CIRCULAR
Guidelines for certifying food production and business establishments meeting food safety conditions under the management of the Ministry of Agriculture and Rural Development.[1]
Circular No. 38/2018/TT-BNNPTNT dated December 25, 2018, issued by the Minister of Agriculture and Rural Development, stipulates the procedures for assessing and certifying food production and business establishments meeting food safety conditions under the management of the Ministry of Agriculture and Rural Development, which took effect from February 7, 2019, amended and supplemented by:
Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development, amending and supplementing certain Circulars on the procedures for assessing and certifying food production and business establishments meeting food safety conditions under the management of the Ministry of Agriculture and Rural Development, which took effect from January 15, 2025.
Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Food Safety Law 2010 and Decree No. 15/2018/NĐ-CP dated February 2, 2018, promulgated by the Government, detailing the implementation of certain provisions of the Food Safety Law;
At the proposal of the Director of the Quality Control Department for Agricultural, Forestry and Fisheries Products[2],
The Minister of Agriculture and Rural Development issues this Circular stipulating the procedures for assessing and certifying food production and business establishments meeting food safety conditions under the management of the Ministry of Agriculture and Rural Development.
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Application
This Circular provides guidelines for certifying food production and business establishments meeting food safety conditions under the management of the Ministry of Agriculture and Rural Development, as well as activities related to food safety inspections, and the responsibilities and authorities of relevant parties.
Article 2. Applicability
1. Entities eligible for certification of meeting food safety conditions: Food production and business establishments under the management of the Ministry of Agriculture and Rural Development (hereinafter referred to as the establishment),except for the following:
a) Small-scale primary production;
b) Production and business of food without fixed premises, fishing vessels with a maximum length less than 15 meters;
c) Small-scale processing;
d) Small-scale food business;
đ) Business of pre-packaged food;
e) Establishments that have been granted one of the following Certificates: Good Manufacturing Practices (GMP), Hazard Analysis and Critical Control Points (HACCP), Food Safety Management System ISO 22000, International Food Standard (IFS), Global Food Safety Standard (BRC), Food Safety System Certification (FSSC 22000) or equivalent certificates still in effect.
2. Entities subject to food safety inspection:
a) The entities specified in Clause 1 of this Article;
b) Establishments that have been granted one of the following Certificates: Good Manufacturing Practices (GMP), Hazard Analysis and Critical Control Points (HACCP), Food Safety Management System ISO 22000, International Food Standard (IFS), Global Food Safety Standard (BRC), Food Safety System Certification (FSSC 22000) or equivalent certificates still in effect.
Organizations, individuals involved in ensuring food safety in the production and business of food at the establishments specified in Clauses 1 and 2 of this Article.
Article 3. Interpretation of Terms
In this Circular, the following terms are understood as follows:
1. Food business establishment of agriculture, forestry, and fisheries: is a place conducting one, several, or all activities of introducing, storage services, transportation services, or trading agricultural, forestry, and fisheries food products, salt.
2. Primary food production establishment of agriculture, forestry, and fisheries: is a place conducting one, several, or all activities of farming, animal husbandry, cultivation, harvesting, fishing, exploitation of agricultural, forestry, and fisheries products, salt production.
3. Review: is an activity of examining and checking the completeness and validity of documents, inspecting actual conditions ensuring food safety for the establishment as prescribed by law.
Article 4. Basis for Reviewing Conditions Ensuring Food Safety
1. National technical standards and national standards.
2. Legal regulatory documents and related provisions concerning food safety of agriculture, forestry, and fisheries.
Article 5. Authority to Issue, Revoke the Certificate of Compliance with Conditions Ensuring Food Safety (hereinafter referred to as the Certificate); Inspect Food Safety [6]
1. The central authority issuing, revoking the Certificate; inspecting food safety are specialized agencies under the Ministry of Agriculture and Rural Development assigned within their management scope for establishments:
a) Exporting directly or participating in production, preliminary processing, processing, preservation for export to countries, territories requiring health certification, food safety certification by Vietnamese authorities;
b) Requesting registration, establishment, supplementation of the export list or issuance of other certificates by Vietnamese authorities according to import market regulations;
2. Local authority is specialized agencies delegated by provincial or municipal People's Committees to issue, revoke the Certificate; inspect food safety for local food production and business establishments of agriculture, forestry, and fisheries and fishing vessels from other regions with such needs (excluding establishments mentioned in Clause 1 of this Article);
In case the importing country's authority does not require the central authority to directly issue, revoke the Certificate, the local authority shall implement the issuance, revocation of the Certificate, and food safety inspection for establishments mentioned in points a and b of Clause 1 of this Article.
