Pursuant to the proposal of the Minister of Science and Technology;

The Prime Minister issues this Decision on the Special-Purpose Data Transmission Network for Party and State Agencies.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decision stipulates the operation of the Special-Purpose Data Transmission Network for Party and State Agencies, including the Vietnam Fatherland Front (hereinafter referred to as the Special-Purpose Data Transmission Network).

Article 2. Applicability

1. Entities using the service

a) Central Party agencies, state agencies, the Vietnam Fatherland Front; Provincial Party Committees, Municipal Party Committees, People's Councils, People's Committees of provinces and centrally governed cities as specified in Appendix I attached hereto;

b) Local Party agencies, state agencies, the Vietnam Fatherland Front as specified in Appendix II attached hereto;

c) Other entities at the proposal of the Central Party Office, the National Assembly Office, the President's Office, the Government Office, the Vietnam Fatherland Front Central Committee, the Supreme People's Court, and the Supreme People's Procuracy.

2. Entities related to management, operation, and provision of services for the Special-Purpose Data Transmission Network

a) The Central Post Office, Ministry of Science and Technology;

b) Organizations and enterprises involved in service provision and relevant agencies.

Article 3. Principles of Operation of the Special-Purpose Data Transmission Network

The Special-Purpose Data Transmission Network shall be established and maintained in accordance with the following principles:

1. Uniformity in organization, management, and connection.

2. Ensuring quality, cybersecurity, information security, confidentiality of state secrets, and smooth operation in all situations.

3. Connection, interconnection, synchronization, and data sharing among Party, state, and Vietnam Fatherland Front agencies.

4. The Special-Purpose Data Transmission Network shall be managed, monitored, and centrally controlled for access.

5. Application of science and technology, innovation, and digital transformation in the operation of the Special-Purpose Data Transmission Network.

Chapter II
PROVISIONS ON THE SPECIAL-PURPOSE DATA TRANSMISSION NETWORK

Article 4. Organization, Management, and Operation

1. The Special-Purpose Data Transmission Network is a national-scale information system connecting from central to commune level to serve Party, state, and Vietnam Fatherland Front agencies and for central and local organizations to jointly use and exploit for economic and social development, ensuring efficiency and avoiding waste.

2. The Special-Purpose Data Transmission Network includes the following components: backbone network; access network; command center in Hanoi; three operational centers in Hanoi, Da Nang, and Ho Chi Minh City.

3. The backbone network serves to connect internal networks, data centers, and information systems of service-using agencies and organizations. The backbone network consists of: three regional centers, three backup centers, three urban networks in Hanoi, Da Nang, and Ho Chi Minh City; provincial centers and connection gateways in provinces and cities.

a) Regional centers include data centers, network equipment, security devices, transmission channels, and auxiliary systems installed to facilitate connections between the North, Central, and South regions and within each region;

b) Backup centers are regional centers serving to ensure cybersecurity, information security, and restore connections and services in case of incidents affecting regional centers;

c) Urban networks consist of network equipment, security devices, transmission channels, and auxiliary systems installed to facilitate connections for central Party, state, and Vietnam Fatherland Front agencies in Hanoi, Da Nang, and Ho Chi Minh City and to connect up to regional centers;

d) Provincial centers consist of network equipment, security devices, transmission channels, and auxiliary systems installed to facilitate connections for local Party, state, and Vietnam Fatherland Front agencies and to connect up to regional centers;

đ) Connection gateways are network devices, security devices, or other equivalent devices providing interfaces for connections between provincial centers, urban networks, and end-user devices of the access network.

4. The access network includes terminal devices and transmission channels serving to connect internal networks, data centers, and information systems of service-using agencies and organizations to the backbone network. The access network comprises Level I access network and Level II access network.

a) The Level I access network has a connection range from central to provincial level for agencies, organizations, and connection subjects specified in point a, Clause 1, Article 2 of this Decision;

b) The Level II access network has a connection range from provincial to commune level for agencies, organizations, and connection subjects specified in point b, Clause 1, Article 2 of this Decision.

5. The network command center includes station infrastructure, hardware systems, software systems, and auxiliary systems installed to manage, operate, monitor, and control access to the backbone network and access network nationwide.

6. The network operation and exploitation center includes station infrastructure, hardware systems, software systems, and auxiliary systems installed to operate, monitor, and control access to the backbone network and access network within a region.

7. The Special-Purpose Data Transmission Network is managed, operated, and monitored through centralized management platforms and systems.

