Regulations on the collection, payment, management, and use of examination fees and license issuance fees for motor vehicle drivers within the People's Public Security Forces

Pursuant to the Road Traffic Law No. 23/2008/QH12 dated November 13, 2008;

Pursuant to the Ordinance on Fees and Charges No. 38/2001/UBTVQH10 dated August 28, 2001;

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Law on Fees and Charges, and Decree No. 24/2006/NĐ-CP dated March 6, 2006 amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002;

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Considering the proposal of the Director of the Tax Policy Department,

The Minister of Finance issues this Circular stipulating the regulations on the collection, payment, management, and use of examination fees and license issuance fees for motor vehicle drivers within the People's Public Security Forces, as follows:

Article 1. Scope of application

Officers and soldiers currently serving in the Public Security sector who request to take driving examinations for motor vehicles at units under the People's Public Security Forces and are examined and issued driver's licenses by these units must pay examination fees and license issuance fees according to the provisions of this Circular, except for students specializing in Traffic Police and Firefighting from Public Security academies who learn to drive as part of their training programs of the Ministry of Public Security.

Article 2. Level of Collection of Fees and Taxes

1. The amount of examination fees for driving tests shall be regulated as follows:

a) For motorcycle driving tests (categories A1, A2, A3, A4): - Theory test: VND 40,000 per test - Practical test: VND 50,000 per test

b) For automobile driving tests (categories B1, B2, C, D, E, F):

- Theory test: VND 90,000 per test

- Practical test in simulated conditions: VND 300,000 per test

- Practical test on public roads: VND 60,000 per test.

c) Individuals taking driving tests for any portion of a driver's license must pay examination fees for that portion (based on each test: first-time test, upgrade test, retest).

2. The amount of license issuance fees is VND 30,000 per issuance (new issuance, renewal, replacement, reissuance).

Article 3. Management and Use of Fees and Charges

1. The agencies and units managing driving tests and issuing driver's licenses are the entities collecting examination fees and license issuance fees.

2. Examination fees and license issuance fees are revenue items belonging to the state budget. The entities collecting examination fees and license issuance fees are entitled to retain 65% of the collected examination fees to cover costs related to organizing driving tests, issuing driver's licenses, and collecting examination fees and license issuance fees (including rental fees for testing centers if applicable).

The entities collecting examination fees and license issuance fees shall remit 35% of the collected examination fees and 100% of the collected license issuance fees into the state budget according to the current State Budget Classification.

Article 4. Organization of Implementation

1. This Circular takes effect from May 5, 2013.

2. Other matters related to registration, declaration, collection, payment, management, use, and disclosure of examination fee and license issuance fee regulations for motor vehicle drivers within the Public Security sector not specified in this Circular shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges, Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002, Circular No. 28/2011/TT-BTC dated February 28, 2011 of the Ministry of Finance guiding the implementation of certain articles of the Law on Tax Administration, guiding the implementation of Decree No. 85/2007/NĐ-CP dated May 25, 2007 and Decree No. 106/2010/NĐ-CP dated October 28, 2010 of the Government, Circular No. 153/2012/TT-BTC dated September 17, 2012 of the Ministry of Finance guiding the printing, issuance, management, and use of various types of receipts for fee and charge payments belonging to the state budget, and any subsequent amendments and supplements (if any).

3. In the course of implementation, if there are any difficulties, agencies, organizations, and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance./.
