ISSUING REGULATIONS ON THE MODEL OPERATING RULES OF THE PEOPLE'S COMMITTEES OF WARD, TOWN, AND SPECIAL ECONOMIC ZONE

On the basis of 61/2014/QH13;

On the basis of Law on Local Administration Organization No. 72/2025/QH15;

The Government issues this Decree to stipulate the Model Operating Rules for the People's Committees of ward, town, and special economic zone.

Article 1. Attached to this Decree are the Model Operating Rules for the People's Committees of ward, town, and special economic zone.

Article 2. Effective Date

1. This Decree takes effect from December 8, 2025.

2. Decision No. 77/2006/QĐ-TTg dated April 12, 2006, of the Prime Minister on the Model Operating Rules for the People's Committees of ward, town, and commune shall be repealed from the date this Decree comes into force.

3. Abolish the provisions related to meetings of the People's Committees of commune, ward, and town and the Chairpersons of the People's Committees at the commune level in Decision No. 45/2018/QĐ-TTg dated November 9, 2018, of the Prime Minister on meeting regulations in the management and operation activities of agencies under the administrative state system.

Article 3. Responsibility for Implementation

1. The People's Committees of commune, ward, and special economic zone shall issue operating rules consistent with the Model Operating Rules for the People's Committees of commune, ward, and special economic zone attached to this Decree.

For the People's Committees of commune, ward, and special economic zone that have issued operating rules ensuring compliance with the provisions of the Law on Organization of Local Administration No. 72/2025/QH15, they shall continue to implement them. In case of necessity, based on the characteristics and practical situation of the locality, legal provisions, and to ensure better operation and activity of the local government machinery, the People's Committees of commune, ward, and special economic zone shall adjust and supplement according to the provisions of this Decree.

2. The Chairpersons of the People's Committees of commune, ward, and special economic zone and relevant agencies, organizations, and individuals are responsible for implementing this Decree.

REGULATIONS

MODEL OPERATING RULES FOR THE PEOPLE'S COMMITTEES OF COMMUNE, WARD, AND SPECIAL ECONOMIC ZONE
(Attached to Decree No. 315/2025/NĐ-CP dated December 8, 2025 of the Government)

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. These Regulations specify the principles of work; responsibility systems; working relationships; scope, methods, and procedures for handling tasks; work programs, activities, and information and reporting systems of the People's Committee of commune, ward, and special economic zone (hereinafter referred to as the commune level).

2. The Chairperson of the People's Committee at the commune level, Vice-Chairpersons of the People's Committee at the commune level, members of the People's Committee at the commune level, agencies, organizations, and units under the People's Committee at the commune level, civil servants, public officials, employees working at the People's Committee at the commune level; Village Chiefs, Ward Heads, and other relevant organizations and individuals are subject to these Regulations.

Article 2. Principles of Work of the People's Committee at the Commune Level

1. All activities of the People's Committee at the commune level must comply with the Constitution and laws; handle tasks as prescribed by law; ensure the leadership and guidance of the Party Committee at the commune level, the supervision of the People's Council at the same level, and the people in the performance of assigned tasks and powers; closely cooperate with the Vietnam Fatherland Front Committee at the same level during the implementation of tasks.

2. The People's Committee at the commune level operates under a collective decision-making system, deciding by majority; while emphasizing the authority and responsibility of the Chairperson of the People's Committee at the commune level; implementing the principle of democratic centralism and provisions on transparency, accountability.

3. The organization and operation of the People's Committee at the commune level must ensure efficiency, effectiveness, streamlined structure, and modern professional local governance requirements. The People's Committee at the commune level has the responsibility to promote the application of information technology, comprehensively digitalize operations in directing, managing, processing tasks, and providing electronic public services to enhance efficiency, aiming towards building a digital government, digital economy, and digital society. Data created during the operation of the People's Committee at the commune level must be ensured to be complete, accurate, timely, consistent, secure, and confidential according to regulations, managed, exploited, and used collectively to serve effective direction, management, and administrative procedure resolution; ensuring accountability tied to power control mechanisms; ensuring a transparent, unified, smooth, continuous administrative system; preventing corruption, wastefulness, and inefficiency.

4. In the division of labor for handling tasks, each task can only be assigned to one agency, organization, unit, one person in charge, and responsible. The agency, organization, unit, or individual assigned as the main responsible party must correspond to their functions, duties, and authorities as prescribed by law and bear responsibility for the progress, results, and resolution of the task.

5. Adhere to the procedures, formalities, authorities, and deadlines for handling tasks, performing delegated and authorized duties and other duties as prescribed by law; have the responsibility to monitor, guide, inspect, and evaluate the performance of delegated duties; bear legal responsibility for the legality of the delegation and the results of the duties delegated.

6. Ensure human rights and citizens' rights; build local governments close to the people, serving the people, promoting the people's right to self-governance, subject to people's inspection and supervision; coordinate and create conditions for the Vietnam Fatherland Front Committee at the same level in the locality to implement social feedback mechanisms.

7. Members of the People's Committee at the commune level and civil servants under the People's Committee at the commune level have the responsibility to closely follow the area, absorb the opinions of the people; implement transparent and regular public explanations, continuously improve their competence, ensuring the efficient and effective operation of the People's Committee at the commune level. 

Chapter II
RESPONSIBILITIES, SCOPE OF TASK HANDLING, AND WORK RELATIONSHIPS OF THE PEOPLE'S COMMITTEE AT THE COMMUNE LEVEL

Article 3. Responsibilities, scope, and methods for handling tasks of the Commune People's Committee

1. The Commune People's Committee shall fully perform the tasks and powers stipulated in the Constitution, the Law on Organization of Local Administration, and related legal documents. It shall organize the implementation of digital transformation tasks according to plans, directives from higher levels, and resolutions of the same-level Party Committee and People's Council, ensuring connectivity, synchronization, and effectiveness.

2. Sending, receiving documents, files, work dossiers, reports, and results of work handling within the Commune People's Committee shall be conducted through electronic environments, except for matters listed in the State Secrets Directory. Agencies, organizations, units, and individuals are responsible for using the Document Management and Operation System in accordance with the guidance of competent authorities.

3. Methods for handling tasks of the Commune People's Committee

a) The Commune People's Committee shall discuss and decide on issues specified in Clause 2, Article 40 of the Law on Organization of Local Administration and other issues as prescribed by law and the operational regulations of the Commune People's Committee;

b) Meetings may be held in person, online, or a combination of both. For urgent issues or those that do not necessarily require collective discussion, upon the Chairman's directive, the Office of the People's Council and People's Committee (hereinafter referred to as the Office) shall send all files and opinion solicitation forms to each member of the same-level People's Committee for their opinions. Soliciting opinions may be done through electronic voting forms via the Document Management and Operation System or other forms decided by the Chairman of the Commune People's Committee. Electronic opinion solicitation forms or other forms have equal validity. The creation, sending, storage, and processing of electronic voting forms must ensure information security, data confidentiality, and comply with legal provisions on electronic transactions, archiving, and record-keeping;

c) Voting may be conducted openly, by submitting opinion forms, or electronically through the Document Management and Operation System or other forms. In cases where electronic voting or other forms are applied, the Chairman of the Commune People's Committee shall decide based on ensuring transparency, democracy, clarity, and compliance with legal provisions;

d) When soliciting opinions from members of the Commune People's Committee through opinion solicitation forms, the following procedures shall be followed:

If more than half of the total number of members of the Commune People's Committee agree, the Office shall report to the Chairman of the Commune People's Committee for decision and report to the Commune People's Committee at the nearest meeting;

If less than half of the members of the Commune People's Committee agree, the Office shall report to the Chairman of the Commune People's Committee for a decision to bring the matter up for discussion at the Commune People's Committee meeting;

đ) The examination and submission of draft resolutions of the Commune People's Council and draft decisions of the Commune People's Committee as normative legal documents shall be carried out in accordance with legal provisions on issuing normative legal documents and the procedures outlined in Chapter III of this Regulation.

Article 4. Responsibilities, scope, and methods for handling tasks of the Chairman of the People's Committee at the commune level

1. The Chairman of the People's Committee at the commune level leads and manages the work of the People's Committee at the commune level; bears individual responsibility and together with other members of the People's Committee at the commune level bears collective responsibility for the activities of the People's Committee at the commune level in accordance with the Law on Organization of Local Administration and other relevant laws.

2. The Chairman of the People's Committee at the commune level represents the People's Committee at the commune level to decide on matters within the jurisdiction of the People's Committee at the commune level and report to the People's Committee at the commune level at the next session, except for the duties and powers specified in Clause 2, Article 40 of the Law on Organization of Local Administration.

3. The Chairman of the People's Committee at the commune level bears individual responsibility for the implementation of assigned duties and powers in accordance with the law and organizes the implementation of tasks delegated from the People's Committee at the provincial level (hereinafter referred to as the People's Committee at the provincial level). Delegation to public service units shall only be implemented for tasks and powers aimed at increasing autonomy for public service units in managing their units and providing public services.

