On the Functions, Duties, Authorities, and Organizational Structure of the Science and Technology Department

THE MINISTER OF POST AND TELECOMMUNICATIONS

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

At the proposal of the Director of the Organization and Cadres Department and the Director of the Science and Technology Department,

Article 1. The Science and Technology Department is the advisory body assisting the Minister in performing state management functions in the fields of research, development, and application of science and technology, environmental protection related to postal services, telecommunications, information technology, electronics, Internet, broadcasting, radio frequency, and information infrastructure (hereinafter referred to collectively as postal services, telecommunications, and information technology); applying information technology to serve state management and socio-economic development.

Article 2. The Science and Technology Department has the following duties and authorities:

1. To take the lead in drafting legal normative documents on science management, standards, and quality in the fields of postal services, telecommunications, and information technology.

2. To manage state affairs in the field of information technology application.

3. To organize the development of policies, strategies, orientations, planning, projects, and regulations in the field of scientific research and application of science and technology related to postal services, telecommunications, and information technology;

4. To organize the development of regulations on standard management, measurement, and quality; standards and norms for equipment, software products, networks, services, and construction works in postal services, telecommunications, and information technology; to guide and inspect the implementation thereof.

5. To organize the development of orientations, mechanisms, policies, and plans for scientific research and information technology application to serve state management and socio-economic development. To guide and inspect the implementation thereof.

6. To manage registration, establishment, and submission for approval of research science plans; to guide implementation and organize appraisal of scientific and technological research topics, application of technical progress at the ministerial level in postal services, telecommunications, and information technology.

7. To guide and inspect the implementation of policies, plans, programs for research and application of scientific and technological progress in postal services, telecommunications, and information technology;

8. To manage standardization, measurement, and quality work of the Ministry; to guide the implementation of standards and norms for equipment, software products, networks, services, and construction works in postal services, telecommunications, and information technology; to guide and manage measurement work in postal services, telecommunications, and information technology; to guide the implementation of quality management work for equipment, software products, networks, services, and construction works in postal services, telecommunications, and information technology; to develop orientations and guide the application of quality management systems for postal services, telecommunications, and information technology products and services. To take the lead in organizing and guiding participation in international mutual recognition agreements regarding conformity certification in the fields of postal services, telecommunications, and information technology.

9. To manage intellectual property activities, industrial property rights, and environmental protection in postal services, telecommunications, and information technology;

10. To participate in implementing information technology development programs.

11. To be the permanent member of the Science and Technology Council and the Council for Examination and Recognition of Industrial Property Rights, Intellectual Property Rights, and Scientific and Technological Innovation Initiatives of the Ministry.

12. To study, propose, and participate in international cooperation activities on science and technology and standardization in the fields of postal services, telecommunications, and information technology.

13. To participate in reviewing investment projects in the field of science and technology in postal services, telecommunications, and information technology; planning and economic and social development plans, technology transfer contracts, and foreign projects.

14. To manage the activities of associations and non-governmental organizations in the field of science and technology according to the division of labor by the Minister.

15. To propose, organize, and participate with other ministries and sectors in science and technology activities related to postal services, telecommunications, and information technology.

16. To manage scientific and technological information work in postal services, telecommunications, and information technology.

17. To participate in researching and providing comments on draft normative legal documents of other ministries and sectors concerning the field of science and technology.

18. To manage organizational structure, cadres, civil servants, experts, documents, and assets of the Department in accordance with the law and the division of labor by the Minister.

19. Performing other tasks assigned by the Minister.

Article 3. The Science and Technology Department is headed by the Director and includes Deputy Directors, specialized staff, civil servants, and experts.

The Director is responsible to the Minister for the results of performing the functions, duties, and authorities stipulated in Article 1 and Article 2 of this Decision. Deputy Directors assist the Director and are responsible to the Director for the tasks assigned to them. The duties and authorities of staff, civil servants, and experts within the Department are defined by the Director.

Article 4. This Decision takes effect from the date of signature. All previous provisions contrary to this Decision are abolished.

Article 5. The Head of the Office, the Director of the Organization and Cadres Department, the Director of the Science and Technology Department, and the Heads of agencies and units under the Ministry of Posts and Telecommunications are responsible for implementing this Decision.
