CIRCULAR

OF THE MINISTRY OF EDUCATION NUMBER 33-GD/TT DATED NOVEMBER 11, 1976 GUIDING THE PROBATION REGIME FOR STUDENTS GRADUATING FROM UNIVERSITIES AND

TEACHER TRAINING COLLEGES

On July 15, 1975, the Prime Minister issued Decision No. 256/TTg, stipulating the probation regime for students graduating from universities and vocational high schools.

The Ministry of Labor - Universities and Vocational High Schools issued Circular No. 01 TT - LB on February 14, 1976 to guide the implementation of Decision No. 256/TTg.

After exchanging and agreeing with the Ministry of Labor (in Circular No. 1400/LĐ-LHCSN dated October 8, 1976), the Ministry of Education issues this circular to specifically guide the probation regime for students graduating from universities and teacher training colleges.

I- OBJECTIVES, REQUIREMENTS

Professional probation is a mandatory activity for all graduates to continue perfecting the process of training teachers in teacher training institutions.

To help students have sufficient time and conditions to further hone their teaching skills, cultivate moral character, work style, independent creativity in educational and teaching activities, and enhance their love for the profession.

To provide educational management agencies and schools with sufficient time to assist and accurately assess probationers in all aspects (moral character, professional qualifications) before officially assigning tasks and recruiting them into state staff.

II- CONTENTS OF PROBATION

During the prescribed probation period, teachers will perform the following tasks:

1- Directly participate in comprehensive educational and teaching activities for students; teach in class, be class advisors, educate labor production and organize collective activities for students.

2- Study to systematically understand the organizational structure, functions, and responsibilities of the education sector, mainly school-based, and the political, economic, educational situation, and local customs and traditions of the area where the school is located.

3- Throughout the implementation of these work contents, teachers must always strive to cultivate themselves in moral character, work style, enthusiastically work, humbly learn from experienced teachers, continuously study and improve to enhance their understanding of the Party's educational policies and professional qualifications.

III- ORGANIZATION OF PROBATION

1- General education schools, concentrated cultural supplementary schools, and kindergarten are the probation bases for graduates of teacher training colleges.

- Educational management agencies, within the permitted staffing quota, are responsible for introducing students to probation bases according to their trained professions.

2- The principal of the school is directly responsible for assigning tasks to probationers and assigning experienced teachers to accompany and assist them throughout the probation period.

Each teacher must develop a plan to implement the entire probation program after being assigned tasks by the principal, in accordance with the above content. Annually, during mid-term and year-end reviews, evaluations should be organized to draw lessons and set directions for continued improvement.

3- Two months before the end of the probation period, teachers submit a request for recognition of completion of probation (and recruitment into state staff) along with a report on the results of probation. This report is submitted to the subject matter team for comments before being sent to the review board.

4- Each school establishes a probation result review board consisting of the principal, vice-principal, and subject matter team leader (of the probationer), chaired by the principal.

Based on the probation result report and the opinions of the subject matter team, the board will examine and evaluate the entire probation work of the teacher, focusing on two main aspects:

- Professional qualifications and pedagogical skills - moral character and work style, to conclude whether the teacher has met the probation requirements.

The review board's minutes are sent to the Department of Education (for primary and secondary school teachers) and the Provincial Department of Education (for high school teachers) within one week of the board's decision.

5- For the evaluation and recognition of completion of probation (and recruitment into state staff) for primary and secondary school teachers, after agreement with the provincial government's organizational department.

- The provincial People's Committee decides on the recognition of completion of probation (and recruitment into state staff) for high school teachers.

IV- PROBATION PERIOD

1- The probation period starts from the date the teacher begins working at the probation base according to the job transfer decision of the direct management agency.

2- Graduates of teacher training colleges for general education, cultural supplementary schools, and kindergarten, which are part of university and vocational college systems, apply the probation period as stipulated in Decision No. 256-TTg of the Prime Minister.