4. Methods for handling tasks of the Chairman of the People's Committee at the commune level

a) Summoning, chairing, and deciding on issues to be discussed at the session of the People's Committee at the commune level;

b) Directing and handling work through electronic means in accordance with local realities. The Office is responsible for assisting the Chairman of the People's Committee at the commune level in handling tasks as stipulated herein;

c) Directly directing the resolution of important, urgent, complex, inter-sectoral issues related to multiple fields, agencies, organizations, and units within the locality and issues within the jurisdiction of specialized agencies but of significant importance. Mobilizing and seeking professional opinions from higher-level agencies, related associations, and organizations to advise and assist the Chairman of the People's Committee at the commune level in resolving important, inter-sectoral issues;

d) Assigning Deputy Chairmen of the People's Committee at the commune level to perform specific duties and powers within the jurisdiction of the People's Committee at the commune level or delegated by the People's Committee at the provincial level, the Chairman of the People's Committee at the provincial level, or the heads of agencies and organizations under the People's Committee at the provincial level. When absent from the office, assigning a Deputy Chairman of the People's Committee at the commune level to manage and resolve the work of the People's Committee at the commune level;

When assigning Deputy Chairmen of the People's Committee at the commune level to perform specific duties and powers delegated by the People's Committee at the provincial level, the Chairman of the People's Committee at the provincial level, or the heads of agencies and organizations under the People's Committee at the provincial level, the Chairman of the People's Committee at the commune level is responsible to the delegating agency, organization, or individual regarding the assignment of Deputy Chairmen of the People's Committee at the commune level to perform delegated duties and powers;

đ) Delegating to the heads of agencies, organizations, and units under the People's Committee at the commune level to perform one or more duties and powers that he has been assigned according to the law within a defined period, except where the law prohibits delegation;

e) Representing the People's Committee at the commune level to sign documents within the jurisdiction of the People's Committee at the commune level or entrusting Deputy Chairmen of the People's Committee at the commune level to sign documents of the People's Committee at the commune level within the scope of work already assigned to Deputy Chairmen of the People's Committee at the commune level; issuing directives and instructions to implement assigned duties and powers as prescribed;

g) Meeting and working with Deputy Chairmen of the People's Committee, leaders of agencies, organizations, and units under his own People's Committee and other related agencies to resolve tasks;

h) In addition to the above methods, the Chairman of the People's Committee at the commune level resolves tasks through other forms: conducting fieldwork; inspecting and urging the implementation of mechanisms, policies, and laws at agencies, organizations, units, village, and ward levels; explaining and answering questions from People's Council representatives; responding to citizens' petitions; holding press conferences and directing the handling of media information; dialoguing with the people; receiving domestic and foreign guests; other methods as prescribed by law.

Article 5. Responsibilities, scope, and methods for handling tasks of the Deputy Chairperson of the People's Committee at the commune level

1. The Deputy Chairperson of the People's Committee at the commune level shall perform duties and exercise powers according to the division of labor assigned by the Chairperson of the People's Committee at the commune level; shall be individually responsible before the Chairperson of the People's Committee at the commune level and before the law regarding decisions within the assigned field, area, scope, and powers; and concurrently, together with other members of the People's Committee at the commune level, shall bear collective responsibility for the activities of the People's Committee at the commune level in accordance with Clause 2 of Article 40 of the Law on Local Administration Organization.

The Deputy Chairperson of the People's Committee at the commune level may exercise the powers of the Chairperson of the People's Committee at the commune level, acting on behalf of the Chairperson of the People's Committee at the commune level when handling tasks within the assigned field and shall be responsible before the Chairperson of the People's Committee at the commune level.

2. Methods for handling tasks of the Deputy Chairperson of the People's Committee at the commune level:

a) Directing and urging agencies, organizations, units under the People's Committee at the commune level to build and implement strategies, plans, mechanisms, policies, development programs, projects in the assigned sector, field, agency in accordance with the guidelines, policies, laws suitable to the directives of higher levels and the actual situation of the locality, ensuring feasibility and high effectiveness;

b) Directing and inspecting agencies, organizations, units under the People's Committee at the commune level to implement guidelines, policies, laws, and tasks within the assigned sector, field, agency;

c) Meeting and working with leaders of agencies, organizations, units under the People's Committee at the commune level and related agencies to handle tasks;

d) Giving opinions on issues related to agencies, organizations, units, fields under their responsibility before submitting them to the Chairperson of the People's Committee at the commune level or the People's Committee at the commune level for consideration and decision; in cases where the issue relates to the field managed by another Deputy Chairperson of the People's Committee at the commune level, directly coordinating to resolve it;

đ) Regularly summarizing the situation of work they are responsible for and reporting to the Chairperson of the People's Committee at the commune level in writing or during a briefing meeting. In directing and managing, if there are issues related to or within the field directly managed by the Chairperson of the People's Committee at the commune level, issues arising outside the plan, issues not yet regulated, Deputy Chairpersons shall proactively propose and report to the Chairperson of the People's Committee for decision. If the issue falls within the jurisdiction of the People's Committee at the commune level, it shall be reported to the Chairperson of the People's Committee to bring to the session of the People's Committee at the commune level for discussion and decision.

3. Within the assigned field, the Deputy Chairperson of the People's Committee at the commune level shall have the following tasks and powers:

a) Directing specialized agencies to prepare files, documents, draft resolutions of the People's Council at the commune level within the assigned field, submitting them to the People's Committee at the commune level for examination, discussion, and decision before submitting them to the People's Council at the commune level; directing specialized agencies to prepare files, documents, draft decisions of the People's Committee at the commune level within the assigned field, submitting them to the People's Committee at the commune level for examination, discussion, and decision; directing the preparation of other administrative documents to implement policies, measures, plans, programs, projects, reports on the mid-term and final assessment of industry development at the locality (hereinafter referred to as documents, projects, programs); reporting to the People's Committee at the commune level and the Chairperson of the People's Committee at the commune level;

b) Directing, guiding, inspecting, and urging agencies, organizations, units to organize the implementation of policies, laws, resolutions of the Party Committee, Standing Committee of the Party Committee at the commune level, resolutions of the People's Council at the commune level, decisions, other administrative documents of the People's Committee and the Chairperson of the People's Committee at the commune level, guidelines, policies, laws within their assigned field; identifying and proposing issues that need amendment and supplementation. In case of discovering agencies, organizations, units issuing documents or performing tasks contrary to the provisions of the law, representing the Chairperson of the People's Committee at the commune level to decide to temporarily suspend the enforcement of such documents or tasks, and promptly proposing measures to the Chairperson of the People's Committee at the commune level for handling in accordance with the law;

c) Acting on behalf of the Chairperson of the People's Committee at the commune level to direct and handle daily issues arising within the assigned field, area, locality; researching, identifying, and proposing issues about policies that need supplementation and amendment within the assigned field, area, locality, and reporting to the Chairperson of the People's Committee at the commune level for consideration and decision;

d) Assisting the Chairperson of the People's Committee at the commune level in monitoring the reform of administrative procedures, organizational activities, digital transformation, personnel of agencies, organizations, units; directing the resolution of internal issues in agencies, organizations, units within the assigned field; directing the exchange and agreement with agencies, organizations, units on contents related or affecting the assigned field, industry, agency, organization, unit before submitting to the People's Committee and the Chairperson of the People's Committee at the commune level for consideration and decision.

4. In cases where the Chairperson of the People's Committee at the commune level assigns them during the absence of the Chairperson of the People's Committee or for other reasons not being present at the office, the Deputy Chairperson of the People's Committee at the commune level shall perform the following tasks and powers:

a) Leading and using the Office machinery to maintain regular activities of the People's Committee at the commune level;

b) Handling tasks of the Chairperson of the People's Committee at the commune level and when assigned by the Chairperson of the People's Committee, also handling tasks of another Deputy Chairperson of the People's Committee at the commune level when that Deputy Chairperson is on official business or absent from the office for other reasons.

5. In addition to the above methods, the Vice Chairman of the People's Committee at the commune level resolves tasks through the following forms: traveling on official business; inspecting and urging organizations to implement mechanisms, policies, and laws at agencies, organizations, units, village areas, and residential wards; explaining and answering questions from People's Council representatives; responding to citizens' petitions; holding press conferences and directing the handling of media information; receiving citizens; receiving domestic and foreign guests; other methods as prescribed by law and assigned by the Chairman of the People's Committee at the commune level.

Article 6. Responsibilities, scope, and methods of resolving tasks for members of the People's Committee at the commune level

1. Members of the People's Committee at the commune level perform tasks and exercise powers as prescribed by law and assigned by the Chairman of the People's Committee at the commune level; they have the responsibility to actively participate in resolving common tasks of the collective People's Committee at the commune level; they are responsible before the law, the People's Committee at the commune level, and the Chairman of the People's Committee at the commune level regarding tasks within their assigned fields; simultaneously, together with other members of the People's Committee at the commune level, they bear collective responsibility for the implementation of the tasks and powers of the People's Committee as stipulated in Clause 2, Article 40 of the Law on the Organization of Local Administration.

