Issuing National Technical Regulations on safety for industrial explosive products - non-electric delay blasting caps for surface use in open-pit mines, underground shaft mines, and underground works without explosive dust
Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to the Law on Management and Use of Weapons, Explosives, and Supporting Tools dated June 20, 2017;
Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Based on Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Based on Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions Decree No. 78/2018/NĐ-CPdated May 16, 2018 of the Government amending and supplementing certain articles of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;

At the proposal of the Director of the Department of Safety Technology and Industrial Environment;
The Minister of Industry and Trade issues this Circular to issue National Technical Regulations on safety for industrial explosive products - non-electric delay blasting caps for surface usefor open-pit mines, underground shaft mines, and underground works without explosive dust used for open-pit mines, underground shaft mines, and underground works without explosive dust.
Article 1. Issuance of the National Technical Regulation
Accompanying this Circular are National Technical Regulations on safety for industrial explosive products - non-electric delay blasting caps for surface use for open-pit mines, underground shaft mines, and underground works without explosive dust.
Code: QCVN 12-21:2023/BCT.
Article 2. Effective Date
1. This Circular takes effect from July 1, 2024.
2. National Technical Regulations on safety for industrial explosive products - non-electric delay blasting caps for surface use for open-pit mines, underground shaft mines, and underground works without explosive dust, number QCVN 12-21:2023/BCT shall take effect from July 1, 2024.
3. Non-electric delay blasting caps for surface use for open-pit mines, underground shaft mines, and underground works without explosive dust that have been declared compliant according to National Technical Regulations on non-electric delay blasting caps number QCVN 07:2012/BCT before July 1, 2024 may continue to be used within their declared shelf life.
Article 3. Implementation Organization
The Director of the Office of the Ministry, Heads of Departments: Industrial Safety and Environmental Technology, Chemicals; Head of the Department of Science and Technology; Directors of Provincial Departments of Industry and Trade under central cities; Heads of agencies, organizations, and individuals related to the implementation of this Circular./.
