GUIDELINES FOR IMPLEMENTING CERTAIN ARTICLES OF THE GOVERNMENT DECREE NO. 72/2007/NĐ-CP ON FEBRUARY 7, 2007 REGARDING THE MANAGEMENT OF DAM SAFETY

Pursuant to the Ordinance on Exploitation and Protection of Waterworks Projects dated April 4, 2001;

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government Decree No. 72/2007/NĐ-CP dated May 7, 2007 on dam safety management;

Pursuant to the Government Decree No. 16/2005/NĐ-CP dated February 7, 2005 on project management for investment construction works;

Pursuant to the Government Decree No. 209/2004/NĐ-CP dated December 16, 2004 on quality management of construction works;

The Ministry of Agriculture and Rural Development guides the implementation and provides detailed regulations on certain Articles of the Government Decree regarding dam safety management as follows:

I. REGISTRATION OF DAM SAFETY

The registration of dam safety is the responsibility of the dam owner, as stipulated in Clause 3, Article 4 of the Decree on dam safety management.

1. Organization of Dam Safety Registration

1.1. For newly operational water storage reservoirs:

Within thirty days from the date of receiving the handover for management, the dam owner must conduct the declaration and registration of dam safety. The declaration form can be obtained from the Department of Irrigation, the Irrigation Sub-Department under the Department of Agriculture and Rural Development, or according to the model published on the website of the Ministry of Agriculture and Rural Development (www.mard.gov.vn).

1.2. For currently operational water storage reservoirs:

a. The People's Committee of the province shall be responsible for organizing the registration of dam safety. The Department of Agriculture and Rural Development shall be the permanent agency assisting the People's Committee in implementing the following tasks:

- Organizing the dissemination of the purpose of declaring and registering dam safety.

Declaring and registering dam safety aims at:

+ Assisting state management agencies at all levels in inventorying and accurately grasping the number of dams in each locality and within the scope of management of the Ministry of Agriculture and Rural Development and the Ministry of Industry and Trade; understanding the general condition of dam quality and management, to strengthen and enhance state management over dam safety, and to direct the assurance of dam safety during the rainy season.

+ Helping dam owners consolidate and enhance dam safety management through reviewing declarations to understand the overall condition of dam quality and management, increasing awareness of the owner's responsibility for ensuring dam safety and downstream safety; facilitating the acceptance of assistance from state management agencies according to current regulations.

+ Establishing and consolidating relations between dam owners and state management agencies to improve the effectiveness of law enforcement and management.

- Distributing and guiding dam owners to declare the Dam Safety Management Declaration Form.

- Urging dam owners to declare and submit the Declaration Form.

- Receiving the Declaration Forms.

- Summarizing results and preparing reports to send to the Provincial People's Committee, the Ministry of Agriculture and Rural Development, and the Ministry of Industry and Trade (for hydroelectric dams).

- Storing Declaration Forms.

b. Deadline for completing dam safety registration: June 30, 2008

2. Annually, the dam owner must prepare a report on the current status of dam safety and submit it to the local Department of Agriculture and Rural Development, in accordance with the content and deadlines specified in Article 16 of the Government Decree No. 72/2007/NĐ-CP dated May 7, 2007 on dam safety management. The Department of Agriculture and Rural Development is responsible for summarizing, preparing reports to send to the Provincial People's Committee, the Ministry of Agriculture and Rural Development, and the Ministry of Industry and Trade (for hydroelectric dams), and storing records according to regulations.

3. Funding for dam safety registration is allocated from local government budgetary funds and other sources according to current regulations.

II. INSPECTION AND CERTIFICATION OF QUALITY CONSTRUCTION OF DAMS

1. Inspection and certification of quality construction of dams aim to provide state management authorities with a basis for examining and deciding on the acceptance of dams for operation and use according to Article 8 of the Government Decree No. 72/2007/NĐ-CP dated May 7, 2007 on dam safety management.