2. Members of the People's Committee at the commune level are responsible and report their work to the People's Committee and the Chairman of the People's Committee at the commune level; provincial state management agencies concerning their sectors and fields of responsibility; members of the People's Committee at the commune level must consider and submit to the People's Committee at the commune level and the Chairman of the People's Committee at the commune level for resolution proposals from agencies, organizations, units, and individuals under their responsibility; members of the People's Committee at the commune level must allocate time to participate and coordinate in resolving collective tasks of the People's Committee at the commune level, decide issues within the authority of the People's Committee at the commune level; and carry out tasks assigned by the Chairman of the People's Committee at the commune level.

3. Attend all sessions of the People's Committee at the commune level; in case of absence, they must report and obtain the consent of the Chairman of the People's Committee at the commune level; provide opinions and vote on issues discussed at the session of the People's Committee at the commune level; provide opinions with other members of the People's Committee at the commune level, heads of agencies, organizations, and units to handle issues related to their assigned fields or issues within their advisory state management functions.

4. Methods of resolving tasks for members of the People's Committee at the commune level:

a) Actively and promptly report and advise the People's Committee at the commune level and the Chairman of the People's Committee at the commune level on difficulties encountered in practice, policies, mechanisms, and necessary legal documents to propose amendments, supplements, and issuance;

b) Proactively propose to the Chairman of the People's Committee at the commune level policies, solutions, and directly direct and manage one or more fields according to the assignment of the Chairman of the People's Committee, promote the application of information technology and digital transformation to enhance the effectiveness of assigned tasks by the Chairman of the People's Committee;

c) Actively review, report, and promptly work with the Chairman of the People's Committee and other members of the People's Committee at the commune level on tasks within the authority of the People's Committee, the Chairman of the People's Committee at the commune level, and other related tasks or when deemed necessary;

d) Direct, monitor, guide, and inspect the implementation of policies and laws of higher-level state agencies and decisions and directives of the People's Committee at the commune level and the Chairman of the People's Committee at the commune level concerning their assigned sectors and fields;

đ) Proactively convene meetings with relevant agencies, organizations, units, and individuals to resolve assigned tasks within their authority or discuss and unify issues with differing opinions among agencies, organizations, and units before submitting them to the People's Committee at the commune level and the Chairman of the People's Committee at the commune level;

e) Travel on official business; inspect and urge the implementation of tasks at units, village areas, and residential wards; explain and answer questions from People's Council representatives; respond to citizens' petitions; hold press conferences; receive citizens; and other methods as prescribed by law and assigned by the Chairman of the People's Committee at the commune level;

g) Members of the People's Committee at the commune level who are also the Chief of the Military Command at the commune level and the Head of the Police Station at the commune level, in addition to performing the aforementioned tasks, are also responsible for implementing decisions, directives, and orders of the Provincial Military Command and the Provincial Police; promptly report tasks assigned by superiors related to the direction and management of the People's Committee at the commune level; in cases where issues arise related to the use of armed forces as prescribed by law, they must directly report and propose solutions to the Chairman of the People's Committee at the commune level.

Article 7. Responsibilities, scope, and methods for handling tasks of the head of agencies, organizations, units under the People's Committee at the commune level subject, organization, unit under the People's Committee of the commune level(subject, organization, unit under the People's Committee of the commune level)

1. The head of agencies, organizations, units under the People's Committee at the commune level shall perform duties and powers as prescribed by law and tasks assigned or delegated by the People's Committee at the commune level or the Chairman of the People's Committee at the commune level; prioritize resources, be responsible for institutional building, mechanism, policy, strategy, planning, directive, administrative reform, organizational structure, development and application of information technology, digital transformation, and handling administrative procedures for citizens and businesses within the organization and operation of the agency, organization, or unit.

2. The head of agencies, organizations, units under the People's Committee at the commune level shall be responsible for performing assigned duties and powers, and those delegated to them, and shall be accountable to the People's Committee at the commune level, the Chairman of the People's Committee at the commune level, and the law regarding the performance of their functions, duties, and powers.

3. Methods for handling tasks of the head of agencies, organizations, units under the People's Committee at the commune level

a) Direct and handle tasks assigned or delegated by the People's Committee at the commune level or the Chairman of the People's Committee at the commune level, and tasks within the functions, duties, and powers of the agency, organization, or unit as prescribed by law; delegate specific tasks and powers within their authority to deputy-level officials, or have such tasks and powers assigned or delegated by the People's Committee at the commune level or the Chairman of the People's Committee at the commune level. When absent from the agency, organization, or unit, delegate management and task resolution to a deputy-level official.

When delegating specific tasks and powers to deputy-level officials that have been authorized by the People's Committee at the commune level or the Chairman of the People's Committee at the commune level, the head of the agency, organization, or unit under the People's Committee at the commune level shall be accountable to the authorizing agency or individual regarding the delegation of these tasks and powers to deputy-level officials;

b) Resolve petitions from organizations and individuals within their functional and jurisdictional authority; report to the Chairman of the People's Committee at the commune level matters exceeding their authority or matters resolved in collaboration with related agencies but without consensus;

c) Participate in proposing opinions on common tasks of the People's Committee at the commune level and implement specific tasks according to the division of labor and delegation from the People's Committee at the commune level, the Chairman of the People's Committee at the commune level, and the competent authority; have the right to request adjustments to the content, scope, and duration of delegation, while not being allowed to further delegate tasks and powers they themselves have been delegated;

d) Participate in providing opinions with other agencies, organizations, and units at the same level to resolve issues within their functional and jurisdictional authority;

đ) Implement task resolution in electronic environments, ensuring shortened processing time, transparency, and accountability; be accountable to the People's Committee and the Chairman of the People's Committee at the commune level for promoting the application of information technology and digital transformation in administrative work and handling administrative procedures;

e) Be provided and use accounts, digital signatures, and official email boxes on electronic information systems; equip information technology means for exchanging opinions, resolving tasks, or accessing information and data to serve directive and management work within their authority;

g) Develop and submit to the People's Committee at the commune level for decision-making on the functions, duties, powers, and organizational structure (if applicable) of their agency, organization, or unit;

h) Implement administrative reform within their agency, organization, or unit and participate in local administrative reform work;

i) Travel on official business; inspect and urge the implementation of tasks in units and village areas; explain and answer questions from People's Council representatives; respond to citizen petitions; hold press conferences; meet with citizens and other methods as prescribed by law and assigned by the Chairman of the People's Committee at the commune level.

4. The head of specialized agencies under the People's Committee at the commune level who is also a member of the People's Committee at the commune level, in addition to fulfilling responsibilities, scope, and methods for handling tasks as stipulated in this Article, shall also fulfill responsibilities, scope, and methods for handling tasks of members of the People's Committee at the commune level as prescribed in Article 6 of this Decree.

Article 8. Responsibilities and scope of work of the Director of the People's Council Office and People's Committee at the commune level

1. Lead and direct the Office to fully perform its functions, tasks, and authorities in providing advice, assisting, and serving the People's Council, People's Committee, Chairperson, and Vice Chairpersons of the People's Committee at the commune level as prescribed by law.

2. Assist the Chairperson and Vice Chairpersons of the People's Committee at the commune level in compiling and monitoring the operation of agencies, organizations, and units under the People's Committee at the commune level; compile the operation of the People's Committee at the commune level and its members, and report at weekly coordination meetings chaired by the Chairperson and Vice Chairpersons of the People's Committee at the commune level; propose to the Chairperson and Vice Chairpersons of the People's Committee at the commune level for research, advice, and proposal on policies, management mechanisms, and specific decisions to handle matters within their state management functions and tasks.

3. Organize the provision of information to support the direction and administration of the People's Committee, Chairperson, and Vice Chairpersons of the People's Committee at the commune level. Uniformly manage and utilize electronic information systems of the People's Committee at the commune level, promote the application of information technology, digital transformation, and administrative procedures for citizens and businesses to enhance the effectiveness of administrative management and information exchange among agencies, organizations, and units in the locality.

4. Urge and inspect the implementation of decisions and directives issued by the People's Committee, Chairperson, and Vice Chairpersons of the People's Committee at the commune level. Monitor, compile, and report on the implementation of work programs for assigned tasks. Monitor, urge, compile, and report to the Chairperson of the People's Committee at the commune level on the handling of citizen complaints and petitions by responsible agencies, organizations, units, and individuals; recommend measures to ensure progress and quality in handling.

5. Draft and submit to the People's Committee at the commune level for approval the Operational Regulations of the People's Committee at the commune level and other related regulations; assist the People's Committee and Chairperson of the People's Committee in monitoring and reviewing the implementation of the Operational Regulations.

6. Ensure working conditions and organize advisory and service activities for the People's Council, People's Committee, Chairperson, and Vice Chairpersons of the People's Committee at the commune level. Organize services for sessions of the People's Committee and meetings chaired by the Chairperson and Vice Chairpersons of the People's Committee at the commune level, ensuring infrastructure conditions for online meetings.

