Periodic rotation of positions in the education sector is the act of the head of the agency, organization, or unit with the authority to decide on the transfer, arrangement, and reassignment of positions for civil servants and officials who have reached the time limit for periodic rotation of positions at the positions within the education sector specified in Article 5 of Circular No. 35/2010/TT-BGDĐT".
"Article 2. Principles, contents, forms, and responsibilities for implementing periodic rotation
1. Principles for implementing periodic rotation of positions: carried out according to the provisions of Clause 1, Article 4 of Decree No. 158/2007/NĐ-CP dated October 27, 2007, issued by the Government, stipulating the list of positions and time limits for periodic rotation of positions for civil servants and officials (hereinafter referred to as Decree No. 158/2007/NĐ-CP) and Clause 3, Article 1 of Decree No. 150/2013/NĐ-CP dated November 1, 2013, issued by the Government, amending and supplementing some articles of Decree No. 158/2007/NĐ-CP dated October 27, 2007, issued by the Government, stipulating the list of positions and time limits for periodic rotation of positions for civil servants and officials (hereinafter referred to as Decree No. 150/2013/NĐ-CP). 2. "Article 3. Time limit for periodic rotation of positions
1. The time limit for rotating positions is five years (sixty months) for civil servants and officials holding positions specified in Article 5 of Circular No. 35/2010/TT-BGDĐT.
3. Article 3 is amended and supplemented as follows:
2. The time limit for rotating positions may be implemented earlier (before sixty months) at the discretion of the head of the unit in the following cases:
a) Health or capability does not meet job requirements;
b) Violation of the moral conduct of civil servants and officials; violation of the working regulations of the agency or unit but not reaching the level requiring disciplinary action".
4. Point b Clause 1 Article 5 is amended and supplemented as follows:
"b) Receiving, reviewing applications, and submitting to the competent authority for approval of various types of training certificates in the national education system".
"a) Advising, organizing examination questions, conducting national high school exams, selecting outstanding students, enrolling in high schools, vocational secondary schools, colleges, universities, master's, and doctoral programs".
Heads of units under the Ministry of Education and Training, Directors of provincial education and training departments, heads of organizations and units, and civil servants and officials in the education sector are responsible for implementing this Circular./.
a) Specialized equipment, means of transport, logistics, and living conditions according to Appendix II attached hereto;
"a) Advising on, organizing examination questions, organizing national high school graduation examinations, selecting outstanding students, enrolling students for high schools, vocational colleges, community colleges, undergraduate, master’s, and doctoral programs."
Article 2. 1. The Director of the Finance and Planning Department is responsible for guiding and supervising the implementation of this Circular.
Article 3. The heads of units under the Ministry of Education and Training, the Directors of provincial education and training departments, centrally governed cities, the heads of organizations and units, and civil servants and employees in the education sector are responsible for implementing this Circular./.
