Decree No. 33/2011/ND-CP amends and supplements some articles of Decree No. 34/2010/ND-CP dated April 2, 2010, of the Government on administrative penalties for violations in the field of road traffic.

Amending and supplementing certain articles of Decree No. 34/2010/NĐ-CP dated April 2, 2010 of the Government

concerning administrative penalties for violations in the field of road traffic

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Administrative Violation Handling Decree dated July 2, 2002 and the Decree amending and supplementing certain articles of the Administrative Violation Handling Decree dated April 2, 2008 (hereinafter referred to collectively as the Administrative Violation Handling Decree);

Considering the proposal of the Minister of Transport,

DECREE:

Article 1. Amending and supplementing certain articles of Decree No. 34/2010/NĐ-CP dated April 2, 2010 of the Government stipulating administrative penalties for violations in the field of road traffic as follows:

1. Amending and supplementing Point a and Point b Clause 2 Article 19 as follows:
"a) Operating a vehicle without sufficient lighting lamps, license plate lights, brake lights, signal lights, windshield wipers, rearview mirrors, escape tools, fire extinguishing equipment, pressure gauge, speedometer or having those devices but they are not functional, do not meet design standards (if there are regulations requiring such devices) or installing additional lighting lamps facing the rear of the vehicle.b) Operating a vehicle without a horn."

2. Supplementing Point d Clause 4 Article 19 as follows:
"d) Operating a vehicle with a horn installed or used that exceeds the permitted sound level."

3. Amending and supplementing Point d Clause 3 Article 36 as follows:
"d) Carrying cargo exceeding the width limit of bridges and roads without a Permit for Operation or carrying cargo exceeding the width limit specified in the Permit for Operation."

4. Amending and supplementing Clause 3 and Clause 4 Article 57 as follows:
"3. For the driver of a motor vehicle committing a violation as prescribed in Point a Clause 8 Article 24 of this Decree, in the case of operating a truck tractor semi-trailer without a Driving License Category FC, the penalty shall be enforced from July 1, 2011.4. For the driver of a motor vehicle committing a violation as prescribed in Point g Clause 1 Article 8 and Point h Clause 2 Article 10 of this Decree, in the case of placing warning signs incorrectly, the penalty shall be enforced from July 1, 2013."

5. Supplementing Clause 7 Article 57 as follows:
"7. Regarding the enforcement of penalties against drivers of vehicles committing violations as prescribed in Point a Clause 6 Article 26 and Point d Clause 3 Article 27 of this Decree, it will be implemented from July 1, 2013."

Article 2. Effectiveness and responsibility for implementation

This Decree takes effect from June 30, 2011.

2. Ministers, heads of agencies at the ministerial level, heads of government agencies, Chairmen of provincial People's Committees, and Chairmen of municipal People's Committees directly under the Central Government are responsible for enforcing this Decree.