7. Manage archival work of the People's Committee, implement the digitization of archival files and documents in accordance with regulations. Assign the processing of incoming documents of the People's Committee and Chairperson of the People's Committee on the Software of the Document Management and Administration System of the People's Committee at the commune level. In cases of paper documents and when deemed necessary, report to the Chairperson of the People's Committee at the commune level and the Vice Chairperson of the People's Committee at the commune level responsible for the relevant field before assigning document processing. Act on behalf of the Chairperson of the People's Committee to sign certain documents in accordance with regulations and assignments from the Chairperson of the People's Committee at the commune level.

8. Serve as the point of contact for officially providing information about the activities of the People's Committee and Chairperson of the People's Committee at the commune level to the press and citizens, organizations, and businesses in the area as assigned by the Chairperson of the People's Committee at the commune level. Be responsible for managing the content of the commune-level electronic information website.

9. Handle specific tasks assigned by the Chairperson or Vice Chairperson of the People's Committee at the commune level.

10. Fulfill the responsibilities, scope, and methods of handling tasks of the member of the People's Committee at the commune level as stipulated in Article 6 of this Decree.

Article 9. Responsibilities and Scope of Work for Specialized Civil Servants under the People's Committee at the Commune Level and Village Chiefs, Ward Chiefs

1. Civil servants have the responsibility to perform their specialized tasks according to their job positions and assignments; they are accountable before the People's Committee at the commune level, the Chairman, Vice Chairmen of the People's Committee at the commune level, and the heads of specialized agencies and administrative organizations under the People's Committee at the commune level regarding the results of their tasks; they must regularly work and handle matters on electronic platforms, except for cases involving state secrets; they must comply with internal procedures, electronic procedures, and information security regulations.

2. Village Chiefs and Ward Chiefs have the responsibility to coordinate and support the People's Committee and the Chairman of the People's Committee at the commune level in organizing activities in villages and wards; implementing tasks and work within their jurisdiction; promoting and mobilizing citizens to implement policies and laws, participating in training courses to enhance their qualifications to guide and assist citizens in online administrative procedures, using the VNeID application and other digital platforms of the government; participating in community digital technology group activities to support citizens; regularly reporting work situations to the People's Committee at the commune level, the Chairman of the People's Committee at the commune level, or responsible agencies, organizations, and units; promptly proposing solutions to the Chairman of the People's Committee at the commune level to address citizens' and organizations' petitions.

Article 10. Coordination Relationships in Work of the People's Committee at the Commune Level

1. The People's Committee at the commune level must maintain regular contact and be subject to the leadership and direction of the People's Committee at the provincial level to ensure the unity and smooth operation of the state administrative system.

2. The People's Committee at the commune level is subject to the leadership and direction of the Party Committee at the commune level in performing political tasks in the locality; maintaining regular contact with the agencies of the Party Committee at the commune level in their work.

3. Closely coordinating with provincial departments, sectors, and agencies in related fields within the commune; implementing periodic reports or when required. Coordinating, guiding, and inspecting the activities of subordinate public service units, agencies, organizations, enterprises located within the commune, and maintaining regular working relationships with villages and wards in implementing Party guidelines and State laws, resolutions of the People's Council, and decisions of the People's Committee.

4. Closely coordinating and regularly exchanging with the Standing Body of the People's Council at the commune level in preparing agendas and contents for sessions of the People's Council at the commune level; meetings of the Standing Body of the People's Council at the commune level; reports and draft Resolutions submitted to the People's Council; being responsible for organizing the implementation of Resolutions of the People's Council at the commune level; studying and resolving according to their authority the petitions of the People's Council, Committees, Delegation Groups, and representatives of the People's Council at the commune level; responding to questions from representatives of the People's Council at the commune level.

5. Closely coordinating with the Vietnam Fatherland Front Committee at the same level in caring for and protecting the legitimate rights and interests of the people; promoting education and mobilization among the people.

The People's Committee at the commune level and its members have the responsibility to resolve and respond to petitions from the Vietnam Fatherland Front Committee at the same level.

6. Coordinating and exchanging information with the People's Procuracy and People's Court in the area concerning efforts to combat crime, violations of the Constitution and laws, maintaining discipline and administrative order, promoting legal education; implementing economic and social goals and Party and State policies.

7. Coordinating to create favorable, safe, and fair investment and business environments for enterprises, organizations, businesses, and individuals within the area, promoting economic and social development. 

Chapter III
RESPONSIBILITIES, PROCEDURES FOR HANDLING FILES AND WORK

Article 11. Documents submitted to the People's Commune Council and the Chairman of the People's Commune Council for handling matters

The documents submitted to the People's Commune Council and the Chairman of the People's Commune Council for handling matters are established, sent, and processed on the Management System of Official Documents and Administrative Procedures, including:

1. Draft presentation papers for draft documents, projects, proposals, reports, and materials (hereinafter referred to as draft documents, projects, and proposals) must clearly demonstrate the necessity, basis for issuance, main content of the draft documents, projects, and proposals, and any differing opinions (if any); they must be signed and submitted by the authorized person in accordance with the law.

In cases where there are differing opinions, the Office shall be responsible for compiling them and reporting to the Chairman of the People's Commune Council, the Vice Chairman of the People's Commune Council in charge of the draft documents, projects, and proposals. The Chairman of the People's Commune Council decides whether to bring the content to collective discussion at the session of the People's Commune Council to decide by majority or conclude the handling according to authority.

2. Draft documents, projects, and proposals.

3. Review documents of relevant specialized agencies (for regulatory legal documents).

4. Reports summarizing the opinions of participating agencies, organizations, units, and explanations of the adoption of the agency, organization, unit primarily drafting the draft documents, projects, and proposals.

5. Opinion documents of participating agencies, organizations, units.

6. Other necessary documents (if any).

Article 12. Reviewing draft documents, projects, and proposals before submitting to the People's Commune Council and the Chairman of the People's Commune Council

1. All draft document, project, and proposal files prepared by the primary drafting agencies before submitting to the Chairman or Vice Chairman of the People's Commune Council must be sent through the Office and processed electronically on the system, except for documents classified as state secrets. The Office is responsible for reviewing the files regarding procedures, format, form of the document, and ensuring the consistency of the content before submission. The review of draft resolutions of the People's Commune Assembly and decisions of the People's Commune Council as regulatory legal documents is carried out in accordance with the Law on Issuing Regulatory Legal Documents and guiding documents.

2. Upon receiving the submitted files, the Office is responsible for checking the procedures, format, form, and issuing authority of the document.

a) If the file submitted by the primary drafting agency, organization, or unit does not comply with the provisions of Article 21 of this Regulation, the Office must return it on the Management System of Official Documents and Administrative Procedures within the earliest time consistent with the deadline for handling the file, but not exceeding two working days from the date of receipt; at the same time, clearly note the requirements for supplementing and perfecting the file in accordance with the regulations.

b) If the submitted file does not meet the requirements in terms of format, form, or the content does not meet the professional requirements or consistency, the Office returns it on the Management System of Official Documents and Administrative Procedures and provides specific guidance on the content that needs to be revised for the primary drafting agency, organization, or unit to complete.

c) If there are differing opinions between the primary drafting agency, organization, or unit and the Office, the Office reports to the Chairman of the People's Commune Council or the Vice Chairman of the People's Commune Council in charge of the field for consideration and decision.

3. Agencies, organizations, and units related have the responsibility to cooperate with the Office to provide opinions on draft documents, projects, and proposals before submitting them to the People's Commune Council and the Chairman of the People's Commune Council for examination when requested.

Article 13. Processing of files for the resolution of tasks and examination, approval of draft documents, projects, and proposals

1. The Chairman and Vice Chairmen of the People's Committee at the commune level shall examine, resolve tasks, and provide direct guidance on the handling of draft documents, projects, and proposals submitted by agencies, organizations, units, and the opinions of the Office, directly on the Management System for Documents and Operations.

2. For tasks with simple content, within two working days from the date of receiving the submitted file, the Chairman and Vice Chairmen of the People's Committee at the commune level must provide an opinion to resolve or sign to issue. For complex tasks requiring discussion at meetings or submission to the People's Committee at the commune level for examination and decision-making, the Chairman and Vice Chairmen of the People's Committee at the commune level shall assign the Office to coordinate with the main agency, organization, or unit to arrange time and prepare the work content.

3. When draft documents, projects, and proposals have been reviewed and resolved by the Chairman and Vice Chairmen of the People's Committee at the commune level, the Office shall coordinate with the main agency, organization, or unit to complete them for signature and issuance by the Chairman and Vice Chairmen of the People's Committee at the commune level. All documents of the People's Committee at the commune level (excluding those classified as state secrets) shall be issued in electronic form, signed digitally by the authorized person, and immediately published on the system.