Article 6. Issuing the Certificate, Inspecting Food Safety
1. Issuing the Certificate applies to:
a) Establishments required to have the Certificate when operating as stipulated in Clause 1 of Article 2 of this Circular, but have not yet been reviewed and issued the Certificate;
b) Establishments that have been issued the Certificate but had it revoked;
c) Establishments with the Certificate still valid for less than 6 (six) months or establishments ceasing production for more than 12 (twelve) months since the date of notification sent to the authority issuing the Certificate;
d) Establishments with changes in legal representative or changes in the system managing food safety conditions compared to the initial state (repair, upgrade, expand production, relocate production site).
2. Food safety inspections are conducted according to Article 17 of this Circular.
Article 7. Content and Methods of Review
1. Content of Review
a) Physical facilities, equipment;
b) Human resources involved in production, business, and food safety management;
c) Implementation of regulations, standards, national technical standards on food safety management programs and product labeling;
d) [8] Sampling for testing: Decided by the Review Team based on risk assessment when there is suspicion of non-compliance with food safety requirements, inadequate food hygiene control activities of the establishment. Sampling and analysis are carried out in accordance with current regulations.
2. [9] Method of Review: Includes activities of examining and evaluating documents, assessing actual conditions ensuring food safety at the establishment including: factory buildings, equipment, management resources, food safety management programs, traceability and recall, handling non-compliant products, implementation results, interviewing relevant parties, and sampling (if necessary).
Article 8. Classification of Premises[10]
1. Classification of premises:
a) Achieved: The premises meet all requirements for food safety assurance conditions as stipulated by law;
b) Not achieved: The premises have not met the requirements for food safety assurance conditions or still have non-compliant points that cannot be rectified within the required timeframe.
2. Guidelines for assessment and classification according to the model inspection report corresponding to the types of premises specified in Seal Registration Certificate, ANNEX III issued together with this Circular. In cases where production and business establishments fall under the objects regulated in Clause 8 and Clause 10, Article 36 of Decree No. 15/2018/NĐ-CP dated February 2, 2018 of the Government, the inspection of premises' conditions shall be carried out in accordance with the regulations applicable to the relevant industry or field.
Article 9.[11] (Repealed)
Article 10. Requirements for the Head of the Inspection Team, Members of the Inspection Team, and Sample Collectors
1.[12] Requirements for members of the inspection team
a) Honest, impartial, without conflict of interest with the inspected premises;
b) Possess appropriate expertise in the relevant field of inspection;
c) Have participated in training courses or seminars on inspection techniques or training courses or seminars on inspection and supervision techniques in the relevant field.
2. [13]Requirements for the Head of the Inspection Team
a) Meet the requirements set forth in Clause 1 of this Article;
b) Have at least two years of work experience and have conducted inspections of at least five premises in the relevant field.
3. Requirements for sample collectors
a) Possess appropriate expertise;
b) Hold a certificate or a certificate of recognition regarding sampling or hold a certificate or a certificate of recognition for participating in training courses or seminars with content related to sampling.
Article 11. Fees and Charges [14]
Chapter II. The collection of fees and charges for issuing the Certificate of Compliance shall be carried out in accordance with the provisions of the Law on Fees and Charges.[15]
Section 1. ISSUANCE AND REVOCATION OF THE CERTIFICATE OF COMPLIANCE FOR FOOD PRODUCTION AND BUSINESS ESTABLISHMENTS MEETING FOOD SAFETY REQUIREMENTS[16]
Article 12. Application Documents for Issuance of the Certificate of Compliance[17]
1. Application documents for issuance of the Certificate of Compliance include components prescribed in Clause 1, Article 36 of the Food Safety Law.
