Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decision No. 37/2008/QĐ-TTg dated March 12, 2008 of the Prime Minister approving the Program on Popularizing and Educating Laws from 2008 to 2012;
Considering the proposal of the Minister of Labor, Invalids and Social Affairs and the Minister of Justice,
DECISION:
Article 1. Approves the Plan for Propaganda and Popularization of Laws for Workers and Employers in Various Types of Enterprises during the period 2009-2012, with the main contents as follows:
I. OBJECTIVES OF THE PROJECT
1. General objectives
Continuing to create a strong change in awareness of respecting and complying with laws in general and labor laws in particular among workers and employers, building harmonious labor relations in enterprises, contributing to promoting production development, social stability, and building and perfecting a socialist rule-of-law state of the people, by the people, and for the people.
2. Specific objectives
By the end of 2012, striving to achieve 95% of employers being informed and educated about labor laws and related legal regulations concerning enterprise activities, and 70% of workers being informed and educated about labor laws and related legal regulations concerning citizens' rights and obligations.
II. CONTENTS OF THE PLAN'S ACTIVITIES
1. Conduct surveys to clearly identify the priority contents and appropriate methods for each target group, each type of enterprise, and each region, serving as a basis for developing activity plans, proposing policies to encourage enterprises to propagate and popularize laws, and evaluating impacts and effectiveness after implementing the Plan.
2. Study and develop policies to encourage enterprises to propagate and popularize laws for workers and employers.
3. Develop legal materials on labor laws and related legal regulations concerning enterprise activities; citizens' rights and obligations to inform and educate workers and employers.
4. Propagate and popularize labor laws and other relevant legal regulations concerning enterprise activities; citizens' rights and obligations through mass media.
5. Propagate and popularize labor laws and related legal regulations concerning enterprise activities; citizens' rights for workers and employers in state-owned enterprises and Vietnamese workers working abroad.
6. Propagate and popularize labor laws, trade union laws, and related legal regulations concerning citizens' rights for workers in private enterprises and foreign-invested enterprises.
7. Propagate and popularize labor laws and other relevant legal regulations concerning enterprise activities for employers in private enterprises and foreign-invested enterprises.
8. Propagate and popularize labor laws and other relevant legal regulations concerning cooperative activities and citizens' rights and obligations in cooperatives modeled after enterprises.
9. Supervise, evaluate, and summarize the implementation of activities and the entire Plan.
(The Plan's activities are divided into five Sub-Plans listed in the attached Appendix).
III. SOURCES OF FUNDS FOR IMPLEMENTING THE PLAN
1. The sources of funds for implementing the Plan are provided by the State budget according to the current classification and other mobilized and sponsored funds.
2. For the annual central government budget funds allocated for the Plan, the ministries, sectors, and central agencies assigned to lead the implementation of the Sub-Plans must prepare detailed budget estimates (the portion guaranteed by the central government budget) and submit them to the Ministry of Labor, Invalids and Social Affairs for consolidation and submission to the Ministry of Finance for approval by the competent authority and inclusion in the annual budget estimates of the leading agencies of the Sub-Plans.
3. Local-level Plan implementation funds are arranged by local budgets. Each year, the People's Committees of provinces and centrally-administered cities base on the Plan's activities within their jurisdiction to prepare budget estimates and submit them to the respective People's Councils for approval.
4. Annual detailed budget preparation shall be carried out in accordance with the provisions of the State Budget Law based on the contents of the Plan approved by the Prime Minister. Ministries, sectors, localities, organizations leading the Sub-Plans must be responsible for settling accounts with the Ministry of Finance regarding the budget and report to the Ministry of Labor, Invalids and Social Affairs for consolidation and reporting of the overall Plan.
IV. IMPLEMENTATION ORGANIZATION OF THE PLAN
1. Implementation Period
The Plan will be implemented from 2009 to 2012 at the central level and in all localities nationwide.
2. Organizational Management of the Plan
- Establish a Steering Committee for the Plan chaired by a Deputy Minister of Labor, Invalids and Social Affairs, with members being representatives of the leaders of the Ministry of Justice, the Ministry of Finance, the Vietnam General Confederation of Labor, the Vietnam Chamber of Commerce and Industry, and the Vietnam Federation of Trade Unions.