Article 14. Procedures for processing draft regulatory legal documents

The procedures for processing draft regulatory legal documents include draft Resolutions of the People's Council at the commune level and draft Decisions of the People's Committee at the commune level, which shall be implemented in accordance with the laws on promulgating regulatory legal documents and the following provisions:

1. Processing of files for draft Resolutions of the People's Council at the commune level and draft Decisions of the People's Committee at the commune level:

a) For draft documents that are fully documented, procedurally compliant, and without differing opinions, the Office shall review and verify the process, procedures, authority to handle, and advise on the content (hereinafter referred to as the review and verification opinion), and submit it to the People's Committee at the commune level for examination and decision.

b) For draft documents that are inadequately documented, procedurally non-compliant, the Office shall send a document requesting the main drafting agency or organization to supplement and perfect according to regulations.

c) For draft documents that are fully documented, procedurally compliant, but still have differing opinions on major issues within the draft:

If the main drafting agency or organization has already coordinated and cooperated with other agencies, organizations, units, and individuals but cannot reach consensus, the Vice Chairman of the People's Committee at the commune level assigned to oversee or designate a leader of the Office to chair a meeting with representatives of the main drafting agency or organization and related agencies, organizations, units, and individuals to discuss, clarify, and reach consensus before submitting to the People's Committee at the commune level.

In case of failure to reach consensus, the Office shall compile all differing opinions comprehensively and submit them to the Chairman and Vice Chairman of the People's Committee at the commune level for examination and decision.

d) The Chairman and Vice Chairman of the People's Committee at the commune level shall provide comments on the Work Resolution Submission Form.

2. Examination and approval of draft Resolutions of the People's Council at the commune level and draft Decisions of the People's Committee at the commune level:

a) In cases where draft documents are discussed and voted on during a session of the People's Committee at the commune level, immediately after the session ends, based on the decision of the People's Committee at the commune level, the main drafting agency or organization shall coordinate with the Office and related agencies, organizations, units, and individuals to incorporate and explain the opinions of members of the People's Committee at the commune level, perfect the draft, and submit it to the Chairman of the People's Committee at the commune level for examination.

b) In cases where opinion sheets and electronic voting sheets are sent to members of the People's Committee at the commune level:

The Office shall take the lead and coordinate with the main drafting agency or organization to determine the contents requiring opinions; send the sheets along with the entire file to the members of the People's Committee at the commune level and process them electronically for members of the People's Committee at the commune level to vote, except for files containing state secrets, which shall be handled in accordance with regulations on protecting state secrets and certain other cases as directed by the Chairman or Vice Chairman of the People's Committee at the commune level responsible.

In cases where the majority of members of the People's Committee at the commune level approve and there are no differing opinions, the Office shall coordinate with the main drafting agency, organization, or unit to perfect the draft and submit it to the Chairman of the People's Committee at the commune level for examination.

In cases where the majority of members of the People's Committee at the commune level approve but there are still differing opinions among some members, the Office shall immediately transfer the opinions of the members of the People's Committee at the commune level to the main drafting agency or organization to incorporate, explain, perfect, and report to the Chairman of the People's Committee at the commune level. In cases where the main drafting agency or organization retains its opinion, the Office shall compile and report to the Chairman of the People's Committee at the commune level for examination and decision or organize a meeting with members of the People's Committee at the commune level who have differing opinions.

In cases where the draft is not approved by the majority of members of the People's Committee at the commune level, the Office shall transfer the opinions of the members of the People's Committee at the commune level to the main drafting agency or organization for continued processing and reporting to the Chairman of the People's Committee at the commune level for examination and decision.

Article 15. Authority to sign documents

1. The Chairman of the People's Committee at the commune level shall sign the following documents:

a) Decisions of the People's Committee at the commune level; reports, administrative documents of the People's Committee at the commune level sent to higher state agencies, the Party Committee at the commune level, and the People's Council at the commune level;

b) Other decisions and administrative documents within their authority as prescribed by law.

2. The Vice-Chairman of the People's Committee shall sign on behalf of the Chairman of the People's Committee at the commune level for documents within the assigned areas. When the Chairman of the People's Committee at the commune level is absent, one Vice-Chairman of the People's Committee at the commune level designated by the Chairman of the People's Committee at the commune level to manage the activities of the People's Committee at the commune level shall sign on behalf of the Chairman of the People's Committee for documents within the authority of the Chairman of the People's Committee at the commune level.

3. The Director of the Office shall sign on behalf of the Chairman of the People's Committee at the commune level for documents announcing the conclusions of the Chairman and Vice-Chairmen of the People's Committee at the commune level during meetings of the People's Committee at the commune level, and other documents and papers according to the assignment of the Chairman of the People's Committee at the commune level.

4. Digital signatures shall be implemented to ensure prompt and timely handling of work anytime, anywhere.

Article 16. Issuance and publication of documents

1. The Office shall be responsible for issuing documents of the People's Council, the Standing Body of the People's Council, the Committees of the People's Council at the commune level, the People's Committee at the commune level, and the Chairman of the People's Committee at the commune level in accordance with the Government's regulations on archival work.

2. Legal regulatory documents issued by the People's Council and the People's Committee at the commune level must be promptly and fully published on the commune-level electronic information website and disseminated through local mass media as prescribed by the Law on Enacting Legal Regulatory Documents and guiding documents, except for those listed in the State Secrets Directory; simultaneously, they must be uploaded on the provincial electronic Gazette system as prescribed.

3. Documents issued by the People's Committee at the commune level and the Chairman of the People's Committee at the commune level must be scientifically classified, stored, and updated in a timely manner. Archiving of files and documents shall be carried out concurrently in paper form for legal regulatory documents that require it and electronically on the agency's storage system, ensuring security, confidentiality, and ease of access.

4. The Director of the Office shall be responsible for organizing management, updating, storing, and utilizing issued documents and incoming documents of the People's Council and the People's Committee at the commune level; implementing document storage in accordance with laws on archival work, storage, the Rules of Procedure of the People's Council at the commune level, and the Rules of Procedure of the People's Committee at the commune level.

Article 17. Inspection of the implementation of documents

1. The Chairman of the People's Committee at the commune level shall be responsible for organizing and directing regular self-inspection or specialized inspection of the implementation of documents in the locality; deciding on handling or assigning the Vice-Chairman of the People's Committee at the commune level to handle according to regulations; reporting to competent authorities for handling illegal documents; amending and supplementing provisions that are no longer appropriate; publicly announcing the results of inspections and handling on the commune-level electronic information website as prescribed by law.

2. The Vice-Chairman of the People's Committee at the commune level shall inspect the implementation of documents through direct work with agencies, organizations, and units within the assigned areas; promptly rectifying violations of administrative discipline and improving responsibility in implementing documents; handling illegal documents, promptly amending and supplementing provisions that are no longer appropriate in the assigned areas by the Chairman of the People's Committee at the commune level.

3. The heads of agencies, organizations, and units shall be responsible for regularly conducting self-inspection of the implementation of documents; promptly reporting and recommending to the Chairman and Vice-Chairman of the People's Committee at the commune level responsible for the areas to handle illegal documents, amend and supplement provisions that are no longer appropriate within the advisory and management areas.

4. Agencies and organizations under the People's Committee at the commune level, as assigned by the Chairman of the People's Committee at the commune level, shall be responsible for advising and assisting the People's Committee at the commune level in implementing state management over inspection and handling of legal regulatory documents in the locality in accordance with their assigned functions and tasks. 

Chapter IV
CHAPTER PROGRAM OF WORK OF THE PEOPLE'S COMMITTEE AT THE COMMUNE LEVEL

Article 18. Types of program of work

1. The program of work includes annual, quarterly, monthly, and weekly programs of work.

2. Contents of the program of work

a) The annual program of work of the People's Committee at the commune level consists of two parts: Part One reflects the orientations, goals, tasks, and key solutions of the People's Committee at the commune level in various fields; Part Two includes the contents of regular meetings and draft documents, projects, and proposals that need to be submitted for consideration and decision-making by the People's Committee at the commune level, the Chairman of the People's Committee at the commune level within their authority, or for submission to the People's Council at the commune level, the People's Committee at the province level, and the Chairman of the People's Committee at the province level during the year;

b) The quarterly program of work is a detailed implementation of the annual program of work as prescribed to be carried out in each quarter and additional or adjusted matters that need to be resolved in the quarter; the contents of regular meetings of the People's Committee at the commune level, the list of draft documents, projects, and proposals that need to be issued in the quarter;

c) The monthly program of work is a detailed implementation of the quarterly program of work as prescribed to be carried out in each month of the quarter and additional or adjusted matters that need to be resolved in the month; the contents of regular meetings of the People's Committee at the commune level, the list of draft documents, projects, and proposals that need to be issued in the month;

d) The weekly program of work includes the tasks of the Chairman and Deputy Chairmen of the People's Committee at the commune level to be resolved on a daily basis throughout the week, which are publicly disclosed on the commune-level electronic information website.