A sample application form for the Certificate of Compliance for premises meeting food safety requirements can be referred to Appendix V attached to this Circular; A sample explanatory document on physical facilities, equipment, and tools ensuring hygiene and safety conditions can be referred to at Appendix VI attached to this Circular; A confirmation letter from the establishment's owner confirming that the owner and direct food producers and sellers have been trained in food hygiene and safety knowledge, organized by the establishment's owner and confirmed.
2. Organizations and individuals submit application documents for issuance of the Certificate of Compliance to the competent authority as prescribed in Article 5 of this Circular through the online public service system, via postal service, or directly at the competent authority.
3. After receiving the application documents from the premises, the competent authority will proceed to verify the completeness and validity of the documents and notify the results to the premises, along with the expected inspection date if the documents are valid; or notify that the documents are not satisfactory and specify the reasons.
Article 13. Establishment of the Inspection Team
1.[18] The competent authority as prescribed in Article 5 of this Circular issues a decision to establish the inspection team immediately upon notification of valid documents. The decision to establish the inspection team includes the following contents:
a) Basis for inspection;
b) Scope and content;
c) Name and address of the inspected premises;
d) Names and positions of the head, deputy head (if any), and other members of the team;
đ) Responsibilities of the inspected premises and the inspection team.
2. In cases where the inspection involves multiple groups of agricultural, forestry, and aquatic food products, the head of the agency assigned the main responsibility shall inform the relevant agencies involved to request their participation in the inspection team.
Article 14. On-site Assessment Organization
The on-site assessment shall be conducted within fifteen (15) days from the date of receiving complete valid files in accordance with point b, clause 2, Article 36 of the Food Safety Law, specifically:
1. The assessment team shall announce the decision to establish the team, clearly stating the purpose and content of the assessment.
2. Conducting actual on-site assessment: reviewing and evaluating records and documents, assessing the actual conditions for ensuring food safety at the facility including factory premises, equipment, management resources, food safety management programs, traceability and recall, handling non-compliant products, implementation results; interviewing relevant parties, taking samples if necessary in accordance with point d, clause 1, Article 7 of this Circular.
3. Drafting the assessment record and notifying the assessment result to the representative of the facility.
4. In case of discovering violations by the facility, the assessment team shall draft a working record or administrative violation record to transfer to the competent authority for handling in accordance with the law.
Article 15. Assessment Record
1. The assessment record shall follow the model at Seal Registration Certificate, ANNEX III promulgated together with this Circular.
2. Requirements for the assessment record:
a) Must be drafted by the assessment team at the facility immediately after completing the assessment;
b) Fully and accurately reflect the assessment results;
c) Clearly list items that do not meet food safety standards and the deadline for the facility to rectify the issues;
d)[20] Provide a general conclusion on the conditions for ensuring food safety and the assessment results of the facility;
d) Include the opinion of the authorized representative of the facility regarding the assessment results and commitment to rectify the issues (if applicable);
e) Have the signature of the head of the assessment team, the signature of the authorized representative of the facility, and the stamp of the facility (if available) on the assessment record or sign each page in case the facility does not have a seal;
f) In case the representative of the facility disagrees to sign the assessment record, the assessment team must note: "The representative of the assessed facility did not sign the record" and specify the reason why the representative did not sign. This record still has legal validity when it has the signatures of all members of the Assessment Team;
g) Be drafted in two copies: one copy retained by the assessment agency, one copy retained by the facility; additional copies may be made if necessary.
Article 16. Handling Assessment Results and Issuing, Revoking Certificates
After receiving the assessment record from the assessment team, the competent authority shall review the record (request the assessment team to explain the evaluation contents if necessary) and proceed as follows:
1. If the assessment result meets the requirements:
a) Issue the Certificate according to the model at REGULATIONS ON THE CERTIFICATE DESIGN FOR OUTSTANDING RURAL INDUSTRIAL PRODUCTS issued together with this Circular in cases where the facility meets the requirements for ensuring food safety conditions. The certificate is valid for three (3) years from the date of issuance.
b) In cases where samples were taken for testing during the assessment, the issuance of the Certificate to the facility will only be carried out upon receipt of satisfactory test results.
For cases where the sample test results do not comply with food safety regulations, the issuance of the Certificate can only be carried out after the facility investigates the cause, takes corrective measures, and passes the review by the competent authority.
2. If the assessment result does not meet the requirements and the facility fails to rectify within the required timeframe: The competent authority shall issue a notice of the assessment result, not issue the Certificate, and simultaneously send it to the local food safety management agency to monitor the facility's operations.
