Guidelines for organizing and implementing Decision No. 14/2012/QD-TTg dated March 1, 2012 of the Prime Minister on amending and supplementing certain articles of Decision No. 139/2002/QD-TTg dated October 15, 2002 of the Prime Minister on medical examination and treatment for the poor Pursuant to Decision No. 139/2002/QD-TTg dated October 15, 2002 of the Prime Minister on medical examination and treatment for the poor;

This Circular prescribes procedures for receiving, providing health care for domestic violence victims and statistical reports on domestic violence victims at medical facilities.
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 14/2012/QD-TTg dated March 1, 2012 of the Prime Minister on amending and supplementing certain articles of Decision No. 139/2002/QD-TTg dated October 15, 2002 of the Prime Minister on medical examination and treatment for the poor;
The Ministers of Health and Finance hereby issue this Circular guiding the organization and implementation of Decision No. 14/2012/QD-TTg dated March 1, 2012 of the Prime Minister on amending and supplementing certain articles of Decision No. 139/2002/QD-TTg dated October 15, 2002 of the Prime Minister on medical examination and treatment for the poor.
1. This Circular guides the establishment of the Medical Examination and Treatment Fund for the Poor; the preparation, allocation, budgeting, management, utilization, and settlement of accounts for the Medical Examination and Treatment Fund for the Poor (hereinafter referred to as the Fund).
Article 1. Scope of Regulation and Applicability
2. This Circular applies to agencies, organizations, and individuals related to the management and utilization of the Fund.
Article 2. Medical Examination and Treatment Fund for the Poor
1. The Fund is established at the Department of Health, has its own seal, and opens a deposit account at the state treasury to manage the support from the state budget.
2. The Management Board of the Fund includes: The leader of the People's Committee of the province or centrally governed city (hereinafter referred to as the Provincial People's Committee) serves as Chairman; the leader of the Department of Health serves as Vice-Chairman in charge; the leader of the Department of Finance serves as Deputy Chairman; representatives of the leaders of the Department of Labor, Invalids and Social Affairs, the Ethnic Group Board of the province, and the Vietnam Fatherland Front of the province.
Article 3. Provisions on the preparation, allocation, budgeting, management, utilization, and settlement of accounts for the Medical Examination and Treatment Fund for the Poor
1. The state budget supports the Fund to implement the contents stipulated in Point a, Clause 2, Article 1 of Decision No. 14/2012/QD-TTg dated March 1, 2012 of the Prime Minister on amending and supplementing certain articles of Decision No. 139/2002/QD-TTg dated October 15, 2002 of the Prime Minister on medical examination and treatment for the poor (hereinafter referred to as Decision No. 14/2012/QD-TTg) according to the current state budget management hierarchy. The preparation, allocation, budgeting, management, utilization, and settlement of accounts for the Fund shall be carried out in accordance with the provisions of the State Budget Law and the guiding documents thereof.
2. In cases where patients choose healthcare facilities outside their designated area or seek medical services beyond their entitlements, or opt for fee-for-service medical care, the payment for medical examination and treatment costs shall be made in accordance with the laws on health insurance; the Fund will not provide financial support for these cases.
3. The management expenses of the Fund are allocated within the annual health service expenditure budget of the Department of Health.
4. The accounting and settlement of the Fund shall be conducted in accordance with Decision No. 19/2006/QD-BTC dated March 30, 2006 of the Minister of Finance on the accounting system for administrative and public institutions, Circular No. 185/2010/TT-BTC dated November 15, 2010 of the Ministry of Finance guiding amendments and supplements to the accounting system for administrative and public institutions issued together with Decision No. 19/2006/QD-BTC dated March 30, 2006 of the Minister of Finance, and the current state budget classification.
5. In cases where the Fund uses capital from domestic and foreign organizations and individuals, the management, utilization, monitoring, accounting, and settlement shall comply with the laws on receiving, managing, and utilizing aid and the regulations of the donor (if any).
1. The People's Committee of the province is responsible for specifying the procedures, formalities, and levels of support for the contents stipulated in Points 1, 2, 3, and 4, Clause 3, Article 1 of Decision No. 14/2012/QD-TTg in accordance with the financial balance capacity of the Fund at the local level.
Article 4. Responsibilities for Implementation
2. The Chairman of the People's Committee of the province is responsible for establishing the Fund in accordance with Article 2 of this Circular and approving the Charter of the Fund's operations.
a) Organizing, managing, and operating the Fund in accordance with the decision of the People's Committee of the province;
3. Provincial Health Departments are responsible for:
b) Preparing the budget of the Fund and management expenses, sending them to the Department of Finance for review, and submitting them to the People's Committee of the province for consideration and approval by the People's Council of the province;
c) Annually, taking the lead and coordinating with relevant agencies to compile the situation of the establishment and operation of the Fund, reporting to the Chairman of the People's Committee of the province for submission to the Ministry of Health to aggregate and report to the Prime Minister.
2. In 2013, localities proactively allocate funds to support the Fund and management expenses within the local state budget already assigned. In case of financial difficulties, localities should submit documents to the Ministry of Finance for consolidation and submission to the competent authority for consideration and resolution in accordance with regulations.
Article 5. Implementation Provisions
1. This Circular takes effect from December 15, 2013.
