CIRCULAR
Regulations on standards, conditions, contents, and forms of examination or assessment for promotion to higher rankscategory of vocational titles in the vocational education sector
Pursuant to the Law on Public Officials dated November 15, 2010;
Based on Decree No. 15/2019/NĐ-CP dated February 1, 2019 of the Government detailing certain provisions and implementation measures of the Vocational Education Law;
Pursuant to the Government Decree No. 29/2012/NĐ-CP dated April 12, 2012 on recruitment, utilization, and management of public officials and the Government Decree No. 161/2018/NĐ-CP dated November 29, 2018 amending and supplementing certain provisions on recruitment of civil servants and public officials, promotion of civil servant grades, promotion of public official ranks, and implementation of employment contracts for certain types of work in administrative state agencies and public service units;
The Minister of Labor, Invalids and Social Affairs issues this Circular regulating the vocational training program for vocational education teachers and vocational teacher certificates.
Pursuant to the Government Decree No. 141/2013/NĐ-CP dated October 24, 2013 detailing and guiding the implementation of certain articles of the Higher Education Law;
Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
At the proposal of the Director General of the General Department of Vocational Education;
The Minister of Labor, Invalids and Social Affairs issues this Circular regulating standards, conditions, contents, and forms of examination or assessment for promotion to higher ranks of vocational titles for public officials in the vocational education sector.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates standards, conditions, contents, and forms of examination or assessment for promotion to higher ranks of vocational titles for public officials in vocational education in colleges, secondary vocational schools, vocational training centers, and vocational training and continuing education centers under public management (hereinafter referred to collectively as vocational education institutions) participating in examinations or assessments for promotion to higher ranks of vocational titles and relevant agencies, organizations, and individuals.
Article 2. Examinations or assessments for promotion to higher ranks of vocational titles for public officials teaching cultural subjects in vocational education institutions shall be carried out in accordance with regulations of the Ministry of Education and Training.
Article 3. Principles of examination or assessment for promotion
Clause 1. The dispatch of public officials in the vocational education sector to participate in examinations or assessments for promotion to higher ranks of vocational titles must be based on job positions, the approved structure of vocational titles, the number of public officials still needed according to the requirements of job positions, and the needs of vocational education institutions.
Clause 2. Public officials in the vocational education sector participating in examinations or assessments for promotion to higher ranks of vocational titles must meet the registration standards and conditions for examinations or assessments as prescribed by law.
Clause 3. The organization of examinations or assessments for promotion to higher ranks of vocational titles for public officials in the vocational education sector must ensure equality, transparency, fairness, objectivity, and compliance with legal regulations.
Article 4. Standards and Conditions for Participation in Examination or Assessment for Promotion
Clause 1. A public official may participate in examinations or assessments for promotion to higher ranks of vocational titles in the vocational education sector if they satisfy all of the following conditions:
Point a) They have been rated at least as having satisfactorily completed their tasks for three consecutive years prior to the year of examination or assessment; they possess good political qualities and morals; they are not within the period of disciplinary action or during the time when related disciplinary regulations are being implemented by competent authorities;
Point b) They meet the standards of the lower rank of vocational title they are registering for examination or assessment as prescribed in Circular No. 03/2018/TT-BLDTBXH dated June 15, 2018 issued by the Minister of Labor, Invalids and Social Affairs on standards for vocational titles of public officials in the vocational education sector;
Point c) They are nominated by the vocational education institution and dispatched by the competent authority to participate in the examination or assessment.
Clause 2. Public officials with outstanding achievements may be assessed for promotion to higher ranks of vocational titles in the vocational education sector if they satisfy any of the following conditions:
Point a) During the period of holding a current rank, they have achieved at least two times the title of Outstanding Worker at the ministry or sector level or equivalent, or once the title of National Outstanding Worker, or received at least one third-class Merit Medal, and meet the standards and conditions specified in point a and point b of Clause 1 of Article 3 of this Circular, and are proposed for promotion by the vocational education institution and the competent authority;
Point b) They have been recognized or appointed as Professor or Associate Professor, and meet the standards and conditions specified in point a of Clause 1 of Article 3 of this Circular, and are proposed for promotion by the vocational education institution and the competent authority.