2. New dams constructed and existing dams that have been rehabilitated, repaired, or upgraded must undergo inspection and certification of quality before being considered for acceptance and put into operation and use.

3. The contents of inspection and certification include:

a. Compliance with the objectives of water storage reservoir exploitation according to approved water resources planning.

b. Compliance with regulations on quality management of investigation, surveying topography, geology, meteorology, hydrology, and the current condition of the structure (for dams undergoing repair and upgrade).

c. Compliance with regulations on quality management of design.

d. Compliance with regulations on construction management.

e. Compliance with other relevant laws related to construction quality.

4. The competent state management authority decides on the acceptance of dams, entrusting specialized agencies for dam safety management or designating consulting units registered for quality construction inspection and certification to carry out inspections and certifications according to the above contents (excluding consulting units that are design contractors or supervisors); deciding on post-inspection handling for inspected items or cases where dams do not meet quality requirements.

5. The project investor and consulting units for surveying, project feasibility studies, technical design, construction contractors, and construction supervision units are responsible for preparing reports, providing information, and supplying documents to the unit assigned the task of inspecting and certifying quality construction of dams; they bear legal responsibility for the information and documents they provide to ensure transparency, honesty, accuracy, and objectivity in the inspection process.

6. The cost for conducting inspections is included in the acceptance budget of the project's total estimate according to current regulations on investment construction management.

7. The deadline for inspection and certification of quality construction of dams does not exceed thirty days from the date of receipt of complete and valid documents and reports.

III. DAM SAFETY ASSESSMENT

1. Requirements for the capacity of dam safety consulting and inspection are stipulated as follows:

a. The dam safety consulting and inspection entity must be a legal person organization registered to practice in water conservancy project design consultancy activities.

b. It must meet the capacity conditions of the organization for reservoir and dam design consultancy as prescribed in Article 61 of the Government Decree on Project Management for Construction Investment Projects No. 16/2005/NĐ-CP dated February 7, 2005, consistent with the level of the reservoir and dam as specified in Appendix I on classification of construction projects accompanying Government Decree No. 209/2004/NĐ-CP dated December 16, 2004 on construction quality management. In cases where there is inconsistency between the project level selected based on reservoir capacity and the project level selected based on dam height, the higher project level among the two results shall be chosen.

2. Implementation organizations.

a. The state management agency for dam safety, assigned responsibilities under Article 24 of the Government Decree No. 72/2007/NĐ-CP dated May 7, 2007 on Dam Safety Management, shall decide on the inspection plan for dams within its jurisdiction based on the time of operation and use of the dam and the current safety status of the dam; notify the dam owner before October 31 each year to prepare documents, reports, budget plans, and select consulting entities for inspection.

b. After receiving notification from the competent state management authority regarding dam safety inspection, the dam owner must implement the following procedures:

- Prepare the outline and budget estimate for the inspection, submit to the competent state management authority for approval. The outline must clearly specify the purpose, requirements, detailed contents, methods, and time schedule for the inspection work. The budget estimate must adequately provide for all anticipated expenses according to current regulations and standards.

- Prepare the budget plan.

- Select and sign a contract with a consulting entity that meets the required capacity as stipulated.

- Prepare a report evaluating dam safety management. The report should cover the following main contents:

+ The establishment and issuance of relevant regulatory documents related to dam safety management, including:

Water regulation procedures for the reservoir.

Operation rules for gate valves of the dam structure.

Gate valve operation logbooks for dam structures.

Maintenance and upkeep regulations for the dam.

+ Evaluation of the implementation results of the aforementioned regulations.

+ Results of dam monitoring work (accompanied by adjusted monitoring documents).

+ Evaluation of regular inspections conducted before and after the flood season (accompanied by reports submitted to the competent state management authority); flood prevention measures at the dam site.

+ Inspection, identification, and remediation of any incidents during dam management.

