On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Considering the proposal of the Director of the Science and Technology Department and the Director of the Vietnam Vehicle Inspection Agency;
The Minister of Transport hereby promulgates this Circular regulating the maximum dimensions of cargo compartments for dump trucks, trailers, semi-trailers for dump trucks, tanker trucks, trailers, and semi-trailers for tanker trucks participating in road traffic.
Article 1. Scope of Regulation
Article 1. This Circular regulates the maximum dimensions of cargo compartments for:
a) Dump trucks, trailers for dump trucks, and semi-trailers for dump trucks participating in road traffic with a total weight of 10,000 kg or more (hereinafter referred to as dump trucks);
b) Tanker trucks, trailers for tanker trucks, and semi-trailers for tanker trucks participating in road traffic with a total weight of 10,000 kg or more (hereinafter referred to as tanker trucks).
Article 2. This Circular does not apply to the following objects:
a) Dump trucks and tanker trucks produced and assembled, imported for the purpose of national defense and security of the Ministry of National Defense and the Ministry of Public Security;
b) Dump trucks and tanker trucks produced and assembled, imported for use at construction sites, mines, or for specific purposes not participating in road traffic.
Article 2. Applicability
This Circular applies to organizations and individuals importing, producing, and assembling dump trucks and tanker trucks, as well as agencies managing, inspecting, and testing motor vehicles.
Article 3. Provisions on cargo compartments of dump trucks and tanker trucks
Clause 1. Cargo compartments must have a sturdy structure, ensuring safety for transported goods.
Clause 2. The overall length and width of cargo compartments must meet the requirements for the rear overhang length and overall width of vehicles specified in the National Technical Regulation QCVN 09: 2011/BGTVT "National Technical Regulation on Quality, Safety Technical Standards, and Environmental Protection for Motor Vehicles" and QCVN 11: 2011/BGTVT "National Technical Regulation on Quality, Safety Technical Standards, and Environmental Protection for Trailers and Semi-trailers."
Clause 3. The cargo capacity of cargo compartments must satisfy the following requirements:
a) Ensuring that the load on each axle does not exceed the maximum load-bearing capacity of the axles according to the manufacturer's specifications and does not exceed the maximum permissible axle load according to the National Technical Regulation QCVN 09:2011/BGTVT and QCVN 11:2011/BGTVT.
b) Ensuring compliance with specific requirements for each type of vehicle as follows:
- For dump trucks: The cargo capacity of the cargo compartment is determined based on the internal geometric dimensions of the cargo compartment and must ensure that the ratio between the gross weight of the cargo and the cargo capacity is not less than 1200 kg/m3.
- For tanker trucks: The cargo capacity of the tanker (excluding the volume of loading doors) is determined based on the internal geometric dimensions of the tanker and must not exceed the volume determined by dividing the weight of the transported goods by the density of the goods.
In cases where there is no documentation introducing the performance and technical specifications, or if the difference between the cargo capacity measurement results and the documentation introducing the performance and technical specifications exceeds 10%, the cargo capacity of the tanker will be determined by the volume of water or the actual transported goods (for dry cargo tankers) up to the highest point inside the tanker.
Article 4. Effective date
Article 4. This Circular takes effect from October 1, 2012.
Clause 2. Inspection certificates issued for vehicles produced and assembled before October 1, 2012, pursuant to Circular No. 30/2011/TT-BGTVT dated April 15, 2011 of the Minister of Transport regarding quality and safety technical inspection and environmental protection during production and assembly of motor vehicles remain valid for registration and circulation.
Clause 3. Certificates of quality, safety technical standards, and environmental protection for imported motor vehicles issued before October 1, 2012, pursuant to Circular No. 31/2011/TT-BGTVT dated April 15, 2011 of the Minister of Transport regarding quality and safety technical inspection and environmental protection for imported motor vehicles remain valid for registration and circulation.
Clause 4. Dump trucks and tanker trucks imported with arrival dates at ports or border gates of Vietnam before October 1, 2012, are not subject to the provisions of this Circular.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
The Director of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Highway Administration, the Director of the Vietnam Vehicle Inspection Agency, the Directors of Provincial Transportation Departments, the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
