CIRCULAR

Regulations on the training program for seafarers and inland waterway vessel operators

Based on the Law on Inland Waterway Transport dated June 24, 2004;

Pursuant to the Vocational Training Law dated November 29, 2006;

Based on Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport,

The Ministry of Transport hereby stipulates the training program for seafarers and inland waterway vessel operators as follows:

Article 1. Scope of application

This Circular stipulates the training programs, supplementary upgrading license courses, and professional certificate refresher courses for seafarers and inland waterway vessel operators.

Article 2. Applicability

1. This Circular applies to agencies, organizations, training institutions, vocational training centers that have registered to provide training, supplementary upgrading license courses, and professional certificate refresher courses for seafarers and inland waterway vessel operators throughout the country.

2. This Circular does not apply to the training programs, supplementary upgrading license courses, and professional certificate refresher courses for seafarers and inland waterway vessel operators in the Public Security sector, Military, engaged in security and defense tasks, and fishermen operating fishing vessels.

Article 3. Definitions

In this Circular, the following terms are understood as follows:

1. Seafarer's license, engine room officer's license is a certificate confirming the capability to assume the position of master or chief engineer on inland waterway vessels;

2. Basic safety training certificate is a certificate confirming the capability of seafarers and vessel operators to handle issues related to labor safety, vessel safety, fire prevention and extinguishing, first aid for injured persons, and environmental protection;

3. Competency certificate is a certificate confirming the capability to assume the positions of able seaman, engine room rating, or vessel operator;

4. Specialized competency certificate is a certificate confirming the capability to work safely on oil-carrying vessels, chemical-carrying vessels, liquefied gas-carrying vessels; or to operate high-speed craft type I, high-speed craft type II, or coastal vessels;

5. High-speed craft type I is a vessel defined in Clause 1 of Article 24 of the Law on Inland Waterway Transport and having a design speed of 30 km/h or more;

6. High-speed craft type II is a vessel defined in Clauses 2 and 3 of Article 24 of the Law on Inland Waterway Transport and having a design speed of 30 km/h or more;

7. Coastal vessel is an inland waterway vessel certified by the inspection authority as meeting the conditions to operate along the coast within the announced inland waterway route.

Article 4. Training program, supplementary upgrading license courses, and professional certificate refresher courses for seafarers and inland waterway vessel operators

1. The training program for seafarers and inland waterway vessel operators includes:

a) The training program for third-class master as specified in Appendix 1;

b) The training program for third-class chief engineer as specified in Appendix 2;

c) The training program for able seaman as specified in Appendix 3;

d) The training program for engine room rating as specified in Appendix 4;

đ) The training program for vessel operator as specified in Appendix 5.

2. The supplementary program includes:

a) The supplementary program for restricted third-class master's license as specified in Appendix 6;

b) The supplementary program for third-class master's license as specified in Appendix 7;

c) The supplementary program for upgrading second-class master's license as specified in Appendix 8;

d) The supplementary program for upgrading first-class master's license as specified in Appendix 9;

đ) The supplementary program for third-class chief engineer's license as specified in Appendix 10;

e) The supplementary program for upgrading second-class chief engineer's license as specified in Appendix 11;

g) The supplementary program for upgrading first-class chief engineer's license as specified in Appendix 12.

3. The refresher course program includes:

a) The refresher course program for high-speed craft type I operation certificate as specified in Appendix 13;

b) The refresher course program for high-speed craft type II operation certificate as specified in Appendix 14;

c) The refresher course program for coastal vessel operation certificate within the announced inland waterway route as specified in Appendix 15;

d) The refresher course program for safe working certificate on oil-carrying vessels as specified in Appendix 16;

đ) The refresher course program for safe working certificate on chemical-carrying vessels as specified in Appendix 17;

e) The refresher course program for safe working certificate on liquefied gas-carrying vessels as specified in Appendix 18;

g) The refresher course program for restricted able seaman certificate as specified in Appendix 19;

h) The refresher course program for restricted engine room rating certificate as specified in Appendix 20;

i) The refresher course program for restricted vessel operator certificate as specified in Appendix 21;

4. The refresher course program for legal education certificate is specified in Appendix 22.

Article 5. Responsibility for compiling textbooks

Based on the training programs stipulated in this Circular, the heads of training institutions and vocational training centers that have registered to train seafarers and inland waterway vessel operators shall be responsible for organizing the compilation and approval of textbooks as formal teaching and learning materials.

Article 6. Reports on training activities

1. Monthly (before the 5th day of the following month), Provincial Departments of Transport, training institutions, vocational training centers shall report the results of seafarer and inland waterway vessel operator training to the Vietnam Inland Waterways Administration.

2. Annually, before January and July, Provincial Departments of Transport, training institutions, vocational training centers shall report the results of seafarer and inland waterway vessel operator training in their localities and units to the Vietnam Inland Waterways Administration.

Article 7. Inspection and supervision

The Vietnam Inland Waterways Administration and Provincial Departments of Transport shall organize inspections, audits, and oversight of seafarer and inland waterway vessel operator training according to the provisions of the law based on their assigned functions and responsibilities.

Article 8. Effectiveness

This Circular shall take effect forty-five days from the date of issuance and shall replace Decisions No. 37/2004/QĐ-BGTVT dated December 24, 2004 on the "Training Program for Seafarers and Inland Waterway Vessel Operators" and Decision No. 39/2006/QĐ-BGTVT dated November 3, 2006 on the "Supplementary Training Program for Seafarers and Inland Waterway Vessel Operators" issued by the Minister of Transport.

Article 9. Implementation

1. The Director of the Vietnam Inland Waterways Administration, the Directors of Provincial Departments of Transport under the central government, and the Heads of training institutions registered to train seafarers and inland waterway vessel operators shall be responsible for implementing this Circular.

2. The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of the various Departments, the Heads of agencies and organizations, and individuals related to this matter shall be responsible for enforcing this Circular./.
