Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing certain provisions of the Law on Technical Standards and Regulations;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;

After receiving the appraisal opinion of the Ministry of Science and Technology at Circular No. 2160/BKHCN-TDC dated August 1, 2012, the Minister of Labor - Invalids and Social Affairs issued the National Technical Regulation on Safe Work for Escalators and Passenger Conveyors.

Article 1. This Circular promulgates the National Technical Regulation on Safe Work for Escalators and Passenger Conveyors.

Article 2. The National Technical Regulation on Safe Work for Escalators and Passenger Conveyors shall take effect six months from the date of issuance of this Circular.

Article 3. Ministries, ministerial-level agencies, agencies under the Government, provincial People's Committees under the Central Government, and organizations and individuals related thereto shall be responsible for implementation./.

Foreword

QCVN 11: 2012/BLDTBXH - National Technical Regulation on Safe Work for Escalators and Passenger Conveyors was compiled by the Department of Occupational Safety and Health and promulgated by the Ministry of Labor - Invalids and Social Affairs pursuant to Circular No. 32/2012/TT-BLDTBXH dated December 19, 2012, after receiving the appraisal opinion of the Ministry of Science and Technology.

FOR ESCALATORS AND PASSENGER CONVEYORS

National technical regulation on safe work for escalators

and passenger conveyors

1. General Provisions

1.1. Scope of Application

This standard applies to all escalators and passenger conveyors (of flat belt type or band type).

1.2. Applicability

These standards apply to:

1.2.1. Organizations and individuals manufacturing, importing, circulating, installing, and using escalators and passenger conveyors;

1.2.2. Agencies and other organizations and individuals related to the matter.

1.3. Definitions

In this standard, the terms and definitions of the National Technical Standard TCVN 6397:2010 Escalators and Passenger Conveyors - Safety Requirements for Construction and Installation are used.

2. Technical Provisions

2.1. General Technical Provisions

2.1.1. All escalators and passenger conveyors mentioned above must meet the safety technical characteristics according to the technical requirements of TCVN 6397:2010 Escalators and Passenger Conveyors - Safety Requirements for Construction and Installation.

2.1.2. In case there are changes or additions to the aforementioned TCVN, the latest provisions shall be followed.

2.2. Specific Provisions

In addition to the provisions stated above, escalators and passenger conveyors must comply with other conditions as follows:

2.2.1. All electrical parts or parts capable of conducting electricity of escalators or passenger conveyors installed in areas with fire and explosion hazards must comply with current regulations on fire and explosion prevention.

2.2.2. At the entrances and exits of escalators and passenger conveyors, there must be sufficient space to avoid hindering passengers.

2.2.3. Preventive measures must be taken at places where building obstacles may cause injury to passengers. Particularly, at intersections with floor surfaces and crossing escalators or passenger conveyors, vertical barriers with a height of not less than 0.3 meters and without sharp edges on top of the handrails must be placed.

2.2.4. The surrounding area of escalators or passenger conveyors must be adequately illuminated, especially near the comb plates. The illumination intensity at entrances and exits including the comb plate area must be consistent with the general lighting system in the area. For escalators or passenger conveyors installed both indoors and outdoors, the illumination intensity at entrances and exits measured on the floor surface must ensure a minimum of 50 lux.

2.2.5. Drive stations and driven stations, as well as internal compartments within steel structures of escalators and separate machine rooms must ensure that unauthorized persons cannot enter.

These compartments can only be used for installation, repair, and maintenance of equipment necessary for the operation of escalators or passenger conveyors.

It is allowed to install fire alarm systems, direct firefighting equipment, and automatic sprinkler heads in these machine rooms provided they are properly protected against unexpected incidents. Drive equipment for escalators is also permitted to be installed in these machine rooms.

3. Management Regulations on Ensuring Safety in Manufacturing, Importing, Circulating, Installing, and Using EscalatorsngandNo.Article 3. Functions, duties, powers of Management Boards and duties, powers of the Chairperson, Vice Chairperson (if any), Secretary, and Members of Management Boardsto Passenger Conveyors 3.1. The original technical documentation of escalators and passenger conveyors includes:

3.1.1. A general description must include: model number, place of manufacture, year of production, permissible load, transportation capacity, drive type, control, speed, operating principle; main dimensions (floor height, width) and key technical features of the system (control equipment, safety equipment, durability, stability of escalators or passenger conveyors, overload limiting mechanism), applicable standards.

