Chapter II

SPECIFIC CRITERIA

Article 4. Standards for Competence and Work Experience

1. Director of the Department of Health

a) Having leadership and management capabilities, effectively implementing the Party’s policies and the State’s laws on health work at the local level, and having financial, human resource, and infrastructure management skills;

b) Having forecasting, strategic thinking, development orientation, and practical summarization abilities;

c) Having advisory and policy-making capabilities, including planning and developing health policies at the local level for approval by competent authorities;

d) Having research capabilities, leading projects, proposing initiatives, solutions, and management methods, and implementing the Party’s policies, State laws, and local regulations and Ministry of Health directives on health work under local conditions;

đ) Having organizational and operational capabilities for health sector activities; coordinating with relevant levels, agencies, organizations, and individuals to effectively perform assigned tasks;

e) Having served in the position of Deputy Director of the Department of Health or Director of central, provincial, or district-level public health institutions, or as head or deputy head of specialized agencies under the People's Committee at the provincial level, or as Secretary or Chairman of the People's Committee at the district level for at least two years. For those serving as head or deputy head of specialized agencies under the People's Committee at the provincial level, or as Secretary, Deputy Secretary, Chairman, or Vice-Chairman of the People's Committee at the district level, they must meet the professional standards in health.

2. Deputy Director of the Department of Health

a) Having leadership and management capabilities, effectively implementing the Party’s policies and the State’s laws on health work at the local level, and having management skills in the assigned field;

b) Having forecasting, strategic thinking, development orientation, and practical summarization abilities;

c) Having advisory and policy-making capabilities, including planning and developing health policies at the local level for approval by competent authorities;

d) Having research capabilities, leading or participating in projects, proposing initiatives, solutions, and management methods, and implementing the Party’s policies, State laws, and local regulations and Ministry of Health directives on health work under local conditions;

đ) Having organizational and operational capabilities for health sector activities; coordinating with relevant levels, agencies, organizations, and individuals to effectively perform assigned tasks;

e) Having served in the position of Head of a Department under the Department of Health, or Director or Deputy Director of central, provincial, or district-level public health institutions, or as head or deputy head of specialized agencies under the People's Committee at the provincial level, or as Secretary, Deputy Secretary, Chairman, or Vice-Chairman of the People's Committee at the district level for at least three years. For those serving as head or deputy head of specialized agencies under the People's Committee at the provincial level, or as Secretary, Deputy Secretary, Chairman, or Vice-Chairman of the People's Committee at the district level, they must meet the professional standards in health.

Article 5. Regarding Qualifications

1. Director of the Department of Health

a) Having postgraduate qualifications in medicine, pharmacy, public health, or healthcare management; preference given to those who have graduated in medicine;

b) Currently holding the rank of Senior Specialist or equivalent;

c) Graduating from advanced political theory training programs, senior civil service management training programs; possessing certificates for completing training and upgrading programs on healthcare management for department directors;

d) Proficient in at least one common foreign language: English, Russian, French, German, Chinese, at least intermediate level; for provinces with a majority ethnic minority population, this can be substituted by the ethnic minority language;

đ) Having computer proficiency for application in management, operation, and professional work.

2. Deputy Director of the Department of Health

a) Having postgraduate qualifications in one of the following fields: medicine, pharmacy, or another relevant field suitable for the assigned work area;

b) Currently holding the rank of Senior Specialist or equivalent;

c) Completion of advanced political theory training programs, state administrative management training programs at the level of Senior Specialist or higher; holding a certificate of completion of health management training programs for provincial Health Department leaders or a certificate of completion of population and family planning business training programs for Deputy Directors of the Provincial Health Departments responsible for population and family planning;

d) Proficiency in at least one common foreign language: English, Russian, French, German, Chinese at a minimum level of Elementary Level 3 or higher; for provinces with a majority of ethnic minority populations, proficiency in the ethnic minority language may be substituted;

đ) Having computer proficiency for application in management, operation, and professional work.

Article 6. Other criteria

1. Possessing sufficient health to work effectively, meeting the requirements and tasks assigned.

2. The age limit for initial appointment to the positions of Director and Deputy Director of the Provincial Health Department shall not exceed fifty-five years old for males and fifty years old for females.

3. In special cases, the decision shall be made by the competent authority upon consideration.

IMPLEMENTING PROVISIONS

Article 7. Effective Date

1. This Circular takes effect from December 2, 2015.

2. Decision No. 587/BYT/QD dated July 23, 1994 of the Minister of Health on the professional standards of Provincial Health Department Directors and Deputy Directors of centrally governed cities shall cease to be effective from the date this Circular takes effect.

Article 8. Responsibility for Implementation

Chairmen of People's Committees of centrally governed cities, Directors of Provincial Health Departments of centrally governed cities, Heads of the Cadre Organization Department of the Ministry of Health, and relevant organizations and individuals are responsible for implementing this Circular./.