Now, the Ministry of Education specifies the subjects exempted or reduced from the probation period as follows:

a) Teachers in state staff who have been teaching for 24 months or more in general education, teacher training, cultural supplementary, kindergarten, and meet the criteria for being sent to teacher training colleges (during the study period, they receive unified living expenses or a percentage of salary), upon graduation and serving in the education sector, are exempt from probation.

b) Teachers who do not meet the time requirement but were sent to teacher training colleges; cadres, soldiers, and young volunteers fighting against the United States to save the country who participated in teaching cultural supplementary classes, kindergartens - nursery classes, and Communist Youth League cadres in schools for at least two consecutive years (24 months or more), with certification from the direct management agency, may be considered for early completion of probation by one-third of the prescribed period.

c) For students who have graduated or are in the probationary period and have been mobilized to serve in the army, volunteer forces against the United States for national rescue, during their service time if they participate in teaching supplementary cultural classes at centralized cultural schools of their units, the teaching time (with certification from the direct managing unit) shall be deducted from the probationary period. In cases where they only teach evening supplementary cultural classes and participate for 24 months or more, one-third of the probationary period will be reduced.

d) Students who have graduated and moved from the lowlands to work in mountainous areas, new economic zones (midlands or mountains) established by the Central Government or localities; ethnic students (including those from the lowlands who have settled in the mountains) moving to work in highland areas (with regional allowances of 20% or more), remote and isolated areas (as stipulated in Circular No. 30/TT-LB dated August 28, 1974 issued by the Ministry of Education and Finance); graduates (regardless of whether from the lowlands or mountains) returning to work in agricultural cooperatives, small-scale industries, handicrafts, and units working on friendly territory shall have one-third of their probationary period reduced.

3- The probationary period for probationers may be shortened or extended in the following cases:

- During the probationary period, if a teacher is awarded the title of outstanding soldier, one-third of the probationary period will be shortened.

- After completing the probationary period, if a teacher does not meet the requirements of the probationary program, the probationary period will be extended (as stated in Circular No. 01-TT/LB dated February 14, 1976 issued by the Joint Board of Labor and Higher Education).

If, after the extended period has ended, the requirements are still not met, the following measures will be taken:

- Transfer to other work if deemed suitable and there is a need.

- Terminate employment or return to the home province.

V- REMUNERATION REGIME FOR PROBATIONERS

1- During the probationary period, teachers are granted a reduction of two hours of classroom teaching per week (for secondary and tertiary level teachers). At primary level, teachers are assigned to teach convenient classes. Schools should reduce other tasks for probationer teachers to allow them time for study and skill development.

2- During the probationary period, teachers are considered members of the school council, participating in meetings and discussions on all school matters; they enjoy all benefits that teachers receive according to Decision No. 256-TTg dated July 15, 1975 issued by the Prime Minister.

The salary regime during and after the probationary period shall be applied as per Circular No. 01-TT/LB dated February 14, 1976 and Circular No. 07-TT/LB dated May 5, 1976 issued by the Joint Board of Labor and Higher Education.

VI- IMPLEMENTATION PROVISIONS

1- This circular applies to all graduates of universities and teacher training colleges, including Northern teachers currently in the probationary period and transferred to work in the South, replacing all previous documents of the Ministry of Education regarding the probationary system.

2- Graduates of 10+3 teacher training schools and college teacher training schools have a probationary period of 24 months.

Graduates of primary teacher training schools have a probationary period of 9 months (one academic year).

Graduates of secondary teacher training colleges and university teacher training colleges in the South, trained according to the standards specified in Directive No. 221-CT/TW dated June 17, 1975 issued by the Central Committee of the Communist Party, shall have a probationary period of 18 months for secondary teacher training colleges, and 24 months for college and university teacher training colleges.

For teachers trained after the liberation, including university teacher training graduates in 1976, the Ministry of Education will provide specific guidance on the probationary system and salary regime in another document (after consultation with the Ministry of Labor).

4- Generally, students who have not yet graduated are not employed. In cases where they are employed to teach, the probationary period starts from the date of graduation recognition. Time spent teaching before graduation may be considered to recognize completion of the probationary period before the prescribed time.

5- For teachers who, as of July 15, 1975, had completed or exceeded the prescribed probationary period, Departments and Bureaus shall promptly process formal recognition procedures according to the guidelines set out in Point 2, Section IV of Circular No. 01-TT/LB dated February 14, 1976 issued by the Joint Board of Labor and Higher Education.

6- This circular shall be widely disseminated to all teachers and students of teacher training schools before they graduate and start their jobs.
