Pursuant to Decree No. 20/2013/NĐ-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decree No. 08/2014/NĐ-CP dated January 27, 2014 of the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology;

Pursuant to Decision No. 2075/QĐ-TTg dated November 8, 2013 of the Prime Minister approving the Science and Technology Market Development Program until 2020;

At the proposal of the Director of the Market Development and Science and Technology Enterprise Department and the Legal Affairs Department;

||| The Minister of Science and Technology issues the Circular to provide for management of the Program on developing the science and technology market until 2020.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular provides for management of the Program on developing the science and technology market until 2020 (hereinafter referred to as the Program) approved by Decision No. 2075/QĐ-TTg dated November 8, 2013 of the Prime Minister.

2. This Circular applies to organizations and individuals participating in implementing and managing the Program and other organizations and individuals related thereto.

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

1. Science and technology market is a legal, investment, and trade environment promoting transaction, exchange, and purchase-sale relationships of science and technology products and services operated with state guidance, regulation, and support.

2. Intermediary organization of the science and technology market (hereinafter referred to as intermediary organization) is an organization prescribed in Clause 2, Clause 3 of Article 1 and has functions prescribed in Article 3 of Circular No. 16/2014/TT-BKHCN dated June 13, 2014 of the Minister of Science and Technology on conditions for establishment and operation of intermediary organizations of the science and technology market.

3. Promoting the development of the science and technology market is an activity to promote, seek opportunities, support transactions, exchanges, and purchase-sale of science and technology products and services through forms such as trade fairs, exhibitions, technology demonstrations, and introductions of domestic and foreign organizations.

4. Organization Organization in charge of implementing tasks under the Program (hereinafter referred to as the organization in charge) is an organization approved by competent authority to undertake the implementation of tasks under the Program.

5. Unit managing the tasks of the Program is the Market Development and Science and Technology Enterprise Department under the Ministry of Science and Technology.

6. Unit managing financial resources for implementing tasks of the Program is the Office of National Science and Technology Programs (hereinafter referred to as the Office of National Programs) under the Ministry of Science and Technology.

7. Steering Committee for the Program on Developing the Science and Technology Market until 2020 (hereinafter referred to as the Steering Committee) is an advisory body assisting the Minister of Science and Technology in determining directions, goals, and main contents of tasks of the Program in each stage.

Article 3. Scientific and technological tasks under the Program

1. Scientific and technological tasks under the Program (hereinafter referred to as tasks under the Program) aim to support the following main activities:

a) Researching and perfecting, organizing effectively policies and laws to promote the development of the science and technology market;

b) Building and enhancing the capacity of the intermediary organization network;

c) Exploiting, developing, and connecting supply and demand for technology;

d) Linking and cooperating in commercializing research results and intellectual property to serve production and business;

đ) Enhancing social awareness and training human resources to support the development of the science and technology market.

2. Tasks under the Program are expressed in the following forms:

a) Scientific projects, scientific and technological research topics proposing to build, amend, supplement, and perfect mechanisms and policies for developing the science and technology market, improving state management capacity over the science and technology market;

b) Scientific and technological projects promoting supply-demand relations for technology, enhancing intermediary organization capacity, and developing science and technology services;

c) Activities supporting the commercialization of research results and intellectual property of students, talented young scientists, potential young research groups, research institutions, and training centers:

- Preparing application files for intellectual property registration for research results and technological solutions with commercialization potential, provided that the applications are accepted validly;

- Formulating income distribution plans in rights transfer, assignment, licensing, and capital contribution with the value of research results and intellectual property, provided that they are approved by relevant parties.

Organizations and individuals conducting activities supporting the commercialization of research results and intellectual property must comply with the requirements stipulated herein without having to go through the procedures for identifying and implementing tasks prescribed in Chapter III of this Circular and are permitted to directly settle accounts with the Office of National Programs according to the Joint Circular of the Ministry of Finance and the Ministry of Science and Technology on financial management of the Program.