Article 4. Exemption from foreign language examination for civil servants participating in promotion examination
1. Being at least 55 years old for males and at least 50 years old for females.
2. Civil servants teaching in vocational education institutions in ethnic minority areas who are ethnic minorities or have certificates in ethnic minority languages recognized by competent authorities. The certificates specified in this clause must still be valid within the prescribed period up to the deadline for submitting registration forms for the promotion examination of vocational education profession titles.
3. Having a graduation certificate in the same level of foreign language training as the required level of specialized vocational training or at a higher level than the required level of specialized vocational training as stipulated in the standards for the grade being promoted.
4. Having a graduation certificate in accordance with the required level of training or at a higher level than the required level of specialized vocational training as stipulated in the standards for the grade being promoted, obtained through studying abroad or studying in a foreign language in Vietnam.
Article 5. Exemption from computer science examination for civil servants participating in promotion examination
Exemption from computer science examination for civil servants having a graduation certificate from a college majoring in information technology, computer science, or mathematics-computer science or higher.
Article 6. Cases applying examination or assessment methods for promotion of vocational education profession titles for civil servants
1. Applying examination method for promotion of vocational education profession titles for civil servants from Grade III to Grade II and from Grade II to Grade I.
2. Applying assessment method for promotion in the following cases:
a) Assessment for promotion of vocational education teacher profession title from Grade IV to theoretical or practical vocational education teacher Grade III;
b) Assessment for promotion of vocational education profession titles from Grade III to Grade II or from Grade II to Grade I for civil servants with outstanding achievements as stipulated in point a, Clause 2, Article 3 of this Circular; assessment for promotion of senior vocational education lecturer (Grade I) for civil servants with outstanding achievements as stipulated in point b, Clause 2, Article 3 of this Circular.
Article 7. Registration dossier for examination or assessment for promotion
1. The registration dossier for examination or assessment for promotion of vocational education profession titles for civil servants shall comply with Clause 1, Article 10 of Circular No. 12/2012/TT-BNV dated December 18, 2012, issued by the Minister of Home Affairs on profession titles and changes in profession titles for civil servants.
2. For civil servants with outstanding achievements, the registration dossier for assessment for promotion shall comply with Clause 1 of this Article and a certified copy of their outstanding achievements as stipulated in Clause 2, Article 3 of this Circular.
Chapter II
TPROMOTION OF PROFESSION TITLES FOR CIVIL SERVANTS IN THE FIELD OF VOCATIONAL EDUCATION
Article 8. Examination for promotion of vocational education senior lecturer (Grade II) to senior vocational education lecturer (Grade I)
1. General Knowledge Subject
a) Examination Content: 60 questions on state management and laws related to civil servants; understanding of duties and responsibilities of civil servants according to the standards for vocational education profession titles of the grade being promoted (accounting for 70% of the examination content); Strategic orientation and development plans of the industry (accounting for 30% of the examination content);
b) Examination Form: Multiple-choice test on paper or computer-based multiple-choice test;
c) Examination Time: 60 minutes.
2. Specialized Knowledge and Vocational Skills Subject
a) Examination Content: Report on the implementation of tasks of the senior vocational education lecturer (Grade I) profession title;
b) Examination Form: Writing a report and presenting it directly, followed by an interview;
c) Examination Time: 90 minutes for writing the report, 30 minutes for presentation and interview (excluding transition time between the two examination forms).
