Regulations on standards and quotas for using office premises of state agencies at communes, wards, towns

 

THE MINISTER OF FINANCE

 

Pursuant to Decree No. 14/1998/NĐ-CP dated March 6, 1998 of the Government on state asset management;

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and Ministerial-Level Agencies;

BASED ON Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 114/2003/NĐ-CP dated October 10, 2003 of the Government on cadres and civil servants at communes, wards, towns;

Pursuant to Decision No. 147/1999/QĐ-TTg dated July 5, 1999 of the Prime Minister on standards and quotas for using office premises at state agencies and public service units;

At the proposal of the Director of the State Asset Management Department,

 

DECISION:

Article 1. This Decision stipulates standards and quotas for using office premises of state agencies at communes, wards, towns (hereinafter referred to collectively as commune level) to arrange workplaces for cadres and civil servants engaged in party work, administrative work, mass organizations, and specialized technical work at communes as prescribed by the Government.

Article 2. The quota for using office premises of state agencies at commune level specified in this Decision shall be set at a maximum for each region as follows:

1- Urban areas not exceeding 450 square meters;

2- Plain and midland areas not exceeding 500 square meters;

3- Mountainous and island areas not exceeding 400 square meters;

The quota for using office premises mentioned above includes: The area of buildings used for work by cadres and civil servants engaged in party work, administrative work, mass organizations, specialized technical work, serving the reception of citizens, meetings, file storage, and other common work needs at the commune.

Based on the actual conditions at the locality and the standards and quotas for using office premises prescribed in Clause 1, 2, and 3 of this Article, the Chairman of the People's Committee of provinces and centrally-administered cities decides the land area allocated to the commune level for office premises in accordance with suitability.

Article 3. The arrangement and use of office premises of state agencies at commune level within the quota prescribed in Article 2 of this Decision shall be implemented as follows:

1- The area used for work by the position of Secretary of the Party Committee or Secretary of the Branch Committee (in places where the Party Committee at the commune level has not been established), Chairman of the People's Council, Chairman of the People's Committee of the commune shall use an area of work from 10 to 12 square meters;

2- The area used for work by the position of Deputy Secretary of the Party Committee, Standing Member of the Party Committee at the commune level (in places without a dedicated Deputy Secretary for Party work) or Deputy Secretary of the Branch Committee (in places where the Party Committee at the commune level has not been established), Deputy Chairman of the People's Council, Deputy Chairman of the People's Committee of the commune shall use an area of work from 8 to 10 square meters.

In cases where a cadre or civil servant at the commune level concurrently holds multiple positions, they shall be calculated based on the quota of the officially appointed position held by that cadre.

3- The area for work of the remaining positions including state civil servants (receiving salary according to civil servant ranks) arranged to work at the commune (if any) and the area used for serving the reception of citizens, meetings, file storage, and other common work needs at the commune shall be arranged appropriately by the Chairman of the People's Committee at the commune level in accordance with the current office premises conditions of the commune.

Article 4. Annually, the competent state agency shall base its decision on the budget capacity of each level, the total existing working building area, the number of cadres and civil servants of each commune, and the standards and quotas for using office premises of state agencies at commune level prescribed in this Decision to decide on the construction, supplementary construction, or allocation of office premises for each commune to gradually ensure sufficient working space for commune-level cadres and civil servants.

Article 5. The Director of the State Asset Management Department shall be responsible for coordinating with relevant agencies under the Ministries of Home Affairs, Construction, Natural Resources and Environment, Planning and Investment to direct, inspect, and guide provinces and centrally-administered cities in constructing office premises for state agencies at commune level in accordance with the standards and quotas prescribed in this Decision.

Article 6. The Chairman of the People's Committees of provinces and centrally-administered cities, based on actual conditions and local budget capacity, and based on the standards and quotas for using office premises at the commune level prescribed in this Decision and design models (if available), shall direct relevant provincial departments, districts, towns, centrally-administered city districts, and commune levels:

1- To implement the rearrangement of existing office premises to be suitable with the standards and quotas, actual conditions at the locality, ensuring efficient and economical use of state assets.

2- To develop plans for new construction and expansion, upgrading of office premises for state agencies at the commune level to be submitted to the competent authority for consideration and decision in accordance with current laws.

3- To manage and use office premises; manage land within the compound of office premises of state agencies at the commune level in accordance with current regulations of the State.

Article 7. For the quota for using office premises at the commune level of the Public Security agency and other specialized state management agencies with specific characteristics, based on the quota for using office premises of state agencies at the commune level prescribed in Article 2 and specific arrangements in Article 3 of this Decision, the Minister, Head of a ministry equivalent to a ministry, or head of a government agency shall prescribe accordingly.

Article 8. This Decision takes effect 15 days after its publication in the Official Gazette. Any previous regulations contrary to this Decision are abolished.

Chairmen of People's Committees of provinces and centrally-administered cities, Directors of Finance Departments of provinces and centrally-administered cities, and Heads of related agencies shall be responsible for implementing this Decision./.