3. Management activities of the Program include:

a) Activities of the Steering Committee; management and implementation activities of the Program by the Market Development and Science and Technology Enterprise Department, the Office of National Programs, and functional units under the Ministry of Science and Technology;

b) Communication, training, guiding submission procedures, project proposal preparation; surveying, evaluating, and recommending potential projects;

c) Organizing inspection, evaluation of task implementation; organizing meetings, conferences, seminars, mid-term and final reviews; preparing review reports; soliciting opinions on the Program;

d) Organizing programs for field visits, practical surveys, and learning experiences from successful and exemplary models of science and technology market development both domestically and internationally;

đ) Other activities in managing and implementing the Program.

Article 4. Investment projects under the Program

1. Procedures for appraisal, organization of implementation, adjustment of content and progress, acceptance, settlement of accounts, and reporting on the results of implementation of tasks related to investment construction projects to enhance the scientific and technological capacity of public technology trading floors, local technology trading centers, and other public intermediary organizations shall be carried out in accordance with current laws.

2. The organization responsible for implementing the tasks specified in Clause 1 of this Article shall be responsible for submitting reports on the results of task implementation to the Department of Market Development and Science and Technology Enterprises for consolidation and reporting to the Minister of Science and Technology.

Article 5. General Principles for Determining Tasks Under the Program

The determination of tasks under the Program shall follow the following principles:

1. Having content consistent with the general tasks of the Program as stipulated in Decision No. 2075/QD-TTg dated November 8, 2013 of the Prime Minister approving the Program for developing the science and technology market until 2020.

2. Having clear and specific objectives and having a positive impact on technological transaction growth and the development of the science and technology market.

3. Being feasible, wherein the organization responsible for implementing the task must meet necessary conditions regarding professional capacity, material infrastructure, and finance to ensure the implementation of the task.

4. Content of activities that have been funded from other state budget sources shall not be considered for state budget funding under the Program task.

Article 6. Task Code under the Program

The Office of National Programs shall record the task code under the Program when receiving registration files for selection and direct assignment of tasks as stipulated in Clause 3 of Article 17 of this Circular according to the following provisions:

TTKHCN.DA.XX-YY;

TTKHCN.ĐT.XX-YY;

TTKHCN.ĐA.XX-YY;

Where:

TTKHCN is the symbol of the Program;

DA is the symbol for registration files in the form of projects;

ĐT is the symbol for registration files in the form of research topics;

ĐA is the symbol for registration files in the form of project plans;

XX is the serial number of the registration file;

YY is the year of receipt of the registration file;

Example: TTKHCN.DA.01-2015 to indicate the registration file in the form of project number 01 received in 2015 under the Program for developing the science and technology market until 2020.

Chapter II

CRITERIA, CONDITIONS FOR SELECTION, CONTENT OF SUPPORT

Article 7. Scientific Project, Scientific and Technological Topic under the Program

1. Criteria and Conditions for Selection

a) Organizations with functions and tasks related to the development of the science and technology market;

b) Objectives, contents, and research products consistent with the objectives and contents of the Program tasks;

c) Having a team of experts with research capabilities and proposing feasible solutions for practical issues to develop the science and technology market.

a) Supporting agricultural and forestry extension activities, providing plant and animal seeds; supporting small-scale processing equipment;

a) Researching and building, perfecting policies and laws on management mechanisms, functions of administrative bodies serving the development of the science and technology market;

b) Researching and proposing measures to strengthen the enforcement of intellectual property rights, protect the legitimate rights and interests of subjects participating in technological transactions;

c) Researching and building a system of standards, criteria, and indicators to serve investigations, surveys, statistics, reports, and evaluations of supply and demand for technology;

d) Researching and building planning, perfecting mechanisms and policies to develop intermediary organizations' network, encouraging the development of science and technology services;

