Pursuant to the Law on Surveying and Mapping dated June 14, 2018;

Pursuant to Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain articles of the Law on Fees and Charges;

Pursuant to Decree No. 27/2019/NĐ-CP dated March 13, 2019 of the Government detailing certain articles of the Law on Surveying and Mapping;

Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Based on the proposal of the Director of the Department of Tax Policy;

The Minister of Finance hereby promulgates this Circular amending and supplementing certain provisions of Circular No. 34/2017/TT-BTC dated April 21, 2017 on the level of collection, payment procedures, management, and use of fees for the examination and issuance of licenses for surveying and mapping activities and Circular No. 196/2016/TT-BTC dated November 8, 2016 on the level of collection, payment procedures, management, and use of fees for the exploitation and utilization of surveying and mapping information data.

Article 1. Amending and supplementing Clause 1, Article 2 of Circular No. 34/2017/TT-BTC dated April 21, 2017 of the Minister of Finance on the level of collection, payment procedures, management, and use of fees for the examination and issuance of licenses for surveying and mapping activities

"1. Organizations applying for a license for surveying and mapping activities listed in Article 29 of Decree No. 27/2019/NĐ-CP dated March 13, 2019 of the Government detailing certain articles of the Law on Surveying and Mapping must pay the examination fee as prescribed in this Circular."

Article 2. Amending and supplementing Article 3 of Circular No. 196/2016/TT-BTC dated November 8, 2016 of the Minister of Finance on the level of collection, payment procedures, management, and use of fees for the exploitation and utilization of surveying and mapping information data

Article 3. Levels of collection, exemption, and reduction of fees

"2. Exemption from fees in cases where the Minister, the head of a ministry-level agency, or the head of a government-affiliated agency, or the Chairman of the People's Committee of a province has a written request to exploit and utilize surveying and mapping information data belonging to public assets for the purpose of:

Clause 1. The level of fees for the exploitation and use of surveying and mapping information and data is specified in the Fee Collection Table attached to this Circular.

a) National defense and security in emergency situations;

Emergency situations referred to herein shall be determined according to the provisions of the Law on Defense and laws on disaster prevention and control.

Point b. Disaster prevention and control during emergencies.

3. The level of fees shall be 60% of the corresponding fee levels set out in the Fee Schedule attached to this Circular in cases where the Minister of Public Security, the Minister of National Defense, or the Chairman of the People's Committee of a province has a written request to exploit and utilize surveying and mapping information data belonging to public assets for national defense and security purposes, except for cases provided for in Clause 2 of this Article."

2. The Fee Schedule for the exploitation and utilization of surveying and mapping information data issued together with Circular No. 196/2016/TT-BTC dated November 8, 2016 of the Minister of Finance on the level of collection, payment procedures, management, and use of fees for the exploitation and utilization of surveying and mapping information data shall be replaced by the Fee Schedule attached to this Circular.

Article 3. Implementation organization and enforcement provisions

1. This Circular shall take effect from August 1, 2019.

4. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance./.

3. In cases where related documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly amended, supplemented, or replaced documents.
