on the organization and operation of Defense Inspection

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Based on the Inspection Law dated November 15, 2010;

Pursuant to the Law on Officers of the Vietnam People's Army dated December 21, 1999 and the Law Amending and Supplementing Certain Provisions of the Law on Officers of the Vietnam People's Army dated June 3, 2008;

Pursuant to the Law on Cryptography dated November 26, 2011;

At the proposal of the Minister of National Defense,

The Government issues the Decree on the organization and operation of Defense Inspection.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the functions, tasks, powers, organization, and operation of Defense Inspection.

Article 2. Applicability

1. State management agencies, Heads of state management agencies; inspection agencies and Heads of inspection agencies under the Ministry of National Defense; Chief of Inspection Delegation, Inspectors, and Inspector Collaborators of Defense Inspection; inspected entities; agencies, organizations, units, and individuals related to the activities of Defense Inspection.

2. Foreign agencies, organizations, and individuals operating within the territory of the Socialist Republic of Vietnam shall have the obligation to comply with Vietnamese laws on national defense and cryptology.

In cases where the provisions of this Decree differ from the provisions of international treaties to which the Socialist Republic of Vietnam is a party, the provisions of such international treaties shall apply.

Article 3. Functions and Tasks of Defense Inspection

Defense Inspection has the responsibility to implement and assist competent state management agencies at the same level to manage state affairs regarding inspection, handling complaints and grievances, receiving citizens, and preventing and combating corruption; conduct inspections, handle complaints and grievances, receive citizens, and prevent and combat corruption in accordance with the law.

Article 4. Entities Subject to Defense Inspection

1. Agencies, units, and individuals under the jurisdiction of the Ministry of National Defense.

2. Vietnamese agencies, organizations, and individuals who have the obligation to comply with Vietnamese laws on national defense and cryptology; perform assigned tasks and technical regulations, and management regulations in the field of national defense and cryptology.

3. Foreign agencies, organizations, and individuals operating within the territory of the Socialist Republic of Vietnam that are related to Vietnamese laws on national defense and cryptology.

Article 5. Content of Activities of Defense Inspection

1. Inspect the implementation of policies, laws, tasks, authorities, and state plans on national defense and cryptology; technical regulations and management regulations in the fields of national defense and cryptology for agencies, organizations, and individuals under the state management authority of the Ministry of National Defense.

2. Inspect the implementation of state policies and laws, compliance with assigned tasks, authorities, orders, directives, and decisions of commanders for agencies and units under the command of the same-level commander.

3. Advise and assist the same-level commander in organizing, managing, and implementing tasks related to handling complaints and grievances, receiving citizens, and preventing and combating corruption in accordance with the law and regulations of the Ministry of National Defense.

4. Recommend competent authorities to suspend or revoke regulations issued contrary to legal documents on inspection.

Article 6. Principles of Operation of Defense Inspection

1. Compliance with the law; military regulations, rules, and regulations; industry-specific regulations; ensuring accuracy, objectivity, honesty, transparency, democracy, and timeliness.

2. Avoid overlapping scope, subjects, content, and timeframes of inspection among agencies performing inspection functions; do not hinder the normal operations of agencies, units, organizations, and individuals subject to inspection.

3. Administrative inspection activities are conducted through Inspection Delegations; specialized inspection activities are conducted through Inspection Delegations or independently by Inspectors.

Article 7. The relationship of Defense Inspection

1. The Ministry of National Defense Inspectorate is under the leadership of the Central Military Commission, the management and command of the Minister of National Defense, and the guidance on work and organization and business procedures from the Government Inspectorate.

2. Defense Inspectors at all levels are under the leadership of the Party’s level committee, the management and command of the same-level commander, and the guidance on work and business procedures from the higher-level Defense Inspectorate.

3. The relationship between inspectorates within the Ministry of National Defense with functional agencies under the Ministry of National Defense is a cooperative relationship to carry out assigned tasks according to laws and regulations of the Ministry of National Defense.

4. The relationship between Defense Inspectors at all levels with inspectors of ministries, sectors, and localities is a cooperative relationship in carrying out inspection tasks within the scope of national administration of the Ministry of National Defense.

Article 8. Activities of agencies and units without a Defense Inspectorate

1. Agencies and units in the military from regiment level and equivalent upwards without an inspectorate shall have the commander responsible for assigning officers under their authority to perform certain tasks in complaint resolution, accusation handling, citizen reception, and anti-corruption within the agency or unit.

2. Public service units and state-owned enterprises in the military organize People's Inspectorates, which are directed by the grassroots trade union committee in accordance with the law on inspection.

Chapter II

ORGANIZATION, TASKS, AND LIMITATIONS OF DEFENSE INSPECTION

Article 9. Organization of Defense Inspection

1. Defense Inspectorates include:

a) The Inspectorate of the Ministry of National Defense (hereinafter referred to as the Inspectorate of the Ministry);

b) Regional Defense Inspectorate;

c) Inspectorate of the General Staff, Political Bureau, and various general departments;

d) Cryptographic Inspectorate;

đ) Military Branch Inspectorate;

e) Border Guard Inspectorate;

g) Inspectorate of the Capital Command of Hanoi; Inspectorate of the Command of Ho Chi Minh City; Inspectorate of provinces and centrally governed cities (hereinafter referred to as Provincial Inspectorate);

h) Inspectorate of Army Corps, Arms Services, and equivalents.

2. The organization, staffing, and equipment of Defense Inspection agencies at all levels shall be regulated by the Minister of National Defense.

3. Appointments, dismissals, and removals of Chief Inspectors, Deputy Chief Inspectors, and other positions for Defense Inspectors at all levels are carried out according to the Law on Officers of the Vietnam People's Army, the Law on Inspection, and other relevant legal provisions.

4. Each level of Defense Inspectorate has its own seal and separate account in accordance with the law.

Article 10. Ministry Inspectorate

1. The Ministry Inspectorate is an agency of the Ministry of National Defense, assisting the Minister of National Defense in managing state affairs related to inspection, complaint resolution, accusation handling, citizen reception, and anti-corruption; conducting administrative inspections of agencies, units, and individuals within the jurisdiction of the Ministry of National Defense; conducting specialized inspections of agencies, organizations, and individuals within the scope of state administration in the field of national defense by the Ministry of National Defense; resolving complaints, accusations, citizen reception, and anti-corruption in accordance with the law.