3.1.3. Assembly drawings of the mechanical components of escalators or passenger conveyors.

3.1.2. Schematic diagram of the operating principle.

3.1.4. Overall drawings of escalators or passenger conveyors indicating dimensions and main parameters.

3.1.5. Inspection and load testing procedures.

3.1.6. Installation instructions, usage guidelines, troubleshooting procedures.

3.1.8. Operating modes of escalators and passenger conveyors, overload limiting mechanisms; safety devices.

3.1.7. Regular inspection, repair, and maintenance schedules.

3.1.9. All components of escalators and passenger conveyors must have complete quality and origin certificates.

3.2. Conditions for ensuring safety for domestically manufactured escalators and passenger conveyors:

3.2.1. Complete technical documentation as stipulated in Clause 3.1 of this standard.

3.2.2. Must be certified as compliant under method 7 (regulations on conformity certification, compliance certification, and announcement of conformity and compliance certification issued together with Decision No. 24/2007/QD-BKHCN dated September 28, 2007 of the Minister of Science and Technology) if escalators or passenger conveyors are manufactured in batches or certified as compliant under method 8 if escalators or passenger conveyors are manufactured individually.

3.2.3. The manufacturing unit must announce compliance and register compliance for escalators or passenger conveyors according to regulations after obtaining compliance certification.

3.2.5. Subject to inspection and supervision by the product quality inspection agency under the Ministry of Labor - Invalids and Social Affairs.

3.2.4. Affix the conformity mark before putting them on the market.

3.2.5. Subject to inspection and supervision by the product quality control agency under the Ministry of Labor, Invalids and Social Affairs.

3.3. Conditions for ensuring safety for imported escalators and moving walkways:

3.3.1. Satisfying technical documentation as prescribed in Clause 3.1 of this Standard.

3.3.2. Being certified as compliant with standard requirements through Method 7 (regulations on certification of conformity to standards, certification of compliance, and announcement of conformity to standards and regulations issued together with Decision No. 24/2007/QĐ-BKHCN dated September 28, 2007 of the Minister of Science and Technology) if escalators or moving walkways are imported in batches or through Method 8 if they are imported individually.

When imported in disassembled form, all constituent parts of escalators or moving walkways must be examined for compliance with the contract or applicable announced standards and technical standards at the customs checkpoint to allow temporary clearance and must be certified as compliant after installation to complete customs procedures.

3.3.3. In cases where escalators or moving walkways are imported according to bilateral or multilateral agreements between competent authorities of the Socialist Republic of Vietnam and exporting countries stipulating that quality inspection is not required upon importation, such escalators or moving walkways will be exempted from import inspection.

3.3.4. Escalators or moving walkways meeting the provisions of Section 3.3.1 above, when imported, must undergo inspection by organizations certified by the Ministry of Labor, Invalids, and Social Affairs or recognized under international treaties to which Vietnam is a party or international agreements signed by competent authorities of the Socialist Republic of Vietnam.

3.3.5. For escalators or moving walkways of the same type and model produced by the same entity satisfying the provisions of Sections 3.3.1 and 3.3.2, if they pass three consecutive quality inspections, they may be exempted from further import inspections. The product quality inspection agency under the Ministry of Labor, Invalids, and Social Affairs will notify the customs authority and publicize this information through mass media.

However, if escalators or moving walkways show signs of non-compliance with import quality requirements or if there are consumer complaints, their quality inspections will revert to the regular import quality inspection process.

3.3.6. Imported escalators or moving walkways must undergo quality inspection according to the prescribed procedures and will be subject to legal penalties if violations are found.

3.4. Conditions for ensuring safety for escalators or moving walkways circulating in the market:

When circulating in the market, sellers of escalators or moving walkways must comply with the following requirements:

3.4.1. Adhere to national technical standards during storage and circulation of escalators or moving walkways.

3.4.2. Undergo quality inspection according to specified contents, procedures, and be subject to legal penalties if violations are found.

3.5. Conditions for escalators or moving walkways to be installed:

Escalators or moving walkways can only be installed if the following conditions are met:

3.5.1. Having the technical documentation as stated in Clause 3.1 of this standard.

3.5.2. Domestic-produced escalators or moving walkways must be certified as compliant and announced as compliant according to regulations. Disassembled imported escalators or moving walkways must be certified as compliant and complete customs formalities after installation.

3.5.3. All accompanying machine components must be compatible or manufactured in modular form by multiple manufacturers or countries and must meet the technical specifications required by the escalator or moving walkway manufacturer. Special attention should be given to the specifications of important components such as:

3.5.3.1. Drive system.

3.5.3.2. Structure of the escalator or moving walkway.

3.5.3.3. Control braking system.

3.5.3.4. Safety brake system.

3.5.3.5. Safety devices and protective signals.

3.5.3.6. Traction machinery (motor, gearbox).

3.5.3.7. Control system.

All components of escalators or moving walkways must meet the technical requirements set forth in TCVN 6397:2010 Escalators and Moving Walkways - Safety Requirements for Construction and Installation.