8. The Special-Purpose Data Transmission Network provides a shared connectivity infrastructure for deploying dedicated networks for political system entities (the Party-wide Information Network, the Government-Wide Information Network - CPNet, the National Assembly, the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy, ministries, ministerial-level agencies, government-affiliated agencies, and provinces and cities), sub-networks for transmitting classified information and data, and other dedicated telecommunications networks serving Party and state agencies (excluding dedicated telecommunications networks for defense, security, and official communications).

Article 5. Services and applications, platforms

1. Services provided on the Specialized Data Transmission Network include:

a) Virtual private network services;

b) Video conferencing services;

c) Dedicated Internet access services provided to the Central Office of the Communist Party of Vietnam, the Office of the President, the Government Office, the National Assembly Office, the Central Committee of the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy, and central Party bodies;

d) Other services as prescribed by the Ministry of Science and Technology.

2. Applications and platforms on the Specialized Data Transmission Network include:

a) National digital platforms; sectoral and cross-sectoral digital platforms;

b) Common applications and platforms of the Party;

c) Common applications and platforms of the National Assembly;

d) Common applications and platforms of the Government;

đ) Common applications and platforms of the Vietnam Fatherland Front;

e) Common applications and platforms of the People's Courts;

g) Common applications and platforms of the People's Procuracies;

h) Applications and platforms of ministries, sectors, and localities.

Article 6. Connectivity

1. Components of the Specialized Data Transmission Network connect with each other through transmission channel infrastructure, ensuring redundancy for connections on the network.

2. Agencies and organizations using services as stipulated in Clause 1, Article 2 of this Decision connect with each other via the backbone network.

3. The Specialized Data Transmission Network connects the National Data Center, Party data centers, National Assembly data centers, Government data centers, Vietnam Fatherland Front data centers, People's Court data centers, People's Procuracy data centers, ministries, agencies at ministerial level, government agencies, provinces, and cities.

4. The Specialized Data Transmission Network connects with other telecommunications networks and information systems to serve interconnection, synchronization, and state secrecy in the digital transformation activities of the entire political system.

5. Data, platforms, and information systems of agencies using the network are interconnected and synchronized with each other through the Specialized Data Transmission Network in compliance with legal regulations and the overall national digital architecture framework.

6. Uniform IP addresses, connection parameters, ports, and routing policies are established on the Specialized Data Transmission Network.

Article 7. Ensuring Cybersecurity and Information Security

1. The Specialized Data Transmission Network fully implements cybersecurity and information security measures as prescribed by law.

2. Data centers, information systems, and internal networks must be inspected before connecting to the Specialized Data Transmission Network and must ensure cybersecurity and information security in accordance with legal regulations.

3. The Specialized Data Transmission Network is monitored for cybersecurity and information security, and centralized access control to network access terminal devices is managed through the use of centralized management platforms and systems.

4. Information systems and internal networks of agencies and organizations using services must comply with Vietnamese technical standards and norms on cybersecurity and information security; they must share cybersecurity and information security monitoring information according to current legal regulations.

5. Network access terminal devices must meet technical requirements allowing service separation; they must be managed and monitored from centralized management platforms and systems as prescribed by the Ministry of Science and Technology.

Article 8. Transmission of State Secrets

1. The transmission of State secrets on the Special-Purpose Data Transmission Network must comply with the laws on protecting State secrets and cryptographic laws.

2. Data and information classified as State secrets when transmitted on the Special-Purpose Data Transmission Network must be categorized and encrypted using cryptographic solutions appropriate to their level of secrecy and processed on systems that meet corresponding security requirements, approved by authorized agencies.

3. The managing agencies of data, platforms, and information systems shall take the lead in developing plans and organizing interconnection within their management scope to ensure measures for data protection and protection of State secrets as prescribed by law.

Article 9. Quality

1. Services provided by the Special-Purpose Data Transmission Network must meet service quality standards as stipulated by the Ministry of Science and Technology.

2. The Special-Purpose Data Transmission Network must ensure continuous service provision 24/7 (24 hours a day, 7 days a week, including holidays and Tet).

3. The Special-Purpose Data Transmission Network must be regularly inspected, reviewed, and evaluated, with bandwidth adjusted based on actual needs; investment and upgrades must be made to ensure service quality.