2. The Ministry Inspectorate has a Chief Inspector, Deputy Chief Inspector, and Inspector.

The Chief Inspector of the Ministry is appointed, dismissed, or removed by the Minister of National Defense after consultation with the Chief State Inspector.

The Deputy Chief Inspector of the Ministry assists the Chief Inspector of the Ministry in performing tasks as assigned by the Chief Inspector of the Ministry.

Article 11. Tasks and Authorities of the Inspectorate of the Ministry

1. In state management of inspection within the scope of state management of the Ministry of National Defense, the Inspectorate of the Ministry has the following tasks and authorities:

a) Drafting inspection plans to be submitted to the Minister of National Defense for approval; organizing the implementation of inspection plans within the responsibility of the Inspectorate of the Ministry; guiding, inspecting, and urging the construction and implementation of inspection programs and plans by inspectors of agencies and units under the Ministry of National Defense;

b) Directing inspection work, guiding, and training on inspection business for the inspector cadre at all levels; participating in managing and using inspection cadres in agencies and units under the Ministry of National Defense; guiding, propagandizing, and inspecting the implementation of laws on inspection by agencies and units under the management of the Ministry of National Defense;

c) Requesting heads of agencies and units assigned to perform specialized inspection functions under the Ministry of National Defense to report on inspection work; compiling and reporting results on inspection work within the scope of state management of the Ministry of National Defense;

d) Monitoring, urging, and inspecting the implementation of conclusions, recommendations, and decisions on handling inspections issued by the Minister of National Defense and the Inspectorate of the Ministry;

đ) Implementing mid-term reviews, final summaries, drawing lessons learned, providing information, reporting, conducting scientific research, compiling professional materials on national defense inspection work;

2. In inspection activities, the Inspectorate of the Ministry has the following tasks and authorities:

a) Conducting inspections or coordinating with Inspectors of other Ministries, sectors, and localities to inspect the implementation of policies, laws, tasks, authorities, and state plans on national defense; regulations on national defense management and professional-technical matters for agencies, units, organizations, and individuals under the state management authority of the Ministry of National Defense;

b) Inspecting the implementation of policies, laws, tasks, authorities, and state plans on national defense, orders, directives, and decisions of the Minister of National Defense by agencies, units, and individuals directly managed by the Ministry of National Defense; inspecting enterprises in the Military established by the decision of the Minister of National Defense;

c) Inspecting other cases assigned by the Minister of National Defense;

d) Checking the accuracy and legality of inspection conclusions and post-inspection handling decisions made by heads of subordinate agencies and units of the Ministry of National Defense when necessary.

3. Assist the Minister of National Defense in state management of complaint and denunciation resolution work and public reception; performing tasks of complaint and denunciation resolution and public reception according to the provisions of the law.

4. Assist the Minister of National Defense in state management of anti-corruption work; performing anti-corruption tasks according to the provisions of the law.

Article 12. Tasks and Authorities of the Chief Inspector of the Ministry

1. The Inspector General of the Ministry shall perform the following duties:

a) Leading, directing, and inspecting inspection work within the scope of state management of the Ministry of National Defense; leading and commanding the Inspectorate of the Ministry to perform tasks and authorities as prescribed in Article 11 of this Decree and implementing other tasks and authorities according to the law on inspection, the Regulations on Military Unit Management of the Vietnam People's Army, and other related legal documents;

b) Chairing the handling of overlapping issues regarding the scope, objects, contents, and timeframes of inspections within the scope of state management of the Ministry of National Defense.

2. The Inspector General of the Ministry shall have the following authorities:

a) Deciding to conduct inspections upon discovering signs of law violations and bearing responsibility before the Minister of National Defense for such decisions;

b) Deciding to reinspect cases that have been concluded by heads of subordinate agencies and units but signs of law violations are discovered, upon being instructed by the Minister of National Defense;

c) Imposing administrative penalties according to the law on administrative violation handling;

d) Requesting heads of subordinate agencies and units to inspect within their management scope upon discovering signs of law violations; if the heads of agencies and units do not agree, having the right to issue inspection decisions, reporting, and bearing responsibility before the Minister of National Defense for such decisions;

đ) Recommending the Minister of National Defense to temporarily suspend the execution of incorrect inspection decisions of agencies and units directly managed by the Ministry of National Defense;

e) Recommending the Minister of National Defense to consider responsibility and handle persons under the management of the Minister who violate laws discovered through inspections or fail to implement inspection conclusions and handling decisions; requesting heads of agencies and organizations to consider responsibility and handle persons under the management of those agencies and organizations who violate laws discovered through inspections or fail to implement inspection conclusions and handling decisions;

g) Recommending the Minister of National Defense to resolve issues related to inspection work; if such recommendation is not accepted, reporting to the Chief Inspector General of the Government;

h) Recommending competent state agencies to amend, supplement, or promulgate regulations in accordance with management requirements; recommending suspension or revocation of illegal regulations discovered through inspection work;

i) Reporting to the Minister of National Defense and the Chief Inspector General of the Government on inspection work within their responsibilities;

k) Inspecting the responsibility of heads of agencies and units under the management of the Ministry of National Defense in implementing laws on inspection;

l) Participating in opinions with leaders and commanders of subordinate agencies and units of the Ministry of National Defense on unified management of military inspectors and arranging, utilizing, appointing, relieving, and dismissing Chief Inspectors and Deputy Chief Inspectors of the same level before submitting to competent authorities for decision;

m) Summoning officers, professional soldiers, civil servants, officials, and defense workers from relevant agencies and units to participate in inspection activities.

Article 13. Military Region Defense Inspection

The Military Region Defense Inspection is an agency under the military region, assisting the Military Region Commander in managing and directing inspection work, handling complaints and denunciations, receiving citizens, and preventing and combating corruption; conducting administrative inspections on agencies, units, and individuals within the management scope of the military region and specialized inspections within the state management scope regarding national defense in the military region's territory; performing tasks of handling complaints and denunciations, receiving citizens, and preventing and combating corruption as prescribed by law.

Article 14. Tasks and Authorities of the Military Region Defense Inspection

1. Drafting inspection plans to submit to the Military Region Commander for approval and organizing their implementation in accordance with the provisions of the law.

2. Organizing inspections or coordinating with inspections at various levels within and outside the Military to conduct inspections on the implementation of policies, laws, tasks, and authorities; regulations on national defense management and professional-technical matters for localities, agencies, organizations, and individuals within the management scope of the military region.