3. Foreign Language Subject
a) Examination Content: 30 questions on reading and writing skills at Level 4 of the foreign language proficiency scale as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Minister of Education and Training on the six-level foreign language proficiency scale for Vietnam (hereinafter referred to as Circular No. 01/2014/TT-BGDĐT), which the examinee registers to take in one of the following languages: English, French, Russian, German, Chinese;
b) Examination Form: Multiple-choice test on paper or computer-based multiple-choice test;
c) Examination Time: 30 minutes.
4. Computer Science Subject
a) Examination Content: 30 questions on basic information technology usage skills as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on information technology skill standards (hereinafter referred to as Circular No. 03/2014/TT-BTTTT);
b) Examination Form: Multiple-choice test on paper or computer-based multiple-choice test;
c) Examination Time: 30 minutes.
Article 9. Examination for promotion from the rank of vocational education lecturer (Class III) to the rank of vocational education lecturer (Class II) in theoretical or practical fields.
1. General Knowledge Subject
a) Examination Content: 60 questions on state management and laws related to civil servants; understanding of duties and responsibilities of civil servants according to the standards for vocational education profession titles of the grade being promoted (accounting for 70% of the examination content); Strategic orientation and development plans of the industry (accounting for 30% of the examination content);
b) Examination Form: Multiple-choice test on paper or computer-based multiple-choice test;
c) Examination Time: 60 minutes.
2. Specialized Knowledge and Vocational Skills Subject
a) Content of the examination: Report on the implementation of tasks of the rank of vocational education lecturer (Class II).
b) Form of the examination: Essay.
c) Duration of the examination: 120 minutes.
3. Foreign Language Subject
a) Content of the examination: 30 questions on reading and writing skills at Level 3 of foreign language proficiency as stipulated in Circular No. 01/2014/TT-BGDĐT, selected by the examinee from one of the following languages: English, French, Russian, German, Chinese.
b) Examination Form: Multiple-choice test on paper or computer-based multiple-choice test;
c) Examination Time: 30 minutes.
4. Computer Science subject
a) Content of the examination: 30 questions on basic information technology usage skills as stipulated in Circular No. 03/2014/TT-BTTTT.
b) Examination Form: Multiple-choice test on paper or computer-based multiple-choice test;
c) Examination Time: 30 minutes.
Article 10. Examination for promotion from the rank of vocational education teacher (Class II) to the rank of vocational education teacher (Class I).
1. General Knowledge Subject
a) Examination Content: 60 questions on state management and laws related to civil servants; understanding of duties and responsibilities of civil servants according to the standards for vocational education profession titles of the grade being promoted (accounting for 70% of the examination content); Strategic orientation and development plans of the industry (accounting for 30% of the examination content);
b) Examination Form: Multiple-choice test on paper or computer-based multiple-choice test;
c) Examination Time: 60 minutes.
2. Specialized Knowledge and Vocational Skills Subject
a) Content of the examination: Report on the implementation of tasks of the rank of vocational education teacher (Class I).
b) Form of the examination: Presentation and direct interview.
c) Examination Time: 90 minutes for writing the report, 30 minutes for presentation and interview (excluding transition time between the two examination forms).
3. Foreign Language Subject

Article 11. Examination for promotion from the rank of vocational education teacher (Class III) in theoretical or practical fields to the rank of vocational education teacher (Class II).
1. General Knowledge Subject
a) Examination Content: 60 questions on state management and laws related to civil servants; understanding of duties and responsibilities of civil servants according to the standards for vocational education profession titles of the grade being promoted (accounting for 70% of the examination content); Strategic orientation and development plans of the industry (accounting for 30% of the examination content);
b) Examination Form: Multiple-choice test on paper or computer-based multiple-choice test;
c) Examination Time: 60 minutes.
2. Specialized Knowledge and Vocational Skills Subject
a) Content of the examination: Report on the implementation of tasks of the rank of vocational education teacher (Class II).
b) Form of the examination: Essay.
c) Duration of the examination: 120 minutes.
3. Foreign Language Subject

Article 12. Organization of examinations for promotion of occupational ranks.
