OF THE MINISTRY OF LABOR, INVALIDS AND SOCIAL AFFAIRS
Guidelines for implementing the system of salary left for family members for state officials, workers, and employees going abroad on official business, work, or study
Implementing Article 6 of Decision No. 574/TTg dated November 25, 1993 of the Prime Minister regarding the supplementation of certain systems for civil servants, administrative and public service staff, armed forces personnel, and social policy beneficiaries, the Ministry of Labor, Invalids, and Social Affairs provides guidelines for implementing the system of salary left for family members for state officials, workers, and employees, as well as those receiving salaries in the armed forces who go abroad on official business, work, or study as follows:
1. Subjects eligible for the salary left for family members system
State officials, workers, and employees (including Party and mass organizations) working at Vietnam's representative offices abroad (diplomatic, permanent, military attaché, press, radio and television, news agency, labor management...), and workers and staff working at international organizations who receive living expenses allowances in foreign currency subsidized by the State.
I. OBJECTS
State officials, workers, and employees (including Party and mass organizations), and armed forces personnel sent to study, intern, or as research fellows abroad.
2. Subjects not eligible for the salary left for family members system
State officials, workers, and employees, and other workers with temporary employment abroad under Decree No. 370/HĐBT dated November 9, 1991.
State officials, workers, and employees, and armed forces personnel sent to work as experts, consultants, or in other capacities abroad, receiving salaries funded by foreign countries or international organizations.
State officials, workers, and employees sent to study, intern, or as research fellows abroad beyond the prescribed period without permission from the competent authority, or going abroad on personal wishes and self-funding all expenses.
State officials, workers, and employees permitted by the State to visit relatives or handle personal matters abroad.
II. SALARY LEFT FOR FAMILY MEMBERS
The subjects mentioned in Point 1, Item 1 above shall leave 40% of their salary according to their rank and grade on the salary scale and wage table stipulated in Decrees No. 25/CP and 26/CP, and the retention differential coefficient (if applicable) pursuant to Circular No. 25/LB-TT dated September 13, 1993 of the Joint Ministry of Labor, Invalids, and Social Affairs - Government Organizational and Cadre Department - Finance (excluding additional salary allowances).
For example, a department head receiving a professional salary level with a salary coefficient of 3.91, with a monthly salary of 262,000 dong from April 1, 1993, going on long-term official business abroad, will have a monthly salary left for family members of 262,000 dong x 40% = 104,800 dong/month.
State officials, workers, and employees, and armed forces personnel receiving salaries where they are assigned shall be calculated and paid the salary left for family members there.
This Circular takes effect from April 1, 1993. Any previous regulations contrary to this Circular are hereby abolished.
During implementation, if there are any difficulties, please report them to the Ministry of Labor, Invalids, and Social Affairs for consideration and resolution./.
III. IMPLEMENTATION PROVISIONS
State officials, workers, and civil servants who are assigned to work elsewhere shall have their salaries calculated and paid by the assigning entity.
This Circular takes effect from April 1, 1993. Previous regulations that conflict with this Circular are hereby abolished.
During implementation, any difficulties should be reported to the Ministry of Labor - Invalids and Social Affairs for study and resolution./.