3. Inspecting the implementation of policies, laws, tasks, authorities, state plans on national defense, directives, orders, and regulations of the Ministry of National Defense and the Military Region Commander by agencies and units directly managed by the military region.

4. Inspecting other cases assigned by the Military Region Commander.

5. Assisting the Military Region Commander in managing and directing complaint and denunciation resolution work and citizen reception; performing tasks of handling complaints and denunciations and receiving citizens as prescribed by law.

6. Assisting the Military Region Commander in managing and directing anti-corruption work; performing tasks of preventing and combating corruption as prescribed by law.

7. Checking the accuracy and legality of inspection conclusions and post-inspection handling decisions made by the Provincial Military Command when necessary.

8. Monitoring, urging, and inspecting the implementation of inspection conclusions, recommendations, and handling decisions made by the Ministry of National Defense and military region inspections on the military region's territory. Summarizing and reporting on inspection work results within the management scope of the military region.

9. Managing inspection work and guiding inspection procedures for commanders, agencies, units, and provincial defense inspections under the military region's management. Organizing guidance for people's inspectors. Implementing mid-term and final reviews, information dissemination, reporting, and participating in compiling inspection industry materials.

Article 15. Tasks and Authorities of the Head of the Military Region Defense Inspection

1. The Head of the Military Region Defense Inspection has the following tasks:

a) Leading, directing, and inspecting inspection work within the management scope of the military region; leading and commanding the Military Region Defense Inspection to perform tasks and authorities as stipulated in Article 14 of this Decree and other legal provisions on inspection, the Regulations on Military Unit Management of the Vietnam People's Army, and related legal documents;

b) Taking the lead in resolving overlapping issues regarding the scope, subjects, content, and time of inspections within the management scope of the military region.

2. The Head of the Military Region Defense Inspection has the following authorities:

a) Deciding to conduct inspections upon discovering signs of law violations and bearing responsibility before the Military Region Commander for such decisions;

b) Deciding to reinspect cases concluded by the Provincial Military Command but discovering signs of law violations, when assigned by the Military Region Commander;

c) Requesting the Provincial Military Command to conduct inspections within its management scope upon discovering signs of law violations; if the Provincial Military Command disagrees, having the authority to issue inspection decisions, report, and bear responsibility before the Military Region Commander for such decisions;

d) Deciding or recommending the Military Region Commander to temporarily suspend the execution of incorrect inspection decisions by agencies and units directly managed by the military region;

đ) Recommending the Military Region Commander to resolve issues related to inspection work; if such recommendations are not accepted, reporting to the Head of the Defense Inspection Bureau;

e) Recommending competent state agencies to amend, supplement, or promulgate regulations in line with management requirements; recommending suspension or revocation of illegal regulations discovered through inspection work;

g) Recommending the Military Region Commander to consider responsibility and handle persons under the Military Region Commander's management who violate the law discovered through inspections or fail to implement inspection conclusions and handling decisions; requesting heads of agencies and organizations to consider responsibility and handle persons under their management who violate the law discovered through inspections or fail to implement inspection conclusions and handling decisions;

h) Participating and recommending leaders and commanders of subordinate units under the military region's management on the management, arrangement, and use of inspectors and the appointment, dismissal, and removal of provincial defense inspection chiefs and deputy chiefs;

i) Recommending competent authorities to decide to temporarily suspend disciplinary actions or job transfers of commanders of agencies and units under the military region's management for those cooperating with inspection organizations or being inspected subjects if it is deemed that implementing such decisions would hinder the inspection process;

k) Reporting to the Military Region Commander and the Head of the Defense Inspection Bureau on inspection work within their responsibilities;

l) Inspecting the responsibility of heads of agencies and units under the military region's management in implementing laws on inspection.

m) Summoning officers, professional soldiers, civil servants, officials, and defense workers from relevant agencies and units to participate in inspection activities.

Article 16. Inspection Units of the General Staff Department, the Political Bureau, and the various general departments

The Inspection Units of the General Staff Department, the Political Bureau, and the various general departments are subordinate agencies under the General Staff Department, the Political Bureau, and the various general departments, assisting the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments in managing and directing inspection work, handling complaints and denunciations, receiving citizens, and preventing and combating corruption; conducting administrative inspections on agencies and units directly managed by the General Staff Department, the Political Bureau, and the various general departments; implementing tasks related to handling complaints and denunciations, receiving citizens, and preventing and combating corruption as prescribed by law.

Article 17. Tasks and Authorities of the Inspection Units of the General Staff Department, the Political Bureau, and the various general departments

1. Drafting inspection plans for approval by the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments, and organizing their implementation.

2. Inspecting the implementation of policies, laws, tasks, powers, and state plans concerning national defense; directives, orders, regulations of the Ministry of National Defense, the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments for agencies and units directly managed by the General Staff Department, the Political Bureau, and the various general departments. When requested by the Inspection Unit, they shall cooperate in inspecting compliance with laws, tasks, state plans, and management regulations concerning national defense and professional-technical matters for agencies, units, organizations, and individuals.

3. Conducting other inspections assigned by the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments.

4. Assisting the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments in managing and directing complaint and denunciation resolution work and citizen reception; implementing tasks related to complaint and denunciation resolution and citizen reception as prescribed by law.

5. Assisting the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments in managing and directing anti-corruption work; implementing tasks related to preventing and combating corruption as prescribed by law.

6. Monitoring, urging, inspecting, and reporting on the implementation of conclusions, recommendations, and decisions regarding inspections for agencies and units under the General Staff Department, the Political Bureau, and the various general departments.

7. Managing inspection work and guiding inspection procedures for command officers of agencies and units under the General Staff Department, the Political Bureau, and the various general departments. Cooperating with political organs at the same level to train civilian inspectors.

8. Implementing summaries, evaluations, information, reports, and participating in compiling materials on inspection work within the Defense Inspection sector.

Article 18. Tasks and Authorities of the Heads of the Inspection Units of the General Staff Department, the Political Bureau, and the various general departments

1. Leading, directing, and inspecting inspection work within the scope of management of the General Staff Department, the Political Bureau, and the various general departments; leading and commanding the Inspection Units of the General Staff Department, the Political Bureau, and the various general departments to perform tasks and authorities as stipulated in Article 17 of this Decree and other legal provisions on inspection, the Military Unit Management Regulations, and other relevant legal documents.

