Issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam

On the basis of the Law on Product Quality dated November 21, 2007;

On the basis of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP of the Government;

On the basis of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use; Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing some articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use;

On the basis of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality;

CONSIDERING the proposal of the Director of the Crop Production Department;

The Ministry of Agriculture and Rural Development promulgates the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam.

Article 1. Attached to this Circular is the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam, including 224 types of fertilizers divided into:

a) Single mineral fertilizers: 04 types;

b) Compound fertilizers: 01 type;

c) Organic fertilizers: 09 types;

c) Bio-fertilizers: 07 types;

d) Organic bio-fertilizers: 28 types;

đ) Organic biological fertilizers: 13 types;

e) Organic mineral fertilizers: 18 types;

g) Foliar fertilizers: 142 types;

h) Rare earth fertilizers: 01 type;

i) Soil moisture retention and soil improvement agents: 01 type.

2. The List of Fertilizers Replacing Those Already Included in the List of Fertilizers Permitted for Production, Business, and Use in Vietnam, comprising 238 types, specifically:

a) Organic fertilizers: 07 types;

b) Microbial fertilizers: 05 types;

c) Organic bio-fertilizers: 09 types;

d) Organic biological fertilizers: 08 types;

đ) Organic mineral fertilizers: 14 types;

e) Foliar fertilizers: 192 types;

g) Soil moisture retention and soil improvement agents: 03 types.

Article 2. The types of fertilizers listed in the Supplementary List of Fertilizers attached to Decision No. 67/2007/QĐ-BNN dated July 10, 2007 on the "Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam" shall cease to be effective from July 10, 2012.

Article 3. Organizations and individuals permitted to produce, trade, and use the types of fertilizers specified in Article 1 must meet the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use; stipulated in Clause 4, Article 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing some articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use.

Article 4. This Circular takes effect from September 2, 2012.

Article 5. The Director of the Office of the Ministry, the Director of the Crop Cultivation Department, the Director of the Science, Technology, and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities, and the Heads of relevant units are responsible for implementing this Circular./.
