CIRCULAR
Guidelines for Wearing Helmets When Riding Motorcycles and Motorbikes
Implementing Clause c of Article 34 of the Road Traffic Safety Regulations and UrbanTraffic Safety Regulations issued together with Decree No. 36/CP dated May 29, 1995of the Government, the Ministry of Transport guides persons sitting on motorcyclesand motorbikes to wear helmets as follows:
I. General Guidelines:
1. Wearing helmets aims to protect persons sitting on motorcycles and motorbikeswhen involved in traffic accidents, reducing brain injuries that cause death orpermanent disabilities.
2. Motorcycles and motorbikes traveling on roads are specifically classified asfollows:
"Motorbike" is a two-wheeled motorized road vehicle with an engine cylindercapacity of less than 50 cm3 and a maximum design speed not exceeding 50 km/h.
"Motorcycle" is a two- or three-wheeled motorized road vehicle with an enginecylinder capacity of 50 cm3 or more and a total vehicle weight not exceeding 400kg.
3. Persons sitting on motorcycles and motorbikes include Vietnamese citizens andforeign nationals, including:
The person driving the vehicle, also known as the driver.
Persons sitting on the vehicle alongside the driver.
4. "Helmet" refers to helmets produced according to ISO 1873-1977 standards orVietnamese Standard TCVN 5756-1993 and certified by the Inspection Bureau to meetquality standards; in 2000, helmets include those currently available on theVietnamese market.
II. Specific Guidelines:
1. As of September 1, 2000, it is mandatory for persons sitting on motorcycles andmotorbikes to wear helmets when traveling on national highways that have beenupgraded and improved and on routes leading to Hanoi, Ho Chi Minh City, HaiPhong City, and Da Nang City.
2. As of January 1, 2001, it is mandatory for persons sitting on motorcycles andmotorbikes to wear helmets when traveling on national highways and provincialhighways outside urban areas under provincial jurisdiction and outside the centralurban areas of centrally governed cities.
3. Before August 30, 2000, the Vietnam Highway Administration, authorized bythe Ministry of Transport, will publicly announce national highways requiringhelmet use for persons sitting on motorcycles and motorbikes; the Department ofTransportation (Department of Transportation and Public Works), authorized by thePeople's Committee of provinces and centrally governed cities, will publiclyannounce sections of local roads managed by the locality requiring helmet use forpersons sitting on motorcycles and motorbikes.
4. Encourage and motivate persons sitting on motorcycles and motorbikes to wearhelmets when traveling on inner-city and town roads and other roads not specifiedin Points 1 and 2 of Part II through various means.
5. Persons sitting on motorcycles and motorbikes traveling on designated roadswho fail to wear helmets will be considered in violation and subject to administrativepenalties as prescribed by law.
III. Implementation Organization.
1. The Director of the Vietnam Highway Administration and the Directors of theDepartments of Transportation (Departments of Transportation and Public Works)shall closely cooperate with the Vietnam Fatherland Front, the Departments ofJustice, Health, Culture and Information, particularly the Public SecurityBureaus of provinces and centrally governed cities, to widely publicize thecontent of this Circular and organize its implementation.
2. This Circular takes effect from September 1, 2000. Any issues should bereported promptly to the Ministry of Transport by relevant agencies, units, andcitizens for consideration and resolution./.