2. Deciding to conduct inspections when signs of law violations are detected and bearing responsibility before the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments for their decisions.

3. Recommending to competent state agencies to amend, supplement, or promulgate regulations in accordance with management requirements; recommending suspension or revocation of unlawful regulations discovered through inspection work.

4. Recommending to the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments to resolve issues related to inspection work; if such recommendations are not accepted, reporting to the Head of the Central Inspection Unit.

5. Recommending to the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments to temporarily suspend the execution of disciplinary decisions or job transfers of command officers of agencies and units under the General Staff Department, the Political Bureau, and the various general departments for those collaborating with inspection organizations or being inspected subjects if it is deemed that the execution of these decisions would hinder the inspection process.

6. Recommending to the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments to consider responsibility and handle persons under their management who have committed law violations discovered through inspections or have not implemented inspection conclusions or decisions.

7. Reporting to the Chief of General Staff, the Director of the Political Bureau, the Heads of the various general departments, and the Head of the Central Inspection Unit on inspection work within their scope of responsibility.

8. Inspecting the responsibility of heads of agencies and units under the management of the General Staff Department, the Political Bureau, and the various general departments in implementing laws on inspection.

9. Summoning officers, professional soldiers, civil servants, and defense employees from related agencies and units to participate in inspection activities.

Article 19. Inspection of Confidential Affairs

The Inspection of Confidential Affairs is an agency under the Government Confidential Affairs Board, assisting the Director of the Government Confidential Affairs Board (hereinafter referred to as the Director) in managing and directing inspection work, handling complaints and grievances, receiving citizens, and preventing corruption; conducting administrative inspections on agencies and units under the management of the Director; conducting specialized inspections within the scope of state management of the Government Confidential Affairs Board; implementing tasks of handling complaints and grievances, receiving citizens, and preventing corruption as prescribed by law.

Article 20. Tasks and Authorities of the Inspection of Confidential Affairs

1. Drafting inspection plans for approval by the Director and organizing their implementation in accordance with the provisions of the law.

2. Inspecting the implementation of policies, laws, assigned tasks, and authorities for agencies, units, and individuals directly managed by the Director.

3. Inspecting compliance with specialized confidential affairs laws, regulations on professional and technical matters, and industry management rules.

4. Inspecting compliance with laws by Vietnamese organizations and individuals, and foreign organizations and individuals operating in Vietnam in research, production, business, and use of cryptographic information protection that does not fall within the scope of state secrets.

5. Inspecting other cases assigned by the Director.

6. Assisting the Director in managing and directing complaint and grievance resolution work, citizen reception; performing tasks of complaint and grievance resolution, and citizen reception as prescribed by law.

7. Assisting the Director in managing and directing anti-corruption work; performing anti-corruption tasks as prescribed by law.

8. Handling or recommending measures to prevent and promptly stop violations of confidential affairs laws.

9. Monitoring, urging, and inspecting the implementation of conclusions, recommendations, and decisions on inspections within the Director's management scope. Summarizing and reporting results of inspection work within the Government Confidential Affairs Board's management scope.

10. Managing inspection work and guiding inspection procedures for commanders and units under the Director's management. Conducting mid-term and final reviews, providing information, reporting, and participating in compiling materials on inspection work in the Defense Inspection sector.

Article 21. Tasks and Authorities of the Chief Inspector of Confidential Affairs

1. Leading, directing, and inspecting inspection work within the Director's management scope; leading and commanding the Inspection of Confidential Affairs to perform tasks and authorities as stipulated in Article 20 of this Decree and relevant regulations of the Confidential Affairs sector, laws on inspection, and other related legal documents.

2. Deciding on inspections when signs of law violations are detected and bearing responsibility before the Director for such decisions.

3. Deciding or recommending the Director to temporarily suspend the execution of incorrect inspection decisions made by agencies and units directly managed by the Director.

4. Recommending issues related to inspection work to the Director; if such recommendations are not accepted, reporting to the Chief Inspector of the Ministry of National Defense.

5. Recommending competent state agencies to amend, supplement, or issue regulations in line with management requirements; recommending suspension or revocation of unlawful regulations discovered through inspection work.

6. Recommending the Director to consider responsibility and handle individuals under the Director's management who violate laws discovered through inspections or fail to implement inspection conclusions and decisions; requiring heads of agencies and units to consider responsibility and handle individuals under their management who violate laws discovered through inspections or fail to implement inspection conclusions and decisions.

7. Administering administrative penalties according to the law on administrative offenses.

8. Reporting to the Director and the Chief Inspector of the Ministry of National Defense on inspection work within their responsibility scope.

9. Inspecting the responsibility of heads of agencies and units under the Government Confidential Affairs Board's management in implementing laws on inspection.

10. Summoning individuals involved in confidential affairs from related agencies and units to participate in inspection activities.

Article 22. Military Branch Inspection

The Military Branch Inspection is an agency under the Military Branch, assisting the Commander of the Military Branch in managing and directing inspection work, handling complaints and accusations, receiving citizens, and preventing and combating corruption; conducting administrative inspections on agencies and units under the management of the Commander of the Military Branch; implementing tasks of handling complaints and accusations, receiving citizens, and preventing and combating corruption as prescribed by law.

Article 23. Tasks and Authorities of the Military Branch Inspection

1. Drafting inspection plans to be submitted to the Commander of the Military Branch for approval and organizing the implementation of the plans in accordance with the provisions of the law.

2. Inspecting the implementation of policies, laws, tasks, authorities, state plans on national defense; directives, orders, regulations of the Ministry of National Defense and the Commander of the Military Branch for agencies and units directly managed by the Commander of the Military Branch. When requested by the General Inspection, cooperate in inspecting the enforcement of laws, tasks, state plans; management regulations on national defense, professional-technical management for agencies, organizations, units, and individuals.

3. Inspecting other cases assigned by the Commander of the Military Branch.

4. Assisting the Commander of the Military Branch in managing and directing complaint and accusation resolution work, citizen reception; implementing complaint and accusation resolution, citizen reception tasks according to the provisions of the law.

5. Assisting the Commander of the Military Branch in managing and directing anti-corruption work; implementing anti-corruption tasks according to the provisions of the law.