3. In cases where the facility's assessment result does not meet the requirements but submits a report on corrective actions and passes the review by the assessment team within the time limit specified in point b, clause 2, Article 36 of the Food Safety Law, the competent authority shall review and issue the Certificate in accordance with point a, clause 1 of this Article.
4. Periodically, the competent authority shall compile, update, and publicly disclose information on the list of facilities issued certificates, validity periods, and facilities that do not meet the conditions for ensuring food safety under its jurisdiction on the electronic portal.
5. Revocation of the Certificate
a) A facility shall have its Certificate revoked if it no longer meets the conditions stipulated in clause 1, Article 34 of the Food Safety Law;
b) Authority to revoke the Certificate: The issuing authority has the authority to revoke the Certificate it has issued;
c) The competent authority shall revoke the Certificate of the facility mentioned in point a, clause 5 of this Article when conducting inspections, checks, supervision, assessments, or revocations based on the request of inspection and check agencies.
The competent authority shall issue a Decision to revoke the Certificate of the facility after receiving a request for revocation of the Certificate from the inspection and check agency.
6. In cases where the issued Certificate remains valid but is lost or damaged, the competent authority shall base its decision on stored files, review, and issue a certified copy from the original book in accordance with the law on issuing certified copies from original books after receiving a request from the facility or issue a refusal letter and specify the reasons for not issuing.
7. In cases of changing address or administrative boundaries without changing location and the Certificate is still valid, the facility shall notify the change of information on the Certificate and attach a copy of the legal document reflecting such changes to the issuing authority.
Section 2. FOOD SAFETY INSPECTION[22]
Article 17. Food Safety Inspection[23]
1. Inspection Object: The establishments specified in Clause 2, Article 2 of this Circular.
2. Principles of Inspection: As stipulated in Clause 4, Article 68 of the Food Safety Law.
3. Inspection Activities:
a) Conducted by the Inspection Team established by the Authority as specified in Article 5 of this Circular with responsibilities and authorities as prescribed in Article 70 of the Food Safety Law;
b) Food safety inspection activities at establishments must be recorded in a Record according to the model in Appendix IA attached hereto;
c) In cases where violations are discovered, the inspection team shall prepare a working record or administrative violation record to transfer to the competent authority for handling in accordance with the law.
4. Planned Inspections:
a) Annually, the Authority as specified in Article 5 of this Circular based on management requirements, assessment of compliance with food safety laws, food safety incidents, food safety monitoring results, inspection and supervision outcomes from the previous period, and directives from higher-level management authorities, shall develop a plan and budget for inspections as prescribed in Point a, Clause 2, Article 69 of the Food Safety Law and submit it for approval by the competent authority;
b) At least three (3) days before conducting the inspection, the Authority must notify the establishment to be inspected in writing;
c) Inspection Frequency: Not more than once per establishment per year, except in cases of unscheduled inspections as provided for in Clause 5 of this Article.
5. Unscheduled Inspections: The Authority shall conduct unscheduled inspections (without prior notice) in the following circumstances:
a) When there are signs of non-compliance with food safety regulations or food safety incidents at the establishment;
b) When there are warnings from domestic, foreign organizations, and international organizations related to food safety, or when there are reports from organizations and individuals regarding food safety issues related to the establishment;
c) Special inspections as directed by higher-level food safety management authorities.
6. Handling Inspection Results: Within five (5) days from the end of the inspection, the Authority shall implement:
a) Notification of the results to the establishment in cases where the inspection meets the requirements.
b) In cases where the inspection results do not meet the requirements: Issue a written request for the establishment to rectify the non-conformities identified in the inspection record, the establishment shall have the responsibility to report the results, accompanied by evidence of rectification within a maximum period of thirty (30) days from the date of the written request.
c) In cases where the establishment does not report within the required time frame or the rectification results are not satisfactory, the Authority shall revoke the Certificate issued to the establishment in accordance with Clause 5, Article 16 of this Circular or notify the certification organization that issued a different certificate to the establishment, as specified in Point k, Clause 1, Article 12 of Decree No. 15/2018/NĐ-CP dated February 2, 2018, to revoke or suspend the certificate issued;
In cases where the certification organization does not revoke or suspend the certificate of the establishment that has violated food safety regulations, the issuing authority of the certification organization's registration for conformity assessment shall review and handle the certification organization (if there is a violation) in accordance with the law.
