, powers, and organizational structure of the Training Department.
Article 5. Responsibilities for Implementation
The Director of the Training Department, the Director of the General Office, the Director of the Organization and Cadre Affairs Department, the Director of the Planning and Finance Department, the Heads of agencies and units under the Ministry, and related organizations and individuals are responsible for implementing this Decision./.