6. Monitoring, urging, inspecting, and reporting on the implementation of conclusions, recommendations, decisions on handling inspections for agencies and units within the Military Branch.

7. Managing inspection work and guiding inspection business for commanders of agencies and units within the Military Branch.

8. Implementing summaries, evaluations, information, reports, and participating in compiling materials on inspection work within the Defense Inspection sector.

Article 24. Tasks and Authorities of the Chief of the Military Branch Inspection

1. Leading, directing, and inspecting inspection work within the scope of management of the Military Branch; leading and commanding the Military Branch Inspection to perform tasks and authorities as stipulated in Article 23 of this Decree and other legal provisions on inspection, the Regulations on Management of the People's Army of Vietnam, and other related legal documents.

2. Deciding to conduct inspections when signs of law violations are discovered and bearing responsibility before the Commander of the Military Branch for such decisions.

3. Recommending to competent state agencies to amend, supplement, or promulgate regulations in accordance with management requirements; recommending suspension or revocation of unlawful regulations discovered through inspection work.

4. Recommending to the Commander of the Military Branch to resolve issues related to inspection work; if such recommendation is not accepted, report to the Chief of the General Inspection.

5. Recommending to the Commander of the Military Branch to temporarily suspend the execution of disciplinary decisions or job transfers of commanders of agencies and units within the Military Branch who are cooperating with inspection organizations or are subjects of inspection if it is deemed that the execution of such decisions would hinder the inspection process.

6. Recommending the Commander of the Military Branch to consider responsibility and handle those under management who have been found to violate laws through inspections or have not implemented inspection conclusions or decisions.

7. Reporting to the Commander of the Military Branch and the Chief of the General Inspection on inspection work within their scope of responsibility.

8. Inspecting the responsibility of heads of agencies and units under the management of the Military Branch in implementing laws on inspection.

9. Summoning officers, professional soldiers, civil servants, officials, and defense workers from relevant agencies and units to participate in inspection activities.

Article 25. Border Guard Inspection

The Border Guard Inspection is an agency under the Border Guard Command, assisting the Border Guard Commander in managing and directing inspection work, handling complaints and denunciations, receiving citizens, and preventing and combating corruption; conducting administrative inspections on agencies and units under the management of the Border Guard Commander; inspecting specialized matters concerning the implementation of laws on protecting territorial sovereignty, security, and border order on land, islands, maritime areas, and at border gates for domestic and foreign organizations and individuals operating within the border, island, maritime, and gate areas under the management and protection of the Border Guard; performing tasks of handling complaints and denunciations, receiving citizens, and preventing and combating corruption as prescribed by law.

Article 26. Tasks and Authorities of the Border Guard Inspection

1. Drafting inspection plans to be submitted to the Border Guard Commander for approval and organizing their implementation in accordance with the provisions of the law.

2. Inspecting the implementation of policies, laws, duties, powers, state plans on national defense, directives, orders, regulations of the Ministry of National Defense, and the Border Guard Commander regarding agencies and units directly managed by the Border Guard Commander.

3. Organizing inspections or coordinating with inspections at various levels to conduct inspections on the implementation of laws on protecting territorial sovereignty, security, and border order on land, islands, maritime areas, and at border gates for domestic and foreign organizations and individuals operating within the border, island, maritime, and gate areas under the management and protection of the Border Guard.

4. Inspecting other cases assigned by the Border Guard Commander.

5. Assisting the Border Guard Commander in managing and directing work related to handling complaints and denunciations, receiving citizens; performing tasks of handling complaints and denunciations, receiving citizens as prescribed by law.

6. Assisting the Border Guard Commander in managing and directing work related to preventing and combating corruption; performing tasks of preventing and combating corruption as prescribed by law.

7. Monitoring, urging, and inspecting the implementation of conclusions, recommendations, and decisions on handling inspections by agencies and units under the Border Guard; compiling reports on the results of inspection work within the scope of management.

8. Managing inspection work and guiding inspection procedures for commanders, agencies, units, and provincial-level Military Inspectorates under the management of the Border Guard Command; implementing mid-term and final reviews, information dissemination, reporting, and participating in compiling professional materials for the Military Inspectorate sector.

Article 27. Tasks and Authorities of the Chief of the Border Guard Inspection

1. Leading, directing, and inspecting inspection work within the scope of management of the Border Guard Commander; leading and commanding the Border Guard Inspection to perform tasks and authorities as stipulated in Article 26 of this Decree and other legal provisions on inspection, the Management Regulations of the People's Army of Vietnam, and other relevant legal documents.

2. Deciding on inspections when signs of law violations are detected and bearing responsibility before the Border Guard Commander for such decisions.

3. Recommending to competent state agencies to amend, supplement, or promulgate regulations in accordance with management requirements; recommending suspension or revocation of unlawful regulations discovered through inspection work.

4. Advising the Border Guard Commander to resolve issues related to inspection work; if such advice is not accepted, reporting to the Chief of the General Inspectorate.

5. Advising the Border Guard Commander to temporarily suspend the enforcement of disciplinary decisions or job transfers of commanders of agencies and units under the management of the Border Guard Commander if they are cooperating with inspection organizations or are subjects of inspection, if it is deemed that enforcing such decisions would hinder the inspection process.

6. Advising the Border Guard Commander to consider responsibility and handle those under management who violate laws discovered through inspections or fail to implement inspection conclusions and decisions.

7. Participating in advising leaders and commanders of provincial Border Guards and related agencies of the Border Guard Command on the management, arrangement, and utilization of inspectors and the appointment and removal of Chief Inspectors of provincial Border Guard Commands.

8. Reporting to the Border Guard Commander and the Chief of the General Inspectorate on inspection work within the scope of their responsibilities.

9. Inspecting the responsibility of heads of agencies and units under the management of the Border Guard Commander in implementing laws on inspection.

10. Summoning officers, professional military personnel, civil servants, public officials, and defense workers from related agencies and units to participate in inspection activities.

Article 28. Provincial Defense Inspection

1. The provincial defense inspection is an agency under the Provincial Military Command. It assists the Commander of the Provincial Military Command in managing and directing inspection work, handling complaints and denunciations, receiving citizens, and preventing corruption; performs administrative inspection tasks within the scope of management of the Provincial Military Command; conducts specialized inspections within the scope of state management in the field of national defense on the provincial territory; implements tasks of handling complaints and denunciations, receiving citizens, and preventing corruption as prescribed by law.

