Based on the Maritime Code of Vietnam dated June 14, 2005;

Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;

Pursuant to the Law on Handling Administrative Offenses dated June 20, 2012;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 81/2013/NĐ-CP dated July 19, 2013 of the Government detailing certain provisions and measures for implementing the Law on Handling Administrative Offenses;

Pursuant to Decree No. 93/2013/NĐ-CP dated August 20, 2013 of the Government on administrative penalties in the maritime transport and inland waterway transport sectors.

At the proposal of the Director of the Department of Transport Safety, the Director General of the Vietnam Maritime Administration, and the Director General of the Vietnam Inland Waterways Administration;

The Minister of Transport hereby issues this Circular on issuing templates for records of inspection and decisions on administrative penalties in the maritime transport and inland waterway transport sectors.

Article 1. Scope of Regulation

This Circular provides templates for records of inspection and decisions on administrative penalties in the maritime transport and inland waterway transport sectors to implement Decree No. 81/2013/NĐ-CP dated July 19, 2013 of the Government detailing certain provisions and measures to enforce the Law on Handling Administrative Violations, and Decree No. 93/2013/NĐ-CP dated August 20, 2013 of the Government on administrative penalties in the maritime transport and inland waterway transport sectors.

Article 2. Applicability

This Circular applies to individuals and organizations that commit administrative violations in the maritime transport and inland waterway transport sectors; persons with authority to issue records of inspection and impose administrative penalties, and individuals and organizations related to the issuance of records of inspection and the issuance of decisions on administrative penalties in the maritime transport and inland waterway transport sectors.

Article 3. Issuing templates for records of inspection and decisions on administrative penalties in the maritime transport and inland waterway transport sectors.

1. Attached to this Circular are templates for records of inspection and decisions on administrative penalties in the maritime transport and inland waterway transport sectors, including:

a) Nine templates for records of inspection and decisions from HH01 to HH09 on administrative penalties in the maritime transport sector;

b) Twenty templates for records of inspection and decisions from TNĐ01 to TNĐ20 on administrative penalties in the inland waterway transport sector.

2. In addition to the templates for records of inspection and decisions issued together with this Circular, competent authorities may use other templates for records of inspection and decisions issued together with Decree No. 81/2013/NĐ-CP dated July 19, 2013 of the Government detailing certain provisions and measures to enforce the Law on Handling Administrative Violations.

Article 4. Effective date

This Circular takes effect from October 15, 2013.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

The Head of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors General of the Vietnam Maritime Administration, Directors General of the Vietnam Inland Waterways Administration, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
