Regulations on Investment Costs for Construction, Maintenance, Upgrade, Management, and Operation of the Price Database

Pursuant to the Law on Prices dated June 19, 2023,

THE MINISTER OF FINANCE ISSUES THIS CIRCULAR TO AMEND AND SUPPLEMENT SOME PROVISIONS OF CIRCULAR NO. 45/2013/TT-BTC DATED APRIL 25, 2013 OF THE MINISTRY OF FINANCE ON GUIDELINES FOR MANAGEMENT, USE, AND DEPRECIATION OF FIXED ASSETS.

At the proposal of the Director of the Price Management Department,

The Minister of Finance issues this Circular stipulating investment costs for construction, maintenance, upgrade, management, and operation of the Price Database.

Article 1. Scope of Regulation and Applicability

This Circular stipulates investment costs for construction, maintenance, upgrade, management, and operation of the Price Database.

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

This Circular applies to administrative agencies, public service units; other agencies and organizations using state budget funds to implement investment construction, maintenance, upgrade, management, and operation of the Price Database.

Article 2. Investment Costs for Construction and Upgrade of the Price Database

1. Sources of investment costs for construction and upgrade of the Price Database include:

a) Public investment funds allocated from the state budget;

b) Other lawful sources of funding (if any).

2. Investment costs for construction and upgrade of the Price Database using public investment funds shall be implemented in accordance with the Law on Public Investment, the State Budget Law, and related guiding documents.

3. Agencies and units assigned the task of constructing the Price Database shall base their plans on existing physical facilities, economic and technical norms for information technology, and research to determine the necessary investments to submit for approval by competent authorities as the basis for allocating funds.

Investment costs for construction and upgrade of the National Price Database shall be included in the state budget estimate of the Ministry of Finance; Investment costs for construction of the Price Database at local levels shall be included in the state budget estimate of the locality according to the budget allocation level.

Article 3. Maintenance, Management, and Operation Costs of the Price Database

1. Sources of maintenance, management, and operation costs of the Price Database include:

a) Regular expenditure from the state budget in accordance with the State Budget Law, allocated by competent authorities in the annual state budget estimates of agencies and units (including additional allocations during the year);

b) Revenue from business activities; development funds for business activities, other lawful funds (if any);

c) Legal financial support from domestic and foreign organizations and individuals, and other revenues as prescribed by law.

2. Annually, agencies and organizations responsible for maintaining, managing, and operating the price database must prepare the state budget estimate for the maintenance, management, and operation of the Price Database to submit for approval by competent authorities in accordance with the law.

3. The Ministry of Finance, People's Committees of provinces and centrally-administered cities shall balance and allocate funds for implementation in their annual state budget estimates in accordance with the provisions of the State Budget Law and other relevant legal regulations.

Article 4. Preparation, Execution, and Settlement of the State Budget

The preparation, management, execution, and settlement of investment costs for construction, maintenance, upgrade, management, and operation of the Price Database shall be carried out in accordance with the State Budget Law, the Accounting Law, the Law on Public Investment, the Bidding Law, Decree No. 73/2019/NĐ-CP dated September 5, 2019 of the Government on management of public investment in application of information technology using state budget funds, guiding documents, and related legal provisions.

Article 5. Contents and levels of expenditure for maintaining, managing, and operating the Price Database

Expenditures from regular funding sources for maintaining, managing, and operating the Price Database shall be carried out in accordance with the State Budget Law, guiding documents, and relevant laws.

During implementation, if actual expenditures arise for maintaining, managing, and operating the Price Database, they shall be handled as follows:

1. Expenditure for renting information and data entry services to maintain, manage, and operate the Price Database shall be implemented in accordance with Circular No. 194/2012/TT-BTC dated November 15, 2012, issued by the Minister of Finance, guiding the level of expenditure for creating electronic information to maintain the regular operation of agencies and units using state budget funds.

2. In cases where local human resources cannot meet the requirements, expenditure for hiring experts to analyze and forecast market prices of goods, services, and assets both domestically and internationally to maintain, manage, and operate the Price Database shall be implemented according to the level of expenditure for hiring experts stipulated in Circular No. 02/2015/TT-BLDTBXH dated January 12, 2015, issued by the Ministry of Labor, Invalids, and Social Affairs, specifying the salary level for domestic consulting experts serving as the basis for the budget estimate of service contracts under time-based usage of state capital.

3. Expenditure for ensuring safety, security, and information confidentiality for the Price Database shall be implemented in accordance with Circular No. 121/2018/TT-BTC dated December 12, 2018, issued by the Minister of Finance, regarding the preparation of budgets, management, use, and settlement of funds for emergency response, ensuring cybersecurity, and related guiding documents.

4. Expenditure for purchasing information and data to maintain, manage, and operate the Price Database shall be conducted in accordance with the provisions of economic contract laws.

5. Other expenditures arising in practice at agencies and units responsible for maintaining, managing, and operating the Price Database shall be implemented in accordance with relevant laws.

6. Expenditures other than salaries for cadres, civil servants, and public officials funded from the state budget, as specified in this Circular and referenced documents, shall be implemented until the salary reform is carried out in accordance with Resolution No. 27/NQ-TW dated May 21, 2018, of the Seventh Plenary Session of the Central Committee of the Communist Party of Vietnam's Twelfth Congress on salary policy reform for cadres, civil servants, public officials, armed forces personnel, and workers in enterprises.

Article 6. Implementation Organization

1. Agencies and units assigned to build, manage, and operate the Price Database shall be responsible for directing relevant agencies, organizations, and units to implement in accordance with this Circular.

2. During implementation, if any difficulties arise, organizations and individuals are requested to promptly report to the Ministry of Finance for research and resolution.

Article 7. Effective Date

1. This Circular takes effect from July 1, 2024.

2. In cases where laws and regulations cited in this Circular are amended, supplemented, or replaced by new laws and regulations, they shall be applied in accordance with the provisions of the amended, supplemented, or replacing documents.