2. The Defense Inspection of the Capital Command of Hanoi and the Defense Inspection of the Ho Chi Minh City Command are agencies under the Capital Command of Hanoi and the Ho Chi Minh City Command, respectively. They assist the Commanders of the Capital Command of Hanoi and the Ho Chi Minh City Command in managing and directing inspection work, handling complaints and denunciations, receiving citizens, and preventing corruption; perform administrative inspection tasks within the scope of management of the Commanders of the Capital Command of Hanoi and the Ho Chi Minh City Command; conduct specialized inspections within the scope of state management in the field of national defense on their respective territories; implement tasks of handling complaints and denunciations, receiving citizens, and preventing corruption as prescribed by law.

Article 29. Tasks and Authorities of Provincial Defense Inspection

1. Develop inspection plans to be submitted for approval by the Commander of the Provincial Military Command, the Commander of the Capital Command of Hanoi, and the Commander of the Ho Chi Minh City Command, and organize the implementation of these plans in accordance with the provisions of law.

2. Inspect the implementation of policies, laws, duties, powers, and state plans regarding national defense and military tasks for agencies and units directly managed by the Provincial Military Command, the Capital Command of Hanoi, and the Ho Chi Minh City Command.

3. Conduct inspections or coordinate with the provincial inspection to inspect the implementation of policies, laws, duties, powers, and state plans regarding national defense; regulations on national defense management and professional-technical management for agencies, organizations, and individuals within the scope of provincial state management authority.

4. Inspect other cases assigned by the Commander of the Provincial Military Command, the Commander of the Capital Command of Hanoi, and the Commander of the Ho Chi Minh City Command.

5. Assist the Commander of the Provincial Military Command, the Commander of the Capital Command of Hanoi, and the Commander of the Ho Chi Minh City Command in managing and directing complaint and denunciation resolution work, citizen reception work; implement tasks of complaint and denunciation resolution and citizen reception as prescribed by law.

6. Assist the Commander of the Provincial Military Command, the Commander of the Capital Command of Hanoi, and the Commander of the Ho Chi Minh City Command in managing and directing anti-corruption tasks; implement anti-corruption tasks as prescribed by law.

7. Monitor, urge, and inspect the implementation of conclusions, recommendations, and decisions on inspection made by the Commander of the Provincial Military Command, the Commander of the Capital Command of Hanoi, the Commander of the Ho Chi Minh City Command, the Provincial Defense Inspection, the Defense Inspection of the Capital Command of Hanoi, the Defense Inspection of the Ho Chi Minh City Command, the superior Defense Inspection, and the provincial inspection conducted at units under the Provincial Military Command, the Capital Command of Hanoi, and the Ho Chi Minh City Command. Summarize and report on the results of inspection work within the scope of management of the Provincial Military Command, the Capital Command of Hanoi, and the Ho Chi Minh City Command.

8. Manage inspection work and guide inspection business procedures for commanders of agencies and units under the Provincial Military Command, the Capital Command of Hanoi, and the Ho Chi Minh City Command.

9. Implement mid-term reviews, final summaries, information dissemination, reporting, and participate in compiling materials on inspection work within the Defense Inspection sector.

Article 30. Duties and Authorities of the Chief Inspector of National Defense at the Provincial Level

1. The Chief Inspector of National Defense at the provincial level shall have the following duties:

a) Leading, directing, and inspecting inspection work within the scope of state management of the Provincial Military Command, the Capital Military Command of Hanoi, and the Ho Chi Minh City Military Command; leading and commanding the Inspection of National Defense of the Capital Military Command of Hanoi, the Inspection of National Defense of the Ho Chi Minh City Military Command to perform their tasks and authorities as prescribed in Article 29 of this Decree and to carry out other tasks and authorities as prescribed by laws on inspection, the Regulations on Management of Troops of the Vietnam People's Army, and other relevant legal documents;

b) Handling overlaps regarding the scope, objects, contents, and timeframes for inspections within the scope of state management of the Provincial Military Command, the Capital Military Command of Hanoi, and the Ho Chi Minh City Military Command.

2. The Chief Inspector of National Defense at the provincial level shall have the following authorities:

a) Deciding to conduct inspections when signs of law violations are detected and bearing responsibility before the Commander-in-Chief of the Provincial Military Command, the Commander of the Capital Military Command of Hanoi, and the Commander of the Ho Chi Minh City Military Command for their decisions;

b) Advising competent state agencies to amend, supplement, or promulgate regulations in accordance with management requirements; advising to suspend or revoke regulations found to be contrary to the law through inspection work;

c) Advising the Commander-in-Chief of the Provincial Military Command, the Commander of the Capital Military Command of Hanoi, and the Commander of the Ho Chi Minh City Military Command to resolve issues related to inspection work; if such advice is not accepted, reporting to the Chief Inspector of National Defense of the Military Region;

d) Administering administrative penalties according to the laws on handling administrative violations;

đ) Advising the Commander-in-Chief of the Provincial Military Command, the Commander of the Capital Military Command of Hanoi, and the Commander of the Ho Chi Minh City Military Command to consider responsibilities and handle persons under their management who are found to have violated the law through inspections or who have not implemented conclusions or decisions on inspections; requesting heads of agencies and units to consider responsibilities and handle persons under their management who are found to have violated the law through inspections or who have not implemented conclusions or decisions on inspections;

e) Advising the competent authority to decide to temporarily suspend the enforcement of disciplinary actions or job transfers of commanders of agencies and units under the management of the Provincial Military Command, the Capital Military Command of Hanoi, and the Ho Chi Minh City Military Command, for those cooperating with inspection organizations or being inspected subjects, if it is deemed that enforcing such decisions would hinder the progress of inspections;

g) Reporting to the Commander-in-Chief of the Provincial Military Command, the Commander of the Capital Military Command of Hanoi, the Commander of the Ho Chi Minh City Military Command, the Chief Inspector of National Defense of the Military Region, and the Chief Inspector of the Ministry about inspection work within their scope of responsibility;

h) Inspecting the responsibility of heads of agencies and units under the management of the Provincial Military Command, the Capital Military Command of Hanoi, and the Ho Chi Minh City Military Command in implementing laws on inspection;

i) Summoning officers, professional soldiers, civil servants, officials, and defense workers from related agencies and units to participate in inspection activities.

