CIRCULAR

Guidelines on the collection and use of examination fees for civil service recruitment examinations and

 promotion examinations for civil servants

Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget; Civil Servant Law and Decree No. 95/1998/NĐ-CP dated November 17, 1998 of the Government on the recruitment, use, and management of civil servants;

After obtaining the unified opinion of the Government Organizational Cadre Board, the Ministry of Finance issues guidelines on the collection and use of examination fees for civil service recruitment examinations and promotion examinations for civil servants as follows:

1. Organizations and individuals, both domestic and foreign, when they are required by competent authorities to handle administrative matters related to ensuring order and safety in inland waterway transport as stipulated in Article 25, Clause 3 of Article 31, and Clause 1 of Article 69 of the Law on Inland Waterway Transport, must pay fees and charges for state administration to ensure order and safety in inland waterway transport according to the provisions of this Circular. The following cases are exempted from paying administrative charges for inland waterway safety:

1. The subjects required to pay examination fees for civil service recruitment and promotion according to this Circular are candidates who meet the criteria and are notified by the competent authority organizing the recruitment examination or the promotion examination for state civil servants.

2. The amount of examination fees for recruitment and promotion examinations for civil servants is stipulated as follows:

a) For civil service recruitment examinations:

- Less than 100 candidates participating, collect: 100,000 (one hundred thousand) VND per candidate per examination.

- From 100 to less than 500 candidates participating, collect: 70,000 (seventy thousand) VND per candidate per examination.

- 500 candidates participating or more, collect: 50,000 (fifty thousand) VND per candidate per examination.

b) For promotion examinations for civil servants:

- Less than 100 candidates participating, collect: 170,000 (one hundred seventy thousand) VND per candidate per examination.

- From 100 to less than 500 candidates participating, collect: 160,000 (one hundred sixty thousand) VND per candidate per examination.

- 500 candidates participating or more, collect: 150,000 (one hundred fifty thousand) VND per candidate per examination.

In each period of organizing civil service recruitment or promotion examinations, the examination organizing board shall base on the number of qualified candidates participating in the examination and the approved quota for each period to notify each candidate the amount of examination fee to be paid according to the above collection rates.

II. MANAGEMENT OF COLLECTION, PAYMENT AND USE:

1. The agency organizing recruitment and promotion examinations for civil servants is responsible for collecting examination fees at the rates prescribed in this Circular, and may use the collected examination fees to cover the following expenses serving the organization of examinations:

a) For civil service recruitment examinations, including:

- Publicly announcing on mass media the quota and conditions for participation in the examination;

- Checking applications, entering data, and sending notifications to participants;

- Compiling examination materials, renting conference halls, hiring teachers to train candidates;

- Renting examination rooms, organizing the examination;

- Expenses for the activities of the Examination Board: convening meetings, preparing examination questions, supervising the examination, grading, rechecking examination papers...;

- Other direct services for the organization of civil service recruitment examinations at ministries, agencies equivalent to ministries, government agencies; provincial People's Committees, centrally governed cities.

b) For promotion examinations for civil servants, including:

- Preliminary selection: reviewing lists of civil servants eligible to participate in the examination at the preliminary examination boards of ministries and provinces;

- In addition to the similar expenditure items as those specified in point a above for civil service recruitment examinations, it also includes travel expenses for lecturers and members of the examination board;

2. Agencies and units engaged in civil service recruitment and promotion examinations for civil servants must annually prepare budgets for examination fees together with their own agency budgets. The preparation and implementation of the budget must comply strictly with the guidance provided in Circular No. 103/1998/TT-BTC dated July 18, 1998 of the Ministry of Finance on the delegation, preparation, and implementation of final accounts of the State budget. Management of income and expenditure from examination fees must comply with current financial regulations and be consolidated into the annual financial final account report of the entity according to the delegated budget management level, ensuring principles of public and democratic finance.

3. Provincial Departments of Finance and Price Control, local tax authorities have the responsibility to guide and inspect the implementation of examination fees for civil service recruitment and promotion examinations in accordance with the provisions of this Circular, Circular No. 54/1999/TT-BTC dated May 10, 1999, and Circular No. 21/2001/TT-BTC dated April 3, 2001 of the Ministry of Finance amending certain contents of Circular No. 54/1999/TT-BTC dated May 10, 1999 guiding the implementation of Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget.

III. IMPLEMENTATION:

This Circular takes effect 15 days after its date of issuance and replaces previous regulations on examination fees for civil service recruitment and promotion examinations. Candidates required to pay examination fees for civil service recruitment and promotion examinations, agencies assigned the task of collecting examination fees, and related agencies are responsible for implementing this Circular.