đ) Researching and building training programs, enhancing professional knowledge, raising awareness about the science and technology market;

e) Researching and proposing solutions to promote supply-demand relationships for technology, improving the effectiveness of intermediary organizations' operations;

g) Researching and proposing public-private partnership mechanisms, collaboration between scientific research and technology development organizations and enterprises, investors, consultants to promote the commercialization of scientific research outcomes and technological assets;

h) Researching and innovating the operation of the science and technology fund system; building mechanisms and policies to develop venture capital funds to serve the commercialization of scientific research outcomes and technological assets;

i) Researching and innovating procedures and formalities for registering and operating science and technology service organizations;

k) Researching and building coordination mechanisms, enhancing management and organizational capacity to implement Program tasks.

Article 8. Investment projects for constructing technology trading floors and technology trading centers

Criteria, conditions for selection and content of support for national technology trading floors and technology trading centers in Hanoi, Ho Chi Minh City, Da Nang, regional technology trading floors, public technology trading centers under provinces and centrally governed cities shall be implemented in accordance with current laws on investment development projects.

Article 9. Projects to establish and develop intermediary organizations

1. Criteria and Conditions for Selection

a) For established organizations, they must have a Certificate of Registration for Scientific and Technological Activities with intermediary functions as prescribed in Circular No. 16/2014/TT-BKHCN dated June 13, 2014 of the Minister of Science and Technology on conditions for establishment and operation of intermediary organizations in the science and technology market, and meet the conditions stipulated in Points c and d of this Clause;

b) For projects to establish intermediary organizations, they must provide documentation proving their ability to meet the conditions stipulated in Circular No. 16/2014/TT-BKHCN dated June 13, 2014 of the Minister of Science and Technology on conditions for establishment and operation of intermediary organizations in the science and technology market, and meet the conditions stipulated in Points c and d of this Clause;

Have a network of consulting experts and potential partner relationships to effectively perform the functions and tasks of intermediary organizations;

Have a business plan, approach plan to efficiently exploit technology supply and demand sources;

a) Supporting agricultural and forestry extension activities, providing plant and animal seeds; supporting small-scale processing equipment;

a) Consulting, drafting, and reviewing proposals for establishing and enhancing the capacity of intermediary organizations;

b) Train skills in commercializing research results and developing technology, place orders for technical support services, brokerage, consultation, evaluation, valuation, and appraisal of technology and intellectual property;

c) Training and nurturing knowledge about establishing, managing, and operating intermediary organizations; training specialized personnel for intermediary organizations;

d) Activities within the functions of intermediary organizations in the science and technology market as prescribed in Circular No. 16/2014/TT-BKHCN dated June 13, 2014 of the Minister of Science and Technology on conditions for establishment and operation of intermediary organizations in the science and technology market.

Article 10. Projects to construct technology incubation bases and scientific and technological enterprise incubation bases

1. Criteria, conditions for selection, and content of support for projects to establish technology incubation bases and scientific and technological enterprise incubation bases shall be carried out in accordance with Article 6 of Circular No. 19/2013/TT-BKHCN dated August 15, 2013 of the Minister of Science and Technology guiding management of the Program to Support the Development of Scientific and Technological Enterprises and Public Scientific and Technological Organizations Implementing the Mechanism of Self-Management and Self-Responsibility, and Joint Circular No. 49/TTLT-BTC-BKHCN dated April 23, 2014 of the Ministry of Finance and the Ministry of Science and Technology guiding financial management of the Program to Support the Development of Scientific and Technological Enterprises and Public Scientific and Technological Organizations Implementing the Mechanism of Self-Management and Self-Responsibility.

2. Criteria, conditions for selection, and content of support for investment projects to construct basic infrastructure for public technology incubation bases and scientific and technological enterprise incubation bases shall be carried out in accordance with legal provisions applicable to development investment projects.

3. Criteria, conditions for selection, and content of support for activities of technology incubation bases and scientific and technological enterprise incubation bases that have been established shall be carried out in accordance with Point a of Clause 1 of Article 9 and Clause 2 of Article 9 of this Circular.