Article 31. Inspection of Army Corps, Military Branches, and Equivalent Units

The inspection of Army Corps, Military Branches, and Equivalent Units is an agency subordinate to the Army Corps, Military Branches, and Equivalent Units, assisting the Head of the same level in managing and directing inspection work, handling complaints and denunciations, receiving citizens, and preventing and combating corruption; conducting administrative inspections on agencies and units under the command of the same-level commander; performing tasks of handling complaints and denunciations, receiving citizens, and preventing and combating corruption as prescribed by law.

Article 32. Tasks and Authorities of the Inspection of Army Corps, Military Branches, and Equivalent Units

1. Drafting inspection plans for approval by the Head of the same level and organizing their implementation in accordance with the provisions of the law.

2. Inspecting the implementation of military tasks, directives, orders, regulations of the Ministry of National Defense, and the same-level commander by agencies and units directly managed by the Commander of the Army Corps, Military Branches, and Equivalent Units.

3. Inspecting other cases assigned by the same-level commander.

4. Assisting the same-level commander in managing and directing the task of handling complaints and denunciations, receiving citizens; performing the task of handling complaints and denunciations, receiving citizens as prescribed by law.

5. Assisting the same-level commander in managing and directing the task of preventing and combating corruption; performing the task of preventing and combating corruption as prescribed by law.

6. Monitoring, urging, and inspecting the implementation of conclusions, recommendations, and decisions on handling inspections conducted by higher-level inspections and their own inspections at agencies and units under the management of the same-level commander. Summarizing and reporting the results of inspection work within the scope of management of the same-level Head.

7. Managing inspection work and guiding inspection business procedures for commanders of agencies and units under the management of the same-level commander. Implementing summary, generalization, information, and reporting on inspection work.

Article 33. Tasks and Authorities of the Chief Inspector of Army Corps, Military Branches, and Equivalent Units

1. Leading, directing, and inspecting inspection work within the scope of management of the same-level Head; leading and commanding the Inspection of Army Corps, Military Branches, and Equivalent Units to perform tasks and authorities as stipulated in Article 32 of this Decree and other laws on inspection, the Regulations on Management of the People's Army of Vietnam, and related legal documents.

2. Deciding to conduct inspections when signs of law violations are detected and bearing responsibility before the same-level Head for such decisions.

3. Recommending to competent state agencies to amend, supplement, or promulgate regulations in accordance with management requirements; recommending suspension or revocation of unlawful regulations discovered through inspection work.

4. Recommending the Commander of the Army Corps, Military Branches, and Equivalent Units to resolve issues related to inspection work; if such recommendation is not accepted, reporting to the Chief Inspector of the Ministry.

5. Recommending the Commander of the Army Corps, Military Branches, and Equivalent Units to handle persons under their management who violate the law discovered through inspections or fail to implement inspection conclusions and decisions; requesting the heads of agencies and units to consider responsibility and handle persons under their management who violate the law discovered through inspections or fail to implement inspection conclusions and decisions.

6. Recommending competent authorities to decide to temporarily suspend disciplinary actions or job transfers of commanders of agencies and units under the Army Corps, Military Branches, and Equivalent Units who are cooperating with inspection organizations or are subjects of inspection if it is deemed that implementing such decisions would hinder the progress of inspections.

7. Reporting to the Commander of the Army Corps, Military Branches, and Equivalent Units and the Chief Inspector of the Ministry about inspection work within their responsibilities.

8. Inspecting the responsibility of Heads of agencies and units under the management of the Army Corps, Military Branches, and Equivalent Units in implementing laws on inspection.

9. Summoning officers, professional soldiers, civil servants, officials, and defense workers from relevant agencies and units to participate in inspection activities.

Chapter III

INSPECTORS AND ASSISTANT INSPECTORS OF NATIONAL DEFENSE INSPECTION

Article 34. Defense Inspector

1. A defense inspector is a person appointed to the inspector rank to perform inspection tasks and other tasks assigned by the head of the inspection agency, meeting the general criteria stipulated in Clause 1, Article 32 of the Inspection Law and the specific criteria for inspector ranks in the military as decided by the Prime Minister.

2. Defense inspectors shall wear uniforms as prescribed by the Vietnam People's Army; they shall be entitled to duty allowances according to their profession as inspectors.

Article 35. Collaborators in Defense Inspection

1. An inspection collaborator is a person not included in the establishment of the state inspection agency who is summoned by the inspection agency to join the inspection team at the request of the Chief Inspector at all levels.

2. Inspection collaborators must be officers, professional soldiers, civil servants, staff members, or defense workers with good political qualities; they must have a sense of responsibility, integrity, honesty, objectivity, and fairness; they must have professional qualifications suitable for the requirements of inspection tasks.

3. When conducting inspections, inspection collaborators must comply with the law and bear legal responsibility for the performance of their assigned tasks.

4. During their participation in the defense inspection team, collaborators shall enjoy policies as prescribed by the Inspection Law, guiding documents for implementing the Inspection Law, and other relevant laws.

Chapter IV

DEFENSE INSPECTION ACTIVITIES

Article 36. Building and Approving Annual Inspection Programs and Plans

1. Annually, based on the direction of the annual inspection program, guidance from the General Inspector of the Government, and management requirements of the Ministry of National Defense, the Chief Inspector of the Ministry shall submit the inspection plan for approval by the Minister of National Defense no later than November 15 each year.

The Minister of National Defense is responsible for reviewing and approving the inspection plan no later than November 25 each year.

2. Based on the inspection plan of the Ministry Inspectorate and management requirements of agencies and units, the Chief Inspectors of agencies and units shall submit the inspection plan for approval by their direct superiors no later than December 5 each year; heads of agencies and units are responsible for reviewing and approving the inspection plan no later than December 15 each year.

3. The inspection plans specified in Clauses 1 and 2 of this Article shall be sent to the inspected entities and related agencies and organizations.

Article 37. Forms and Time Limits for Inspections

1. Forms of Inspection

a) Planned inspections are conducted according to approved plans;

b) Unscheduled inspections are carried out when signs of law violations are detected by agencies, units, or individuals; upon request for handling complaints, accusations, and anti-corruption measures, or as assigned by the head of the national administrative management agency at the same level;

c) Regular inspections are conducted based on the functions and responsibilities of specialized inspection agencies.

