Circular No. 31/2025/TT-BCT stipulates the contents of the basic design of projects for mineral exploitation and mine design.

Pursuant to the Law on Construction dated June 18, 2014; the Law Amending and Supplementing Certain Provisions of the Law on Construction dated June 17, 2020;

Pursuant to the Law on Geology and Minerals No. 54/2024/QH15 dated November 29, 2024;

Pursuant to Decree No. 40/2025/NĐ-CP dated February 26, 2025, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government Decree No. 06/2021/NĐ-CP dated January 26, 2021 detailing certain provisions on quality management, construction works, and maintenance of construction projects;

Pursuant to the Government Decree No. 10/2021/NĐ-CP dated February 9, 2021 on management of construction investment costs;

Pursuant to the Government Decree No. 35/2023/NĐ-CP dated June 20, 2023 amending and supplementing certain articles of decrees under the Ministry of Construction's jurisdiction;

Pursuant to the Government Decree No. 175/2024/NĐ-CP dated December 30, 2024 detailing certain provisions and measures for implementation of the Construction Law regarding construction activity management;

Upon the proposal of the Director of the Industry Department;

The Minister of Industry and Trade promulgates this Circular providing the contents of the design foundation of mineral exploitation investment projects and mine design.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular provides the contents of the design foundation of mineral exploitation investment projects and mine design to serve mineral exploitation activities (excluding oil and gas; natural waters that are not natural mineral water or natural hot water), regardless of the source of capital used.

Article 2. This Circular applies to:

a. Organizations and individuals engaged in mineral exploitation;

b. Organizations and individuals involved in investment and construction consulting activities;

c. State administrative agencies authorized according to laws on construction, planning, investment, minerals, and other relevant laws.

Article 3. Contents of the design foundation of mineral exploitation investment projects

The contents of the design foundation of mineral exploitation investment projects using open-pit method shall be carried out according to Appendix 01, underground mining method according to Appendix 02, and pumping extraction method according to Appendix 03 attached hereto;

Article 4. Contents of Mine Design to Serve Mineral Exploitation Activities

Point 1. Contents of Technical Design of Mineral Exploitation Investment Projects

The contents of Technical Design of Mineral Exploitation Investment Projects are specified according to the exploitation methods:

- Open-pit method: carried out according to Appendix 04 attached hereto;

- Underground mining method: carried out according to Appendix 05 attached hereto;

- Pumping extraction method: carried out according to Appendix 06 attached hereto.

Point 2. Contents of Construction Drawing Design of Mineral Exploitation Investment Projects

a) In cases where a single-step or two-step design is not separately established for individual project components: The construction drawing design of mineral exploitation investment projects is specified according to the exploitation methods:

- Open-pit method: carried out according to Appendix 07 attached hereto;

- Underground mining method: carried out according to Appendix 08 attached hereto;

- Pumping extraction method: carried out according to Appendix 09 attached hereto.

b) In cases where a two-step design is separately established for individual project components and a three-step design: Components or clusters of components of mineral exploitation investment projects are carried out according to Appendix 10 attached hereto.

Article 4. Transitional Provisions

Clause 1. Basic design and construction design implemented after basic design of mineral exploitation investment projects which have been submitted to specialized construction administration bodies for review or adjustment review before this Circular takes effect but have not yet received review results shall be implemented according to Circular No. 26/2016/TT-BCT dated November 30, 2016 of the Minister of Industry and Trade on the establishment, review, and approval of construction investment projects, construction design, and construction cost estimates for mineral mines.

Clause 2. Basic design and construction design implemented after basic design of mineral exploitation investment projects not falling within the scope provided for in Clause 1 of this Article shall be implemented according to this Circular.

Article 5. Effective Date

- This Circular takes effect from July 1, 2025.

- This Circular abolishes Circular No. 26/2016/TT-BCT dated November 30, 2016 of the Minister of Industry and Trade on the establishment, review, and approval of construction investment projects, construction design, and construction cost estimates for mineral mines.

Article 6. Implementation Organization

Clause 1. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, centrally governed cities, and related organizations and individuals are responsible for implementing this Circular.

Clause 2. In case the legal normative documents serving as the basis and cited in this Circular are amended, supplemented, or replaced, they shall be applied according to the amended, supplemented, or replacing legal normative documents.

Clause 3. During the process of implementation, if there are difficulties, obstacles, or new issues arising, the concerned agencies, organizations, and individuals are requested to report in writing to the Ministry of Industry and Trade for guidance./.