- The Secretariat assisting the Steering Committee shall be established as decided by the Chairperson.
- Agencies and organizations assigned to lead the Plan's activities shall establish working groups or specialized units to direct, manage, and oversee the implementation of those activities and coordinate with the Plan's Steering Committee.
3. Assignment of Responsibilities:
- The Ministry of Labor, Invalids and Social Affairs is the leading agency for the Project, organizing coordination, inspection, evaluation, summary, and reporting on the implementation of the Project's activities nationwide; it leads the implementation of Sub-Project 1 of the Project including activities such as surveying; compiling source materials; training and enhancing the cadre working on propaganda and legal dissemination to enterprises; organizing legal propaganda and dissemination to workers and employers in state-owned enterprises; general communication activities of the Project; pilot guidance and exemplary replication; monitoring and evaluating the Project.
- The Ministry of Justice: directs and advises on methods for implementing legal propaganda and dissemination, collaborates with the Ministry of Labor, Invalids and Social Affairs, the Ministry of Finance, the Vietnam General Confederation of Labor, the Vietnam Chamber of Commerce and Industry, and the Vietnam Federation of Trade Unions to develop policies encouraging enterprises to proactively organize legal propaganda and dissemination; collaborates with the Ministry of Labor, Invalids and Social Affairs and other relevant ministries and sectors in drafting materials, training cadres, and organizing legal propaganda and dissemination for labor laws and other laws related to enterprise operations and citizens' rights and obligations for workers and employers in various types of enterprises.
- The Ministry of Finance: leads the implementation of Sub-Project 2: researching and developing policies to encourage enterprises to proactively organize legal propaganda and dissemination; collaborates with the Ministry of Labor, Invalids and Social Affairs, the Ministry of Justice, the Vietnam General Confederation of Labor, the Vietnam Chamber of Commerce and Industry, and the Vietnam Federation of Trade Unions to monitor and evaluate the implementation of policies encouraging enterprises to proactively disseminate legal information; ensuring and guiding the use of funds for the Project.
- The Vietnam General Confederation of Labor: leads the implementation of Sub-Project 3 on the propaganda and dissemination of labor laws, trade union laws, and some related laws concerning enterprise activities to workers in private enterprises and foreign-invested enterprises; participates in the common activities of the Project.
- The Vietnam Chamber of Commerce and Industry: leads the implementation of Sub-Project 4 on the propaganda and dissemination of labor laws, trade union laws, and some related laws concerning enterprise activities to employers in private enterprises and foreign-invested enterprises; participates in the common activities of the Project.
- The Vietnam Federation of Trade Unions: leads the implementation of Sub-Project 5 on the propaganda and dissemination of labor laws and some other related laws concerning cooperative activities and the rights and obligations of citizens and workers in cooperatives modeled after enterprises; participates in the common activities of the Project.
- The Ministry of Information and Communications: collaborates with the Ministry of Labor, Invalids and Social Affairs to direct the development, consolidation, maintenance, and improvement of the quality of specialized sections and columns for legal dissemination on mass media concerning labor laws and other laws related to enterprise activities and citizens' rights and obligations.
- Relevant ministries and sectors: according to their functions and responsibilities and as stipulated in Decree No. 66/2008/NĐ-CP dated May 28, 2008 of the Government on legal support for enterprises, have the responsibility to collaborate with the Ministry of Labor, Invalids and Social Affairs, the Vietnam General Confederation of Labor, the Vietnam Chamber of Commerce and Industry, and the Vietnam Federation of Trade Unions to implement the activities of this Project.
- People's Committees of provinces and centrally governed cities: according to their functions and responsibilities and as stipulated in Decree No. 66/2008/NĐ-CP dated May 28, 2008 of the Government on legal support for enterprises, take the initiative to ensure funding from local budgets, collaborate with relevant ministries, agencies, and organizations to implement the activities of this Project.
Article 2. This Decision takes effect 45 days from the date of issuance.
Article 3. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
