Circular 33/2024/TT-BYT stipulates the economic and technical characteristics for milk and functional food intended for children under six years old within the price stabilization program and price declaration, issued by the Minister of Health.

CIRCULAR

REGULATIONS ON ECONOMIC AND TECHNICAL CHARACTERISTICS FOR MILK AND FUNCTIONAL FOODS FOR CHILDREN UNDER SIX YEARS OLD IN THE STABILIZED PRICE RANGE, PRICE DECLARATION

Pursuant to the Law on Prices dated June 19, 2023;

Pursuant to Decree No. 85/2024/NĐ-CP dated July 10, 2024 of the Government detailing certain provisions of the Law on Prices; 7 The Minister of Health issues this Circular regulating economic and technical characteristics for milk and functional foods for children under six years old in the stabilized price range, price declaration.

Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Food Safety Administration;

This Circular regulates milk, functional foods, and the economic and technical characteristics for milk and functional foods for children under six years old in the stabilized price range, price declaration.

Article 1. Scope of Regulation

1. Milk for children under six years old in the stabilized price range, price declaration includes the following product categories:

a) Nutritional formula products for children up to 36 months of age according to national technical standards issued by the Ministry of Health;

b) Milk and nutritional products containing animal milk in powder or liquid form that have been declared for use by children under six years old but not according to national technical standards issued by the Ministry of Health or the relevant sectoral management agency.

2. Functional foods for children under six years old in the price declaration range include the following product categories:

a) Health protection foods;

b) Medical nutrition foods (also known as special purpose medical nutrition foods);

c) Supplement foods;

d) Special diet foods (without milk).

Article 3. Economic and technical characteristics for milk and functional foods for children under six years old in the stabilized price range, price declaration

Milk and functional foods for children under six years old in the stabilized price range, price declaration include the following economic and technical characteristics:

1. Product name (detailed name);

2. Product category;

3. Product form (formulation/form);

4. Registration number for product declaration or self-declaration number for the product.

Circular No. 30/2013/TT-BYT dated October 4, 2013 of the Ministry of Health issuing the List of milk for children under six years old subject to price stabilization measures and Circular No. 22/2018/TT-BYT dated September 12, 2018 of the Ministry of Health detailing the List of functional foods for children under six years old subject to price declaration shall be repealed from the date this Circular takes effect.

Article 4. Effective date

1. This Circular shall take effect from January 1, 2025.

1. Provincial People's Committees are responsible for organizing the implementation of price declarations in accordance with the laws on prices to ensure convenience for organizations and individuals in making declarations.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

2. The Food Safety Agency of the Ministry of Health shall issue a document requesting the agency designated by the provincial People's Committee to receive price declarations to send the declared prices to the Ministry of Health (through the Food Safety Agency) for evaluation of market price fluctuations and preparation of price stabilization reports.

3. Organizations and individuals declaring milk and functional foods for use by children under six years old in their declaration files and on product labels (including products declared for multiple age groups where one of which is under six years old) shall submit price declaration documents to the agency designated by the provincial People's Committee to receive price declarations in accordance with Clause 1, Article 17 and Clause 2, Article 18 of Decree No. 85/2024/NĐ-CP dated July 10, 2024 of the Government detailing certain provisions of the Law on Prices.

4. The Food Safety Agency of the Ministry of Health shall take the lead and coordinate with related units to guide the implementation and organization of this Circular. During the implementation process, if there are difficulties or obstacles, organizations and individuals shall report them to the Ministry of Health (through the Food Safety Agency) for consideration and resolution.