Article 18.[24] (Repealed)
Chapter III. IMPLEMENTATION
Article 19. Provincial People's Committees and Municipal People's Committees directly under the Central Government[25]
1. Specify the competent authority referred to in Clause 2, Article 5 of this Circular.
2. Allocate resources and provide funding from the local budget for the Competent Authorities to perform their tasks as prescribed in this Circular.
Article 20. Departments of Agriculture and Rural Development, Departments of Food Safety, Food Safety Management Boards of provinces and centrally governed cities[26]
1. Take the lead and coordinate with relevant agencies to submit to the provincial People's Committee regulations on the Competent Authority referred to in Clause 2, Article 5 of this Circular.
2. Direct and guide the implementation of this Circular within the scope assigned.
Article 21. Central Competent Authority [27]
1. Guide the work of assessing and certifying food safety conditions for food establishments; inspect food safety throughout the system from central to local levels within the assigned management area.
2. Guide the uniform application of documents, forms, and assessment methods for food establishments under its management. In case of necessity, propose, develop, and submit to the Ministry of Agriculture and Rural Development for issuance of model inspection reports suitable for the specific nature of the establishment.
3. Organize training and provide professional guidance to staff assigned the task of assessment and to local Competent Authorities.
4. Annually establish, approve, and implement plans for food safety inspections of establishments under its management as stipulated in Article 17 of this Circular.
5. The Quality Control, Processing, and Market Development Department organizes the issuance and revocation of Certificates; inspects food safety at establishments involved in preliminary processing, processing, preservation of aquatic products and aquatic food products, and mixed food products (plant, animal, aquatic) as specified in Clause 1, Article 5 of this Circular and as provided in Circular No. 48/2013/TT-BNNPTNT dated November 12, 2013 of the Ministry of Agriculture and Rural Development and the amended and supplemented Circular.
6. The Plant Protection Department issues and revokes Certificates; inspects food safety at establishments producing, preliminarily processing, processing, and preserving plant-based food products for export as specified in Point b, Clause 1, Article 5 of this Circular.
The Plant Protection Department introduces and compiles lists of establishments producing, preliminarily processing, processing, and preserving plant-based food products for export to countries and territories requiring different food safety certifications based on Certificates issued by local Competent Authorities or equivalent certificates still valid and meeting the food safety criteria of importing countries and territories. The Plant Protection Department conducts on-site inspections of these establishments when necessary.
7. The Animal Health Department organizes the issuance and revocation of Certificates; inspects food safety at establishments producing, preliminarily processing, processing, and preserving terrestrial animal-based food products for export as specified in Clause 1, Article 5 of this Circular.
The Animal Health Department registers, introduces, and compiles lists of establishments producing, preliminarily processing, processing, and preserving terrestrial animal-based food products for export as food based on Certificates issued by local Competent Authorities or equivalent certificates still valid and meeting the food safety criteria of importing countries and territories. The Animal Health Department conducts on-site inspections of these establishments when necessary.
8. Compile, update, and publicly disclose on the website of the Competent Authority and the Ministry of Agriculture and Rural Development lists of establishments that meet and do not meet food safety requirements within the scope of management.
9. Conduct inspections of the implementation by local Competent Authorities.
Article 22. Local Authority
1. Organize the issuance, revocation of Certificates, and food safety inspections at production and business establishments within the scope of authority assigned by the Provincial People's Committee/City People's Committee.
2. Implement the establishment, submission for approval by competent authorities, and organization of implementation of plans for food safety inspections at establishments under its management as stipulated in... Article 17 of this Circular.
3. Organize training, instruction, and guidance on specialized professional matters for staff tasked with assessment duties.
4. Periodically compile, update, and publicly disclose on the local authority’s and provincial/city people's committee’s online portal lists of establishments that meet and do not meet food safety assurance conditions within the local management scope.
5. Store related files concerning the issuance, revocation of Certificates, and food safety inspections at establishments within the management scope as assigned.
