CIRCULAR

Issuing certain economic and technical norms

 to serve the preparation of social welfare train operation plans 

Pursuant to the Railway Law dated June 16, 2017;

Pursuant to Decree No. 65/2018/NĐ-CP dated May 12, 2018 of the Government detailing the implementation of certain provisions of the Railway Law; Decree No. 01/2022/NĐ-CP dated January 4, 2022 of the Government amending and supplementing certain provisions of Decree No. 65/2018/NĐ-CP dated May 12, 2018 of the Government detailing the implementation of certain provisions of the Railway Law;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering or tendering for the provision of products and services using state budget funds from regular expenditure;

On the basis of Government Decree No. Pursuant to Decree No. 56/2022/NĐ-CP dated August 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Transport Department and the Director of the Vietnam Railway Administration;

The Minister of Transport hereby issues this Circular. issues detailed information in the system, economic and technical norms to serve the preparation of social welfare train operation plans.

Article 1. Attached to this Circular are certain economic and technical norms to serve the preparation of social welfare train operation plans.

Article 2. Scope of Regulation

This Circular applies to the preparation and review of social welfare train operation plans on the Gia Lam - Quan Trieu and Gia Lam - Dong Dang railway lines.

Article 3. Applicability

This Circular applies to organizations and individuals related to the preparation, review, and implementation of social welfare train operation plans on the Gia Lam - Quan Trieu and Gia Lam - Dong Dang railway lines.

Article 4. Responsibilities of relevant organizations

1. Railway infrastructure business enterprises and railway transport business enterprises shall annually (2024-2026) be responsible for compiling, statistics, reviewing, and breaking down costs related to the organization of social welfare train operations and submitting them to the Vietnam Railway Administration for review, monitoring, and compilation.

2. The Vietnam Railway Administration shall take the lead and coordinate with railway infrastructure business enterprises and railway transport business enterprises to be responsible for summarizing and evaluating the pilot work over three years of implementation (2024-2026) to serve as a basis for proposing the issuance of economic and technical norms to organize social welfare train operations applicable in subsequent years.

3. The Transport Department shall be responsible for monitoring and urging units to implement the provisions of Clause 1 and Clause 2 of this Article, and promptly reporting to the Ministry of Transport any issues arising or difficulties encountered.

Article 5. Implementation Provisions

1. This Circular shall be piloted from February 1, 2023 to February 1, 2028.

2. The Director of the Ministry's Office, the Inspector General, the Heads of Departments, the Director of the Vietnam Railway Administration, the Heads of agencies and units, and individuals concerned shall be responsible for implementing this Circular./.