1. The organization of examinations for promotion of occupational ranks of vocational education professionals shall be carried out through the Examination Board for Promotion of Occupational Ranks.
2. The Examination Board for Promotion of Occupational Ranks of vocational education professionals operates according to the Regulation on the Organization of Examinations for Promotion of Occupational Ranks of Professionals issued together with Circular No. 03/2019/TT-BNV dated May 14, 2019, of the Minister of Home Affairs amending and supplementing certain provisions on recruitment of civil servants and public officials, upgrading civil servant grades, promoting occupational ranks of professionals, and implementing employment contracts for certain types of work in administrative agencies and public institutions (hereinafter referred to as Circular No. 03/2019/TT-BNV).
3. The organization of examinations for promotion of occupational ranks of vocational education professionals shall be carried out according to the Examination Regulations for Promotion of Occupational Ranks of Professionals issued together with Circular No. 03/2019/TT-BNV.
Chapter III
2. Agricultural and rural development professionals may register to participate in the promotion examination for professional occupational titles if they meet the following standards and conditions: IN THE FIELD OF VOCATIONAL EDUCATION
Article 13. Content and form of assessment for promotion of occupational ranks.
Review the file to determine compliance with the criteria for the occupational rank of vocational education professional at the rank being assessed.
Article 14. Organization of assessment for promotion of occupational ranks.
1. The organization of assessment for promotion of occupational ranks of vocational education professionals shall be carried out through the Assessment Board for Promotion of Occupational Ranks.
2. The Assessment Board for Promotion of Occupational Ranks of vocational education professionals operates according to the Regulation on the Organization of Assessment for Promotion of Occupational Ranks of Professionals issued together with Circular No. 03/2019/TT-BNV.
Chapter IV
DETERMINATION OF PROFESSIONALS QUALIFIED FOR PROMOTION TO OCCUPATIONAL RANKS OF VOCATIONAL EDUCATION PROFESSIONALS PROFESSIONAL FIELD OF VOCATIONAL EDUCATION
Article 15. Determination of Civil Servants to be Promoted in the Promotion Examination for Professional Titles
1. The examination result is the total score of the General Knowledge subject and the Specialized Vocational subject. The scores of the Foreign Language and Computer subjects are conditional scores and are not included in the total examination score.
2. A civil servant must participate in all examination subjects prescribed in this Circular for each rank, achieving a minimum score of 50 points in each subject except those exempted according to regulations, with each subject being graded out of 100 points. The civil servants who achieve higher examination results will be promoted in descending order until the promotion quota specified in the approved examination organization plan is filled.
3. In cases where two or more civil servants have the same examination result at the final quota, the civil servant to be promoted shall be determined in the following priority order:
a) The civil servant with a higher score in the Specialized Vocational subject;
b) The civil servant with longer years of service.
4. If it is not possible to determine the civil servant to be promoted based on the priority order, the Examination Board shall directly interview, review, and decide on the civil servant to be promoted.
5. A civil servant who does not get promoted in the promotion examination for professional titles shall not retain their examination results for subsequent promotion examinations.
Article 16. Determination of Civil Servants to be Promoted in the Promotion Review for Professional Titles
1. A civil servant who gets promoted in the promotion review for professional titles is a civil servant who meets the criteria and conditions stipulated in Article 3 of this Circular as determined by the Promotion Review Board for Professional Titles.
2. A civil servant who does not get promoted in the promotion review for professional titles shall not retain their review results for subsequent promotion reviews.
Article 17. Announcement of Results in the Promotion Examination or Review for Professional Titles
1. Within 15 working days from the date of receiving the examination or review result report from the Board, the head of the competent authority organizing the promotion examination or review for professional titles must publicly post the examination or review results at the workplace and on the electronic information website of the competent authority organizing the promotion examination or review for professional titles.