Article 23. Head and Members of the Assessment Team
1. Head
a) Direct and instruct members of the assessment team to carry out all contents recorded in the assessment decision.
b) Ensure objectivity, accuracy, and honesty during the assessment process.
c) Sign the assessment minutes, report on the assessment results, and bear responsibility before the head of the assessment authority and the law for the assessment results conducted by the assessment team.
d) Issue the final conclusion of the assessment team regarding the assessment results.
đ) Maintain confidentiality of information related to the production and business secrets of the assessed establishment and the assessment results until they are officially recognized and announced by the assessment authority.
2. Members of the Assessment Team
a) Assess and evaluate the compliance of the establishment's food safety conditions with relevant regulations and technical standards.
b) Carry out tasks according to the division of labor by the head of the assessment team.
c) Adhere strictly to procedures, formalities, methods of assessment, and sampling; ensure objectivity, accuracy, and honesty when conducting assessments and sampling.
d) Bear responsibility and report the results of assigned tasks to the head of the team.
đ) Maintain confidentiality of information related to the production and business secrets of the assessed establishment and the assessment results until they are officially recognized and announced by the assessment authority.
Article 24. Agricultural, Forestry, and Aquatic Product Production and Business Establishments
1. Appoint a person with sufficient authority to represent the establishment in working with the assessment team.
2. Facilitate the assessment team in conducting assessments and sampling on-site; provide complete information, samples, files, and documents as required by the assessment team.
3. Fully rectify errors noted in the assessment minutes and submit a written report to the assessment authority within the deadline specified in the assessment minutes.
4. Publicly post the assessment minutes at the establishment.
5. [29] Pay the assessment fee for the Certificate issuance as prescribed.
6. Recall and handle products that do not meet food safety requirements as stipulated.
7. Have the right to lodge complaints with the assessment authority if there is disagreement with the assessment results of the assessment team.
8. Notify the assessment authority in cases of cessation of production and business operations, dissolution, relocation of production sites, changes in production conditions, or changes in ownership.
Chapter IV. IMPLEMENTING PROVISIONS[30]
Article 25. Effective Date
1. This Circular takes effect from February 7, 2019.
2. This Circular replaces Circular No. 45/2014/TT-BNNPTNT dated December 3, 2014 of the Minister of Agriculture and Rural Development on inspection of agricultural inputs production and business establishments and inspection and certification of agricultural, forestry, and aquatic product production and business establishments meeting food safety conditions.
Article 26. Amendment and supplementation of the Circular
Any difficulties or obstacles arising during the implementation of this Circular shall be reported to the Minister of Agriculture and Rural Development for consideration to amend and supplement it appropriately./.

[5] This Article is amended and supplemented pursuant to Clause 4, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024 of the Minister of Agriculture and Rural Development amending and supplementing some Circulars stipulating the examination and certification of food production and business establishments under the management of the Ministry of Agriculture and Rural Development that meet the conditions for ensuring food safety, which shall take effect from January 15, 2025.
[6] This Article is amended and supplemented pursuant to Clause 5, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024 of the Minister of Agriculture and Rural Development amending and supplementing some Circulars stipulating the examination and certification of food production and business establishments under the management of the Ministry of Agriculture and Rural Development that meet the conditions for ensuring food safety, which shall take effect from January 15, 2025.
[7] This Article is amended and supplemented pursuant to Clause 6, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024 of the Minister of Agriculture and Rural Development amending and supplementing some Circulars stipulating the examination and certification of food production and business establishments under the management of the Ministry of Agriculture and Rural Development that meet the conditions for ensuring food safety, which shall take effect from January 15, 2025.
[8] This Point is amended and supplemented pursuant to Clause 7, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024 of the Minister of Agriculture and Rural Development amending and supplementing some Circulars stipulating the examination and certification of food production and business establishments under the management of the Ministry of Agriculture and Rural Development that meet the conditions for ensuring food safety, which shall take effect from January 15, 2025.
[9] This Clause is amended and supplemented pursuant to Clause 8, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024 of the Minister of Agriculture and Rural Development amending and supplementing some Circulars stipulating the examination and certification of food production and business establishments under the management of the Ministry of Agriculture and Rural Development that meet the conditions for ensuring food safety, which shall take effect from January 15, 2025.