Article 10. Funding for Operation and Service Provision of the Special-Purpose Data Transmission Network

1. Central budget funds are used for investment, procurement, leasing, maintenance, and operation of the Special-Purpose Data Transmission Network, specifically:

a) Development expenditure funding for new construction, renovation, upgrading, and expansion of the Special-Purpose Data Transmission Network according to public investment laws and other relevant laws;

b) Recurrent expenditure funding for procurement, leasing, operation, and maintenance of the Special-Purpose Data Transmission Network according to state budget laws and other relevant laws, without overlapping with tasks and projects included in the mid-term public investment plan of the Ministry of Science and Technology.

2. For agencies and units specified in points b and c of Clause 1, Article 2 of this Decision, if they are public service organizations or non-budgetary units, the funding for using the Special-Purpose Data Transmission Network shall be self-funded by the agencies and units.

Chapter III
IMPLEMENTATION

Article 11. Rights and Responsibilities of the Central Post Office Administration

1. Managing, supervising, controlling access, ensuring continuous and smooth operation of the Special-Purpose Data Transmission Network, and meeting quality, cybersecurity, and network information security regulations.

2. Inspecting cybersecurity and network information security for data centers, information systems, and internal networks before connecting them to the Special-Purpose Data Transmission Network, and conducting periodic inspections as prescribed by cybersecurity and network information security laws.

3. Implementing centralized management platforms in real-time and sharing network monitoring rights with specialized agencies responsible for information technology and digital transformation of the Party, National Assembly, Government, Vietnam Fatherland Front, People's Courts, People's Procuratorates, ministries, ministerial-level agencies, government agencies, provinces, and cities.

4. Taking the lead and coordinating with telecommunications organizations to connect networks, inspect, and handle technical issues to ensure service quality, cybersecurity, and network information security; coordinating with the specialized agency of the Ministry of Public Security in network surveillance.

5. Being allocated funding by the Ministry of Science and Technology for investment, modernization, upgrading, and maintaining the operation of the Special-Purpose Data Transmission Network as stipulated in Clause 1, Article 10 of this Decision.

6. Taking the lead and coordinating with specialized agencies responsible for information technology and digital transformation as stipulated in Clause 3 of this Article to review connection objects, unify bandwidth adjustment plans suitable to actual needs. Regularly evaluating and adjusting bandwidth and transmission channels to meet service quality requirements.

7. Coordinating with the Government Cryptographic Agency in implementing cryptographic solutions on the Special-Purpose Data Transmission Network to serve the transmission of State secrets for agencies under the political system from central to local levels.

8. Studying and implementing different connection methods to ensure uninterrupted network operations in all situations; applying artificial intelligence, cloud computing, big data, and other advanced technologies in network management and operation.

Article 12. Rights and responsibilities of agencies and organizations using the service

1. Agencies and organizations using the Specialized Data Transmission Network shall serve interconnection, synchronization, exploitation, and utilization of applications and platforms prescribed in Article 5 of this Decision.

2. Agencies and organizations using the service shall be entitled to use the Specialized Data Transmission Network without paying service fees (excluding public service units and units not using state budget funds as stipulated at points b and c, Clause 1, Article 2 of this Decision).

3. Cooperate in inspecting and ensuring cybersecurity and information security for data centers, information systems, internal networks before connecting to the Specialized Data Transmission Network and conducting periodic inspections as prescribed by law.

4. Monitor cybersecurity and information security, control access to data centers, information systems, internal networks when connected to the Specialized Data Transmission Network, share monitoring information as prescribed in this Decision and related laws.

5. Arrange and ensure stable power supply, technical infrastructure installation for equipment operation continuously 24/7, protect network devices, basic security devices, and the Specialized Data Transmission Network infrastructure located at the agency according to the law.

6. Transmit state secrets on the Specialized Data Transmission Network in accordance with the law on state secret protection and the law on basic security.

7. Bear responsibility for the content and information transmitted on the Specialized Data Transmission Network in compliance with relevant laws.

Article 13. Responsibilities of organizations and enterprises related to service provision activities

1. Implement regulations on services, connections, ensuring cybersecurity, information security, transmitting state secrets, and quality as prescribed in this Decision, regulations of the Ministry of Science and Technology, the Ministry of Public Security, and the law on basic security.

2. Coordinate with the Central Post Office to implement connections to the Specialized Data Transmission Network to ensure continuous service provision, quality, cybersecurity, and information security; proactively implement backup connection plans.

3. Deploy transmission channels to connect enterprise data centers serving Party, State, and Vietnam Fatherland Front agencies to the Specialized Data Transmission Network to ensure quality, cybersecurity, and information security.