Article 11. Project to organize training courses for the cadre and specialist team serving the development of the science and technology market

1. Criteria and Conditions for Selection

An organization with functions and tasks of training and enhancing knowledge related to the development of the science and technology market;

Have a team of staff, experts, and collaborators with professional capabilities suitable for the work of developing the science and technology market;

Have a training program framework and teaching material framework approved or agreed upon by the Ministry of Science and Technology, suitable for the purposes and practical needs of the trainees;

a) Supporting agricultural and forestry extension activities, providing plant and animal seeds; supporting small-scale processing equipment;

Conduct training, enhancement, and workshops both domestically and internationally, and online training on management, organization, and operation skills for activities to develop the science and technology market;

Conduct training, enhancement, and workshops both domestically and internationally, and online training on specialized professional skills serving the work of developing the science and technology market;

Compile and publish technical materials, model materials, guidance materials for technology transactions, commercialization of research results and technological development, intellectual property; provide and guide the exploitation of technology information, research results and technological development, intellectual property;

Develop and organize the implementation of exchange programs for experts and interns to share experiences in commercializing research results and technological development, intellectual property between domestic and foreign research institutions and training institutions.

Article 12. Project to assess technology needs and supply capacity

1. Criteria and Conditions for Selection

a) An organization with the function and mission of assessing technology needs and supply capacity;

b) Having a team of specialized staff or being linked and cooperating with organizations that have a team of specialized staff capable of assessing technology needs and supply capacity;

c) Determining appropriate criteria for assessment consistent with the purpose of the assessment;

d) Proposing feasible and suitable methods for assessing technology supply capacity and demand characteristics.

a) Supporting agricultural and forestry extension activities, providing plant and animal seeds; supporting small-scale processing equipment;

a) Searching and selecting technology and technology information from databases and electronic information networks according to orders for technology supply and demand;

b) Building, maintaining, and developing databases on technology supply sources and demand, and connecting supply and demand for technology;

c) Establishing, maintaining, and developing channels for consulting information, electronic portals for technology transactions (including online techmarts), commercializing scientific research results and technological development, intellectual property;

d) Evaluating the capability and exploitation potential of technology supply and demand sources.

Article 13. Project to support the commercialization of scientific research results and technological development, intellectual property

1. Criteria and Conditions for Selection

a) Organizations capable of developing feasible plans, models, and solutions for the commercialization of research results and technological development, intellectual property; or

b) An organization capable of evaluating and determining the value of scientific research results and technological development, intellectual property to serve their commercialization;

a) Supporting agricultural and forestry extension activities, providing plant and animal seeds; supporting small-scale processing equipment;

a) Developing plans for the commercialization of scientific research results and technological development, intellectual property: technology transfer; investment in technological research and development; nurturing technology; nurturing science and technology enterprises; establishing, contributing capital to establish science and technology enterprises; application in production and business; providing public services for community benefits and social security;

b) Developing plans for evaluating and pricing scientific research results and technological development, intellectual property to serve activities specified in Point a Clause of this Article.

Article 14. Project to promote the development of the science and technology market

1. Criteria and Conditions for Selection

a) An organization with the function and mission of implementing activities to promote the development of the science and technology market;

b) Having a team of specialized staff capable of implementing activities to promote the development of the science and technology market;

c) Having specific activity plans and ensuring resources to implement the project;

d) Determining methods and measures to meet the development needs of the science and technology market.

a) Supporting agricultural and forestry extension activities, providing plant and animal seeds; supporting small-scale processing equipment;

a) Investigating, surveying, researching the market, collecting information, identifying potential targets for promoting the development of the science and technology market;

b) Organizing or participating in technology and equipment markets (Techmart), technology supply-demand connection demonstrations (Techdemo), seminars and exhibitions introducing scientific research and technological development results of research and training institutions (Innovation Showcase), technology commercialization investment days (Demo Day), startup days (Startup Day), innovation days (Innovation Day), invention exhibitions, potential commercialization technology product exhibitions (Techshow) both domestically and internationally, including the following activities:

- Activities of consultant advisors, artistic design, overall decoration, sound and lighting techniques;

- Opening ceremony, activities of the host, technical support;

- Activities of participants, including travel, accommodation, transportation of equipment, samples, models;

- Activities of the organizing committee, advisory board, award committee, consultant advisors, independent scientists, exhibitors, other event participants;

- Communication and promotion through mass media; creating electronic data to promote events;

- Printing necessary materials (brochures, catalogs, invitations...);

- Translation; organizing scientific and technological seminars;

- Renting space (including security, protection, electricity and water); setting up booths; displaying products;

- Awards (certificates of merit, certificates of appreciation, plaques, commemorative medals); organizing award ceremonies;

- Other necessary activities.

c) Advising, introducing, promoting, and facilitating the commercialization of scientific research results and technological development, intellectual property of students, young talented scientists, young research groups, potential startup groups; building and perfecting production and business models, marketing, and commercialization plans for scientific research results and technological development, intellectual property;

d) Advising, introducing, promoting, and facilitating the commercialization of new technologies and products created from new technologies of science and technology organizations, science and technology enterprises, individual researchers in science and technology.

Article 15. Science and Technology Market Development Communication Project

1. Criteria and Conditions for Selection

a) An organization with functions and tasks to implement communication activities for developing the science and technology market;

b) Having a team of staff and collaborators with specialized expertise to carry out communication activities for developing the science and technology market;

c) Accurately identifying needs, having specific goals, and clear strategic plans for activities;

d) Determining methods, anticipating the effectiveness of communication activities; innovative communication approaches.

a) Supporting agricultural and forestry extension activities, providing plant and animal seeds; supporting small-scale processing equipment;

a) Developing scripts, collecting information, implementing the professional content of the communication program (including radio programs, television programs, documentaries, games, seminars) on innovation, investment linkage for research and application of technology, promoting technology transfer, commercializing scientific research results and technological development, intellectual property;

b) Honoring and rewarding outstanding organizations and individuals in innovation, promoting technology transfer, commercializing scientific research results and technological development, intellectual property;

c) Communicating about the implementation of tasks under the Program and other activities to enhance the dissemination effect of the Program.

Chapter III

DETERMINATION AND IMPLEMENTATION OF TASKS

Article Article 16. Determination of Tasks Under the Program

1. Based on the implementation plan of the Program, the Program Director's Board builds the direction, objectives, main content of tasks of the Program in each phase, proposing the Minister of Science and Technology for approval and publication on the Ministry of Science and Technology's electronic portal.

2. The procedures and formalities for determining tasks under the Program shall be carried out in accordance with Circular No. 07/2014/TT-BKHCN dated May 26, 2014, issued by the Minister of Science and Technology, stipulating the procedures and formalities for determining national-level science and technology tasks using state budget funds.

3. The Market Development and Science and Technology Enterprise Development Department is responsible for coordinating with relevant units to establish a scientific and technological advisory board to determine tasks, and if necessary, seek opinions from independent organizations and experts according to regulations; compile proposals for ordering tasks, through the Planning and General Affairs Department of the Ministry of Science and Technology for the Minister of Science and Technology to consider and approve the list of tasks under the Program.

Article 17. Selection and Direct Assignment of Organizations and Individuals to Implement Tasks Under the Program

1. Based on the Decision approving the list of proposed tasks under the Program, the Market Development and Science and Technology Enterprise Development Department coordinates with relevant units to propose the Minister of Science and Technology to establish an advisory board for selection or directly assign implementation of tasks, and if necessary, seek opinions from independent organizations and experts to review the content of the tasks according to regulations.