+ Conclusions providing an evaluation of dam safety management and the dam owner's assessment of dam safety.

+ Preparation of necessary documents related to the consulting entity's inspection work.

- Organize for the consulting entity to carry out the dam safety inspection according to the approved outline.

- Prepare a report on the inspection results, accompanied by the consulting entity's evaluation, and submit it to the competent state management authority for review and approval.

IV. DEVELOPMENT OF FLOOD CONTROL PLANS FOR THE DOWNSTREAM AREA OF DAMS.

1. Flood control plans for the downstream area of dams are established by the dam owner and submitted to the People's Committee of the province managing the affected flooded areas for approval; aimed at proactively responding to emergency flood release situations and dam failure scenarios.

2. Depending on the specific characteristics of the reservoir and dam, the dam owner needs to develop practical plans to proactively respond effectively to the worst possible scenarios.

The purpose of the plan is to:

a. Determine or predict the flash flood route and inundation area when an incident occurs.

b. Propose measures to protect, prevent, or mitigate damage to residential areas, economic facilities, security, and defense.

c. Develop a rapid and thorough evacuation plan for residents, ensuring their safety.

3. The contents of the plan should cover the following issues:

a. Scenario prediction:

Based on the geographical location characteristics of the project, materials, dam structure, foundation characteristics, current dam quality status, flood discharge capacity of the reservoir, and economic, security, and defense conditions of the downstream region of the dam, scenarios requiring response plans should be predicted.

For large flood response scenarios, three cases need to be considered for plan development, including:

- The case of flood discharge through permanent flood discharge structures.

- The case where the reservoir's flood discharge capacity does not meet current dam design standards, with the scenario considering dam failure at the design flood level.

- The case where the reservoir's flood discharge capacity meets current dam design standards, with the scenario considering dam failure at the inspection flood level.

b. Determine or predict the flash flood route and inundation area according to different scenarios.

Determining the flash flood route and inundation area is a complex task that generally requires specialized consultants to perform based on calculations of floods and flood waves caused by dam failure, topographic and geomorphological data, channel data, etc. When specific calculation conditions are not available, it is necessary to predict the flash flood route based on regional maps and field investigations to make decisions.

c. List the affected objects and the degree of impact under different scenarios.

d. Propose proactive prevention, response, damage reduction, and aftermath remediation plans, including preparatory work before the situation occurs, such as building additional embankments, evacuation routes, rescue operations, equipping communication devices, sirens, whistles, etc.

e. Evacuation plan for residents: evacuation direction, assistance forces and means, logistical support during evacuation...

f. Predict the organization and implementation of the plan:

To organize the implementation of the plan, specific regulations must be established regarding the following issues:

- Information reporting system for reservoir conditions from the dam owner to the Flood Control Command at higher levels.

- Duty roster at the dam and at the Flood Control Command at all levels.

- Authority to decide on evacuation (alert, action order).

- Responsibilities of local authorities in organizing resident evacuation.

- Warning signals for different scenarios.

- Rescue organization.

4. After the plan is approved, annually, before the rainy season:

a. The dam owner must take the lead in coordinating with affected localities to supplement and update necessary information.

b. The Chairman of the People's Committee of the county and commune expected to be affected by floods must update and specify the plan, assign organizations and individuals responsible for each task. Supervise and urge preparation work in localities and facilities; disseminate and ensure people's understanding to implement.

5. Funding for the establishment of flood control plans for the downstream of dams shall be borne by the dam owner based on the annual budget plan for water conservancy project management and other appropriate funding sources in accordance with current regulations.

V. EFFECTIVE DATE OF IMPLEMENTATION

During implementation, if there are difficulties, organizations and individuals are requested to promptly report to the Ministry of Agriculture and Rural Development for guidance and supplementation.

This Circular applies to all reservoirs throughout the country and takes effect 15 days after its publication in the Official Gazette.