4. Coordinate with related units to inspect and handle technical incidents, ensure service quality, cybersecurity, and information security.

Article 14. Responsibilities of the Ministry of Science and Technology

1. Develop strategies, planning, plans, or projects for the development of the Specialized Data Transmission Network.

2. Approve network design, service quality standards, and economic-technical norms.

3. Issue a list of national digital applications and platforms, sectoral, field-specific, regional shared platforms on the Specialized Data Transmission Network; prescribe rules for connecting to the Specialized Data Transmission Network and direct the implementation of this Decision.

4. Lead and coordinate with related agencies to inspect the implementation of legal provisions governing the activities of the Specialized Data Transmission Network.

5. Lead and coordinate with agencies and organizations using the Specialized Data Transmission Network service to implement, review, and evaluate the execution of this Decision, propose amendments and supplements, and submit them to competent authorities for decision.

6. Prioritize the use of allocated budgets for investment, upgrading, modernization, and maintenance of the Specialized Data Transmission Network.

7. Lead and coordinate with the Ministry of Public Security and the Ministry of National Defense to develop a cooperation regulation for connections between the Specialized Data Transmission Network and dedicated telecommunications networks for defense, security, and basic security purposes.

Article 15. Responsibilities of the Ministry of Public Security

1. Take the lead and coordinate with the Ministry of Science and Technology to review, guide the implementation of measures to ensure cybersecurity and information security for data centers, information systems, internal networks before connecting to the Specialized Data Transmission Network in accordance with the provisions of the law.

2. Coordinate with the Ministry of Science and Technology to implement measures to protect cybersecurity and information security for the Specialized Data Transmission Network; assess, inspect, evaluate conditions, monitor, and coordinate responses to cybersecurity incidents and information security incidents in accordance with the provisions of the law.

3. Coordinate with the Ministry of Science and Technology to develop regulations on cooperation in the connection between the Specialized Data Transmission Network and the dedicated telecommunications network of the Ministry of Public Security.

Article 16. Responsibilities of the Ministry of National Defense

1. The Minister of National Defense shall direct the Government Cryptographic Agency

a) Take the lead and coordinate with the Ministry of Science and Technology to implement security solutions on the Specialized Data Transmission Network;

b) Take the lead and coordinate with relevant agencies and units to protect state secrets transmitted over the Specialized Data Transmission Network in accordance with the laws on protecting state secrets and cryptographic laws;

c) Use allocated funds to research, produce, and implement cryptographic security solutions on the Specialized Data Transmission Network.

2. Coordinate with the Ministry of Science and Technology to develop regulations on cooperation in the connection between the Specialized Data Transmission Network and the dedicated telecommunications network of the Ministry of National Defense.

Article 17. Responsibilities of the Ministry of Finance

Take the lead and coordinate with the Ministry of Science and Technology and the Ministry of National Defense to ensure investment and regular funding from the central budget for the operation of the Specialized Data Transmission Network.

Article 18. Responsibilities of ministries, sectors, and localities

1. Issue a list of applications and platforms on the Specialized Data Transmission Network as stipulated in point h, Clause 2, Article 5 of this Decision after reaching consensus with the Ministry of Science and Technology.

2. Direct subordinate agencies and units to cooperate with the Central Post Office, the Government Cryptographic Agency to connect and use applications and platforms on the Specialized Data Transmission Network in compliance with this Decision.

Chapter IV
IMPLEMENTING PROVISIONS

Article 19. Transitional Provisions

1. For localities that have implemented leasing or purchasing services of transmission channels according to Decision No. 8/2023/QĐ-TTg dated April 5, 2023 of the Prime Minister on the Specialized Data Transmission Network serving Party and State agencies, continue to maintain implementation until December 31, 2026.

2. For ministries, ministerial-level agencies, and government agencies that have implemented dedicated networks (excluding dedicated telecommunications networks serving security, defense, and cryptography purposes), they are responsible for maintaining the dedicated network to ensure continuous and stable operation without upgrading or expanding the network; before December 31, 2025, reach consensus with the Ministry of Science and Technology on plans to switch to using the Specialized Data Transmission Network.

Article 20. Implementation Provisions

1. This Decision shall take effect from the date of issuance.

2. This Decision replaces Decision No. 8/2023/QĐ-TTg dated April 5, 2023 of the Prime Minister on the Specialized Data Transmission Network serving Party and State agencies.

3. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of People's Committees at all levels, and related agencies, organizations, and individuals are responsible for implementing this Decision.