2. Procedures for establishing an advisory board for selection or direct assignment of implementation of tasks, and procedures for seeking opinions from independent organizations and experts are implemented in accordance with Circular No. 10/2014/TT-BKHCN dated May 30, 2014, issued by the Minister of Science and Technology, stipulating the selection and direct assignment of organizations to implement national-level science and technology tasks using state budget funds, and Circular No. 23/2014/TT-BKHCN dated September 19, 2014, issued by the Minister of Science and Technology, amending and supplementing certain articles of Circular No. 10/2014/TT-BKHCN.

3. The registration dossier for participation in selection or direct assignment of implementation of tasks includes the following documents:

a) Application form for leading the implementation of science and technology tasks (Form B1-1-ĐON);

b) Detailed project proposal (Form B1-2d-TMĐA); Detailed topic proposal (Form B1-2a-TMĐTCN or Form B1-2b-TMĐTXH); Detailed project proposal (Form B1-2c-TMDA);

c) Summary of science and technology activities of the organization applying to lead the science and technology task (Form B1-3-LLTC) and attached with annual activity evaluation results of that science and technology organization (if available);

d) Scientific curriculum vitae of the individual applying to lead the task and other individuals applying to implement the main science and technology task, confirmed by the personnel management agency (Form B1-4-LLCN);

đ) Brief scientific curriculum vitae of foreign experts accompanied by confirmation of expert salary level (in case of hiring foreign experts);

e) Confirmation document of agreement from organizations applying to cooperate in implementing the science and technology task (if applicable) (Form B1-5-PHNC);

g) Document proving the capability of human resources, equipment of the cooperating unit, and the ability to mobilize funds from other sources to implement (in case of cooperation and mobilization of funds from other sources).

Article 18. Organization of Content and Budget Assessment for Tasks under the Program

1. The procedures, files, and forms for assessing the content and budget for tasks under the Program shall be carried out in accordance with Circular No. 10/2014/TT-BKHCN dated May 30, 2014, issued by the Minister of Science and Technology on the selection and direct assignment of organizations to implement national science and technology tasks funded by the state budget, and Circular No. 23/2014/TT-BKHCN dated September 19, 2014, issued by the Minister of Science and Technology amending and supplementing certain provisions of Circular No. 10/2014/TT-BKHCN.

2. In cases where there is disagreement in the assessment of the content or when competent authorities request a re-examination of the content of the task, the capacity, and conditions of the organization proposing to undertake the main responsibility for implementing the task, the Department of Market Development and Science and Technology Enterprises shall conduct procedures to seek opinions from experts and independent consulting organizations regarding related issues before submitting them to the Minister of Science and Technology for consideration.

Article 19. Approval of the Leading Organization for Task Implementation

Based on the results of the content proposal assessment, the capacity, and conditions of the organization proposing to undertake the main responsibility for implementing the task, as well as the opinions of experts and independent consulting organizations (if any), the Department of Market Development and Science and Technology Enterprises shall coordinate with the Office of National Programs through the Planning and Synthesis Department to submit to the Minister of Science and Technology for consideration and approval of the leading organization, content, budget, and time frame for implementing tasks under the Program.

Article 20. Signing of Contracts for Task Implementation

Based on the Decision approving the list of tasks by the Minister of Science and Technology, the Office of National Programs shall coordinate with the Department of Market Development and Science and Technology Enterprises to organize the signing of contracts for task implementation with the leading organization. The form of the contract for task implementation shall follow the guidelines set forth in Circular No. 05/2014/TT-BKHCN dated April 10, 2014, issued by the Minister of Science and Technology promulgating the model contract for scientific research and technological development.

Article 21. Inspection and Evaluation of the Task Implementation Process

The Office of National Programs shall take the lead and coordinate with relevant agencies to organize inspections, supervision, and evaluations of the progress and outcomes of task implementation according to the signed contract in accordance with the regulations of the Ministry of Science and Technology.

Article 22. Adjustment of Content, Budget, and Implementation Schedule

1. For tasks assigned with allocated funds, the leading organization shall, based on the actual requirements of the work, proactively adjust the budget estimates between the allocated funding items within the total allocated budget estimate in compliance with current laws.