Article 19. Procedures for building the program of work

1. Building the annual program of work

a) By the latest on November 25th of each year, agencies, organizations, and units under the People's Committee at the commune level send the Office a list of draft documents, projects, and proposals that need to be submitted to the People's Committee at the commune level, the Chairman of the People's Committee at the commune level, or for submission to the People's Council at the commune level, the People's Committee at the province level, and the Chairman of the People's Committee at the province level for issuance in the following year;

b) The Office is responsible for compiling and drafting the proposed annual program of work of the People's Committee at the commune level within five working days and sending it to relevant agencies, organizations, and units for comments;

c) Within five working days from the date of receipt of the proposed annual program of work of the People's Committee at the commune level sent by the Office, agencies and organizations solicited for comments must respond in writing, return to the Office to complete the draft, and submit it to the Chairman of the People's Committee at the commune level for review, and report to the People's Committee at the commune level at the last regular meeting of the year;

d) Within three working days from the date the People's Committee at the commune level approves, the Office submits it to the Chairman of the People's Committee at the commune level for approval, sends it to members of the People's Committee, agencies, organizations, and units under the People's Committee at the commune level for implementation, reports to higher state authorities as prescribed, and publishes it on the commune-level electronic information website for public oversight and monitoring.

2. Building the quarterly program of work

a) By the latest on the twentieth day of the last month of the quarter, agencies, organizations, and units responsible must send the Office a report evaluating the results of implementing the quarterly program of work and reviewing and proposing adjustments and supplements to the next quarterly program of work of the People's Committee at the commune level;

b) The Office is responsible for compiling and drafting the next quarterly program of work of the People's Committee at the commune level and submitting it to the Chairman of the People's Committee at the commune level for decision;

c) By the latest on the twenty-fifth day of the last month of the quarter (if falling on a holiday, it is considered the nearest preceding working day), the Office must send the next quarterly program of work to members of the People's Committee at the commune level, heads of agencies, organizations, and units under the People's Committee at the commune level, agencies, organizations, units, and individuals for implementation and reporting to higher state authorities as prescribed.

3. Building the monthly program of work

a) By the latest on the twentieth day of each month, heads of agencies, organizations, and units base on the progress of preparing draft documents, projects, and proposals in the quarterly program of work, pending issues, or newly arising ones to build the next monthly program of work of their agency, organization, or unit and send it to the Office;

b) The Office compiles the monthly program of work of the People's Committee at the commune level, categorizes it according to sectors overseen by the Chairman and Deputy Chairmen of the People's Committee at the commune level, and submits it to the Chairman of the People's Committee at the commune level for decision;

c) By the latest on the twenty-fifth day of each month (if falling on a holiday, it is considered the nearest preceding working day), the Office must send the next monthly program of work to members of the People's Committee at the commune level, heads of agencies, organizations, and units under the People's Committee at the commune level, agencies, organizations, units, and individuals for implementation and reporting to higher state authorities as prescribed.

4. Building the weekly program of work

Based on the monthly program of work and instructions from the Chairman and Deputy Chairmen of the People's Committee at the commune level, the Office builds the next weekly schedule of work for the Chairman and Deputy Chairmen of the People's Committee, submits it to the Chairman of the People's Committee at the commune level for decision by the latest on Friday of the previous week, and notifies relevant agencies, organizations, units, and individuals to implement and report to higher state authorities as prescribed.

5. Registration, compilation, construction, and approval of the annual, quarterly, monthly, and weekly programs of work of the People's Committee at the commune level shall be conducted through the Document Management and Operation System. The Office advises the People's Committee at the commune level to construct, adjust, and urge the implementation of the program of work.

Adjustments to the program of work are decided by the Chairman of the People's Committee at the commune level; the Office promptly announces such adjustments on the Document Management and Operation System or through other means so that members of the People's Committee, heads of agencies, organizations, and units concerned are aware and can implement them.

6. During the process of constructing the program of work, the Office is responsible for coordinating with the Party Committee Office at the commune level to ensure that activities between the Standing Committee of the Party Committee, the Standing Body of the People's Council, and the People's Committee at the commune level, the Chairman, and Deputy Chairmen of the People's Committee at the commune level do not overlap.

7. Members of the People's Committee at the commune level, heads of agencies, organizations, and units under the People's Committee at the commune level within the scope of their assigned responsibilities shall be responsible for fully implementing all tasks within the work program of the People's Committee at the commune level; in cases where it is necessary to change the content or participate in reviewing issues recorded in the work program, they must report to the Chairman of the People's Committee at the commune level for decision.

Article 20. Monitoring and Evaluating the Results of Implementing the Work Program

1. The head of agencies, organizations, and units under the People's Committee at the commune level shall be responsible for regularly updating the progress and results of assigned tasks on the Management Document and Administrative System. On a monthly, quarterly, and annual basis, based on the work program of the People's Committee at the commune level that has been approved, agencies, organizations, and units under the People's Committee at the commune level shall be responsible for reviewing, assessing, and evaluating the results of the work within their scope of responsibility; notifying the Office of the results of processing draft documents, projects, and programs assigned to lead; reporting remaining draft documents, projects, and programs, explaining reasons, subsequent measures, and recommendations for adjustments and supplements to the work program of the People's Committee at the commune level for the next period.

2. The Office shall monitor, urge, compile, and submit to the Chairman of the People's Committee at the commune level for decision on adjusting and supplementing the work program to ensure compliance with leadership and management requirements; periodically reporting to the People's Committee at the commune level on the results of implementing the work program on a monthly, quarterly, and annual basis.

3. The Vice Chairman of the People's Committee at the commune level assigned to oversee draft documents, projects, and programs shall be responsible for directing agencies, organizations, and units to implement according to the approved program and plan.

Article 21. Preparing Draft Documents, Projects, and Programs for Submission to the People's Committee at the Commune Level, the Chairman of the People's Committee at the Commune Level

1. Based on the work program and plan of the People's Committee at the commune level, the head of the leading agency, organization, or unit shall prepare draft documents, projects, and programs. Draft documents, projects, and programs must clearly specify the serial number, name of the document, project, or program, main content, leading agency, organization, or unit, cooperating agencies, organizations, implementation schedule, and submission time.

2. The head of the leading agency, organization, or unit preparing the draft document, project, or program shall be responsible for organizing the construction of content in accordance with format, procedures, and drafting regulations; soliciting opinions from relevant agencies, organizations, and units; ensuring the submission deadline as prescribed. In cases where it is necessary to adjust the content, scope, or submission deadline, the head of the leading agency, organization, or unit preparing the draft must report to the Chairman of the People's Committee or the Vice Chairman of the People's Committee at the commune level overseeing the relevant field for consideration and decision.

Soliciting opinions and conducting reviews shall be carried out through electronic environments. Agencies, organizations, and units receiving requests for opinions must respond in electronic form with digital signatures within the required timeframe.

3. For draft regulatory documents, the solicitation of opinions must comply with the provisions of the Law on Enacting Regulatory Documents and guiding documents for its implementation. The head of the agency, organization, or unit requested to provide opinions on draft documents, projects, and programs related to their management area shall be responsible for responding in writing in accordance with the content and deadline required and bear responsibility for the provided opinions.

4. The Director of the Office shall be responsible for assisting the Chairman and Vice Chairmen of the People's Committee at the commune level in monitoring and urging the preparation of draft documents, projects, and programs for submission to the People's Committee at the commune level and the Chairman of the People's Committee at the commune level. 

Chapter V
MEETING REGIME, RECEIVING GUESTS, BUSINESS TRAVEL, AND INFORMATION REPORTING

Article 22. Meetings of the People's Committee at the commune level

1. The People's Committee at the commune level shall convene regular meetings once a month; hold coordination meetings as decided by the Chairman of the People's Committee at the commune level; in cases of necessity, organize extraordinary or specialized meetings. Meetings may be conducted directly, online, or through a combination of direct and online methods with higher-level agencies, villages, residential wards, and related agencies.

2. Soliciting opinions from members of the People's Committee at the commune level via electronic means may be implemented instead of holding a meeting in the following circumstances:

a) Urgent matters requiring immediate resolution;

b) Matters that do not necessitate collective discussion;

c) Files and documents have been fully transmitted to members of the People's Committee at the commune level and there are no differing opinions on their contents;

d) Technical systems meet the conditions for ensuring information security and data storage as stipulated by law.

3. Organizing online meetings or hybrid meetings combining direct and online formats shall be carried out according to the following procedures and formalities:

a) The Chairman of the People's Committee at the commune level decides on the format, composition, content, time, location (if applicable), and technical system to be used for organizing the online meeting;

b) The Office is responsible for preparing documents, sending invitations and meeting materials to members and attendees; ensuring network connections, equipment, audio-visual systems, and data security throughout the meeting;

c) Members of the People's Committee at the commune level are responsible for logging in, checking connectivity, attending fully, expressing opinions, and voting within their authority; in case of absence, they must report and obtain approval from the Chairman of the People's Committee at the commune level;

d) During the meeting, the chairperson has the right to manage, conclude, and solicit voting opinions; the meeting secretary is responsible for recording minutes, confirming voting results, and storing them along with meeting data;

đ) The archiving of minutes, image and sound data, and other documents generated during online meetings shall be carried out in accordance with legal regulations on archives and records management, ensuring information security and the evidentiary value of electronic documents.