2. Time Limits for Inspections

a) Administrative inspections conducted by the Ministry Inspectorate, Military Region Inspectorates, General Inspectorates, Cryptographic Inspectorates, Service Inspectorates, and Border Guard Inspectorates shall not exceed 45 days, and may be extended up to 70 days if complex;

b) Administrative inspections conducted by other-level inspectorates shall not exceed 30 days, and may be extended up to 45 days if complex;

c) Specialized inspections conducted by inspectorates at various levels through teams shall not exceed 45 days, and may be extended up to 70 days if complex; inspections conducted independently by specialized inspectors shall not exceed 5 days.

Article 38. Authority to issue inspection decisions; construction and approval of plans for conducting inspections

1. Based on the annual inspection plan, the Heads of Inspection at all levels shall issue inspection decisions and establish inspection teams to carry out inspection tasks.

2. For complex cases involving the management responsibility of multiple agencies and units, the same-level commander shall issue inspection decisions and establish inspection teams to carry out inspection tasks.

3. Issuing an inspection decision must be based on one of the following grounds:

a) An inspection program or plan that has been approved by the competent authority;

b) When signs of violation of laws are discovered;

c) Requirements for handling complaints, reports, and anti-corruption measures;

d) At the request of the same-level commander.

4. Construction and Approval of Plans for Conducting Inspections

The Head of the inspection team is responsible for leading the construction of the plan for conducting the inspection and submitting it for approval by the person issuing the inspection decision.

Article 39. Tasks and Authorities of the Person Issuing the Inspection Decision

1. The person issuing the inspection decision performs the tasks and authorities stipulated in Article 48 or Article 55 of the Inspection Law.

2. Conclude or authorize the Head of the inspection team to conclude on the content of the inspection.

Article 40. Tasks and Authorities of the Head of the Inspection Team

1. The Head of the inspection team has the tasks and authorities stipulated in Article 46 or Article 53 of the Inspection Law.

2. Conclude on the content of the inspection when authorized by the person issuing the inspection decision.

Article 41. Tasks and Authorities of Members of the Inspection Team

1. Carry out tasks according to the division of labor by the Head of the inspection team.

2. Require the inspected entity to provide information, documents, and written reports, and explain issues related to the content of the inspection; require agencies, organizations, and individuals with relevant information and documents to provide such information and documents.

3. Recommend the Head of the inspection team to apply measures within the scope of the Head's duties as stipulated in Article 40 of this Decree to ensure the completion of assigned tasks.

4. Recommend the handling of other issues related to the content of the inspection.

5. Report the results of assigned tasks to the Head of the inspection team, and bear responsibility before the Head of the inspection team and the law regarding the accuracy, truthfulness, and objectivity of the reported content.

Article 42. Reporting the Results of Inspections

1. The Head of the inspection team is responsible for organizing the construction of the report on the results of the inspection, with the content of the report on the results of the inspection carried out in accordance with Clause 2 of Article 49 of the Inspection Law.

2. The Head of the inspection team organizes meetings of the inspection team to discuss the draft report on the results of the inspection; in case members of the inspection team have different opinions, the Head of the inspection team will consider and decide, and bear responsibility for their decision.

Article 43. Inspection Conclusions

1. Based on the report on the results of the inspection, the explanations of the inspected entity (if any), and related documents, the person issuing the inspection decision or the Head of the inspection team (when authorized) shall direct the completion and signing of the inspection conclusion. The inspection conclusion includes contents as prescribed in Clause 2 of Article 50 of the Inspection Law.

2. The person issuing the inspection decision or the Head of the inspection team (when authorized) is responsible for organizing the announcement of the inspection conclusion or sending the inspection conclusion to the inspected entity. The announcement of the inspection conclusion is recorded in a protocol.

3. The inspection conclusion is sent to agencies, organizations, and individuals as prescribed in Clause 1 of Article 50 of the Inspection Law.

Article 44. Publicizing Inspection Conclusions

1. Inspection conclusions must be publicized, except for inspection conclusions that are classified military secrets and state secrets.

2. Within ten days from the date of signing the inspection conclusion, the person issuing the inspection conclusion shall be responsible for publicizing the inspection conclusion.

3. The publicizing of inspection conclusions shall be carried out in the form prescribed in Clause 2, Article 39 of the Inspection Law.

Article 45. Handling and Directing Implementation of Inspection Conclusions

1. After receiving an inspection conclusion or upon receipt of an inspection conclusion, the Minister, Heads of agencies and units shall be responsible for directing the implementation of the inspection conclusion:

a) Handling, requesting or recommending the competent state agency to handle economic violations;

b) Handling, requesting or recommending the competent state agency to handle persons who violate the law;

c) Applying, requesting or recommending the competent state agency to apply measures to rectify; perfect mechanisms, policies, and laws;

d) Handling other issues within the scope of authority as stated in the inspection conclusion.

2. Persons responsible for handling inspection conclusions who fail to handle them or handle them incompletely shall be subject to responsibility according to the provisions of the law.

Article 46. Handling Violations in Inspection Activities

Any person obstructing, offering bribes, retaliating against those performing inspection duties, making false accusations, violating the law on inspections; any person taking advantage of their position, power in inspections or due to personal motives or lack of responsibility leading to incorrect handling of violations or conclusions, infringing upon the lawful rights and interests of organizations and individuals shall be subject to disciplinary action, administrative penalties, and if damage is caused, they must compensate or be held criminally liable according to the provisions of the law depending on the nature and severity of the violation.

Article 47. Ensuring Conditions for Inspection Activities

1. Funding to ensure defense inspection activities is allocated in the annual state budget expenditure plan of the Ministry of National Defense and other sources of funding as provided by law. The establishment, management, and use of funds shall be carried out in accordance with the State Budget Law and other relevant laws.

2. Ensuring material and means to serve the organization and operation of defense inspections at all levels shall be the responsibility of the commanders at the same level as stipulated by the Minister of National Defense.

Chapter V

IMPLEMENTING PROVISIONS

Article 48. Effective Date

This Decree takes effect from June 15, 2014, and replaces Government Decree No. 26/2006/NĐ-CP dated March 21, 2006, on the organization and operation of defense inspections, and Government Decree No. 12/2005/NĐ-CP dated February 3, 2005, on the organization and operation of cryptographic government inspections.

Article 49. Responsibility for Guidance and Enforcement

1. The Minister of National Defense shall be responsible for guiding the enforcement of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government shall be responsible for enforcing this Decree./.