2. For tasks not assigned with allocated funds, based on the documents proposed by the leading organization, the Department of Market Development and Science and Technology Enterprises shall coordinate with the Office of National Programs and relevant units to submit to the Minister of Science and Technology for consideration and decision on the adjustment of the content, budget, and implementation schedule of the task in accordance with current regulations.

Article 23. Evaluation, acceptance, and recognition of the results of implementing tasks

1. Self-evaluation of the results of implementing tasks: the organization responsible for implementing the task shall be responsible for self-evaluating the results of implementing the task in accordance with regulations before submitting the evaluation and acceptance dossier to the Market Development and Science and Technology Enterprises Department. The result of self-evaluation is a condition for conducting national-level evaluation and acceptance.

2. National-level evaluation and acceptance: the Market Development and Science and Technology Enterprises Department shall coordinate with the Office of National Programs and relevant units to organize national-level evaluation and acceptance of the results of implementing tasks under the Program.

3. Based on the conclusion of the advisory board for evaluating and accepting the results of implementing tasks, opinions from independent organizations and experts (if any), the Market Development and Science and Technology Enterprises Department shall submit to the Minister of Science and Technology for recognizing the results of implementing tasks under the Program.

4. The procedures for evaluating, accepting, and recognizing the results of implementing tasks under the Program shall be carried out in accordance with Circular No. 11/2014/TT-BKHCN dated May 30, 2014, issued by the Minister of Science and Technology, regarding the evaluation and acceptance of the results of implementing national-level science and technology tasks funded by the state budget.

Article 24. Management of funds, liquidation of contracts, assets, and results of implementing tasks

1. Authority and procedures for managing funds, contents, and budget quotas for state-funded tasks of the Program shall be implemented in accordance with the joint circular between the Ministry of Finance and the Ministry of Science and Technology guiding the financial management of the Program.

2. Procedures for liquidating contracts for implementing tasks, registering, preserving, and managing the results of implementing tasks, intellectual property rights, and other types of assets arising during the implementation of tasks under the Program shall be carried out in accordance with current laws.

Chapter IV

MANAGEMENT OF THE PROGRAM

Article 25. Implementation of the Program

1. The organization and implementation of the Program shall be conducted in accordance with Point b Clause 1 Section IV and Section V, Article 1 of Decision No. 2075/QD-TTg dated November 8, 2013, approving the Program for developing the science and technology market until 2020, issued by the Prime Minister.

2. The Steering Committee of the Program shall be established and operate according to the charter issued by the Minister of Science and Technology.

3. The Market Development and Science and Technology Enterprises Department shall be responsible for organizing the determination of tasks; receiving proposals for tasks; implementing procedures for selecting and directly assigning tasks; organizing national-level evaluation and acceptance of the results of implementing tasks; and performing other assigned tasks related to the management of tasks under the Program.

4. The Office of National Programs shall be responsible for implementing procedures for signing contracts for implementing tasks, disbursing funds, settling accounts for contract implementation funds, and other assigned tasks related to the management of task implementation funds under the Program.

5. The funds for all activities of the Program stipulated in Clauses 1, 2, and 3 of Article 3 of this Circular shall be guaranteed from the annual state scientific and technological affairs fund allocated to the Office of National Programs.

Article 26. Responsibilities of the Ministry of Science and Technology

1. Direct and manage the organization and implementation of the Program according to the division of labor of the Prime Minister in Decision No. 2075/QD-TTg dated November 8, 2013, approving the Program for developing the science and technology market until 2020.

2. Issue guidance documents for organizations to register participation and implementation of the Program.

3. Decide on the establishment of advisory boards for determining tasks, selection, direct assignment; evaluation and acceptance of the results of implementing tasks; approval and assignment of organizations to implement tasks.

4. Approve the content and funding support for tasks of the Program; guide ministries, sectors, and localities to allocate funds for integration and approval, and organize implementation.