[10] This provision is amended and supplemented pursuant to Clause 9, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement some Circulars on the examination and certification of food production and business establishments in the agriculture, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[11] This provision is repealed pursuant to Point a, Clause 26, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement some Circulars on the examination and certification of food production and business establishments in the agriculture, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[12] This clause is amended and supplemented pursuant to Clause 10, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement some Circulars on the examination and certification of food production and business establishments in the agriculture, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.

[15] The name of this Chapter is amended and supplemented pursuant to Clause 12, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement some Circulars on the examination and certification of food production and business establishments in the agriculture, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[16] The name of this Section is amended pursuant to Clause 13, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement some Circulars on the examination and certification of food production and business establishments in the agriculture, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[17] This provision is amended and supplemented pursuant to Clause 14, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement some Circulars on the examination and certification of food production and business establishments in the agriculture, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[18] This clause is amended and supplemented pursuant to Clause 15, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement some Circulars on the examination and certification of food production and business establishments in the agriculture, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[19] This is amended and supplemented pursuant to Clause 16, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development amending and supplementing some Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors to meet food safety conditions under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[20] This Point is amended and supplemented pursuant to Clause 17, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development amending and supplementing some Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors to meet food safety conditions under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[21] This is amended and supplemented pursuant to Clause 18, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development amending and supplementing some Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors to meet food safety conditions under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[22] The name of this Section is amended and supplemented pursuant to Clause 19, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development amending and supplementing some Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors to meet food safety conditions under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[23] This is amended and supplemented pursuant to Clause 20, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development amending and supplementing some Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors to meet food safety conditions under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[24] This provision is repealed pursuant to Point a, Clause 26, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement some Circulars on the examination and certification of food production and business establishments in the agriculture, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[25] This is amended and supplemented pursuant to Clause 21, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development amending and supplementing some Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors to meet food safety conditions under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[26] This is amended and supplemented pursuant to Clause 22, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development amending and supplementing some Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors to meet food safety conditions under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[27] This provision is amended and supplemented pursuant to Clause 23, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement certain Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[28] This provision is amended and supplemented pursuant to Clause 24, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement certain Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[29] This clause is amended and supplemented pursuant to Clause 25, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement certain Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[30] Article 3 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement certain Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025, provides as follows:
"Article 3. Effective Date
1. This Circular takes effect from January 15, 2025.
2. This Circular replaces Circular No. 32/2022/TT-BNNPTNT dated December 30, 2022, issued by the Minister of Agriculture and Rural Development to amend and supplement certain Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall cease to be effective from the date this Circular takes effect.
3. Transitional Provisions:
a) Food production and business establishments ranked 1 and 2 and included in the priority list prior to the effective date of this Circular shall continue to maintain the sampling inspection regime for food safety risks until there is a change in their priority ranking;
b) Applications for examination and certification of food safety; examination and certification of batches of aquatic products submitted before the effective date of this Circular shall be processed according to the laws in force at the time of submission of the application.
4. In cases where the legal documents referred to and applied in this Circular are amended, supplemented, or replaced by corresponding new documents, such new documents shall apply.
5. During implementation, if difficulties or obstacles arise, organizations and individuals are requested to report them to the Ministry of Agriculture and Rural Development for review and amendment.
[31] This Appendix is added pursuant to Point b, Clause 26, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement certain Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[32] Appendix II and Appendix III promulgated together with Circular No. 38/2018/TT-BNNPTNT dated December 25, 2018, are replaced by Appendix II promulgated together with Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, pursuant to Point c, Clause 26, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement certain Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[33] Appendix V promulgated together with Circular No. 38/2018/TT-BNNPTNT dated December 25, 2018, is replaced by Appendix III promulgated together with Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, pursuant to Point c, Clause 26, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement certain Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
[34] Appendix VI promulgated together with Circular No. 38/2018/TT-BNNPTNT dated December 25, 2018, is replaced by Appendix IV promulgated together with Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, pursuant to Point c, Clause 26, Article 1 of Circular No. 17/2024/TT-BNNPTNT dated November 28, 2024, issued by the Minister of Agriculture and Rural Development to amend and supplement certain Circulars on the examination and certification of food production and business establishments in the agricultural, forestry, and aquatic sectors that meet the conditions for ensuring food safety under the management of the Ministry of Agriculture and Rural Development, which shall take effect from January 15, 2025.
