CIRCULAR
Amending and supplementing certain provisions of Circular No. 256/2016/TT-BTC
dated November 11, 2016 on the level of collection, collection procedures,
payment and management of fees for issuing citizen identification cards
Pursuant to the Law on Fees and Registration Fees dated November 25, 2015;
Pursuant to the Citizen Identification Card Law on November 20, 2014;
Pursuant to the State Budget Law dated June 25, 2015;
Pursuant to Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges;
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Department of Tax Policy,
The Minister of Finance promulgates this Circular amending and supplementing certain provisions of Circular No. 256/2016/TT-BTC dated November 11, 2016 on the level of collection, collection procedures, payment and management of fees for issuing citizen identification cards.
Article 1. Amending and supplementing certain provisions of Circular No. 256/2016/TT-BTC dated November 11, 2016 issued by the Minister of Finance
1. Clause 2 shall be amended and supplemented as follows:
"Article 3. Fee Collecting Organizations
Vietnamese citizens aged 14 years and older when applying for replacement or issuance of a citizen identification card must pay the citizen identification card fee as stipulated in this Circular".
Article 4. Export Tariff according to the list of taxable goods
"Article 4. Fee Collection Amounts
1. Citizens transferring from a 9-digit Identity Card, a 12-digit Identity Card to issuance of a citizen identification card: VND 30,000 per citizen identification card".
3. Article 5 shall be amended and supplemented as follows:
"Article 5. Cases of exemption from payment of fees
1. Cases of exemption from fees
a) Replacement of Citizen Identity Cards when the State changes administrative boundaries;
b) Replacement or issuance of a citizen identification card for citizens who are parents, spouses, children under 18 years old of martyrs; war invalids; persons receiving treatment policies equivalent to war invalids; children under 18 years old of war invalids and persons receiving treatment policies equivalent to war invalids; war disabled veterans; citizens permanently residing in border communes; island districts; ethnic minorities in communes with particularly difficult socio-economic conditions; citizens belonging to poor households as defined by law;
c) Replacement or reissue of Citizen Identity Cards for citizens under 18 years old who are orphaned and without support.
2. Cases not required to pay fees
a) Citizens aged 14 years and older applying for issuance of a citizen identification card for the first time as provided for in Clause 1, Article 19 and Clause 2, Article 32 of the Citizen Identification Card Law;
b) Replacement of a citizen identification card as provided for in Article 21 and point a, Clause 3, Article 32 of the Citizen Identification Card Law;
c) Replacement of a citizen identification card when there is an error in the information on the citizen identification card due to the fault of the citizen identification card management agency."
Article 2. Implementation
Article 1. This Circular shall take effect from February 10, 2017 and shall apply to applications for issuance, replacement, and reissuance of citizen identification cards submitted to competent authorities as stipulated in Article 26 of the Citizen Identification Card Law from January 1, 2017.
During implementation, if any difficulties arise, organizations and individuals are requested to promptly reflect them to the Ministry of Finance for study and supplementary guidance./.
