Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 158/2007/NĐ-CP dated October 27, 2007 of the Government stipulating the list of job positions and periodic rotation terms for job positions for cadres, civil servants, and public officials; Decree No. 150/2013/NĐ-CP dated November 1, 2013 of the Government amending and supplementing certain articles of Decree No. 158/2007/NĐ-CP;

At the proposal of the Director of the Cadre and Civil Servant Organization Department;

The Minister of Agriculture and Rural Development issues this Circular stipulating the list of job positions and periodic rotation terms for job positions for civil servants and public officials in the agriculture and rural development sector.

Article 1. Scope of Regulation and Applicability

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

This Circular stipulates the list of job positions and periodic rotation terms for job positions at agencies and units under the agriculture and rural development sector.

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

This Circular applies to civil servants and public officials who do not hold leadership or management positions at agencies and units under the agriculture and rural development sector.

Article 2. Principles, contents, forms, and responsibilities for implementing periodic job position rotations

Principles, contents, forms, and responsibilities for implementing periodic job position rotations shall be carried out in accordance with Decree No. 158/2007/NĐ-CP and Decree No. 150/2013/NĐ-CP.

Article 3. List of job positions subject to periodic rotation

1. In the field of agriculture: Job positions performing the review of applications for issuance, reissuance, extension, and revocation of various types of permits, certificates, confirmation letters, diplomas, and certificates include:

a) Permits and certificates for plant quarantine; animal quarantine, animal products quarantine (including aquatic products);

b) Import permits for crop varieties not listed in the approved crop variety production and trading directory in Vietnam; certificates of protection for crop varieties; certificates of practice for representing rights over crop varieties; certificates recognizing crop varieties permitted for production, trading, and use in Vietnam;

c) Import permits for fertilizers; certificates of free circulation for exported crop varieties and fertilizers; certificates recognizing fertilizers permitted for production, trading, and use in Vietnam;

d) Testing permits for plant protection chemicals; import permits for plant protection chemicals; certificates of eligibility for plant protection chemical production; certificates of eligibility for plant protection chemical trade; registration certificates for plant protection chemicals;

đ) Permits and certificates in the field of livestock breeding, feed, and livestock farming environment;

e) Import permits for veterinary drugs, raw materials for veterinary drugs, and vaccines; testing permits for veterinary drugs; certificates of veterinary hygiene eligibility; certificates of veterinary drug circulation; veterinary practice certificates;

g) Certificates of food safety for establishments; food safety certificates (certificates); recognition of enterprises permitted to export goods of animal origin into Vietnam within the authority of the Ministry of Agriculture and Rural Development.

2. In the forestry field:

a) Job positions performing the issuance, reissuance, extension, and revocation of various types of permits, certificates, and certificates in the forestry field including: Permits for logging, harvesting wood and non-timber forest products; export and import permits and certificates for wildlife specimens;

b) Job positions in the Forest Rangers force including: Special Forest Ranger; mobile and firefighting Forest Rangers; Forest Rangers at forest gate stations; Forest Ranger stations in protective and special-use forests.

3. In the fisheries field: Job positions performing the review of applications for issuance, reissuance, extension, and revocation of various types of permits, certificates, confirmation letters, and certificates include:

a) Permits for fishing activities and operations in national or territorial waters of other countries;

b) Import permits for fish seedlings, fish feed, and environmental treatment and improvement products for trial, research, and exhibition; notifications of imported fish seedling quality; confirmations of fish feed; notifications of results of imported environmental treatment and improvement product quality checks; recognitions of fish feed; certificates of free circulation for environmental treatment and improvement products permitted for circulation in Vietnam; confirmations of raw materials for fishing; certificates of fishing; certificates of origin for mollusks;

c) Registration certificates for fishing vessels and floating fish farms; technical safety certificates for fishing vessels and floating fish farms;

d) Certificates for fishing vessel captains and chief engineers;

đ) Designation documents for laboratories and testing facilities; recognitions of establishments participating in the export seafood certification program according to each market.

4. In the water resources field: Job positions performing the review of applications for issuance, reissuance, extension, and revocation of various types of permits include:

a) Permits for activities within the protected area of waterworks;

b) Permits for discharging wastewater into waterworks systems.

Article 4. Periodic rotation term for job positions.

The periodic rotation term for job positions specified in Article 3 of this Circular is three years (36 months).

Article 5. Implementation Provisions

1. This Circular takes effect from December 1, 2015. The Decision No. 3486/QĐ-BNN-TCCB dated November 5, 2008 of the Minister of Agriculture and Rural Development promulgating the list of job positions in the agriculture and rural development sector that must undergo periodic rotation is hereby abolished.

2. Heads of agencies and units under the agriculture and rural development sector are responsible for developing plans and organizing the implementation of periodic job position rotations for civil servants and public officials under their jurisdiction; they must compile and report to the Ministry of Agriculture and Rural Development the results of implementation before November 15 each year.

Clause 2. In the course of implementation, if there are difficulties, agencies and units shall reflect them to the Ministry of Agriculture and Rural Development for consideration and resolution./.