Article 23. Preparation work for meetings of the People's Committee at the commune level

1. The Office is responsible for advising and proposing to the Chairman of the People's Committee at the commune level to decide on the content, time, agenda, and composition of participants for the meeting.

2. Agencies, organizations, or units primarily responsible for drafting proposals, documents shall submit files for review and decision by the Chairman or Vice-Chairman of the People's Committee at the commune level overseeing the relevant field regarding inclusion in the meeting agenda of the People's Committee at the commune level.

3. The Office is tasked with:

a) Checking and compiling all files, proposals, and documents to be presented at the meeting;

b) Preparing the meeting agenda and proposed composition of participants for approval by the Chairman of the People's Committee at the commune level; preparing conditions to serve the meeting. At least three working days before the meeting date, it shall present to the Chairman of the People's Committee at the commune level for approval the content, agenda, file proposals, documents, time, and composition of participants, while simultaneously informing members of the People's Committee. In cases where the files, proposals, or documents do not meet requirements, the Chairman of the People's Committee at the commune level shall decide to postpone their presentation to the meeting for further refinement;

c) Urging heads of agencies, organizations, and units under the People's Committee at the commune level primarily responsible for submitting files and related documents;

d) Sending the agenda, meeting times, and materials to members of the People's Committee at the commune level at least two working days before the start of the meeting, except in cases of emergency or urgent meetings. Materials must be sent electronically, except for those classified as state secrets. In cases of changes to the meeting date or time, the Office shall immediately notify members of the People's Committee at the commune level and invited representatives.

Article 24. Participants in the session of the People's Committee of the commune

1. The Chairman of the People's Committee of the commune shall preside over the session, ensuring that it is conducted in accordance with its content, program, and regulations. In the absence of the Chairman of the People's Committee of the commune, one Vice Chairman of the People's Committee of the commune designated by the Chairman of the People's Committee of the commune shall preside over the session.

2. The Chairman and Vice Chairmen of the People's Committee of the commune shall manage discussions on each draft document, project, or proposal submitted to the People's Committee of the commune within their assigned areas of responsibility.

3. Members of the People's Committee of the commune shall be responsible for attending all sessions fully. In case of absence, they must obtain the consent of the presiding officer and may authorize a deputy to attend in their place; the member who authorizes another person to speak on their behalf shall be responsible for the opinions expressed by the authorized person.

4. A session of the People's Committee of the commune can only be held when at least two-thirds of the total number of members of the People's Committee of the commune are present.

5. Invited guests to attend the session of the People's Committee of the commune:

a) Representative of the Standing Committee of the Party Committee of the commune;

b) Representative of the Standing Body of the People's Council of the commune;

c) Chairman of the Vietnam Fatherland Front Committee at the same level, and representatives of the Committees of the People's Council of the commune when discussing issues related to them;

d) Heads of agencies, organizations, units under the People's Committee of the province and central sector units located within the commune territory when discussing related issues;

đ) Village Chiefs, Ward Chiefs when discussing related issues.

Article 25. Procedure for the session of the People's Committee of the commune

1. The Director of the Office shall report the number of members of the People's Committee of the commune present, absent, those attending in place of others, invited delegates, the content and program of the session.

2. The presiding officer shall conduct the session.

3. The People's Committee of the commune shall discuss each draft document, project, or proposal according to the following procedure:

a) The head of the agency, organization, or unit responsible for drafting shall present a summary of the content of the draft document, project, or proposal; clearly state the issues requiring the opinion of the People's Committee of the commune; the time for presentation shall be decided by the presiding officer of the session;

b) Members of the People's Committee shall express their opinions, clearly stating their agreement or disagreement, issues needing clarification, and recommendations for adjustment or supplementation;

c) Delegates attending the session shall express their opinions as requested by the presiding officer;

d) The Director of the Office shall present a report summarizing the opinions of the members of the People's Committee of the commune or the Office; clearly stating each member's opinion, issues agreed upon, unresolved issues, and recommendations for discussion and decision-making;

đ) The head of the agency, organization, or unit responsible for drafting shall express their opinions on receiving feedback, explaining unclear or unresolved issues, and responding to relevant contents;

e) The Chairman or Vice Chairman of the People's Committee shall chair the discussion and conclude; members of the People's Committee of the commune shall vote. A draft document, project, or proposal is approved when more than half of the total number of members of the People's Committee of the commune agree; in cases where there are still unclear issues, the presiding officer shall request the People's Committee of the commune not to approve and require the agency, organization, or unit responsible for drafting to continue perfecting it.

4. If necessary, the Chairman of the People's Committee of the commune may request the head of the agency, organization, or unit responsible for drafting the document, project, or proposal to report additional information on related issues outside the content already submitted.

5. Voting at the session of the People's Committee of the commune:

a) The People's Committee of the commune decides issues at the session through voting. Delegates attending the session who are not members of the People's Committee of the commune have the right to express opinions but do not have the right to vote. Members of the People's Committee of the commune have the right to vote in favor or against;

b) Voting may be conducted openly, by secret ballot, electronically, or by other appropriate methods as determined by the Chairman of the People's Committee of the commune;

c) A decision of the People's Committee of the commune is adopted when more than half of the total number of voters agree. In case the number of votes in favor and against are equal, the decision shall follow the opinion of the Chairman of the People's Committee of the commune;

d) For urgent matters or those that do not need to be discussed and voted on directly at the session, the Chairman of the People's Committee decides to collect opinions by written ballots. Voting by written ballots is carried out in accordance with Clause 3, Article 3 of this Regulation. The Chairman of the People's Committee of the commune is responsible for announcing the results of voting by written ballots at the nearest session of the People's Committee of the commune.

6. The presiding officer shall make concluding remarks at the end of the session.

7. Minutes and announcement of the results of the session:

a) All sessions of the People's Committee of the commune must be recorded in minutes. The minutes must include all opinions expressed, the course of the session, the conclusions of the presiding officer or the voting result (if any), and must be signed and confirmed by the Director of the Office; they shall be kept in the archives of the People's Committee of the commune as prescribed.

b) After each session, the Director of the Office shall be responsible for issuing a document announcing the conclusions of the presiding officer of the session, sending it to the members of the People's Committee of the commune, relevant agencies, organizations, units, and individuals for their knowledge and implementation; simultaneously, reporting to the Standing Committee of the Party Committee and the People's Council at the same level.

Article 26. Meetings of the Chairman of the People's Committee at the Commune Level

1. Weekly coordination meetings of the Chairman of the People's Committee at the Commune Level with Deputy Chairmen of the People's Committee at the Commune Level.

2. Meetings to handle regular work and complex, urgent matters involving multiple sectors and fields.

3. Meetings to resolve issues with heads of agencies, organizations, and units under the People's Committee at the Commune Level.

4. Advisory meetings with agencies, organizations, and units in charge of projects, documents, and representatives from related agencies, organizations, and units to hear reports and advice before making decisions on handling work.

5. Emergency meetings and specialized topic meetings.

6. Training and implementation meetings when new policies or guidelines are introduced.

7. Summary and conclusion meetings.

Article 27. Meetings of the Chairman of the People's Committee at the Commune Level with Agencies, Organizations, and Units within the Administrative Area

1. Weekly, the Chairman of the People's Committee at the Commune Level organizes meetings with heads of agencies, organizations, and units to review and resolve work related to the implementation of policies, plans for socio-economic development, and the budget at the commune level.

2. When necessary, the Chairman or Deputy Chairmen of the People's Committee at the Commune Level meet with agencies, organizations, and units under their jurisdiction to inspect, understand the situation, urge implementation of programs, and direct handling of emerging issues. In cases of necessity, the Chairman of the People's Committee at the Commune Level may convene meetings with heads of some agencies, organizations, and units to resolve related issues.

Article 28. Organization of Meetings to Resolve Work Issues and Important Cross-sectoral Issues Exceeding Authority

1. Heads of agencies, organizations, and units have the right to request meetings with the Chairman of the People's Committee at the Commune Level or Deputy Chairmen responsible for the relevant sector to seek guidance and coordination in resolving important cross-sectoral issues exceeding the authority of their agency, organization, or unit.

2. In cases where draft documents, projects, proposals, or specific tasks submitted to the Chairman of the People's Committee at the Commune Level have differing opinions among agencies, organizations, and units, the Director of the Office shall be responsible for organizing meetings with related agencies, organizations, and units to coordinate handling, unify solutions before submitting to the Chairman of the People's Committee at the Commune Level or Deputy Chairmen responsible for the relevant sector. Within two working days from the end of the meeting, the main agency, organization, or unit must research, adopt, and complete the dossier; the Office will prepare the dossier for submission to the Chairman of the People's Committee at the Commune Level or Deputy Chairmen responsible for the relevant sector for consideration, decision-making, or directive on handling the matter.