5. Approve the content and funding for Program activities to be included in the annual science and technology budget plan.

6. Approve plans, objectives, contents, budget estimates, and progress schedules for tasks under the Program; suspend and cancel contracts for implementing tasks when necessary; handle issues arising from suspended or canceled tasks.

7. Approve final settlement of funds for tasks under the Program and Program activities.

Article 27. Responsibilities of the Market Development and Science and Technology Enterprises Department

1. Carry out assigned tasks related to managing tasks under the Program; coordinate with relevant units to develop budget estimates for managing tasks under the Program; compile a list of proposed tasks; reach consensus with relevant units on adjusting the content and budget through the Planning and General Affairs Department for submission to the Minister of Science and Technology for consideration and decision.

2. Organize procedures related to selecting, directly assigning implementation of tasks, and requesting the Ministry of Science and Technology to approve; organize national-level evaluation and acceptance of tasks under the Program.

3. Lead in preparing periodic reports, mid-term summaries, assessment reports, and final summaries on the implementation of the Program; organize mid-term and final summaries of the Program's activities.

4. Coordinate with functional units to implement regular or spot supervision and inspection of the implementation of tasks under the Program.

5. Propose to the Minister of Science and Technology forms of reward for organizations and individuals who excellently complete tasks and measures to handle organizations and individuals who violate during the implementation of tasks under the Program.

6. Advise and support activities related to granting ownership rights, usage rights, and commercialization of research results and intellectual property created from tasks under the Program; report on the exploitation and utilization of research results and intellectual property generated from tasks under the Program.

7. Develop, maintain, and update information on the implementation of tasks on the Program’s electronic news page; disseminate information about the Program's activities; publicize the results of implementing tasks under the Program.

8. Perform other tasks assigned by the Minister of Science and Technology.

Article 28. Responsibilities of Ministries, Sectors, and Localities

1. Propose tasks under the Program according to relevant management fields; create conditions for organizations to effectively carry out assigned task contents.

2. Allocate funds, manage the organization of implementing task contents under the Program that are integrated with tasks within the jurisdiction of ministries, sectors, and localities.

3. In necessary cases, coordinate with the Ministry of Science and Technology to adjust the objectives, content, budget items, and progress of tasks under the Program that have been approved.

4. Regularly submit reports every six months and annually on the situation, progress, and results of implementing tasks under the Program to the Ministry of Science and Technology for consolidation and reporting to the Prime Minister.

5. Proactively mobilize and utilize state budget from various sources within the scope of authority to ensure the synchronous and effective implementation of tasks.

Article 29. Responsibilities of the Head and Leading Organization Implementing Tasks

1. Build and implement approved contents; be responsible for the progress and results of implementing Program tasks; propose to the Market Development and Science and Technology Enterprises Department issues arising during the implementation of tasks that need resolution.

2. Coordinate with the Market Development and Science and Technology Enterprises Department and National Programs Office in inspecting and supervising the implementation of Program tasks according to set goals, content, and progress.

3. Submit written recommendations to the Market Development and Science and Technology Enterprises Department when it is necessary to adjust the objectives, content, and progress of Program tasks to meet practical requirements.

4. Fully comply with regular and extraordinary reporting systems on the implementation of Program tasks (every six months, annually, mid-term, final) and final budget reports to the National Programs Office.

5. The task leader is responsible to the organization mainly implementing the task for organizing the implementation of the task and the results of the task implementation according to the agreement with the main implementing organization.

Chapter V

IMPLEMENTING PROVISIONS

Article 30. Effective Date

1. This Circular takes effect from December 25, 2014.

2. In case the legal normative documents cited in this Circular are amended, supplemented, or replaced by new legal normative documents, the new documents shall apply.

3. In the course of implementation, if there are difficulties, agencies, organizations, and individuals are requested to report to the Ministry of Science and Technology for research and consideration to amend and supplement appropriately./.