2. Within 15 working days from the date of public posting of the examination or review results for professional titles, the civil servant participating in the examination or review has the right to submit a request for re-examination of the examination or review results (except for computer-based multiple-choice tests or interviews). The head of the competent authority organizing the promotion examination or review for professional titles shall assign the Examination Board or Review Board to organize the re-examination within 15 working days from the end of the deadline for submitting re-examination requests as stipulated in this clause.
3. After implementing the provisions of Clause 1 and Clause 2 of this Article, the head of the competent authority organizing the promotion examination or review for professional titles shall approve the examination or review results and send a written notification recognizing the examination or review results for professional titles (clearly stating the promoted professional title) to:
a) The civil servant participating in the examination or review at the registered address;
b) The competent authority and vocational education institution that nominated the civil servant for the examination or review to implement the appointment of the professional title as prescribed.
Article 18. Cancellation of examination results or promotion assessment outcomes
If a civil servant uses illegal diplomas or certificates, makes false declarations to meet the criteria and conditions for examinations or promotion assessments for occupational titles, upon discovery, they will be dealt with according to the law and their examination results or promotion assessment outcomes will be cancelled. The competent authority organizing examinations or promotion assessments for occupational titles shall be responsible for cancelling the examination results or promotion assessment outcomes.
Chapter V
ORGANIZATION AND IMPLEMENTATION
Article 19. Responsibility for Implementation
1. The General Department of Vocational Education shall develop a proposal to organize examinations or promotion assessments for occupational titles for civil servants specializing in vocational education for the senior vocational education lecturer title (Class I) and Class I vocational education teacher, submit it to the Ministry of Labor, Invalids and Social Affairs for comments from the Ministry of Home Affairs before March 31 each year to implement.
2. The Minister, Head of a ministry-level agency, agency under the Government, Chairman of the People's Committee of a province or centrally governed city shall develop a proposal to organize examinations or promotion assessments for occupational titles for civil servants specializing in vocational education for the principal vocational education lecturer title (Class II) and Class II vocational education teacher, submit it for comments from the Ministry of Home Affairs before March 31 each year to implement.
3. Each year, the Minister, Head of a ministry-level agency, agency under the Government, Chairman of the People's Committee of a province or centrally governed city shall organize or delegate and authorize agencies and units to organize promotion assessments for occupational titles for civil servants specializing in vocational education for theoretical vocational education teacher title (Class III) and practical vocational education teacher title (Class III).
4. Heads of vocational education institutions shall, based on the conditions stipulated in this Circular within the scope of their assigned authority, appoint civil servants to participate in examination periods or promotion assessments for occupational titles and bear legal responsibility for the standards and conditions of the appointed civil servants participating in examinations or promotion assessments; retain and manage the registration files of civil servants participating in examinations or promotion assessments for occupational titles in accordance with the law.
5. Civil servants teaching in vocational education institutions participating in examination periods or promotion assessments for occupational titles organized before December 31, 2020 are not required to have training certificates according to occupational title standards; within 12 months from the date of announcement of examination results or promotion assessment outcomes, the competent authority managing and using civil servants must have the responsibility to appoint successful candidates in examination periods or promotion assessments for occupational titles for civil servants specializing in vocational education to attend a training course to obtain a training certificate according to the occupational title standards of the class applied for in the examination period or promotion assessment. Civil servants who are issued a training certificate according to the occupational title standards of the class applied for in the examination period or promotion assessment, the competent authority shall implement the appointment of civil servants to the successful occupational title class in the examination period or promotion assessment from the date of announcement of examination results or promotion assessment outcomes. In case civil servants are not issued a training certificate according to the occupational title standards of the class applied for in the examination period or promotion assessment, the competent authority shall not appoint civil servants to the successful occupational title class in the examination period or promotion assessment and shall not retain the examination results or promotion assessment outcomes already participated in.
Article 20. Effective Date
This Circular takes effect from March 20, 2020.