3.6. Requirements for entities installing and maintaining escalators or moving walkways:

3.6.1. Registering business operations in this field according to legal regulations.

3.6.2. Having sufficient technical staff trained in specialized fields. Having skilled workers who have been trained in occupational safety and hold safety certificates as required.

3.6.3. Possessing adequate technical conditions and technological capabilities for installation, calibration, and repair work.

3.6.4. Adhering to the installation and testing safety requirements of the manufacturer. Installation and testing must comply with TCVN 6397:2010 Escalators and Moving Walkways - Safety Requirements for Construction and Installation and TCVN 6906:2001 Escalators and Moving Walkways - Methods for Testing Safety Requirements for Construction and Installation.

3.6.5. Being responsible for installation and maintenance according to contracts signed with users.

3.6.6. Providing guidance on operation, maintenance schedules, repairs, periodic inspection regimes, and emergency measures to users.

3.6.7. Establishing safety measures for installation and maintenance processes while strictly adhering to relevant national technical standards and guidelines for installation and maintenance provided by the manufacturer.

3.6.8. During the installation process, the installing entity must prepare an acceptance record for each component, and when the installation work of escalators or passenger conveyors is completed, the installing entity must prepare an overall installation acceptance record with the user entity. The content of the acceptance record must clearly reflect the actual measurement inspection and evaluation results according to the technical requirements specified in TCVN 6397:2010 Escalators and Passenger Conveyors - Safety Requirements for Design and Installation and TCVN 6906:2001 Escalators and Passenger Conveyors - Methods for Testing Safety Requirements for Design and Installation.

If the manufacturer's design standard specifies higher requirements, then those requirements shall be followed.

3.7. Management and safe use of escalators or passenger conveyors

3.7.1. Each escalator or passenger conveyor must have safety usage instructions.

3.7.2. The person responsible for technical management and operation of escalators and passenger conveyors must undergo initial safety training before being assigned duties, and annual safety refresher training to understand the technical features, relevant standards and regulations concerning escalators or passenger conveyors, emergency prevention and response measures according to the guidance of the installing entity, and must obtain a safety certificate or occupational safety card as prescribed.

3.7.3. Safety requirements for using escalators or passenger conveyors:

3.7.3.1. Only use escalators or passenger conveyors that are in good technical condition and have not exceeded the validity period of their technical safety inspection.

3.7.3.2. In case of power failure, warning signs must be posted at the entrances and exits of the escalators or passenger conveyors.

3.7.3.3. When escalators or passenger conveyors are under repair or testing, there must be notifications and measures to prevent unauthorized persons from approaching the repair or testing areas.

3.7.3.4. Each escalator or passenger conveyor must have maintenance, repair, and replacement tracking numbers for all required components according to the manufacturer's specifications.

4. Technical safety inspection for escalators or passenger conveyors

4.1. Escalators or passenger conveyors must undergo initial inspection, periodic inspection during use, or extraordinary inspection according to the inspection procedures issued by the Ministry of Labor, Invalids and Social Affairs.

The technical safety inspection of escalators or passenger conveyors must be conducted by organizations designated by the Ministry of Labor, Invalids and Social Affairs.

4.2. Periodic inspection cycle for escalators or passenger conveyors:

4.2.1. Once every five years for escalators or passenger conveyors operating under normal working conditions.

4.2.2. Once every three years for escalators or passenger conveyors operating in corrosive environments or with high frequency of use.

5. Supervision, inspection, and handling of violations

5.1. State labor inspectors shall conduct inspections, checks, and handle violations of this Standard.

5.2. Quality control of manufacturing, importation, circulation, and use of escalators or passenger conveyors shall be carried out in accordance with the Law on Product and Goods Quality and the provisions of this Standard.

6. Responsibilities of organizations and individuals

6.1. Organizations and individuals responsible for manufacturing, importing, circulating, repairing, installing, managing, and using escalators and passenger conveyors are responsible for complying with the provisions of this Standard.

6.2. This Standard serves as the basis for quality inspection agencies to conduct inspections and for conformity assessment organizations to issue compliance certification.

7. Implementation

7.1. The Department of Occupational Safety and Health, Ministry of Labor, Invalids and Social Affairs shall be responsible for guiding and supervising the implementation of this Standard.

7.2. Local state management agencies on labor shall be responsible for guiding, supervising, and inspecting the implementation of the provisions of this Standard.

7.3. During the implementation process, if there are any difficulties, relevant agencies, organizations, and individuals shall promptly reflect them to the Ministry of Labor, Invalids and Social Affairs for consideration and resolution./.
