GUIDELINES FOR IMPLEMENTING THE SYSTEM OF SENIORITY ALLOWANCES FOR ELECTED POSITIONS ON A TERM BASIS

CIRCULAR OF THE JOINT MINISTRIES

Pursuant to Article 1 of Decision No. 574/TTg dated November 25, 1993 of the Prime Minister on supplementing certain systems for civil servants, administrative and public service personnel, armed forces, and social policy beneficiaries, the Ministry of Labour - War Invalids and Social Affairs, the Staff Organization Board of the Government, and the Finance Department issue guidelines for implementing the system of seniority allowances for elected positions on a term basis as follows:

I. ELIGIBILITY AND CONDITIONS FOR RECEIVING ALLOWANCES

Individuals holding elective positions on a term basis (including certain other positions classified under the salary scale for elected positions) within state agencies from central to district levels, currently classified under the salary scale for elected positions issued with Resolution No. 35/NQ-UBTVQHK9 dated May 17, 1993 of the Standing Committee of the National Assembly and Decree No. 25 dated May 23, 1993 of the Government.

Those individuals mentioned in Point 1 above, if re-elected to the same position from the second term onwards, shall be entitled to receive seniority allowances for elected positions.

In cases where an individual is elected to fill a vacancy, they must hold the position for at least half of the term to be considered as a full term.

1. Recipients

For example, Mr. A was elected to serve as Chairman of the People's Committee of the province since 1987, and continued to be re-elected to serve as Chairman of the People's Committee of the province for the second term in 1992. This term will be eligible for seniority allowances for elected positions.

c) For some special areas, the participation period of civilian workers may be earlier or later than the above periods as specified by the Minister of Defense.

II. LEVELS AND CALCULATION METHODS FOR SENIORITY ALLOWANCES FOR Elected Positions

Individuals meeting the conditions stipulated in Section I above, from the second term onwards, shall receive monthly seniority allowances for elected positions equal to 5% of their current position salary for each term, specifically:

- Second term: allowance level equals 5% of the current position salary.

- Third term: allowance level equals 10% of the current position salary.

For example, Mr. H serves as Chairman of the People's Committee of the district for the third term, with the Chairman of the district's salary according to regulations from April 1, 1993 being 323,000 VND/month, the percentage of seniority allowance for elected positions is 10%. Therefore, Mr. H receives a monthly seniority allowance for elected positions of:

- The seniority allowance for elected positions is paid together with the monthly salary.

- The seniority allowance for elected positions is used to calculate social insurance benefits but not for other allowances.

- Individuals holding elected positions who are currently receiving retention coefficient allowances as prescribed in Circular No. 25/LB-TT dated September 13, 1993 of the Ministry of Labour - War Invalids and Social Affairs, the Staff Organization Board of the Government, and the Finance Department, if they meet the conditions for receiving seniority allowances for elected positions as stipulated in this Circular, may choose to receive either the retention coefficient allowance or the seniority allowance for elected positions, but not both simultaneously.

- For those receiving salaries from the state budget, the special allowance is paid by the state budget according to the current decentralization regulations. For enterprises, it is included in the unit labor cost and accounted for in production costs or circulation fees.

- If an individual falls ill during the term and requires long-term treatment, they still receive the seniority allowance for elected positions.

- If an individual transfers to another job not classified under elected positions or is relieved of duty, they cease to receive the seniority allowance for elected positions from the date of the decision.

This Circular takes effect from April 1, 1993. Ministries, sectors, and localities that have completed the review of salary schemes based on this Circular should prepare lists and amounts of seniority allowances for those individuals who are entitled to seniority allowances according to terms without enjoying the retention system prescribed in Circular No. 25/LB-TT dated September 13, 1993 of the Ministry of Labour - War Invalids and Social Affairs, the Staff Organization Board, and submit them to the Ministry of Labour - War Invalids and Social Affairs, the Staff Organization Board for supplementary funding of additional salaries for 1993.

During implementation, if there are difficulties, ministries, sectors, and localities are requested to report to the Ministry for study and resolution.

- Transfer to other work not within elected positions or be relieved of duty, then cease receiving seniority allowance from the date of the decision.

This Circular takes effect from April 1, 1993. Ministries, sectors, and localities that have completed the review of salary schemes based on this Circular shall establish lists and levels of allowances for those entitled to seniority allowances according to their terms of office but not enjoying the retention benefits stipulated in Circular No. 25/LB-TT dated September 13, 1993, issued jointly by the Ministry of Labor - Invalids and Social Affairs and the Civil Service Organization Board, calculate the total and submit it to the joint Ministry of Labor - Invalids and Social Affairs and the Civil Service Organization Board for supplementary funding of the increased salary fund for 1993.

During implementation, if there are difficulties, they are requested to be reported back to the joint Ministry for study and resolution.