Article 29. Responsibilities of the Director of the Office in Organizing Meetings of the Chairman and Deputy Chairmen of the People's Committee at the Commune Level

1. To compile and integrate the annual, quarterly, monthly, and weekly meeting schedules of the Chairman and Deputy Chairmen of the People's Committee at the Commune Level into the Implementation Plan of the Work Program, and submit it to the Chairman of the People's Committee at the Commune Level for decision.

2. To advise the Chairman and Deputy Chairmen of the People's Committee at the Commune Level on arranging and scheduling meetings reasonably, scientifically, and effectively.

3. To participate in discussions regarding the necessity and content of meetings proposed by heads of agencies, organizations, and units to be organized by the Chairman of the People's Committee at the Commune Level or Deputy Chairmen responsible for the relevant sector to direct and coordinate in resolving important cross-sectoral issues exceeding the authority of agencies, organizations, and units.

4. To ensure that the correct and relevant agencies, organizations, units, and individuals are invited to attend the meetings.

5. To urge and guide agencies, organizations, and units assigned to prepare all required materials and documents according to the meeting agenda and submit them before the scheduled date.

6. To organize the preparation of venues, facilities, and conditions to serve the meetings, ensuring security during meetings held at the People's Committee at the Commune Level headquarters; to coordinate with related agencies, organizations, and units if the meetings are held at other administrative units.

7. To participate in discussions on draft documents, projects, proposals, and tasks included in the meeting agenda; to summarize issues, identify areas of disagreement, and propose solutions.

8. To attend or delegate a deputy to attend meetings as assigned.

9. To organize the recording of the minutes of the meeting according to the instructions of the chairperson.

10. To notify in writing the conclusions and directives of the meeting chairperson (if any).

11. To check and urge agencies, organizations, and units to implement the conclusions and directives of the meeting.

12. To act as the point of contact for providing and publishing information about the meeting on the commune-level electronic information website and supplying information to the press as directed by the Chairman of the People's Committee at the Commune Level.

13. To propose measures to improve the quality and reduce the number of meetings in a year, and submit them to the Chairman of the People's Committee at the Commune Level for consideration and decision.

Article 30. Meetings of agencies, organizations, and units under the People's Committee at the commune level

1. The head of the agency, organization, or unit decides to organize meetings within the scope of management of their own agency, organization, or unit.

2. When it is necessary to invite the Chairman or Vice-Chairman of the People's Committee at the commune level to attend a meeting or work session, the agency, organization, or unit must submit a registration document in advance to the Office for coordination in preparing the content, scheduling the work, and assigning civil servants to monitor and serve. In cases of urgent issues arising, the Director of the Office has the responsibility to directly report and proactively arrange time for the Chairman or Vice-Chairman of the People's Committee at the commune level to work with the agency, organization, or unit, ensuring timely resolution.

Article 31. Receiving Guests of the People's Committee at the Commune Level

1. The Office is responsible for presenting to the Chairman or Vice-Chairman of the People's Committee at the commune level in charge of the relevant field to decide on the time and content of receiving guests based on the proposal of the head of the agency, organization, or unit or according to the request of the guest; coordinating with related agencies to prepare the program, content, and organizing service for the reception and work session.

2. Agencies, organizations, and units that have foreign guests coming to contact or work with the Chairman or Vice-Chairman of the People's Committee at the commune level must coordinate with the police at the commune level and related agencies to ensure security and order in accordance with the law and the Office in advising on the content of exchanges to be appropriate with policies and regulations on foreign affairs.

3. The head of the agency, organization, or unit when receiving foreign guests must report in writing about the composition of the guests, time, content, and results of the reception, sending to the Chairman of the People's Committee at the commune level, and simultaneously sending to the Office for consolidation and monitoring.

Article 32. Traveling on Official Business, Inspection, and Understanding the Situation

1. The head of the agency, organization, or unit under the People's Committee at the commune level when traveling outside the commune area or being absent from the workplace must report in writing and obtain the consent of the Chairman of the People's Committee at the commune level; and must delegate authority to a deputy to handle business during the absence.

2. The Chairman, Vice-Chairman, and Member of the People's Committee at the commune level and the head of the agency, organization, or unit are responsible for allocating time to meet the people in villages and residential wards to inspect and understand the actual situation; promptly resolving issues within their authority or proposing to the leadership of the People's Committee at the commune level for consideration and handling difficulties and obstacles; promptly correcting any violations. Direct dialogue with the people and businesses shall be conducted through appropriate forms.

3. The Vice-Chairman of the People's Committee at the commune level and the head of specialized agencies and other administrative organizations under the People's Committee at the commune level when traveling abroad must report in writing and only travel with the consent of the Chairman of the People's Committee at the commune level.

4. The Office is responsible for advising the Chairman and Vice-Chairman of the People's Committee at the commune level to implement the unified management regulations on external activities properly, ensuring compliance with the Party and State's foreign policy guidelines and requirements for diplomatic protocol.

Article 33. Information and Reporting System

1. The head of agencies, organizations, and units under the People's Committee at the commune level shall be responsible for fully implementing regular and urgent reporting systems to the Chairman of the People's Committee at the commune level and relevant specialized agencies, administrative organizations, and public service units under the People's Committee at the provincial level as prescribed.

2. The head of agencies, organizations, and units under the People's Committee at the commune level shall be responsible for compiling and reporting on management areas as required by the People's Committee at the commune level, the Chairman of the People's Committee at the commune level, the Party Committee, and the People's Council at the commune level.

3. The Director of the Office shall be responsible for compiling and preparing reports on the work of directing and managing by the People's Committee at the commune level on a monthly, quarterly, six-monthly, and annual basis, as well as urgent reports to send to the People's Committee at the provincial level, members of the People's Committee at the commune level, and heads of agencies, organizations, and units under the People's Committee at the commune level.

4. The Director of the Office shall be responsible for providing information about the activities of the People's Committee at the commune level and the socio-economic situation of the locality to the Vietnam Fatherland Front at the same level and the press according to the instructions of the Chairman of the People's Committee at the commune level. Information about the activities of the People's Committee at the commune level and new policies must be promptly and fully published on the website, social media, and other communication channels so that citizens and businesses can easily access them.

Chapter VI
RECEIVING CITIZENS, SETTLING COMPLAINTS, REPORTS, PETITIONS, AND REFLECTIONS

Article 34. Responsibilities of the Chairman of the People's Committee at the Commune Level

1. Direct the implementation of citizen reception, complaint settlement, report handling, petition resolution, and reflection processing in accordance with the law; publicly disclose progress and results of settlement. Regularly convene meetings with Deputy Chairmen of the People's Committee and heads of agencies, organizations, and units under the People's Committee at the commune level related to unresolved cases.

2. Personally implement citizen reception in accordance with the law. Citizen reception must be closely coordinated with the Standing Committee of the Party Committee, the Standing Body of the People's Council at the commune level, and the Vietnam Fatherland Front at the same level; promote digital transformation in citizen reception work.

3. Settle complaints, reports, petitions, and reflections within their authority; if necessary, delegate to the Deputy Chairman of the People's Committee responsible for the relevant field as prescribed by law.

4. Bear responsibility before the People's Committee and the Chairman of the People's Committee at the provincial level if corruption, waste, unresolved complaints, reports, petitions, and reflections occur within their jurisdiction.

Article 35. Responsibilities of the Deputy Chairman of the People's Committee at the Commune Level

1. Implement legal provisions regarding citizen reception, complaint settlement, report handling, petition resolution, and reflection processing; convene meetings to direct and resolve cases within the assigned fields.

2. Participate with the Chairman of the People's Committee at the commune level and heads of related agencies, organizations, and units to propose solutions for handling and resolving complex, prolonged, and escalated complaints, reports, petitions, and reflections in the locality.

3. Be responsible and report to the Chairman of the People's Committee at the commune level on the resolution of complaints, reports, petitions, and reflections within the assigned scope and field as prescribed by law.

Article 36. Responsibilities of Members of the People's Committee at the Commune Level, Heads of Agencies, Organizations, and Units under the People's Committee at the Commune Level

1. Regularly self-inspect the implementation of decisions on handling complaints, denunciations, recommendations, and reflections made by the People's Committee at the commune level and higher state agencies within their own agencies, organizations, and units.

2. Handle complaints, denunciations, recommendations, and reflections within their authority; promptly report to the Chairman of the People's Committee at the commune level for consideration and direction on complex cases involving multiple sectors and fields related to citizens and businesses within their jurisdiction.

3. Fully and strictly implement conclusions and decisions of the Chairman of the People's Committee at the commune level, Vice-Chairman of the People's Committee at the commune level, and competent authorities regarding the resolution of complaints, denunciations, recommendations, and reflections within the management domain of their agencies, organizations, and units.

4. Coordinate with relevant agencies, organizations, and units in resolving complaints, denunciations, recommendations, and reflections directly related to individuals under their management.
